when you have two law enforcement officers, a civilian injured, one of the law enforcement officers, 26 years to the day his father was also a sheriff's deputy lidied in the line of duty. >> most shocking is that he was pulled over at least ten times and cited by police in the years that he snuck back into this country after being deported. >> i wasn't his name in a federal database as a criminal alien? we don't know at this hour, but it turns out he was not identified and allowed to remain on the loose. >> would it have mattered? it looks like the number of criminals was lied about.

it turns out there's sexual assault, domestic violence, gun violence, criminal activity, shoplifting, holding up stores at gunpoint. >> serious felonies. >> serious felonies. >> these are not people who took a left on red. these are people who have committed acts of violence. by the way, many critics say this is about the elections, about winning over a constituency, a specific demographic that the president is pandering to. no, we are not going to enforce immigration laws in exchange for vote. here's the senate judiciary saying how scary this situation is to the united states. >> they didn't tell us that we released these individuals and there was some sort of special circumstances. they only made that up after the fact. the second thing is, you know how tough it is to get these people anyway and charge them and convict them with crimes and they unilaterally release them back into our community. the other thing we didn't even see on that exchange was the

fact that they acknowledged that they were releasing gang members back, didn't even know whether they were releasing them or not. >> two things, if you remember when this happened, the white house stressed about it and said we're trying to clear out the ja jails, make room for more criminals. this is because of the republicans and their budget cuts and sequester. whose fault is it really? you think when the white house press secretary was asked about this, was he either lying or did he know he was covering it up? >> right. because low-level criminals, so a part of them, 2.2 -- what was it, over 2,000 low criminals. but when you look at the rap sheet, they had to know because of the paperwork. >> if they didn't, they are not good enough for their job. >> but they have said time again, the president, the vice

wrong. we'll look at the temperatures 5, 5 in new york city. 44 in chicago. still very warm across the southern u.s. we could break some daytime records with temperatures soaring close to 90 degrees again today. we'll take a look at the radar as this system pushes through. you see san francisco, most of the rain will be north of that area which is great news. but that's where they're getting most of the moisture and mountain snow across the northwest. so this system pushes through and we saw hurricane-force winds yesterday across the northwest. then we have another waiting in the wings. this is typically the rainy season across the northwest, but the next system could bring not only rain but gusty winds in the forecast as we head into monday and tuesday. a quick look at your forecast, those are your wind gusts for monday into tuesday for seattle to portland with the next system pushing in with winds excess of 60 miles per hour. there's seattle again, kind of unsettled for the next several days. they are used to it, this is their rainy season heading into

a large number of non-citizens are voteing in the presidential election. in 2008 the number was 6.4%. and in 2010 the number was 2.2%. and the remarkable amount of non-citizens said they were registered to vote, 14%. jim, thank you for coming on. >> tucker, good to be with you. >> the numbers are much bigger than people concerned about voter fraud ever imagined. are they real? >> it's a really good question. certainly, it's a big comprehensive study. 32,000 people they talked to in 2008. of that sample that year, only 27 people said they were non-citizens and voted that year. now, these are people who admitted to it. you have to wonder how many were non-citizens that didn't feel like saying to a pollster, by the way, i committed a crime.

it is conceivable it is higher, but if you extrapolate out the numbers, 6.4% in 2008. well, with 11 million immigrants, you run the number, that's 70,000 people! 700,000! even half that, 350,000 people, that's still a huge number. >> depending on where they voted, that's enough to swing an election. first of all, it doesn't matter because the principle of the matter is it is illegal. but this is getting politicians elected. >> yeah. and in past examples, in north carolina they found 700 people who had the same first name, last name, date of birth and last four digits of their social security number as people who voted in other states. that was possible that it was a coincidence, but look at those people who voted twice. and a couple up votes could swing an election. back to bush and gore in florida

in 2000. this is on a scale where it is not happening in a couple hundred votes and shouldn't be counted in each state, if it's a couple thousand, now we are dealing with a much bigger problem with the idea that this may have changed the control of the senate in 2000. >> not all parties are benefiting from this. if illegal voters are voting for democrats by and large, is anything being done to prevent this? >> one of the really shocking conclusions of this study is that voter i.d. laws don't seem to make that much of a difference because of the 27 people who voted illegally, most of them were asked for i.d. and showed something. i.d. they should not have. and somehow it's either a fake i.d. or it's an i.d. that is issued to a non-citizen. but the person at the ballot box, thele whoing place accepts it, so you have to wonder if everybody's memories are defaulty, but these are notten documented immigrants.

every child in the school goes to this. they are given a permission slip and their parents sign that and then they are allowed to do this. i mean, what is the argument? are they upset that these children are here to be respecting them when they get home from school, respect their teachers, respect others, do unto others? what's the argument? >> well, sometimes we have little opposition, but the small opposition we have is usually stirred up by atheists that are not pleased with the fact we are teaching the bible in the public schools. so that was a decision made in 2001 by the united states supreme court. in which they said it's okay for good news club to take place in a public school after the last bell rings and have equal treatment just like any other club. and we get great feedback both from children, from parents, from teachers, a school staff, they love the presence of the club and it improves the school in my ways. >> every child needs a

permission slip from their parents to join the club in the first place, but i want to expand on what you just pointed out, is that the kids and parents like it. that's growing body of resurgence showing the detrimental effects on the kids who come home without their parents home, they are playing video games and not being watched. but this is a great opportunity for kids. >> this is a great opportunity for kids to have something positive to do after school, but they are also coming to learn to love god and to love others. and just recently we did a survey with over 200 principals from 28 states and they said that 87% of those principals had personal knowledge that the good news club had a positive impact in their schools. as a matter of fact, we have principal that is are actually requesting us to come to their

schools with the good news club because it has such a positive impact as the children learn the bible and learn good principles. >> we need to wrap things up, but would you ever consider having similar teachings just minus the loving god, loving jesus and following biblical principles yet focusing on the moral compass? >> no, we are a christian organization and teach the gospel of christ. we teach the bible and make no apologies for that. so we see all the time the great benefit of life being impacted by the truths. and certainly the schools reap the benefit of better behavior. in some cases, we have even gotten reports of better grades. so we are very excited about what god is doing through these clubs all over the country. by the way, we have 62,000 of them in 190 countries where last year we ministered to 15.6 million children. >> wow. at the end of the day, every kid needs a permission slip to join

recent u.s. electitions. gone in and registered to vote, not challenged and cast their votes overwhelmingly for democrats. jim garrity came on the show a few minutes ago to explain the scope of this problem. listen. >> people we talked to in 2008, now of that sample, for example, that year they only had 27 people who said they were non-citizens and voted that year. now these are people who admitted to it. you have to wonder how many were non-citizens who didn't feel like telling a pollster i committed a crime. voter i.d. laws don't seem to make that much of a difference because of the 27 people who voted illegally, most of them said they were asked for i.d., they showed something, i.d. they should not have. maybe our government has completely lost the ability to distinguish between a u.s. citizen and non-citizen. >> 700,000 may have voted illegally according to the report. think how many in the past few elections which have been tight in states like ohio and florida, just a few hundred votes in

online postings are free. we don't regulate speech. we just regulate large expenditures for speech. and since online postings are for free and there's a variable free marketplace of ideas, both medium costs, low costs and they are all treated the same and are accessible in the same way on the internet and people opt in to the internet and seek out that speech and those messages, we have not regulated them. but in the case we released on friday, the vote was 3-3 with commissioners voting not to regulate free posted youtube videos and three democrats voting to open force the law. >> i thought democrats were for free speech. that was and earlier species. so what does it mean to regulate speech on the internet and the ads that youtube does report? >> well, i think it is a great threat. when you look at the internet

today, you'll see hundreds of thousands of postings in all forms from chat rooms to facebook and social media, to websites that people build to put out political messages to youtube postings. and blogs, right? and people have been doing this for a decade or more now. and the american people have become quite accustomed to going online and picking up political commentary information. but if the federal election commission were to start regulating all of those blogs and websites and social media pages, i can't imagine what it would take. i take it would probably require a team of government regulators calling the internet daily to look for violators and people who aren't reporting their expenditures online. what is the cost of a blog, for example? would we have to start sending letters out to the pollsters saying, how much money did you

spend on your blog? i can't imagine the regulatory regime reaching deep into the internet. >> it would have a huge effect on american life, that's for sure. no offense, everyone respects the sec, but as an unelected body, how would it have the power to regulate political speech on the internet? shouldn't congress be doing that anyway? >> i think you're right. let me go back to the point i made just a minute ago. the only right that the political chair has to regulate speech at all is to disseminate large expenditures to the supreme court. the reason we have any speech at all is to prevent corruption of the political system and the corruption that can come from contributions to candidates. but the internet has been a low-cost mechanism for people to speak and communicate their ideas. the little guys compete with the big boys on an even playing field on the internet. and if we start regulating free

driving home after watching a movie with a friend. i crossed an intersection and the lady took a left in front of me and i co collillided with an vehicle. then i had metal hit all over my face from the top of my left nostril to my eyelid. >> as you are recovering, you have come to a realization and what is that? >> don't take things for granted. unfortunately, i didn't know about the air bag recall and there needs to be a change in process to notify the people that the air bags are defective. >> yeah, well, april, because stephanie had just taken her honda civic into a honda dealership and apparently they didn't know about the recall or if they did they didn't do anything about it. what is the recourse with this? >> well, as you know there, has been a lawsuit filed.

because as you remember the federal government is no longer open forcing federal drug laws when it comes to possession of marijuana. we have seen the colorado experiment when the colorado voters legalized marijuana in 2012. now the states maybe aren't going as far as colorado in terms of legalization, production and in places like florida they are considering it just for medical use. so it does range from state to state. but they are using colorado as an example of the experiment to go forward with. >> it could be legal in washington, d.c. >> it could be yes. >> unfortunately on the ballot, the most famous of states is tennessee but what is at stake? >> abortion is on the ballot and they are looking at more personhood amendments. in colorado the voters have the ability to put the words child and person into the criminal wording. and that has ramifications.

also looking at the races being run in the states, candidates are having to take a stand an pro-abortion and pro-life issues. >> five states are going to be talking about taxes, tax policy potential changes. this could affect families immediately. >> yeah, so in tennessee they are talking about implementing a state income tax against tennessee right now since they don't have one. which i'm not sure voters will vote to give themselves more taxes. in neighboring georgia, they are talking about freezing the income tax. and in massachusetts, voters there have the opportunity to freeze the gas tax to force legislators to vote on increasing the tax instead of automatically increasing it with inflation. so that would require them to take those increasing tax votes coming up in the next legislative session. >> gun rights are on the ballot in a bunch of state. where could this be curtailed? >> this is is a huge waun. this is happening in washington

state over on the left coast. the initiative 594 is one of the big ones billionaires like bill gates, michael bloomberg and michael allen have decided to dump millions of dollars into this initiative. the nra will create a gun database, which of course will lead to confiscation. the police are pushing back on thissish notive saying it is unenforceable and waste of resources for the state. but the gun control advocates believe that this will allow for background checks and implementing new fines on transfers of firearms. the police are concerned about the implications for governorship and whether this will criminalize gun owners already who have firearms legal in this state. >> this would include private transfers. so if i give my son a gun, he has to undergo a background

check. >> i-594 is sold as the universal background check piece of legislation. sounds great but when you get into the details of the legislation, it does criminalize transfers between family members and imposes these expensive fines or fees from transfer to transfer. yes, tucker, if you want to transfer your shotgun or other firearms of the legal amount to your sop, transfer it, pay a fee and transfer it again to pay another fee. the ranges they are concerned about is how ranges are going to verify who the guns are owned by? do gun owners need to carry papers with them going to the range? billion nars across the country are pouring money into a state and local initiative to have a hun impact on a different level maybe other than nationally. >> i am looking for them to disarm their bodyguard. >> yeah. thank you, guys. a 3-d printer used to make

friday, i thought it was another attack on law enforcement by terrorists. we had two in canada and one in new york, the hatchet attack. and it wasn't linked to terror, it was linked to another issue we need to be caring about, and that's immigration reform. when are we going to wake up? this guy was deported twice? why do we have a catch and release policy for people like this killing our law enforcement officers? >> in this case, catch and not doing anything about. so his fingerprints were in a federal database. we noknow that because his fingerprints were in a database. what turns out is he was pulled over and released ten times and charged with various low-level violations over the time that he snuck back into the united states. >> and one of the heroes that died that day, died 26 years to the day that his father also died during the line of duty in a helicopter crash. >> currently the "usa today"

uncovered just to get documents from the government. we heard from the obama administration they were going to release low-level illegal immigrants in this country illegally. they were going to release them. these are people with traffic violations and they smoke marijuana, those sorts of things. turns out that's not true. and it turns out there are 167,000 criminal immigrants in this united states, many of them low-level immigrants released had major felonies. in fact, homicide, kidnapping, sexual assault and a whole host of other items on their wrap sheet. >> and the obama administration refused to open force immigration laws. they are under pressure from ethnic lobbying groups, but this could be part of the answer. a new study shows non-citizens are voting across the country in upwards of 700,000 illegal immigrants apparently voted in the 2008 election.

that's enough to swing the results, by the way. maybe that has enough to do with the president's immigration policy. >> people we talked to in 2008, of that sample, for example, that year they only had 27 people who said that they were non-citizens and they voted that year. now, these are people who admitted to it. you have to wonder how many of them were non-citizens that didn't feel like saying, by the way, i committed a crime. voter i.d. laws don't make that much of a difference. because of the 27 people who voted illegally, most of them were asked for ichl .d., they sd something they shouldn't have. maybe the government has lost the ability to distinguish between a u.s. citizen and non-u.s. citizen. >> lost the desire. and the most resilient part of the study showing overwhelmingly people voting illegally are voting for democrats. >> in 2008, 80% voted for

robertson was almost laughed off the stage when she said this -- 40% of likely voters were opposed to 42% who favored the democrats. but in the same poll last month, women favored democrats 47% to 40%. quite a big slide there? what is behind the big shift? should the left lose the war on women line for good? joining us to debate, lisa booth and democratic strategist alex cyst mcgill johnson. thank you for being with us. >> hi, anna. thank you for having us. >> alexis, i will start with you. what matters on election day is who is motivated to get out to vote. what is the deal with the war on women and correlation to voting patterns? >> i totally agree. midterms come down to turnout and intensity. but when you have -- any time you have a party that has been actively against minimum wage,

equal pay, promoting legislation that is essentially anti-women's health, you do have a war on women. maybe the language is a little tired at this point, but i have to tell you, there are a lot of women who are motivated when you look at the polls among base voters in the democratic party, they are still prioritizing women's issues as number two just behind the economy. so i think we do realize that there is a war on women. the majority of minimum wage workers are women. and i think we need to be thinking about that. >> you are chomping on the bit, lisa, weigh in. >> the whole war on women concept is laughable. truly laughable. and the associated press and the fact that republicans are gaping ground with women is a game-changer and it paints a bleak picture for democrats this november. democrats have bet that the war on women playbook would work like last election cycle but attempts are falling flat across the country. if you look at tough senate races like arkansas, the republican candidates are

winning with women voters there right now. and it is not just senate races. look at governors races like the one in texas with someone like wendy davis who has become the face of the pro-abortion movement and is a woman, she's losing against her republican candidate greg abbott with women voters. >> not so much, though. she's actually made so much progress in the last few weeks. and it's about the base she's turning out. i would argue you look at north carolina and look at new hampshire and kay hagan in north carolina, women are pushing a message not just on abortion or access to contraception, but issue that is matter to women and working women. we are talking about minimum wage and equal pay. that's putting them over the edge and they are not afraid to run on that. >> lisa, do you need to backfire? >> democratic voters are taken women for granted and have tagged them as single issue

we have father jonathan morris here. why? >> put that in the spam box. when you get that letter, throw it in the garbage. the reason is because it's a scare tactic. while i do believe that the americans united for separation of church and state have an important point for us, less son for us pastors to not open divorce candidates, because i think it is bad for the churches. the church should not be kept out of being a voice for moral reason within a political process like an election. so you have to avoid endorsing candidates, but you should speak out about issues. >> that's why they use the word intervene. but they also say the congregation could be held responsible? >> it's a scare tactic. but it is true that the irs has pretty big language as well saying churches should not get involved politically in a campaign. we are all indirectly involved in a campaign if we are speaking

out for what we believe. i think unfortunately this organization has shown its true colors. in the past as well as now. what they want is not a proper relationship between church and state where the state is not controlling the church and the church is not controlling the state. that is healthy. but what they want is a silent church. they want pastors to be quiet and want them to be only talking about those parts in the bible that have nothing to do with the public square. that's what they want. >> why are they in the crosshairs? we talked recently about houston being in the cross-hairs with you. >> i think when we get closer to the election, they as we are now, their emotions get high. and there are a lot of people who really believe that the role of the church is to be quiet on all public policy. that is not a good policy. why? because we need the church to be speaking up, as every church to be speaking up, every individual

with whom cares deeply about american values and to be giving reasons why to be involved in the political process. >> is there a better platform than the church to be able to do this? >> that's a great point. i think pastors have, first of all, the right as individuals and citizens to gather together with other pastors and other citizens and to form a political action committee or other political organizations to say, i as a pastor have the right to speak out and to get involved with politics if i want. but i don't think we should be turning our churches into a place for endorsing candidates. that's my personal view. it is legal to do it. to endorse someone and say, this is the best candidate, but i don't think it serves the church well, okay? make sense? by the way, you guys, when it gets closer to halloween, i get it all the time, is that -- you guys know it's the real deal. >> on you it works great. if i wear it -- >> try going in the subway in

mexico in 2001. >> and his wife was with him, too, apparently, during this time. murder charges and carjacking charges. >> it was only a matter of time before something like this happened. remember, we just learned that 167,000 criminal immigrants are at large in the united states. we don't know where they are. and the obama administration told us that they were going to release some low level criminals from prison because of overcrowding. they said, look, because of republican budget cuts to prisons, we can't afford to house them any more. don't worry about it, these are people with minor traffic violations, maybe they didn't return a library book or something like that. it turns out, though, according to "usa today" and the freedom of information act, that's not the case at all. some of them have large felonies, including murder, on their wrap sheet. >> aggravated kidnapping and child abuse or child sexual assault or something, just

dramatically over the last month. a poll, republican party, who should be controlling congress? the republican party, 44% against the democratic party, 42%. but take a look at just last month. those numbers very different. democratic party, 47%, republican party 40%. >> so what happened? >> democrats were planning on women being single issue voters. here is a new flash, we care about a lot more issues than just our reproductive rights. >> and birth control is not in peril. nobody is trying to ban birth control. maybe i mean some person out of 320 million. but no politician is. but that was not true from the very beginning. what is interesting is if you break these numbers down, if you break them out by category, unmarried women still strong supporters of the president, married women overwhelmingly vote republican. that is the divide among women. i think that's probably a lot of reasons for this. people are dependent upon

welcome back. a study reveals large numbers of noncitizens are voting in american elections. that's illegal, yet it's happening. data from a congressional action study estimates voters turnout by noncitizens in 2008 was 6.4%. that equals 700,000 voters b, at least. in 2010, it was 2.2%. in a shocking 2.4% of noncitizens said they were registered to vote. 80% of them voted for democrats.

so this means that, if these number res true and this seems like a legitimate survey, that elections may be decided by noncitiz noncitizens which begins to rethink this. what is being done about this? >> pretty much nothing is being done about this. especially when you consider, too, tucker, there are a lot of states that issue driver's licenses to noncitizens. that should be, to me, the discussion that we need to have. a lot of these respondents in this study says, we have government issued i.d. so there's no big problem, right? the study questions whether a lot of those voting according to their level of education, they were less jaepted than those who responsibility dollars that they didn't vote, maybe they were unaware that it's illegal to cast a vote in an election in which you're not a citizen. but back to 245 number that you mentioned, that is a sizable number. i am admittedly skeptical as to whether or not voter fraud can have massive impact on the presidential election.

because you're talking about hundreds and hundreds and hundreds and thousands of votes. but on smaller races, like senate races, al franken in minnesota who barely squeaked by, i look at aenate races, if those noncitizen votes perhaps factored into that, we could be looking at whether or not obama care passed and that's huge. >> well, sure. there have been presidential elections that are pretty close. so you never know. >> yes. >> you have a new book out, i love the title. "hands off my gun." in it, you dive into the origins of gun control. what's the point of gun control. why did the founders included this second amendment? why did they put a second amendment? it meant a lot to them, obviously. why did they do that? >> these are individuals that had fought to free themselves from red coat rule. and the institution almost wasn't ratified until a certain number of founders pressed for the inclusion of the second amendment. they wanted to make sure that
