of the senate as you know. what happens tuesday if they do? >> after more than seven months in mexican jail, a u.s. veteran. andrew tahmooressi returning last night after a mexican judge recordered his release. tahmooressi spent time under harsh conditions for crossing the border with loaded guns. he got lost on a california freeway ramp and never meant to cross into mexico. and live in los angeles with more. hi, william. >> reporter: arthel, that one mistake, wrong turn, cost tahmooressi seven months of his life. trying to get back on track with ptsd treatment in southern california when he drove into tijuana. despite significant evidence it was a mistake. mexico refused to release the former marine, suggesting as a

withdrew. independent, greg orman, emerged to mount ape serious challenge. now a dead heat. according to the latest fox news poll. our chief correspondent joins us, where he is live, he has been chasing orman across the state. hey, carl. >> reporter: hi, arthel. chance cancel red for a long, long time. pat roberts wasn't supposed to be in jeopardy. as the hours tick by. he is in a tight race. the fox poll up by by a point. excuse me. orman of by a point. baftling back and forth for a weeks. this is a republican, independent does not have a party apparatus. when pat roberts was out campaigning he had half a dozen governors campaigning. chris christie, looking at a 2016 presidential run. after that event. greg orman referred to it as the a clown car of establishment

republicans. bob dole took offense as did other republicans working with pat roberts and be gain a receipt battle. roberts weighed in first criticizing orman. orman changed his tune. watch. >> that was a cheap shot. i am not even sure greg orman said. that might be a campaign person. i think he owes bob an apology. but having said that just shows how out of touch his qucampaigns with kansas. nobody in kansas. democrat, independent, any body is going to say anything bad about bob dole. >> i have nothing but the utmost respect for senator dole. i talked at length through out this campaign abut senator dole as an exam pull of the kind of senator and the kent of representation we need in washington. someone who can reach across the aisle. some one who can forge consensus. among people who have different ideas and get things done for the american people.

what happens to presidents, president now, during mid terms? >> well, look. everyone says this always happens. not really. you have democrats in a difficult position. for years, six years. seven. they embraced obama, supported him. a member of a party in charge of the country and created what they say is success. americans aren't feeling it. communication comes in. no paycheck. paycheck two part time jobs. we see the problems when it comes to direction of the country. super majority of americans are unhappy with what is happening. do not have faith in the future for their children. and so they're looking at the party as a whole. and the president as the representative is the leader of that party. so, democrat candidates can run but they can't hide. and obama has been making it clear also and harming them. that his policies are on the ballot. and this we are seeing in, in the polls, the american people understand that. so, look i think americans would have a lot more respect for democrats, who would embrace and

say, look, i have supported the president. that either was a mistake or the policies were a mistake ch. do a bill clinton -- i was wrong. this is where we need to go. the rejection of the president is not appreciated by the american people. they see it as a little bit of a lie, and certainly not genuine. >> richard pryor in the interview seemed to be running as far away as he could. is this president more of a drag on colleagues than previous presidents? >> there is a six-year itch, right. the president's party loses 30 seats in the house. we know that is going to happen. handful in the senate. seems like it is possible. by luck of the draw. we have a lot of contested senate seats in states, mitt romney won. if some one told you, tammy, me,

a year ago the president's poll numbers would be where they are now and this right track, wrong direction number would be where it is, not great. we would be here three days before election day, really truly wondering whether republicans would peck up c-- p control of the senate. they would fell you you were crazy. if they said there was a republican candidate, with the backdrop of the numbers in jeopardy of losing they would say that is impossible. then you have all these republican incumbent governors in pennsylvania. wisconsin. michigan. alaska, the list goes on who are in the fight of their lives. hardly a wave going on. of course the president is not popular. stipulate to that. one senator in a fight for her life. let's take a look live at hillary clinton, campaigning at a landreau. the senator did not make any

friends with controversial remarks about minorities down there republicans have pounced on. tammy, what does this mean if landreau, can pull it out. either side will not get 50% tuesday. likely a run-off in november. what does it mean, not just for landreau and democrats but for that woman, hillary clinton, and her prospects for 2016? >> look, every day can change a prospect for people. the democrats that are out there need to move to some one. they seem to be moving to the clinton because they can't move to the man that they have support ford -- support ford six years. doesn't seem to be any one else, perhaps other than elizabeth ryan on the horizon. there is no democrat inspiring any one for this matter. you are looking at a run-off for louisiana. we then, two other people running. tea party candidate as well. we expect mr. cassidy to do well and win the run-off.

fact is, democrats have to realize that their hope and change for obama is actually been a failure. they're in trouble. they're going to have to rethink and beyond the clintons, what does the future look like for them. because, after tuesday, i, i think richard we are going to see a real serious wave. and the democrats are going to have to rethink their entire strategy for the next two years. >> wow. richard, can the democrats think be yobd tyond the clintons? they have been to 25 states. >> you know she is running. so think beyond the clintons a assume hillary clinton runs and wins. can we think past ten years from now? that should be the biggest problem. >> hold on a second. listen. the fact that bill and hillary clinton are invited into kentucky, georgia, louisiana. >> who else are they going to invite? >> states that are not, usually hospitable to national democrats it tells you. look at all the polls. any survey recently shows hillary clinton running, about

washington examiner. hi. >> hi. >> lot's work under this supposition, the gop gains control of the senate. then what? does that mean that the drain of lawmaking suddenly is unclogged? kong we and congress will get things done? is that a guarantee, susan? >> that's the question. when you have one party controlling both chambers of congress. it shines a spotlight on the differences within their own party. so that is a great question. will they be able to govern? or will they fight amongst themselves. don't forget. two factions to the republican party right now. one being on a more conservative side. and then there is the mainstream republican whose are more will to neg goeotiate on larger issu with democrats. that's where they're at. on this point. can they pass legislation. i think they can? i think there are some bills that have a lot of bipartisan support. they've will be able to put on the president's desk and put political pressure on him to

sign. those include, the keystone pipeline project. democratic support. there are some parts of the health care reform bill that democrats and republicans would both look to get rid of including the medical device tax, the 30-hour workweek requirement under obama care, and some others. so there are definitely places where the republicansns can pas things and put on the president's desk. what they well do from the get-go, beginning in january if they get majority. go for the low hanging fruit. >> go for the low hanging fruit. once that is all cleared away going for the higher hanging fruit if you will. are there any, use that will cause in ear party fighting? >> you bet? i think they are going to try to sink their teeth into something big. that would be tax reform. something that neither party really wants to deal with the but they know they have to. if republicans have control of both chambers they have paul ryan on one side. orrin hatch in the senate. see them try to work out something. and that's where you are going

to see infighting. there will be people who don't want to have any tax increases or tax loophole closures. that will cause fighting. discussions about funding. on the larger issues, beyond the low hanging fruit we des cusdis. they may have a harder tomb moving forward. >> susan, how much pushback would a gop led senate get from the democrats and on what issues? >> oh, i think they will get a lot of push back. certainly many democrats do not support the keystone exile pipeline. many democrats don't want to see changes to the health care law. both working at opposite ends. on tax reform. democrats will fight tooth and nail. broaden the tax base so more are paying taxes. ever an issue about reforming

medicare. so you are raising the eligible. democrats will fight that. there will be a lot of push back. that will make it difficult for republicans in the senate to get 60 vote threshold vote to pass anything. if they send it to the president, if he vetoes it. they need 67 more, thus democrats they will never get. go back to your original question. are we going to pass anything? is there going to be gridlock. you may see things pass out of congress. much harder to get anything signed into law. >> okay. well, that says a lot there. let me wrap it up. ask you this. i think i have 30 second for your answer. all of the above scenarios play out that you painted for us. let's say they play out. so over the next two years. where it would happen. what would that mean come 2016 for the presidential race? >> don't forget. starting november 5th. everyone is going to start th k thinking about 2016. everything republicans do.
