today is the last day we actually look at polls. you can see that in a number of key states, the republicans are actually doing better than they were last week, and that's buoyant for them. mitch mcconnell is leading in kentucky by about nine. >> which is significant because they thought mcconnell could go the way of a lot of other leaders. now he leads by two points and now if grimes does lose she has herself to blame. a lot of people are upset because she would not admit who she voted for in the election, let alone support. >> now purdue, look at this, this is david purdue running against michelle nun. he is at 48%. she is at 44%.

>> then you go down to louisiana, and the senate race right now, the republican is leading the incumbent. bill cassidy at 50% and mary landrieu at 45 probably, probably still heading for a run-off unless somebody gets more than 50%. >> let me bring up one other thing with that poll. if all three are together, believe it or not, the other conservative candidate running as a libertarian would get 15%. landrieu is actually in front. when you put them head to head, cassidy would have the lead and mannis indicated if there was to be a run-off and if he were to lose -- which he is going to, he would side with the republican. >> you'll be talking to him on the >> we'll be talking to joni ernst. she is surging in the des moines register poll. it is led by a republican

in iowa who has had an uncanny ability to get this on the nose. joni ernst 51% and bruce braley at 44%. there is joni ernst yesterday. what is interesting is the incumbent, tom harkin, the democrat, long time there, says she's really a nice person, but then he kind of goes off the rails with this sound bite. listen to this. >> [inaudible] joni ernst, she is really attractive and she [inaudible] i got to thinking about that. i don't care if she's good-looking as taylor swift or as nice as [inaudible]

in the great state of pennsylvania. he was at an arena, and take a look at this. if you notice, the arena is cut in half because they knew they wouldn't have enough people to fill it up. there is a black curtain that cuts the place in half. then, as you can see as well, this tom wolf rally yesterday in philly, about half the seats not filled. >> he comes here on this day with a 44% approval, over 50% you unfavorable rating. even in the africa he went from 97 -- even in the african-american community he has dropped. he wants to be out there, and it bothers them that there is no push to get him out there. i couldn't believe as unpopular as i thought george bush was at the six-year mark, he still made hundreds of appearances around the country as well as

bahamas for a night before boarding another ship back to miami. investigators say it is not yet clear what the ship actually hit. >> new overnight. the ntsb indicating pilot error was involved in the crash of the virgin galactic space ship 2. investigators say cameras inside the cockpit show a pilot unlocking a lever used to slow the aircraft's descent too early. two seconds early the spacecraft's tail lifted upwards and started spinning at speeds of 700 miles an hour. the space ship broke apart killing one pilot and injuring another. investigators say they're still trying to determine the root cause. in a matter of hours test results are expected in a possible ebola case at duke university. north carolina health fishes hon torg a -- officials monitoring a patient who developed a fever days after returning from liberia. in the meantime, nurse kaci hickox publicly apologizing

>> sergeant andrew tahmooressi freed tbra mexican -- from a mexican prison and back on american soil today thanks to the efforts of an american bipartisan team including former governor who even provided an airplane to get tahmooressi home. he joins us now to talk about what it took to free the retired marine. good morning to you. >> thank you. nice to be with you. >> what took so long? >> well, this was an effort led by a wonderful mother, jill tahmooressi, who organized a coalition of, as you mentioned, bipartisan congressmen, republican congressmen, myself, a very sound legal

strategy. i'm going to give credit to the mexican government. the attorney general recommended that based on ptsd there should be a humanitarian release. a judge accepted this. this is a good story. the story is that we should never leave our veterans behind not just in conflict, but in civilian life. but we need to learn more about ptsd. but sergeant tahmooressi, i spent a lot of time with him, a wonderful human being. positive, good-looking kid, patriotic, war hero. it's a good story in the midst of all this dysfunction in government, in the midst of all this policies in washington that don't work that republicans and democrats teamed up together to produce a very good outcome. >> governor, it was nice to see the video when his feet hit the ground, american soil. you were on the airplane. you provided this. your airplane. we all say thank you for your efforts in getting him

home safely. what was it like being on the airplane with him? what was he talking about and what were some of his thoughts? >> well, what he was talking about was he wants to spend a little time decompressing with his family. you know, he mentioned that he had been in prison for seven months. he wants to have no eyes looking at him. he wants to spend time with his family. he also mentioned to me before that he wants to get some stone crabs at joe's stone crabs in miami. but he, i think he's going to probably be very quiet for awhile. but his mom, jill tahmooressi, deserves enormous credit. and i think you guys at fox, you raised this issue with the american public. but i think what is important here is the mexican government deserves credit. they don't like to be pressured. they were nationalistic. they're very nationalistic. so the outcome is a very good one. >> governor, when people are at their brutal worst,

they send you to talk to them. you talked to saddam hussein, you go to north korea. then you have to step up to help tahmooressi get out. and i know you have to deal on a diplomatic level with the mexican government but you cannot give them credit. they deserve no credit. the reason they give to let him out, is ptsd, i'm sorry you have to suffer with that to get out but they should be condemned, they should not get applause at this hour. >> well, i don't agree with you. i believe very strongly that the strategy, the legal team that andrew had to pursue a strategy -- >> do you know how brutal those conditions were originally? that's not the way a neighbor treats a marine. >> i visited that prison. what i think we have to understand is the mexicans have very little experience with ptsd. they're not a nation at war. what they wanted was

evidence, medical evidence -- >> but he did nothing wrong. he made a wrong turn into a country which is ridden with outlaws and gangs and cartels. they took a marine and kept him for 214 days. >> look, look, i think the importance -- the state department also played a very good role. the consular service in tijuana, roberta jacobson, assistant secretary. to say there wasn't a comprehensive effort pushing for this, but you have to be careful. you can't show it's diplomatic and heavy-handed pressure. so the strategy was one, i think alerting the american public. a lot of marines have been in touch with us. and the crowt come is good. it's because of a strong u.s.-mexico relationship. i'm going to give you guys credit at fox. you alerted the american public. you brought this to the attention, the mexicans were watching. we should celebrate a good

reaction. the fact that we're talking about the freedom tower which opens today and the boston bombing, amongst those dead and wounded is an eight-year-old child. am i missing it or is that something we should not be kidding about? >> i couldn't believe what i was hearing. i think humor is a good part of our society -- >> you think he's fantastic? >> i love chris rock and i think we need to laugh at ourselves more as far as religion, sexuality, i think we would be a better society. but i think what he did is crossing over this line. he was making light of murder. those people went to work that day. i commuted to the trade center that day. my cousin steve was killed that day. they knew it was a target. in 1993 that place was bombed. yousef, one of the bombers said they were going to attack it again. these people went to work that day to support their families and chris rock is saying he's never going to go in there. you know what? he has that choice. these people didn't.

school, you don't need it. >> it is a story everyone has been watching. the portland woman with terminal brain cancer who wanted to die with dignity and she did take her own life yesterday. >> heather childers joins us with more. >> her name is brittany maynard. she was just 29 years old. she died saturday. she was surrounded by family and friends after drinking a lethal mixture of medicines prescribed by her doctor. she posted on facebook saying this quote. today is the day i have chosen to pass away with dignity in the face of my terminal illness, this brain cancer that has taken so much from me but would have taken so much more. maynard became the face of the controversial right to death movement after she was diagnosed with a stage 4 mag -- stage 4 malignant brain tumor she was given six months to live and moved her family to oregon where it is legal to give

certain medication. maynard said she m(qq the decision to end her life after longer seizures and stroke-like symptoms. she said she didn't want the disease to control her life for her final days. maynard made the most of her last months alive crossing off items on her bucket list. she traveled to alaska, canada and yellowstone national park with family and friends. her final trip was october 21 to the grand canyon. just so you know, four other states allow terminally ill states to seek help from doctors in dying. washington, montana, vermont, and new mexico. and back to you. >> heather, we thank you very much. a couple of days ago she put out word that she was feeling better and thinking about moving the date, and then this. >> she did teach all of us so much about seizing the day and just appreciating every day that you have. i'm glad that she got to go to the grand canyon. if you watch her videos, that was one of her goals. >> she said she was upset by the way her last message was misinterpreted.

she passed away but on a different note, we have more to tell but, including the stuff beyond the midterm elections. >> good morning, guys. first off, police making multiple arrests following a devastating hit-and-run that killed three teenage trick or treaters in california. police have been hunting down suspects since witnesses saw two people take off on foot, ditching their s.u.v. at the scene in santa ana friday night. the three 13-year-old girls were crossing the street in a crosswalk when they were hit by a speeding vehicle. two of the victims are twin sisters. police expected to release the details of the arrest today. >> pastors in houston will no longer be forced to hand over their sermons but they still have a strong message to make during the i stand sunday in texas. thousands of spiritual leaders and activists rallied for a faith-based life without government intrusion. >> what it means to the united states in texas terminology, it means don't

the chiefs are a solid team, jets hurting big time. a college freshman isn't the best basketball player on her team but still the most inspiring athlete in the country this morning. she's 18. she's lauryn hill and she was diagnosed with incurable bane cancer. but instead of -- incurable brain cancer but she suited out so she could live out her dream and play college ball. they had to switch venues to hold all her fans. >> coming up, the final results from tomorrow's elections might not be known for months because the races, many of them are just too close to call frankly. but there are a few key races that might predict the entire thing. polling expert scott rasmussen with your cheat sheet next.

development. >> americans head to the polls tomorrow for the final day and some experts predict we may not know if the republicans will capture control of the senate for weeks, maybe months. but our next guest advises to know the outcome sooner watch a couple of states with early poll closings on election night. here to explain is scott rasmussen. good morning, scott. you say there are certain states that if they go the republicans' way, for instance, in new hampshire. right now scott brown is trailing jean shaheen by a couple in the real clear politics average. let's say he suddenly leaps to a lead tomorrow. what does that tell you? >> if he wins -- the point of this is there are early races so you can get to bed, so you can watch "fox & friends" the next morning. if scott brown wins that means it is likely to be a very good night for republicans. number one, he's been trailing all year. nobody thought this was a

real race he had a shot at until lately. and he's made his roundup by lashing senator shaheen to barack obama, if it works for scott brown in new hampshire, it could work all across the country. >> down in north carolina, kay hagan has been pretty artful at backing away from barack obama, currently according to real clear politics average, she is a little ahead of the republican. >> that is a race thearlly in the year -- a race that early in the year we thought this is going to a tight race. republicans picked up other opportunities since then. polling has shown senator hagan is a little ahead but it has been tight lately. what does it tell us about future elections? if senator hagan hangs on and wins that particular election, it means it's not going to be a terrible night for democrats. they could still lose control but it might be a narrower loss. if tillis wins and brown wins you're looking at a different snar yes.

>> another state that closes early and right now the republican is leading michelle nun who still refuses to say whether or not she voted for barack obama, whether she voted for obamacare. >> she is the best possible candidate democrats could have recruited in georgia. what you're going to look for here, if either candidate wins outright it will be a surprise. if they are able to avoid a run-off, if that happens it will be a good night for their party. if michelle nunn but doesn't gept to avoid a run-off, still a pretty good night for democrats. of all the results, new hampshire, florida, down into georgia and other trending in the same direction it will be a good night for that party. >> in kentucky, if there is one republican democrats wanted to kill off it is mitch mcconnell and right now he's surging. >> because it is mitch mcconnell it is a race democrats wanted to try to win.

because it was a big gap a little while ago. >> new hampshire is one of the races we'll watch early on in the night. if it looks like scott brown might actually pull that off, that will open up the door to a lot of things. we could see a lot of things for republicans that night. if it's an easy win for jean shaheen, it's another indicator. i think new hampshire is turning on a couple of things. one is scott brown is focused on immigration and also on foreign policy. and jean shaheen is on the senate foreign relations committee. armed services committee. all the isis talk has not been a great focus for that campaign. >> and it's a surprise because if you said that six months ago, people are like no one cares about overseas. they're burnt out from middle east problems. but when you a resident of new hampshire get beheaded and scott brown was tougher on that then you say, let's give this guy another look. plus, he seems to like meeting people, going out, working the bars, going to the marathons.

the white house has been hit with an avalanche of scandals and problems all impacting our nation's heros directly. 22 million veterans in america and 57% of them voted in the 2010 midterm elections. so will they get out the vote tomorrow and have their voices heard once and for all? pete hegseth is the ceo of concerned veterans for america and he's on a mission to get veterans to vote and joins us now from the battle ground state of north carolina. captain, do you think the veterans are motivated to vote and in the past, why haven't they? >> how could they not be motivated. from the scandals at the department of veterans affairs, we're gutting our military, isis is on the march, we're trading deserters for traitors.

over to lea who has our headlines. >> good morning. police making multiple arrests following a devastating hit and run that killed three teenage trick or treaters in california. police have been hunting down suspects since witnesses saw two people take off on foot, ditching their suv at the scene in santa anna on friday. the three 13-year-old girls were crossing the street in a crosswalk when they were hit by the speeding vehicle. two of the victims are twin sisters. police are expected to release details of those arrests today. armed and ready to fly. the tsa confiscating dozens of guns from carry-on bags at airports across the u.s. 181 firearms were found just last month. 157 of them were actually loaded. nearly a third of those had rounds in the chamber. but it wasn't just guns. agents also found grenades and a 13-inch cane sword. how do you spell hypocrisy?

here. pamela, you welcome your children calling you pam, correct? >> yes. they have called -- they call me pam and mom about 50% of the time. >> whenever we called our patients by the first name, it rarely happened and it was really a joke. so why do you give your kids the option? why don't you prefer mom? >> well, they really learned that from me. when i was four years old, i was in a setting with my mom, she had a lot of friends over. i kept saying, mom oh, mommy, and she didn't listen. so i finally said joy. and she stopped and turned and looked at me and all of her friends did and everybody laughed. i called her that from then on. >> mark, why do you think it's not appropriate? >> ainsley, i have five children and i called my 22-year-old daughter last night and said, hey, emily, you want to start calling me by my first name? and her reactionçó was, no, dad. i said, well, why not? and she said, i can call so many other people by their first name

>> joining us from "fox business" network, maria bartiromo. good to see you. >> tomorrow was a big day. mid terms are here. and if the gop does control both the house and the senate, how is this going to affect the president when it comes to finances and the economy? >> it depends on what the president would like to do. does he want to have a legacy that he actually is getting things done or does he want to keep going up against the other side and not -- vetoing things? i suspect that the republicans, if they take both chambers, they will come up with job creating bills. that means capitalizing on the energy story, fracking, the xl pipeline, tax reform, lowering the rate and broadening the base. all of this seems very likely to actually get businesses to create jobs. whether or not the president will veto those remains to be seen. >> we know they've been working on tax reform in the house with david camp and company. we'll see if that moves forward.
