them, their families. we are grateful for their safe return. i appreciate director clapper doing a great job on what was obviously a challenging mission. >> now, today's release follows last month's release of jeffrey fowle and that means there are no americans being held by the north korea regime. dominic dinatelli join us live with the latest on the developing story. >> you probably can see by the look on president obama's face this is extremely good news. intelligence officials in washington saying kenneth bae and matt miller are heading back to the united states right now. miller was serving a six month jail term on charges of espionage while bae is a missionary. with them, the director of national intelligence james clapper who had negotiated with the dprk for their return. here's what his office had to say in a statement a short while

ago. kenneth bae and matthew todd miller have been allowed to depart the dprk and they're on their way home accompanied by dni clapper to rejoin their families. the united states government is facilitating their return to the united states. bae was serving a 15-year sentence for alleged anti-government activity. he's had serious health proble s s and the u.s. had appealed on humanitarian grounds. they allowed him a visit by his mother just over a year ago. this is what he had to say at the time. >> translator: i have told her about my mental and physical health conditions while i am staying here and i also asked her how the rest of the family is doing. >> what we know of miller he's from palo alto, california, and put on trial after he reportedly

behaved very bizarrely after arriving at the airport in april of this year. allegedly, he ripped his passport up and demanded asylum. very strange events in north korea including the vanishing of kim jungen. usually, the regime holds western citizens as a means to get something out of wealthy nations. unclear as to what the trade was this time, uma. >> all right, dominic, thank you for the latest on that breaking news. turning now to the fight against isis. u.s. and its coalition partners launching 11 air strikes over syria and iraq over the past few days. this as the white house announces we are now sending 1,500 additional troops to help out the iraqi forces, deepening u.s. involvement at a time when that terror group is gaining ground with its brutality across iraq and syria. joining us now, john huddy, who has the latest from the middle

east bureau. >> these additional troops will basically serve in a noncombat role according to military officials. essentially training and supporting iraqi forces, rather than fighting alongside them. president obama gave the green light to double the size of u.s. troops in iraq to 3,100 over the next 2 to 3 months. they'll train nine iraqi army brigades and three iraqi kurdish peshmerga brigades. training sites will be set up outside baghdad in ner beal erb including inclu include where some of the bloodiest fighting has gone on for months now. as air strikes continue, with seven hitting isis positions near the syrian border town of kobani, a very important strategic town, as it sits along the turkish border. another six air strikes taking out isis units and facilities near fallujah and baja.

baja is where iraq's largest oil refinery is. another important fight going on there. a bloody one. a tug-of-war between forces and isis militants. that again has been happening in the past couple of months. all this comes at a very hefty price tag for the u.s., uma. the white house is requesting an additional $5 billion to fight isis. and that includes $1.6 billion for the training and support of iraqi forces. uma. >> all right, john heady from our middle east bureau, thank you. now many people are asking why the president waited to let the american people know he was sending in troops after this week's midterm elections. critics are crying foul about the timing. joining us now for reaction, illinois senator mark kirk. welcome, senator. >> thank you for having me. >> let me ask you, why do you think the president waited just days after the election to announce this, when it's known that iraqi battalions first asked our military leaders for that assistance in september?

>> he has timed almost everything to not affect the midterm elections. you can imagine he was quite afraid of what was going to happen in the elections. he didn't want anything to upset the apple cart there. >> what would move the president to suggest that iran's supreme leader ayatollah khomeini and the u.s. had a shared interest against isis and any cooperation fighting it is terror group would be contingent to iran reaching nuclear agreement by november 24th? we know for instance iran has been complicit in the rise to isis. we're talking about that secret letter that went out. >> i don't think the letter's going to lead to much. definitely turned into the appeaser in chief. appeasement in history has never really worked with dictatorships or terrorist regimes. >> isn't this letter another example of what critics would say is president obama acting with little regard for our allies as he tries to pursue this deal with iran? >> certainly, it would

demoralize our arab allies and israeli friends quite a bit if there's potentially a lot of strategic cooperation. we all know the iranians really want an atomic weapon. this condemns the next generation of americans to witnessing a nuclear war in the middle east. >> the iaea just came out with its own report yesterday, saying that just weeks before the november 24th deadline, iran has still not provided vital information about its suspected explosives test. does the president really believe tehran is ready to stand down and set aside its nuclear ambitions? >> i think he's going to tell us that the president is horribly misguided here. passing love notes to khomeini is not going to work. we have to understand iran was a -- certified as a terrorist nation by democratic or republican presidents for the

last 30 years. they're an exceedingly poor partner to work with, with interests that are anamical to the united states. >> even as the white house confirms the letter went out, security adviser susan rice is saying the u.s. is not trying to make a separate deal with iran. let's hear what she's saying this week. >> with respect to potential presidential correspondence, i think you know that i'm not going to comment on any private communication between the president and any world leader. but i will say this, first of all, as i've said repeatedly in public and others have too, we are in no way engaged in any coordination, military coordination, with iran on countering isil. >> what's your reaction to her response? >> seeing susan rice running this policy really makes me worry, given her past record on coming clean on the national tv shows on benghazi. i would say in this case we

should make sure we treat our friends well and our allies the best and not deal so closely with iran in such an idealistic way -- >> what's the senate going to do about it going forward? we've got a gop controlled -- >> now that we have a republican senate -- >> what are you going to do? >> now that we have a republican senate coming, i think one of our first votes should be on the bipartisan mendez/kirk sanctions on iran, getting support for that, especially with chuck schumer of new york. >> what does that entail exactly? >> would be tougher sanctions than led us to the position where we got 74% of the iranian currency cut. that brought them to the table. as the president's told us over and over again. >> i want to switch gears for just a moment. i want to ask you about the supreme court saying that it will hear the new est challenge to the law over tax subsidies in obamacare. your reaction to that?

>> in the case of the new republican senate, i think we will not fund some of the parts of the law that are particularly egregious like individual mandate or the ipad rationing mechanism. i would see key positions for obamacare as not being filled by the senate. that will relieve that enormous wet blanket which the aca puts over the economy if the american public sees the aca is not going into full effect, a number of small businesses will start to hire again. >> senator kirk, thank you for joining us today with your insights, appreciate it. we promised we were going to give you a fair and balanced response later on in the show. from representative john garamendi about the future of the congress as it moves forward to 2015. all right, let's get back to that secret white house letter to iran's supreme leader and how the news is sitting with our key

ally in the middle east, israel. welcome, sir. >> it's good to be here. >> i know israel must be very upset with the news that this letter was actually sent to iran's supreme leader. give me your reaction. >> well, israel is very upset and very surprised. because that letter is really a letter of appeasement. it is, you know, it's sleeping with the enemy, the morning after sending them a love letter. as we know, it's not the first time. it's probably the fourth communication between the president and the iranian leadership. totally disregards the fact that the recipient of that letter is a terror state, which perpetrated, harbors, finances terror all over the world. is really the main reason for the rise of isis. support hezbollah and hamas on the borders of israel. and to do this is a sign of

weakness. the message it sends out to its allies, to america's allies, especially to israel, is a message of weakness, of a weak america, and the worst thing is the message it sends out to the iranians is how eager the united states is for that deal, how eager the united states is to cooperate with this evil from the extreme cruel and cynical regime in tehran. everybody was talking at the time many years ago about -- remember, chamberlain was prime minister of england, stand, saying i have a piece of paper here attesting to his agreement with hitler. we know what happened the day after. this is a paper umbrella from a paper tiger with a message of weakness to the rest of the world. what it says to the american allies is they cannot rely on the united states and what it says to america's enemies is they can get away with murder and in a very tough neighborhood, a very, very cruel

and cynical world we live in, this is very dangerous. >> what do you think would move this president to send this kind of letter at this point, at this moment? >> you know, i think the president is desperate for some kind of achievement in foreign policy. his row of disasters, middle east, vis-a-vis china, vis-a-vis russia, especially iran. i think it's a sign of desperation. as you know, whether it's in politics or business, when you negotiate, you have to come from a position of strength. what the iranians are saying. believe me, i know mohammed jarel, the chief minister, he served with me as iran's ambassador to the u.n. he's have shrewd, very charm, very able. what he sees in front of him is a weak america and a president probably traumatized by afghanistan and iraq who

desperately wants a deal and is actually beseeching the iranians to cooperate, disregarding they're a terrorist rogue regime. and at the same time, iraq, which is eager to do business with iran. and i think what that bodes for the rest of the world is just sitting and watching how a bad deal is actually being finalized and it makes us very nervous. >> we had a report from the iaea that just says iran is not providing the information it was supposed to so far. you're just weeks away from that november 24th deadline. clearly, it look, as though iran is saying we're not going to play ball. if you want this greagreement, have to do it on our termings. >> you sit at the table with a side so eager for agreement, you take advantage of its weakness, you negotiate the best deal you can, and i think that's what the iranians are doing, while playing the clock, and, you know, we've seen it before. we've seen it with north korea.

with north korea, there was even an agreement. and we know north korea went nuclear. and i think what will happen is that there may be a bad agreement. the world will be lulled by iran who is a master at playing the clock. and one day we'll wake up to a nuclear iran and believe me, uma, a world in which iran has nuclear capabilities is a world we do not want to live in. it will be dangerous. it will be ugly. it will be cruel. iran's fingers are all over the map. they're not just threatening israel. they're not just, you know, trying to advocate a second holocaust while denying the first one. their threat to the arab world, the sunni world, their threat to saudi arabia and the gulf states and their threat to civilization as we know it. it's beyond me how the president does not realize it. he is supposed to be the leader of the degree world and the weakness he shows at these very crucial times is very worrying. >> thank you so much for joining

the jack gave way. he's a nascar star who's now facing allegations of domestic abuse. kurt busch known as the outlaw in racing circles and 2004 champion is accused of allegedly assaulting his ex-girlfriend inside his motor home at dover international speedway in september. bush is denying those charges. how this has another sports association having to manage domestic violence against one of its high-profile stars. >> they broke up this september but about a week after their split, driskell claims the nascar driver verbally abused and hit her. according to court documents obtained by the associated press, driskell alleges on the night of september 26 inside busch's motor home, busch jump upped, grabbed her face, causing

her severe pain and bruising. driskell says the incident happened after busch had a bad night at the racetrack, accusing her of having spies watching him and that busch said he wished he had a gun so he could kill himself. driskell ran from the motor home. on wednesday, she asked a judge to order busch to stay away from her and get a psychiatric evaluation. in a statement from his lawyer, busch denies the allegations. quote, the dover police department has been informed that mr. busch will fully cooperate with their investigation and he expects to be evindicated. this allegation is a complete fabrication by a woman who has refused to accept the end of a relationship and mr. busch vehemently denies her allegations. nascar says they're aware of the investigation, are gathering information. busch is known for his hot temper on the racetrack. nicknamed the outlaw, he has a reputation for feuding with

reporters and drivers. he is expected to race this sunday. now, the armed forces foundation, a nonprofit for veterans who driskell is president of, has dropped busch as an ambassador for the program. a hearing for the case is scheduled for december 2nd. uma. >> all right, thank you. some sad news on that tragic washington state school shooting. we have news another student wounded in that rampage has died. he's 15-year-old andrew fryberg who was also the shooter's cousin. jaylen fryberg opened fire in the school's cafeteria killing four students and killing himself. the only victim to survive being shot was another of jalen's cousins, nate hatch who went home from the hospital on thursday. now that the gop has taken control of the new congress, what lies ahead when it comes to working with the democrats who took a beating in this week's midterms? coming up, we will talk with california democrat congressman

>> the president had planned to wait until after his ten-day trip to asia to announce his choice for attorney general. but her name leaked in the press yesterday. so today the white house quickly arranged an event so the president could introduce her. 55-year-old loretta lynch is the u.s. attorney for the eastern district of new york, a position she also held under president bill clinton. here's what president obama said about lynch today. >> it's pretty hard to be more qualified for this job than loretta. throughout her 30-year career, she has distinguished herself as tough, as fair, independent lawyer who has twice headed one of the most prominent u.s. attorney's offices in the country. >> first, lynch has to be confirmed by the senate and that process starts in the senate judiciary committee. the outgoing chairman, democratic senator patrick leahy, called lynch an experienced prosecutor and urged that she be confirmed in a

reasonable time period. the expected new chairman of the senate judiciary committee republican senator chuck grassley said of lynch, i have every confidence miss lynch will receive a very fair but more thh vetting. u.s. attorneys are very rarely elevated to this position so i look forward to learning more about her and how she proposes to lead the department. as you said, uma, if she's confirmed, lynch would be the first african-american woman to hold the attorney general position. uma. >> all right, molly, thank you very much. i believe that the president continues to act on his own, he is going to poison the well. when you play with matches, you take the risk of burning yourself. and he's going to burn himself if he continues to go down this path. >> that was house speaker john boehner with his dire prediction just days after the gop's big

win this week as it gains control of both the house and senate. president obama is saying that he may just bypass congress and use executive actions on issues like imcombination reform. joining us now, our guest who has reaction to speaker boehner's pronouncements there and what lies ahead. as we look forward to hopefully seeing both sides working together. congressman, welcome. >> good to be with you. good morning or good afternoon depending where you are in this world. i think we have to be hopeful. the american public really wants us to do the work that needs to be done. there's some very, very heavy duty issues out there. certainly among them, immigration. there are also issues not so controversial. both the president and the leadership have talked about infrastructure. transportation bill is pending. we should get that done. that's a major job opportunity. there's talk about the repatriation of foreign earnings

back to the united states. we could work on that. certainly, and there's a proposal that's already before congress, to repatriate that money but also make sure it is used to build the american economy. that it's invested in american produced goods, services, infrastructure and the like. there are many things we can work on that are not as controversial as the immigration issue. >> the immigration issue is something the president spoke about again this week. saying that he would like to see some real action happen before the end of the year. would that mean then if he decides to take some executive actions that democrats are going to be happy about it? >> well, i think there's two different things that action could take place. there's a senate bill that has been in the house of representatives for about a year and a half now that could be acted on in the lake duck session. about 90% of the senate and the house will be the same next year as it is this year. so we could take that up. if we did, that issue would be

behind us. in my own district, large agricultural district here in california, the farmers desperately need an immigration bill, as does the high-tech industry in this state. there's a lot of opportunity here to work to get that done. will it get done? i don't know. will the president take action? probably. but keep in mind the only action that he could take is within the existing law. he can't operate outside the law. now, there may be controversy about what he does, but nonetheless, it can only be within the law itself. and that's not unusual. the legislation passes and then it's interpreted by the administration, put into effect by the administration. so hopefully whatever he does won't create a big blowup so that we are unable to pass any immigration law -- >> are you concerned at this stage of the president already coming out and saying he may take it upon himself to make an end-run around congress and use executive actions if necessary?

>> well, you can't -- i don't think end run and running around congress is appropriate use here. the president has no authority to act outside of the law. within the law, and it's been in place now for many years, there are administration actions that the president can take. but that has to be consistent with the current law. it may not be what democrats or republicans may want the next law to look like, but he can only do what the law currently allows. and that's not an end run around congress, that's acting within the existing law. there's going to be a lot of huffing and puffing on both sides. the real action must be in congress. we really do need a rewrite of the immigration laws which clearly do not work for anybody, either those who are here without documents or those who want to come to this nation or the farmers that want to have workers brought in or high-tech

workers brought into this country to keep our economy moving. so we have work to do for sure. congress must deal with this issue. hopefully in the lame duck session. if not, then certainly, next year, in the new session of congress. >> congressman, quickly, let me ask you, what is your take on the fallout from the election? what is the message that you are hearing from the american people? >> well, clearly the american public is unhappy. unhappy with a variety of things. and the progress that has been made since the great recession in 2008 has not satisfied the american public. it's been, what, 55, 56 weeks of job growth. but the wages of the american worker has not kept up. in fact, has fallen off a little bit. and so the public, general public, is unhappy. they're very, very concerned. obviously, the ebola issue, the isil issue, the international problems in ukraine.

all of those things weigh heavy on the american public when, on top of that, the american public doesn't see much growth in their personal income. keep in mind that the american public lost several trillion dollars of asset value. their homes, their assets plummeted while wall street and those people owning stocks are doing very well, that's not the general public of america. so there's an unhappiness. and a concern on the part of the american public on all of these issues. and they voted. they voted their concern. looking to, you know, to bring in the republican control of many state legislatures. and certainly the congress and the senate. the underlying problems remain to be resolved. obviously, the international issues. we've made progress on the ebola situation. nonetheless, we have an enormous amount of work to do in congress. from tax policy to immigration. to really getting the american

jobs machine working in such a way that the wages of the middle class actually increase. >> all right, congressman, great to see you. i think the other big message is the public is tired of all the gridlock. >> no doubt about that. >> they want the people's work to get done. so thank you so much for joining us, sir. appreciate it. former president george w. bush stopping by texas health presbyterian hospital in dallas. it's the facility where one ebola patient died and two nurses were infected with the disease. mr. bush giving a big hug and kiss to amber vinson. you remember her, she was one of the nurses who is now ebola free and here's her reaction. >> amber, how are you? how you feeling?
