states. talk about it with the senior politics writer for u.s. news and world report. that could be one of those be careful what you wish for situations republicans won the senate, now they have to prove they can govern. what is the first job when it comes to the budget situation? >> i think the budget will be fascinating to watch because a number of these senate candidates that won ran against a senate the never passed a budget over the past five years, so now they will have to put forth a budget. mitch mcconnell says he wants to do so, but will they be voting on the ryan budget. it passed in the house, dead on arrival and the senate, republicans will have that senate, and it looks like they will have the votes to pass the ryan budget. it has five republican defections when the senate had to vote for it one time, will

you get any republican defections? and any moderate democrats or red state democrats looking at this saying maybe i will vote for the ryan budget. the budget will be where a lot of the action is and we will see a lot of it based on how that shakes out. jon: the only way to reduce the budget is to shrink the budget, right? >> that is a big change in terms of the way medicare is deliver delivered, making social security a different program, basically reining in some of the entitlements, spending over time, but you see them getting hit on it right now where bill

republicans pick up another u.s. senate seat. alaska's dan sullivan declared a winner an a week after the midterms. he beat incumbent in a very tight race. he celebrated last week with a lead of 8000 votes after counting absentee and questionable ballots, they said he is going to win. that is eight seats for majority of 53 now, and we're still waiting for the results of next month's runoff in louisiana. heather: breaking news the search for violent robbers who hit in new york city jewelry store caught on camera, two gunmen pulling off his heist in broad daylight in midtown manhattan diamond district, literally half a block from where we sit right now it they pistol whipped the store owner in the process. are there any closer to finding these guys? >> writes now they're telling us

they don't have a line on the suspect but they will when they get it. this brazen robbery was surprising for many reasons happen right over our shoulder outside of our offices. security cameras are everywhere. it happened during the veterans day parade where there were thousands of people out on the street. and those two men slipped into the crowd after grabbing the $2 million worth of hardware from the watch standard jewelry store in manhattan's diamond district. one posed as a delivery worker to get buzzed in well the other stood lookout on the shop located on the eighth floor. he demanded property that was inside. one of the employees were pistol whipped when he walked in during the robbery. >> there were four employees in the store. suspect number one pulled out a gun and demands the jewelry be placed in a bag he was carrying. a fifth employer returns at this

israel, that really sent a very strong signal to the palestinians that what they were doing was working and i that is dangerous. what we need to see sectarian states john kerry doing today when he meets in jordan is to send him a strong message that this type of violence, this literally healthy and activists driving over israelis, hitting them with their car, all of this is to be condemned strongly by the king, and to be very clear on this. we should say you must condemn this as well. when we have a palestinian government that is dismissive of this violence and supportive in some way creates a culture within the palestinian community

celebrating it, we have seen them celebrating these perpetrators. heather: you mentioned there is song and campaign on social media. this is making the rounds on social media, these cartoons, if you will be at that is encouraging people to speed up, encouraging palestinians to speed up and hit crowds of innocent civilians. this one done something similar and again, this one. these are sick and encouraging people to use their car as weapons to kill and maim innocents billions and that is what is happening there right now bid >> we have seen this over and over and over. when there are things like this, it is sick. you have to speak out and we have to demand palestinian governments do the same after

all our u.s. tax dollars are going to find the palestinian government. if they're going to look the other way or celebrate this, it means they can't govern, they are not concentrating on picking up the trash and creating jobs. that is what secretary of state john kerry needs to do is the unequivocal. so we must have condemnation. u.s. government is not demanding this. heather: they are in part and encouraging these of campaigns. want to read something from the jerusalem post today, there is a sense of freefall of events getting out of control. anyone who has lived here in the first and second will recognize the same nervous spirit in the streets. it is now on safety stand a bus stop or light rail station and that is where some of these car tax and stabbing attacks have taken place. do you feel there is a new

posting uprising that is now underway? >> have always had palestinian violence because they don't have a government that represents them. what w we're seeing is no pressure. when the u.s. government withdraws and doesn't pressure the palestinians or others and really makes consequences for their actions, there is a much edgmessage sent you should conte doing these outrageous acts. john kerry is pressuring the israelis to sit down and talk to this palestinian unity government. we would never allow another country to tell us to sit down with the taliban or some other terrorist organization and work out the details. so why are we allowing the secretary of state to push the israelis. heather: thank you so much, we will talk to you again later.

but they were getting together on daily basis to engage what married couples do. she admits they were having con sense awl sex. it ended that night and took up a shower and she says threw her back on the bed and essentially starts to rape her so she shot him. ashley is that ground? is there justification there for a murder? >> definitely, definitely. it comes down to what the jury believes. if the jury believes her and think she is credible they're justified in finding her not guilty. it will come down to whether or not they believe her story and allegations of prior abuse. there were allegations that he was rough with her in the past. maybe they liked rough sex. there are allegations of that. he took a step too far and violent with her in the past. it will come down to whether or not the jury thinks she is credible and the story is credible about that abuse. jon: credibility, dan, comes into question because she told police that the stab wound that she had in her side was

inflicted by her estranged husband. then after questioning for a while, she admitted that she did it to herself. doesn't that suggest that she staged this whole thing? >> yeah, she has some credibility problems. one, as you said, she originally said she was stabbed by her estranged husband. then she said she did it to other herself. she said she only said that because the police were badgering her to say that. that wasn't really true. about her originally saying she shot him by accident. now saying it was intentional because it was in self-defense. there is issue of first responder who said the body was cold when he got there. of the meaning that the body might have been dead for an hour or more. on the other side she does have injuries. she has vaginal injuries. she has a chipped tooth. she has bruises, scratches. so she was hurt in this encounter. there is compelling facts on both side. jon: so, ashley, what do you do? if it is up to the jury to sort this out, it is a very complicated case. again it could go either way. she is not charged with

first-degree murder. second-degree murder case, right? >> right. and what you've got to do you have got to explain to the jury why the person would tell police different version of events. why she would change her story. that undermines her credibility. she says, i don't remember how i was stabbed. i don't remember if he was one that did it. oh, wait, i actually stabbed myself that really undermines her story. she has to explain and put the jury in her mind as what she was going through when she was being interrogated hours on end by the police and why she would give different versions of events of that night. that is what really undermines her credibility. jon: dan, can she argue self-defense when admittedly they were having consensual sex before this incident? >> absolutely, if they were having consensual sex and it turned violent, he got violent, she had alleged violence against him in the past. if she was being violent she has to defend herself. if that is true, absolutely she could use deadly force. she could shoot him and kill him if there is imminent threat of

serious physical injury of death from him of the question the prosecution would have to ask her what would be motive to shoot her if it was not self-defense? motive is not element of crime. jury will wonder why did she shoot him if it wasn't for self-defense. jon: we'll keep eye an eye on that. we'll talk about another story, a name we haven't heard in a while, chandra levy, who disappeared in may of 2001. the man convicted of killing her is asking for a new trial. his lawyers claim his former cellmate lied on the stand. ashley, what you know about that. the immigrant who has been convicted in her murder. he had a cellmate, a gang member, who testified against him. said that he didn't want anything but in fact he did ask something from authorities. >> right. they always want something, jon. there is no way that this man just came forward out of his own

good grace and out of what he thought was right or wrong to testify against this man. he clearly wanted something. the real question in this case is whether or not the government knew that and whether or not they knew he wanted something. he had asked for something. and whether or not there was information that they were required to turn over about that. because once he testified, as their witness, if they know that he was lying or they have information that is contradictory to what he was testifying to, they have got to disclose. that they have to disclose it to the defense. they have to disclose it to the court. so that is the real issue in this case, whether or not they knew that information, they knew there was a specific instances that undermined his credibility and whether or not they supplied that information to the people they were required to. jon: his attorneys are also saying, dan, that this cellmate, supposedly didn't know how to, or had claimed he didn't know how to come forward to authorities with information, but in fact, he had testified in earlier criminal cases. he was apparently involved in some criminal case, some gang

activity out in california. >> right and that's the question here because we know that he testified that he didn't know how to come forward to authorities. that was part of how he told his story and that added to his credibility. the fact that he actually had been an informant before undermines that. as ashleigh said, the question did the prosecutors know that or should they have reasonably known that? if not, i don't think the defense wins on this issue. if the prosecution did know about it, that's a different story. jon: so what happens? do they throw out the conviction all together? do they have a new trial? how does this, how does this work out, ashleigh? >> what is most likely the judge would give them a new trial, if the judge believes this information is important, that it's relevant and it could have changed the actual outcome of the trial then the judge has a duty to grant a new trial. they might be faced with having a new trial, with or without morales testifying. if he does testify again, the defense would be able to cross-examine him on all of information and bring that out in front of a jury. jon: ashleigh merchant, dan

slows downhill and burns through a fence and destroys a driveway. that molten rock has been spreading for months now claiming its first house two days ago. we're learning the family who lost that home is now building a new one on land about 10 miles away. that one was also covered by lava years ago. jon: hope lava doesn't strike twice in the same place. we're learning about some oui r new health troubles for rocker bret michaels, forcing him to reschedule several performances. julie banderas here with the for example 411. >> that's right. it has been a couple rough years for bret michaels. the last couple weeks were pretty intense. michael's guitarist announced on facebook and his website the singer has been in the hospital six times in just the past two weeks including undergoing kidney surgery. according to him, michaels had two stents put in his body past week. shortly after the procedure he insisted on returning to his tour and performed in memphis,

against doctors requests. well after the show, michaels was hospitalized again and once again he insisted on playing at his next concert in knocksville. that decision put the 51-year-old in grave danger. he writes, this time it went real bad. during the show he gave 100% but he hurt himself. jumping around with two stents is bad idea. i can't explain the amount of blood and where it came from. it was horrifying on his bus after the show. bret was again taken to a hospital and this time given medication that would keep him down. the doctors basically refused to release him. michaels health scares began in 2010 after having emergency appendectomy. after that he suffered a hemorrhage at base of his brainstem. the singer with type one diabetes had to be rushed offstage due to low blood sugar. keeping the tans updated on the rock kerr's condition he added he is still not 100% and there are no plans to postpone anymore

convicted just a few weeks back of murdering a teacher now says he wants a new trial. lawyers for allen prue say the trial judge made a mistake when he excluded testimony from a expert witness, a new hampshire psychologist. she was hired by prue's wife in the case, to bolster an insanity test from her. the judge blocked the wife from testifying about the husband's mental state. the couple lured out to their car with false claims of car trouble. heather: powerful union getting a foothold in a non-union car plant in state of tennessee. tell this to volkswagen, now announce as new policy today, saying it will not involve collective bargaining. the united auto workers union is expected to have a voice with management. jonathan serrie is following the story live from our atlanta

bureau. jonathan, how is this all going to work? >> reporter: hi, heather. vw announced its new policy today setting guidelines for the company's engagement with labor organizations. however the german automaker states, quote, this policy may not be used by any group or organization to claim or request recognition as exclusive representative of any group of employees for the purposes of collective bargaining. back in february the united auto workers attempted to unionize vw's chattanooga plant. that attempt was defeated by a vote of 712 to 626. however sources say it appears the uaw would be among multiple labor groups invited to the table in a collaborative arrangement modeled after the work councils in germany. >> definitely think it is a move to get more conversation, to get more dialogue back and forth. i do not see this at all as a move to ultimately recognize uaw
