a third intfadda and some believe it has already started. >> thank you, john. >> in case you haven't heard the gop picked up another senate seat. sullivan led by 8100 votes on election night and the absentee could not help begich. sullivan tied bi gich to obama policys that are unpopular in alaska. >> the fallout continues after an obama care architect admitted that the legislation was designed to mislead voters and citing the stupidity of the american voter for getting that law passed. now the professor is trying to back off of those remarks.
10:05 am
>> the comments in a academic conference and i basically spoke inappropriately and regret that comment. >> now another video in which gruber slams the american voters once again. they will no longer get a 40 percent tax break. 40 percent, half of the insurance companies themselves. that is pretty much the same thing. why does it matter? you will see. let's bring in petessnyder fox news contractor and julie is a fox news contractor and former advisor to former senator. >> pete, americans are too stupid to understand. >> john, you can't make this stuff up. those lines would be rejected
10:06 am
because they are too absurd. this is the reality of the obama administration. this is really what they were thinking when nancy pelosi said we'll know what is in the bill when it passes. they wanted a lack of transparency and total distain for the american people. no wonder washington has the lowest approval rating. ncalling voters stupid, julie, is getting the attention, but something that is not getting attention, is the fact if you call it a tax, it would never pass. that's why we call it something else. >> first of all his remarks are themselves stupid. he shouldn't have said it or thought. it i am not the thought police, but anybody who thinks that the american people are stupid i profoundly disagree with. he was right to apologize. to the larger point. the supreme court ruled that it is it a tax. that's why john roberts said it

in his ruling. and the reality of obama care is a law of the land. and i understand the republicans will try to repeal it. i don't think they will be successful and if we want to continue the battle of obama care and repeal and rather than tinkering with it. we should look to the law and see how it is able to be made better. >> if this went in the writing of the law it ought to be repealed people may say. when asked if the obama administration misrepresented the affects of the health care law to get it passed, 55% said yes. this poll was taken a month ago in october before the comments from johnathon uber came out and also on the same topic, when asked how they felt about obama
10:08 am
care and was it good for the country or not, 52 percent said it is bad for the country, julie. i can't imagine these remarks from gruber are changing people's opinions. >> you are right about that. and the president said if you like your health care policy you can keep it. i am surprised only 55 percent think that parts of obama care were misrepresented and we know that the president misspoke about the aspects of it. i will also say this. the very people who don't like obama care, you saw it in the kentucky election where people were upset with the state health care policy and still votered for mitch mcconnell. they loved the fact that they have access to health care because of obama care and you can see that over and over and over again. >> you don't see the love out there for the program. >> you do actually. >> and only 40 percent of the

rescission. if you have cancer you could be thrown off those are popular provisions. >> julie, i would like to repeal. we are talking about government competency. you have state governments that be scrambling to implement this and we'll see the second verge of obama care 2.0. >> you and i know there is some governments that have done excellent. new york state and others are doing a poor job. >> for all of the costs and expense. i don't think it is it worth it at all. it is failed politics. >> i have sewn health care for other needs. millions of people have health care. >> and health savings account would be a perfect thing and a lot more efficient and economic to give them health care. >> they are not going to do it this time. >> one more point, back to johnathon gruber and the so-

afternoon. we'll keep you updated. well, the family of thomas eric duncan, only ebola patient to die in the united states. reaches an undisclosed settlement with a hospital in texas. casy ste gal. >> reporter: the family believed that the presbyterian hospital in dallas made errors when it came to the treatment of duncan. how he was discharged from the emergency room. duncan went to the feeling well and reportedly told a nurse he had been in liberia and his travel history was not sewn and so he was sent home with medication. days later, he returned to the same hospital when his condition deteriorated and only then did they realize he had ebola.

10:38 am
united states is expected to cut it 25 percent. and my concern is how will you monitor it? will the chinese abide by the agreement? how will it affect the american economy? i am sure this is one of the things that the congress will take up because of the tremend concerns about it. and of course, after a bad election and a lot of the foreign policy failures for the team obama, this looks like a foreign policy success. it provides good optices for the white house. >> did we get steam rollered a bit? they hold a ton of our debt and hacking our computer and the post office computer system and strengthening ties with vladimar putin? >> the white house's view on foreign policy is broken down simply, if we are nice to them
10:39 am
they will be nice to us. by allowing them to move forward with the agreement it looks like we are cooperating instead of confronting and there is a lot of reasons for us to confront china because of the assertion of the perceived national interest in asia. china wants to replace the united states as a pour in asia and they are on the track to do so. and if they so the united states in decline as they do under president obama they will take advantage of it. >> do we get anything out of it? >> i don't know. it depends on how you look at the agreement. i think the white house would say it is a foreign policy victory for the united states. on the issue of climate change. i hold a different view and i will turn it over to the environmentalist and experts on the environment. but i am concerned.

10:48 am
it is a historic moment for the space exmroration. comets are a time capsule of the galaxy. and we'll talk about what is achieved with tashing malac. managing editor of space.com. it is incredible when you hear the mission. ten years in the making and they caught the comet in space and using the graveitational pull and checked out asteroids en route and landed the little thing on a moving comet. >> ten years and they have travelled and throw hundred million miles from earth. it is done with precision operation. the spacecraft is on the surface of the comet. >> one of the big concerns when they got close and looked at it, it was much, much rougher than they expected. they built a machine that could

half an hour later did we find out what happened. and it seemed to go well. >> one of the possible side-effects should we find it is heading toward earth in a trajectory to take it right to earth, they may be able to land something to blow it up or break and divert its path. nhumanity has shown with the european mission, we can approach slowly and land and watch its speed and if you take a lot of equipment ten years ahead, you know you can do it successfully. and now years ago, it would be hit with projectiles and you have a winning combination. >> cool stuff. thank you. heather? >> i love that. defending the planet. how about they can zap that out

a huge chunk of our country is getting an early taste of winter weather this week. this includes denver, colorado, where the highs are expected to be just 5 degrees, so let's get to our chief meteorologist rick wrightmuth who has a look at the weather today and what it's going to look like going forward. hi there. >> a lot to do with denver. yeah, incredibly cold. the lopping-term forecast doesn't hang that much overall. take a look at the high forecast. you notice the number on the right. that's as far below average you are. denver, around 54 degrees below
10:55 am
what you typically should be. you have broken that zero up to two degrees right now. minus 4 in casper. these temperatures are wind chill temperatures xshgs they'll continue to remain danger aresly cold. this is a night that you have to do everything that you can to stay warm. make sure you have your plans in place because it does not take much time at all to run into big problems when temperatures are like this. today around 40 degrees below average. it is coming to the east coast, and this pattern sticks with us. it looks like for another week. >>. >> let's go back to lower manhattan. it looks like a barge floating on a river. it's actually a scaffold.
10:56 am
a window washer scaffold. riding the scaffold up and down cleaning the glass on the big manhattan skyscrapers and other cities as well. they are stuck there. can you see that the moerts apparently have misfired. these are pictures that we understand came in from the fdny. the fire department here. they say the two men on board or two people on board this scaffold, they are safe for now. they are tethered to the scaffold, and firefighters are undertaking the job of trying to rescue them. i imagine they'll have to pull some window glass out and get the two people out of there. they are going to try to get the scaffolding secured and get the
10:57 am
two people on board inside and into safe safety. 69 stories up. imagine that. you can see it shaking in the wind just a little bit. 69 stories. almost 700 feet in the air. two people stuck there at one world trade center, the nation's tallest building. >> so frightening to look at, though. take a look at that. there is that shot you were talking about. to pull back and give us a little bit of a sense of perspective on just how high that is and how tall that building is, of course. you know those men or women who were up there doing that job have to be thinking about the height of that and, of course, what happened on 9/11 and people making the decision to jump down. i'm not alluding that they would be thinking of that, but just what can happen when you are that high and you have a problem. >> i flew into new york city. at 2,000 feet above sea level, i was right even with the tower on the top of that particular
10:58 am
building, so these people are up there a long way, and look at how that thing is tilted. i mean, even though they are secured, even though they have their harnesses on and they are apparently latched that scaffold, that scaffold is tilting very precariously. you know they've got to be feeling more than a little built uneasy. >> absolutely. of course, we just report on this. a week or two ago that the first tenant advisory started moving in that building. magazine publisher is one of the big tenant fz that building. that building is at least partially he furnished with employees. we don't know if it's on the 69th floor. i believe it was the 69th floosh. >> it's reported as the 68th or 69th floor, and when you see the way that thing is tilted, it's sort of covering both. that may be part of the discrepancy here. that is one world trade center. the freedom tower as it's sometimes also known. one world trade center. the tallest building in the
10:59 am
country. it stands on ground that was generally occupied by the former world trade center, although the footprints of the original towers themselves are now part of the memorial to those who died in the attacks of 9/11. right now two people, two window washers stuck on the side there. wow. there you get a good view of some of what's going on. new york city fire department on the scene. 60 firefighters there to rescue them. >> more coverage throughout the day, you can imagine, here on fox. they'll have their hands full. >> thank you for joining us. everybody. it's been a busy day, hasn't it? >> it has been. the real story with gretchen carlson starts now. >> thanks, guys. fox news alert. we're continuing the coverage right now. dramatic rescue underway at the newly opened one world trade center.
11:00 am
this is in downtown manhattan in new york city. take a look at your screen there. two window washers right now trapped on that scaffold that you can see on your television screen there. dangling on the side of the steep angle after some sort of a cable snapped. now, this is all unfolding on the 69th floor. apparently on the south side of one world trade center. trained members of the new york city fire department are on the scene at this time. some 60 firefighters to try and figure out how to rescue the people that are currently trapped on that piece of scaffolding. the workers are recordly strapped in safely. at least for now. luckily, the fog indicates there's not much of a breeze. as can you see, there's not much of a breeze going on. that's the good news here. rescuers reportedly plan to cut out some sort of a pane of glass to try to reach these workers. where? because as can you see from the sleek outside of this building, there are no ledges.
