obamacare architect jonathan gruber has explaining to do after a third video shows the less than flattering comments about american voters. his gaffes made more than a year ago saying a lack of transparency was essential in getting obamacare passed. the white house distancing himself from gruber. the tax treadity in the law which helps millions afford coverage were no secret and scheduled to the leg salt lake. not only do we disagree with those comments they are simply not true. republicans aren't buying it and one called for public hearings to question gruber. >> it isn't the first time they have talked to to the american people. it is nanny state government which says you are too stupid to figure out which healthcare is intes for your family.

president obama will legalize millions of undocumented i am grants. the plans are not twiquite fina yet. >> the president is still planning to make decisions and announce them prior to the end of this calendar year. that should be an indication the president is nearing a final decision. >> no final decision yet but here are the draft proposals fox learned about. 4 and a half million parents of american born children would be legalized. the president would also expand the exemption for immigrants brought here adds minors. there would be a big pay raise for immigration and custom enforcement officers that is the group that has been often times critical of the president's handling of immigration. this plan is something many democrats have been pushing for. many republicans are going to be very angry about this. it could blow up relations with congress. some of these republicans think this is nothing short of amnesty

>> ashley webster from our sister network shows how it could impact the whole country. ashley? >> fighting words there. the tiny town of westminster, massachusetts population about 70,000 could be the first to ban the sale of all tobacco products. a public meeting last night became so rowdy it only lasted 25 minutes. local board members had to be escorted out of the meeting by police. not surprisingly tobacco industry groups are calling this proposal a bad policy that would harm local employers. smokers and shop keepers wills fuming. local merchants say smokers will make their purchases in other towns and probably buy their gas and groceries there as well. it's not just economics that upsets the critics they say it is a classic example of government over stepping. one local resident a vietnam veteran says he is forced to show people have a choice.

welcome back. it's frightening seen, unfolding 827 feet above the streets of new york. window washers getting the scare of their lives after a cable breaks trapping them for 90 minutes on scaffolding at one world trade center. robert moses live downtown in manhattan with the desperate call one worker made to his wife. robert, good morning. >> leah, good morning to you. of course in "the new york post," one of those window washers called his wife from high atop the city and told her to take care of

his children because he didn't know what was going to happen next. fortunately this story ended just fine. everything unfolded here on the south side of one world trade center. the window washers were cleaning 70 stories up when the rig developed slack on its left side. it went from horizontal to nearly vertical. people on the ground craned their necks. rescuers went to work. fire fighters went to the roof of the building and lowered a rope to the men as well as a portable radio so they could communicate. another group of rescuers inside on the 68th floor cut through the thick glass. this was a painstaking process but fortunately it worked. about 90 minutes after it all started, the window washers were pulled to safety. they were briefly hospitalized for minor hyperthrmia but this morning we're told they are just fine. >> robert moses, thank you. stop and ask permission, a
