the biggest al qaeda-linked group in syria is joining the islamic state in the fight against their enemies. coming together to fight as one. that is according to sources who spoke with the -- that from re joint chiefs of staff chairman general martin dempsey, he and the defense secretary testified in congress today. they told lawmakers that the united states is making progress, but they warned americans to be ready for a very long and difficult fight. secretary hagel knocked down recent reports there was some sort of strategy change in the works, but even though president obama has promised again and again that u.s. troops will not go into combat, general demsey says he may recommend that. >> i'm not predicting at this point i would recommend that those forces in mosul and along the border would need to be

accompanied by u.s. forces but we're considering it. >> you heard him say any such troops would accompany iraqi forces but make no mistake. americans would be fighting side-by-side with the iraqis. in the meantime, there's word the leader of isis is not only alive, he is in essence challenging the united states and its partners to bring the best fighters to him. that leader, of course, is abu bakr al baghdad. he recorded a message strowing to fight to the last man standing. the video shows he did survive a recent airstrike. the message is full of propaganda and claims the u.s. airstrikes are failing and the has to send in ground troops to their death and destruction. jennifer griffin is live at the pentagon. so there's not a strategy change here but we're not new at this, and it's clear what is happening.

reporters took place on november 2nd at a farmhouse in a town west of aleppo. represents of of isis, the two leading jihaddist groups in syria which had been at war with each other, their representatives reportedly met and agreed to team up to fight against the kurdish forces the u.s. is backing in northern syria. in other words they will stop fighting each other for now in order to defeat the kurds and other u.s.-backed forces, including the free syrian army. another example just how messy and complicated the fight in syria and is how even limited u.s. involvement is uniting the jihaddists. this is an iraq-first policy. >> jennifer, thank you. let's dug -- dig in deeper. mr. ambassador, thank you. >> it's clear that if your

minority leader. republicans re-elected the house speaker john boehner. analysts expect democrats to vote next week to keep nancy pelosi as house minority leader. senator mcconnell says it would be a, quote, big mistake for president obama to got alone on immigration. a source close to the white house tells fox news the president is planning to unveil a plan dish said a five-point peninsula -- it's a ten-point plan that affects five million people and a plan to overhaul u.s. immigration policy through executive action. the source says the president would make the announcement as early as next week. the plan reportedly includes suspending deportation for millions of undocumented immigrants, it would beef up border secure and pay raises for immigration officers. of course, that first one that is causing all the trouble. the president said he would take action on immigration if congress did not do so by the end of the year. clearly it will not do so. the white house says the

president has not made a final decision but will retract any executive order if the house approves the immigration reform bill that the senate already passed. so where are we? mike emanuel is live on capitol. republicans are pushing back as expected. >> that's right, and a source in the room says house speaker john boehner's message to husband republican members is that he warned president obama that if he goes forward with what boehner called executive amnesty, it would kill the chances of getting innings reform done during hi presidency and would jeopardize other issues as well. a short time ago the senate republican leaders' message, he blasted the president's actions since last week's elections. >> we'd like for the from recognize the reality that he has the government he has negotiate one he wishes he had, and work with i us to improve the immigration system. >> timing is a concern here on capitol hill. if the president goes forward with it, as soon as next week,

19 minutes past the hour. the lawyer for the guy accused of murdering his 22-month-old child by leaving him to roast to death in a hot car, has asked a judge for two separate trials. one for the murder charges, and then another trial that involves charges that the father had been sexting with an underage girl.

legal analysts say the move could help the father, ross harris, because jurors in the murder trial would not hear about the sexting allegationss' also say it's unlike he the judge will grant the request. investigators in georgia say that on the day the child died ross harris was exchanging nude photos with several women ask a teenaged girl. it happened back in june. cop says the dad left his son, cooper, in the car for seven hours while he was at work and the temperatures outside were in the 90s. ross harris sis it was a mistake. he forgot to take cooper to day care. the prosecutor says his story does not add up. investigators say the toddler's parents had two life insurance policies on the little boy and that the father and the mother both admitted to researching hot car deaths online though father's lawyer is asking the judge to drop evidence in the case because he says the cops

judge's decision, the probative value. the useful value of the jurors knowing the sexting, does that outwage the prejudice? that gives tremendous prejudice against the defendant when you hear about what he was sexting. so it's up to the judge to let the evidence in or out. if they separate the trials it probably wouldn't come in. if they don't separate the trial, itself will come in. >> here's what they laid out for us. the picture. mom and dad, separately or death, but both of them have researched people dying in hot cars, and after that, dad goes to work, leaves the child in the car and while he is in inside at work and his son is dying in the car, he is sending nude pictures with a couple of women ask a teenage girl, and then he gets done with the day, comes out to the car, and there's the ted son. and during the day he actually win to the car answer. you telling me the sexting allegations are so --

>> well, the first part, about the research? if i'm the judge, i'm allowing that in i believe the usefulness of that outweighs the prejudice, as prejudicial as it is, that is right on point to what the person is charges with. the sexting, you can have a conversation that, the fact he was having a love affair with a goat, how does that -- or anyone else, what does that have to do with killing hid child? that's the argument the defense attorney would make. and of course the prosecutor will say, this is all part of one thing, one mens rea. what is going on in his mind, what's driving him market valeting him? it's the research on the killing, the sexting, want to get out of this relationship, and then the ultimate act of the death. >> if you're the authorities can you get to the wife to flip on the husband. >> can try to almost be malpractice not to. he's going jail, this wasn't

investigators described him as a popular freshman what was apparently targeting his cousins and his friends. in ferguson, missouri, attorneys for the family of michael brown are asking protesters and police to please show restraint. once a grand jury announces its decision as to whether the police officer who shot and killed the unarmed 18-year-old should face charges. the a couple of days ago the governor called for people who choose to protest to do so peacefully. some demonstration officers the summer turned violin. but it was not just protesters. video captured police using very aggressive tactics, including opinioning a rifle at protesters and making threats. today attorneys for michael brown's family says the governor should have told the cops to act peacefully as well. >> they have been too many reports of excessive behavior and agitation by police officers. which have resulted in the outburst of the kind that the

governor described by otherwise peaceful demonstrators. >> the governor said the national guard will be on standby for when the jurors announce the decision. the decision is expected sometime this month. that's all they're willing to tell us. the forensic investigator whom brown's family hired to do an autopsy, testified today in front of the grand jury. his name, dr. michael bodden. he is also a fox news contributor. he became famous during the o.j. simpson trial. he performed the private autopsy for the family in august. st. louis county investigators conducted their own, as did the justice department. what did the doctor tell the jurors, garrett? >> we know a little bit. all along we have heard very conflicting reports of just how it was that michael brown was shot. was he surrendering or was he the aggressor? autopsy reports are supposed to help investigators gate bert idea what happened in this case,

dr. bodden's report matched win the medical examiner, except the county roz report found gunshot particulate on the teen0s thumb, meaning the shootos fired at close range. that supports officer darren wilson's reported account of the events that brown grabbed the officer's gun before it went off in a struggle. the body had already been cleaned by the time dr. bod 'performed his autopsy. the brun's family's attorney say he is requested to examine the tissue. >> where is the grand jury in the process? >> well, it's a 12-person jury, nine white, three black. the meet every wednesday to hear evidence and the group is now meeting several days a week whenever they're all available. since the beginning the brown family attorneys have not been a fan of this grand jury process. they said they simply don't

investigators believe corrupt cops kidnapped these 43 students and turned them over to a drug cartel, and that drug cartel reportedly shot them, piled their bodies up like cord wood, and set them on fire. prosecutors say a mayor and his wife, these two here, ordered the whole thing because the students planned to protest a speech she was going to give. prosecutors say, surprise, surprise, the mayor had ties to the cartel. that cartel's members claim to have carried out a string of murders and kidnappings in the town since the mayor was elected. the mayor and his wife were arrested last week. this picture tells the story. thousands demonstrating for weeks and you can see a crowd flipping over a car, people set fire to government buildings.

this is a state building. this is another state building here. you can see three cars back there in the back, burning in front of that building. a concrete building. and these are relatives of some of those students. they've gone to the acapulco airport and they're holding up pictures of their loved ones, wondering if there will ever be justice. casey stiegal has been following this from our dallas newsroom. what else wereuj5p learning abt the students. >> frankly, some very disturbing information about a potential crime scene because one of the suspects, not the mayor or his wife that you mentioned, someone much lower on the totem pole, reportly bragged to police how all 43 of the students were marched to land phil, ordered to dig their own grave, murdered, and then their bodies were burned in a 14-hour bonfire. the charred remains being tested for dna by forensic scientists in austria with hopes of identifying them. the protests are growing more
