explaining how he and his administration lied about what the plan entails. here is video from vermont. it was shot in 2011. he asked about a citizen who wrote in expressing what obamacare might look like. here is the exchange. asked, they are concerned about ballooning costs, increased taxes and bureaucratic outrages. they are concerns. >> crazy. >> how did that happen? >> it did. >> after he reads it concerns, the response was, was this written by my adolescent children, by any chance, talking about a letter a taxpayer wrote in listing concerns about obamacare. all the concerns did come true, it has ballooning costs and taxes. >> it's ludicrous. you must be a child, a moran, you are dumb if you believe that. listen to us, we are the experts, we are much smarter than you are. >> it's nice it all came out. it confirmed suspicions. so many people worried about obamacare. now, we are seeing evidence of

an individual who said hey, look, we are going to lie to the american people because we can't be transparent. if we are, the law is not going to pass. >> here is how we managed to put it through congress. ted kennedy is an architect of how we did it in massachusetts. here is the trips of gruber over the past week. watch. >> basically, you know, call the stupidity of the american voter. basically, that was really, really critical to get it to pass. >> the dirty secret in massachusetts, the feds pay for our bill. in massachusetts, we had a powerful senator named ted kennedy. they basically figured out a way to rip off the feds for $400 million a year. people say you can't tax my benefits. what we did was think about how could we make this work? obama is like, well, you know, he's really realistic.

i can't just do this. it's not going to happen politically. it won't pass. how do we manage to get there. the cadillac tax. barack obama is not a stupid man, okay? he knew, when he was running for president, that quite frankly the american public doesn't care about the uninsured. they care about costs. >> talking about being ripped off. taxpayers are footing the bill for his consulting fees because he was seen as this brilliant guy for fixing and architecting obamacare that we are going to bring in multiple states. he's on the payroll from the department of health and human services for $392,000. that is what we are paying for. all the states chipped in so michigan, minnesota, wisconsin, vermont, this is how much they are paying or have paid for him to come in and set up exchanges. here is a guy that since the age of 18 worked in colleges.

he's never had a full-time private sector job. this guy never lived in the american economy. he has no idea. at the same time, he's getting rich from taxpayers. millions of dollars, this guy jonathan gruber made from you, me and the rest of us. no one asked our permission. he's laughing about it. you wouldn't have voted for it if you knew the truth but we know what is good for you. we are going to ram it down your throat. >> charles had this to say. >> much larger than obamacare. it's larger than just this issue. the liberal mind is that the experts understand the world, they have to dictate, they have the best interests of the masses. you see it in the environmental movement when they say science has spoken on climate change. you yahoos are too unintelligent to understand, thus you have to

phone think oh, that's the cell phone tower. when itdoes, the way it goes where you are, if i wanted to call you, it has to search where clayton's phone is. it is capturing the information necessary to identify the phone, where it's at and things like the number. it is not, however, listening to your conversation. >> we saw similar problems google had driving around and capturing open wi-fi. they got hammered. >> they got slammed for it, of course. how is this any different? >> the difference here, because it's the government. after edward snowden and the nsa program, there's a lot of sensitivity to make sure the is are dotted and ts are crossed. now, the big question is what do they do with the information not related? where are the checks and balances? when they are done, they are

you and your crew, right? >> that's correct. we are self-employed, so we are not eligible for unemployment. you don't work, you don't eat. >> in two days, you learned your world is turned upside down. i read about families in the business for four generations, teaching their sons how to fish. they are picking fish over families. >> i think that's right. i think the government, at this point, is more interested or elements of the fishery service are more interested in proving the fishermen are wrong than finding out about the status of the stock. >> i'm confused by this. it's my understanding, all kind of different fisheries up and down the east coast, the fish are threatened by foreign factory fishing operations as much as anything. is the u.s. government doing anything to keep asian nations

from depleting the fish stock? >> on the east coast of the united states, it's not an issue. we have a 200 mile limit and our continental shelf doesn't extend unit 200 milings. there's no issue on this coast. >> you can't troll now in the areas until april 30, 2015. some say, hey, it's not forever, hang in if you can, it's five and a half months. is that the case? >> it's not actually true. we can't go until july and fish come to the coast seasonally, so basically, all the months you can catch any now is closed. >> so, what are you going to do? >> well, i'm hoping that congress will take this up and overrule the fishery service and reverse this executive action. >> what happens -- congress is not known for moving speedily.

how long do you think it will take and what are you going to do in the meantime? >> i don't really know what i'm going to do in the meantime. i don't retire well. i'm going to continue to push to get a new assessment that would involve fishermen and outside academic experts and try and prove what we see on the water, a lot more cod out there than the government thinks. >> can you go further out? if you go further out, it takes a bigger boat and many people are affected because they are smaller boats. if you go further out, can you catch the cod there? >> you can but they put in a 200 pound trip limit. the cost of the fuel exceeds the value of the fish to catch them. boats like me, small boats which is what new hampshire has, all small boats, the closures go beyond the range of the boats. they really don't have a choice. they simply cannot fish.

committee. the united states preventive services task force, basically a group of appointed academics have the authority to tell what health services will be included and those that won't. to give you an example, it's routine mammograms for women age 40 to 49. routine prostate cancer. >> let's start with the mammograms. the task force recommends women between 50 and 74 get mammograms. that's not what independent doctors recommend. >> they do routine mammograms in younger women. they say it shouldn't be done. they mandate what has to be covered and mandate it needs to be covered in full. things they don't mandate aren't going to get covered now. really, the decision is being taken away from doctors or they have to go out of pocket. >> they are given to lobbyists. a lot of them are in the law because you have to lobby to put them in there.

>> right. people make political decisions. it has been influenced by politics. the problem is the board meets in private. they don't have to issue their recommendatio recommendations. you can't sue them and you can't appeal. there's no appeals mechanism. it is an ivory tower group that aren't going to be subject to the ability to appeal. open enrollment for obamacare starts today. >> let's get to the colonoscopy. men between 76 and 85 but major health organizations recommend younger than that. >> right, they recommend 50 to 75, not old men get the routine. that's the distinction there. if you are above a certain age, it's no longer worth getting the screening. slow to incorporate new signs. people using aspirin to provent stroke and heart attacks, this

administration weighs making massive changes toward our immigration system and unilaterally giving almost 5 million immigrants a way to stay here legally. could going around congress do more harm than good and poison the atmosphere in washington for a jep rags? joining us now is immigration attorney and author of "the compassionate and conservative approach to immigration reform," what is the rationale for this, the debate over immigration going on for some time, some bipartisan agreement on elements of the two bills that have already been written, why would the president take this moment to unilaterally ram through an amnesty? >> >> well, the president is under enormous pressure right now to act. he feels that he has waited around for congress, congress has failed to put forward -- to go forward with comprehensive

plan and right now he feels that he needs to take this sort of unilateral action on his own. >> but there's no groundswell of support for this. there's not a single poll that shows anything like a majority of voters wanting this to happen. a small group of very rich, lobbyists on the left, have flooded zone basically on this issue and pushing the president. the interest group is pushing the president. the public is not pushing the president, unless i'm missing something? >> well, there's no question that the president has significant discretion in executing the immigration laws. the question is, you know, how far does that discretion go? the discretion probably rests on a balancing scale that can -- that can tilt so far over that it becomes ultravirus. but it's clear that congress has power over immigration and that the president is

constitutionally bound to take care that the laws be faithfully executed but i think in this instance we need to look beyond what the law allows. >> we need to look beyond. here's -- i felt this issue was crystallized pretty well by for john cornyn of texas who pointed out that this is, among other things, unfair to people who follow the rules. watch this. >> we are a nation of legal immigrants. how unfair, how much more unfair, could it be for the president to issue this order and essentially bump all of these new folks ahead of those who have been waiting patiently and trying to play by the rules. >> so what do you say to someone stand pg in line for three years at the u.s. consulate? sorry? >> this is certainly a legitimate argument. it's an argument that's been around. but the people are here unlawfully anyway, 11 to 12 million people. what are we going to do about it? many of these people are here

states"i states" looking at tax and spending policies over the last 50 years, we saw in the november election that governors that promised to cut taxes and did so, stood trial and voters re-elected them in the case of kansas, a lot of people were speculating governor brownback may not survive and he won by over 4 points. >> let's dive into the states here, states where governors went from blue to red. illinois, maryland, massachusetts, and arkansas. what happened here? >> illinois is a shining example of a blue state coming in here and turning decidedly red with the candidate governor elect bruce rauner promising to end personal and corporate tax hikes that are set to expire this january passed by his predecessor. gas tax hike in pennsylvania that helped be responsible for overthrowing governor corbett in a state going from red to blue. massachusetts, turning red for the first time in quite a while.

and a lot of other states, you know, hearing this debate about more take home pay. income tax >> let's talk about the states that stayed red. like i said again, people were surprised by kansas. wisconsin, florida, and ohio. >> yeah. so governor scott walker who many people know, stood trial multiples times on his term, but in the process lowered the middle income taxes, be governor kasich in ohio performed very well and passed over $2.5 billion of tax cuts. of course the big one on the electoral college map is florida. very tight, very expensive governors race. 20 million residents in florida now. we know from our movement figures a lot of people moving there and governor rick scott pulled it out by cutting taxes and running on his record. >> what about colorado, floating over there? >> it shows you two other examples here. actually three remain flashing.

bood" and the audio book called you have to eat. welcome back. of course the first one, was the go to sleep book and as a new parent when that book came out, we were sharing it with all other new parents that had just recently born children. and it struck a cord with all of us. why do you think it was successful? >> i think it was because there are things that are taboo to talk about in parenting and one is how frustrating it can be. this book gave people the opportunity to realize they weren't the only one that felt this way after an hour spent trying to escape from their child's room and a little bit of reli relief. the language, of course, is an attempt to accurately narrate the parental inner monologue. >> after you vice president had sleep this is how you're feeling as a parent. did you write this based on experience? >> oh, yeah. my daughter vivienne, beautiful, amazing daughter vivienne, 2 1/2 and sleep not high on her list of priorities.

as you may have noticed from this week, he has conceded obama care became law through subterfuge. >> he's been caught with another statement. you know the first one was calling the americans stupid. well the latest tape we have, the fifth tape we've received, this was him in vermont. he was meeting with the vermont house health committee and the chairman is reading a letter he got from a constituent in vermont saying here are my concerns about obama care and then gruber responds. here it is.

>> so laughs about those -- someone looking in the crystal ball. >> how silly. >> price increases, device taxes, premiums going up. turns out all of that actually happened and by the way, you're footing the bill. the stupid americans whom he called a few years ago, are footing the bill for his salary. in fact, at the federal level, the department of health and human services paying him $392,000 taxpayer dollars goes to fund his salary. didn't stop there at the federal level went to the states too. >> that's what's outrageous about it. we're the ones paying their salary. this is how much he got to go to different states and talk about obama care and sell a product he says in all of these tapes, you can't be transparent about it or the bill won't pass. you're right, it is going to be expensive, it's not going to work, you're not going to be able to keep your doctor. let's don't tell the american people that. they're stupid. >> what's interesting is, he's paid millions by the government to fix health care systems, but

summit the australian prime minister is long known as a climate change skeptic. where they are likely to find some kind of agreement where there's a consensus building is taking on the russian president vladimir putin over ukraine. bottom line is, president obama gave a speech here in australia a short time ago, basically pointing the finger at russia over the downing of that malaysian jet over ukraine hotly disputed of course, by the russians. then you have tony abbott who is the host. the australian prime minister had a tense one-on-one meeting with vladimir putin and basically at one point said you need to stop trying to recreate the lost glories of czarism. in the front page of the "courier mail" has a russian bear taking on the australian kangaroo. reports out of that tense meetings say that tony abbott also said, that he wanted to shirt front putin. i'm told by rugby fans that's a term when you want to hit somebody pretty hard, shirt

there's a financial ability to pay college is a necessity under a case known as newberg. a necessity. and therefore the parents are obligated to pay part of that tuition. >> she's not 18. she's not 16. she's not even living in the house. she's 21 years old. as an adult you can be forced to foot the bill for someone? she doesn't even talk to them in two years. >> according to this judge in the state of new jersey even though the judge got it wrong, because part of the case david cited there are other factors that the judge could have taken into consideration. it's not automatic when you have two divorced parents you're forced to pay for your kid's college. the judge can take into consideration the relationship of the parties. in other words, since she's emancipated, since the daughter is emancipated, not living under her parents' roof, not requiring her parents' care, the judge could and should have ruled the other way. why the judge ruled this way? mystery. >> absolutely the right decision under the law. the law is the law because it's the law. those are factors involved here.

but she was thrown out of the house. there's another side of the story and temple university, great university. >> wait, that's the other thing. >> she's not going out to become a drug dealer. she want ts to go to college. >> fantastic. good for her. get a loan like i did and pay for college. the order in this court was that originally the parents were only going to have to pay for a state school which is common. in new york, same thing. only obligated to pay for a state school education. went to an expensive school and now the judge is saying, tough, parents, you have to pay more because of your daughter's choice that you had nothing to do with. come on. >> that's not the law in the state of new jersey. it has -- you don't have to be -- >> yes, it is. >> that's not the law. >> that was the law that the judge -- >> that occurred after the newberg case which basically says that parents have to pay for any university apart thereof. >> the other side of the story there's another side of the story, why is she not living with them some why was she kicked out?

why didn't she have communication with them? does that matter to the judge at all? >> it should have. >> it's a factor. the bottom line is, she's living with the grandparents right now and the parents don't want to pay for anything and under the law, the children have to be part of this whole divorce. they're part of it. >> bottom line -- >> what's in the best it interest of the child. >> when you're getting divorced you do not want to be in a position where a judge is making your parenting decisions for you. inevitably it's not going to work in your benefit and this is one case in point. >> it happens every day, change the law. >> you don't have to do that. parents get along when getting divorce. fight over the lawn mower. don't find out how you're going to parent. >> in a perfect world. >> i'm keeping my up lawn mower. >> great to see you this morning. go to our facebook page and weigh in on ff weekend what do you think about it? coming up on the show, remember waking up to days like this? >> no! >> good old snow days.

too much praise can actually lead to false superiority and big egos. how much praise is too much and what's the right way to show your asflooul joining us is our parenting panel. the author, saw him earlier on the show, "you have to bleeping eat," some dirty words there. host of "the moms," cindy albert, and parenting expert erica katz. good too see you all. this new study comes out that shows it's called self-enhancement, overinflating kids' egos by giving them too much praise. they're not likely to want to take on other academic projects because they feel they're too good for it now. how much praise is too much? >> i think it depends on the kid. i have two so, you see the differences with your child. i have one who needs a lot of praise and one who doesn't need it as much. i think it really depends on the child. i think you're also born a certain way and this article talks a lot about being humble. i think that it's hard to teach

kids to be humble. i think that it's sort of like in you. >> is it in you from birth? >> i don't know fit's in you, but i think what's important is it's fine to praise kids for who they are. praising kids for what they do is a little more problematic. if you praise him for getting an a on the test, that's great at the moment but that kid also knows if he brings home a c the praise disappears. i think it's more important to praise kids' sense of who they are as opposed to what they've capable of doing. >> and other research telling kids you're so smart. what it does is sets them up for failure, doesn't it? because then they're not likely to take risks later in life. they don't want to appear unsmart at some point in life. >> it's important to tell your children you're really great at something when they are great at something, but if they're not doing as well, you should tell them too. if my child comes home with a 70 on a test, i'm not going to be, like, wow, you're so smart. i'm going to say you're great in

school but sometimes you need to study a little bit harder and in this case you probably just didn't study enough. so you don't want to tear them down, but you also have to say, look, you need a little improvement here. >> a 70 on a test for some kids would be awesome. >> maybe some kids don't test well. >> right. >> absolutely. i think each child is different. i think a 70, like, a's don't matter in life, sorry, like my kid -- it doesn't matter. they're going to be good at certain things and they're not going to be good at certain things. it's how they try and find something they are good at ap. >> but if you know they got a 70 because they didn't study enough then you have to come down on them about it because it's not okay to be lazy about it or because you want to play basketball all day. it's one thing if it's learning issues, but you have to talk -- >> they might become a basketball player and not need that 70. >> to be specific, the study said kids who were praised in

comparison to other kids developed animosity toward those kids and vice versa. all the study is saying is don't praise your kids in comparison to other kid. it was also done in germany. we realize the studies are culturally specific so, that's germany. >> in minneapolis, one thing i looked forward to every winter was snow days. i couldn't wait. i'd hear the radio. you'd listen to 102.5 in reading, pennsylvania, and listen to see if your school would be called on a the radio so you would have the one snow day to get outside and shovel. school in minneapolis, st. cloud cathedral high school is getting attention because despite a heavy snow day earlier this week they decide to cancel the snow days. you have to stay home and be virtual on your computer and log in to class. is this the right way to go? >> awesome. 100%. i wish my kids' school would do that once a week and my kids could stay home. there are so many kids today

with so many issue ls and adhd and a.d.d., i wonder if having one day to work at home in a different environment would be helpful. >> are we coddling them? >> this is minnesota, so presumably there's lots of snow days. i think virtual classes are fine, it works on a university level, probably works for high school, but i have a policy that's going to solve this. first snow day is free. you go outside, snowball fights, hot chocolate, sledding. after that, second, third snow day, class. >> are you on board with that, erica? >> i that idea. i also think virtual days are good and you can even plan on some movies. my son just learned about the civil war so i had him watch "gone with the wind." why not take those snow days and ghism an assignment like watching a movie that's appropriate and -- >> that's my kind of teacher right there. >> but you know what, he got a 97 on that test. because it brought it to life. >> i had to watch "the avengers again" for school, mom. great to see all of you.

kerry kupack. thanks for being with us. >> thanks for having me on. >> tell me what's going on. why is this a problem? >> well, it's really a sad day in our education system when schools cease to be the marketplace of ideas. they're supposed to be. instead of encouraging students to have conversations and exchange ideas, school officials sensor them and shut them down nap's exactly what's going on here with chase windbank. he's a senior in high school and since he was a freshman he's been getting together with his fellow classmates during free time in a period called seminar and they pray sometimes, they talk about the issues that matter to them from a religious perspective and they've been doing this with no problem for three years. other students are allowed to do go outside during this time, go hang out and talk, go in empty classrooms, text, go on their phones and play games but this september the assistant principal called chase in and said he could no longer what do what he was doing. >> why? why would the principal do that?

what's the reason? >> it's really hard to say. the school says separation of church and state. but there's a big problem with that. for starters that's not even found in the constitution, but what is found in the constitution is the first amendment which expressly protects the exact kind of conversation that chase and his classmates are having. it expressly protects the activities that they're engaging in right now. this is a problem. >> it's voluntary, during their free time. let me read the statement from the school. they say time counted as academic time toward the minimum hours of instruction that schools are required to provide by state law and therefore must be used for academic purposes. what's your reaction to that? >> well, the school is forgetting that in the handbook for the school district they define seminar quite differently. in that definition, it says that this time period, this free part of this period, can be used for students to build community with each other, to build communication with each other, and like i said, what this

period, this free time has been historically used for is exactly that. students can get a snack, go to the restroom, they can talk about really anything they want to talk about. but because chase and his classmates are talking a ing ab god, the school is censoring them and shutting them down, clearly unconstitutional. >> many people would argue and say that is academic, learning the bible, learning about religion is an academic subject. so if they're going to ban people from talking about god, should they ban kids from talking about pop culture, from talking about kim kardashian or any other actor? >> right. exactly. and you would think that educators -- and i would think parents would be thrilled that these students are initiating this kind of conversation. this is completely self-initiated. these students are showing leadership. they're getting together. they're fleshing out the ideas that matter most to them. they're taking what they learn in the classroom and figuring out for themselves what matters most. so for the school to shut them down and sensor them the way they're doing is not just
