tv Justice With Judge Jeanine FOX News November 16, 2014 1:00am-2:01am PST
1:00 am
minute of the show. because we know where you are, we know where you live and we will come get you if you miss a minute. that's it for now. this is mike huckabee from new york. good night and god bless. stay tuned for "justice with judge jeanine." hello and welcome to "justice." i'm judge jeanine pirro. thank you for being with us tonight. so, are you stupid? >> and they proposed it and that passed. lack of transparency is a huge disadvantage. but basically that was really critical to get anything to pass. >> of course, that's jonathan gruber talking about obamacare. they think you're stupid. that they can pull the wool over
1:01 am
your eyesme. they know more than you do. they know what is good for you and it's best to keep you simply in the dark. so why lie to the american people and make no mistake, we were lied to. starting with you can keep your health care plan and your doctor to this is not a tax but a penalty. how can we possibly have a law that would cover millions more with no added cost to you? after all, you're the one who always gets squeezed. and with the president's impending executive action on immigration, might you be the one to pay for health care for those additional 5 million illegals? yet no one talks about increasing the number of doctors or enrollment in medical schools to cover all the new patients. the white house says they don't agree with what the obamacare architects said.
1:02 am
yet records confirm that gruber spent time at the white house and gruber himself says he met with the president twice, including in the oval office to discuss the law. hey, gruber, americans aren't stupid. we knew all along that obamacare was an attempt to socialize medicine and tax us for the redistribution of wealth. americans are honest people. we respect authority and believe that our commander in chief would only tell the truth, never thinking he would lie. so what do we do about an administration that lies to us? one that pays a man $400,000 to make the health care bill as convoluted as possible? to write the bill in a tortured way to make sure that the congressional budget office doesn't say that the mandate was really a tax. now, it may be my background, but when someone lies and admits they perpetrated a fraud and
1:03 am
picks a victim they think they can fool, which costs that victim money, they should be prosecuted for fraud. when more than one person is involved and there are meetings on how to perpetuate the fraud, it becomes a conspiracy. and today "the new york times" tells us that the cost for those who have coverage under the affordle care act, the name in itself another falsehood, will increase in 2015. so let me see if i understand this. if you liked your plan, you can keep it. and now if you like your new plan, you can pay even more to keep it. and what about that $2500 a year that every family of four would save under obamacare? if they think we can't see that this is simply a transfer of wealth from those who have
1:04 am
insurance to those who don't, from the young and healthy to those who are old and sick, a transfer of wealth from legals to illegals, then they're the ones who are stupid. >> don't call me stupid. >> oh, right, to call you stupid would be an insult to stupid people! i've known sheep that could outwit you. i've worn dresses with higher i.q.s. >> so what to do? congress can repeal obamacare to know end but the supreme court will veto it. and if that happens, the guts of the law dies. but the biggest problem would not only be health care but with everything the administration does is there's no transparency. we need transparency in government. the system is constantly being gamed as players prevent the congressional budget office from
1:05 am
identifying the financial impact of the law. what we want are the facts, nothing more, nothing less. and once we have the truth, we can make an honest decision. over 6 million americans had their insurance canceled because their plans were illegal by definition. through legislation obama required health care plans to include criteria that was more most of us superflous. pregnancy coverage for seniors? people should be given a tax credit to buy their own health care. take your money and buy whatever you want. yes, we were right all along. we never liked obamacare from the get-go. true costs were hidden in a complex 1700-page bill that we
1:06 am
would only understood once it was passed. and speaking of nancy pelosi, that paradigm of truth and honesty, she now says she never heard of this guy, gruber. >> i don't know who he is. he didn't help write our bill. and, so, with all due respect to your question, you have a person who wasn't writing our bill commenting on what was going on while we were writing the bill. let's put him aside. >> let me explain something to you, nancy. he's the architect of the bill. this administration paid him $400,000. now, the architect does not bill the house. the general contractor does. gruber designed the bill and then the drafters wrote it. stop playing stupid! and nancy, you denied knowing this guy just a few years ago you sent this. >> our bill brings down rates, i
1:07 am
don't know if you have seen jonathan gruber of mit's analysis. >> having trouble with your memory, nancy? unless, of course, you were lying, too. now i don't want to be like gruber and call you stupid, but in the words of this great american -- >> tell me something, are you stupid or something? >> stupid is as stupid does, sir. >> and that's my open. tell me what you think on my facebook page or twitt twitter @judgejeanine. and with me, obec roy, god to have you here. are americans stupid? >> well, judge, as you noted in that brilliant opening statement to which i have almost nothing to add, americans suspected this all along. they knew all along that it didn't make any sense that you could cut the cost of health
1:08 am
insurance by $2500 for every family and cover all the uninsured and reduce the deficit. none of that made any sense and it was the american people who actually figured all that out. >> and the american people never liked it from the beginning and still don't like it. but according to the visitor logs, gruber visited the white house over seven times, had meetings with staffers another eight times, this was -- was this an intentional crafting of a law to basically mislead us? >> no, there's absolutely no doubt that jonathan gruber was the central figure in designing obamacare. yes, people in congress and staffers in congress wrote the actual legislation, but in terms of the basic concepts, the idea, we would have an individual mandate that forced everyone to buy insurance, the idea that the insurance products that people could buy would be heavily restricted by the government. all that was gruber's idea. and gruber's idea are in this bill and that's why he makes millions of dollars talking
1:09 am
about this and consulting with state governments all around the country at our expense. >> you know, i fact, ovik, that's there's so much dishonesty, and it is not just misat the same times bstatf washington but lies. i don't know if people will ever have faith in this administration or any subsequent administration, but why was it so important for them to pass this law? >> you know, one thing that you notice if you watch some of these jonathan gruber videos, he'll make wisecracks about how stupid the american people are and the crowd laughs. it's kind of like an inside joke. and that's because in the progressive left-wing community, it's taken for granted that you can't trust average americans to control their own health care dollars. because if the average americans controlled their health care dollars according to the left, they would make bad decisions. that's why we, the experts and the government have to make the decisions for you.
1:10 am
so of course you lie, of course you make things confusing because you expect that that's the only way to get things done if you believe the american people are stupid and have bad motives. >> but avik, when you say that's the only way to get things done, why did they need this done? >> well, they philosophically believe that the health care system won't work unless the government controls it all. that's basically their ideology, right in they have the opposite view we do. if you control the money yourself like every other sector in the economy, that's when prices go down, technology gets better, all the things we see better in cell phones and computers and everything else. they believe in state controlling much of the economy as possible, particularly when it comes to health care. >> what is interesting about the mandate, the supreme court, when the individual mandate was that portion of law was not repealed and the supreme court, you know, affirmed it, the supreme court said, hey, guys, not for nothing but this is a tax.
1:11 am
and so what -- i don't know if americans even got it at that point, the way the white house was spinning it was saying, look, you know, this has been constitutional from the beginning. they didn't even admit at that point that it was a tax. but now, what do ordinary americans do? >> well, i mean, obviously with president obama in office, he'll repeal the veto to repeal the law. even if they were republican, if we had a republican in 2017, this law is so entrenched, it's so burroed into the health care system that repealing it just flat out is going to be really, really hard. i think we have to start thinking intelligently and strategically about how to roll back the law, particularly its worst elements, these mandates and regulations that you talked about, that increase the level of government involvement and decrease the ability of average americans to do what they want to do with their own health care. but you know what, the main thing -- go ahead. >> no, you go ahead. >> i was going to say the main
1:12 am
thing the people can do in the next two years is what you said in your opening statement. demand transparency from government. there are all these agencies out there like health and human services and the congestiressio budget office that do what they do behind closed doors. we have to demand they open up the way they model these things and project what is a tax and what spending and how much it's going to cost. how much this is going to cost because that's the only way we'll reform the system in the right direction, to be able to compare our own plans to the way the government calculates how the plans work in the future. that's what gruber was taking advantage of because he's an insider. and that's what the rest of us have to have access to as well. >> avik roy, thank you for being with us. he admits the bill was written in a way to destroy the truth, so what is the mainstream media got to say about this? i'll give you a hint, not much. and vote in tonight's instant poll. how do you feel about being called stupid by the obamacare architect?
1:16 am
president obama said his would be the most transparent administration in history. remember that one? apparently he doesn't. the lies just keep on coming. and with me now, the author of "beating obamacare," betsy mccoy. the woman who travels around with 2500 pages. >> 2,572. >> do you run around with that thing? >> will the law be repealed? >> those who say we can repeal the law within the framework of the law haven't read the law. it's rotten to the core. >> to rule on these not been
1:17 am
available for subsidies, what does that mean? >> does the obama administration have to enforce the law as it's written. the plain text of this law says -- >> the question i'm asking you is about the federal exchanges. >> that's right. and the plain text of this law says the federal exchanges cannot offer subsidies to the consumers who come and sign up for obamacare. >> okay, so contrary to what is in the law. >> that's right. >> what will the supreme court do with this? >> the supreme court is going to rule that the obama administration must implement the law as written. they don't have the power to change the law. and the result is going to be the end of obamacare because four out of five people who are signing up for this health law get a subsidy and that subsidy is so big compared with the price that once the supreme court rules, they are going to see the actual cost of these obamacare affordable plans and it's going to be 400% higher than it currently is. nobody is going to sign up for
1:18 am
these. this exchange period that started today, it's going to be the last one in history. >> all right. well, we'll mark your words tonight if that's the case. i'm sure many people -- >> mark my words. >> but betsy, the question is this, if it goes up 400% as you say, and that we now have to subsidize the federal exchanges, then people who don't want to pay for health care, what about the new 5 million illegals? then that means that they shouldn't be eligible to pick. >> let me point out one thing, many of the people in the argument you said a few minutes ago, this is so deeply entrenched. 8 million people have signed up out of a population of 318 million, don't let the tail wag the dog. >> all right. now, if this does happen, where do we go back to? >> well, first of all, we are never going to pass another law like this if we have any common sense.
1:19 am
madison said in federal 62, never let wrong pass laws, these are his own words, so vo voluminous. and the immigration bill looks exactly like this. >> do we know how much this law has cost us in terms of the implementation of the website, the health care facilitators, remember that? >> that's right. >> and all of the additional people who have been added on. >> well, that transparency is lacking. who knew that gruber, this liar, had been ahead $400,000? >> the insiders knew. >> well, some of them. but the m.o. of the obama administration is this. the people are too stupid to make their own decisions. and the ends always justifies the means, including lying. >> okay, so what does the ordinary person who is watching this show tonight and who is
1:20 am
going to have his premiums increased with this new 2015 enrollment, then what do they do? >> well, many people are trying to avoid this. unfortunately, it's an onerous law and we have to put pressure on congress to repeal this. elections have consequences. and this election that just passed, obamacare was on the ballot. it was a referendum on this. and it got trounced. >> well, we'll see what the supreme court does do to it. and whether or not this administration will, in the beginning, start trashing the supreme court to intimidate them in terms of supporting this. betsy mccoy, always good to have you with us. all right. and coming up, a new terror alliance in syria makes
1:24 am
isis and al ka da decided to join forces today as the leader reportedly still alive urges his followers to erupt volcanos of jihad everywhere. with me now, founder of the investigative project, steve emerson. good evening, steve. reports of two of the most brutal terror groups joining forces in syria. isis and part of al qaeda, what does this mean? >> judge, i think it is very similar to what hitler did with stalln during world war ii. these two groups were duking it out, and now they don't have to fight each other. now they can focus their resources on fighting the u.s., fighting the west, fighting assad. it strengthens each other's resources in so far as now they
1:25 am
can really fight with the intensity that they had intended to have with the, you know, the brutality that they intend to inflict on westerners and against the anti- -- against the assad forces that they thwart against and were created to fight against. >> so we now that isis is expert at media, internet, recruiting, nasara is reportedly the bombmakers. but whether or not they make a decision to fight together or not fight each other, there's no question that the two of these groups together are far more dangerous than one direction and one in the other. >> no doubt, judge. because already, they have declared to create a similar caliphate in northern syria competing now with the caliphate that isis is creating in iraq. so what you're already seeing
1:26 am
now is the emergence of these very strong radical islamic groups create these territorial swaths of independents that are returning to the days of mohommad and the days of decapitations. so you're right to the extent that these groups now have more independence and the notion, however, that this administration is, you know, envoking to the congress that there's going to be opposition created by the cia and the dod and the pentagon by building up moderate opposition is a fanciful notion. there is no such thing as a moderate opposition. the free syrian army is a contrite concept made up of ripoff artists in cafes in europe that the state department is pumping millions of dollars into, and they are basically spending it on nothing but themselves. there is no such thing as a free syrian army in syria. there is no such opposition that is considered moderate.
1:27 am
they have been wiped out. >> all right. i want to move on to what happened this week with the american soldiers. actually, they were sailors who were attacked by a mob in turkey. what is with the turks? i mean, on the one hand they have their tanks on the border watching the fight. on the other hand, we're supposed to be is going on? >> first of all, turkey, over the last several years, has emerged largely in a very hostile, with a hostile environment against the west, against israel in a way that has aligned itself with hamas, aligned itself with islamic jihad and aligned itself with the muslim brotherhood movements against the united states. it has whipped up the muslim proponents of the muslim brotherhood in turkey, against the united states, of course, this attack was by nationalists in turkey against the u.s. the u.s. has 2,000 members of the armed forces stationed in
1:28 am
istanbul. so it's not surprising to see attacks on the united states unfortunately in the west on u.s. soldiers because of the hysteria whipped up but the turkish hostility to the united states and to the west its over the last five to ten years. >> why are they still in nato? >> they shouldn't be in nato whatsoever. if you look at their record on human rights, look at their record on the issue of freedom for gender rights, for women, you look at their record of crackdown on the support for hamas and the radical islamic terrorism. they should never have been allowed in nato at all whatsoever. >> all right, steve emerson, good to be with you. thanks. coming up, i go one-on-one with a liberal on this week's most outrageous headlines. and executive amnesty for 5 million
1:33 am
now back to "justice" with judge jeanine. some people in washington think we're too stupid to see through their partisan political games. i think it's time to hear from a liberal. joining me now, political comedian and radio host, john fugelsane. how are you tonight? >> i'm delightful. thank you for saying my name right. >> are you stupid? am i stupid in are we stupid in. >> i think mr. gruber is stupid and that's what conservatives can agree on. >> but he made up to $400,000 from the government and up to $2 million talking about that. >> mr. gruber actually made it from the government. >> i mean mr. gruber made it from the government so he's too stupid, is he? >> he's not too stupid but the government likes to hire those guys who have developed a funny line that has come back to haunt him. >> what do you think, you are a
1:34 am
self-described liberal? >> i prefer to think of myself as an eisenhower republican but get called liberal quite a bit. >> do you agree being a liberal? >> i think all sane people are progressive in some areas and conservative in other areas. you have liberal friends, right? you have liberal people in your life? do you have liberals in your life that you love? >> are you a liberal? yes or no? >> in many areas i am. yes. >> yes or no? >> you want me to say i'm just liberal. >> no, i'm not asking that. are you a liberal? >> i try to be. >> are you a conservative? >> in many ways. >> are you a republican? >> i'm independent. i'm not a democrat. >> i asked the questions, you tell the jokes. all right, so what do you think about this immigration amnesty executive order, 5 million new people on obamacare? >> are we done with gruber already? >> we are done with gruber. he made the money. >> can i say gruber was not the
1:35 am
architect of obamacare? >> he isn't? what was he? >> a paid consultant by a man who saw that insurance companies were ripping off regular people, a man who passed a law to try to get people covered, and this guy was an economist to help crunch the numbers and people did get covered. and the man who passed the law was mitt romney. >> i knew you were going there. so why is he at the white house 17 times? >> 7 and 8. >> 7 and 8. 15. they couldn't crunch the numbers themselves? >> he signed into the white house, right? so he's not an employee. >> he's an independent contractor. >> that's why mitt romney and barack obama hired the same guy to do a virtual identical health care plan. >> you know my dluting this by mitt romney does not make it any less egregious.
1:36 am
>> how many people do you think, tv guys think americans are stupid. we have heard nothing new about this law. there's no scandal. >> i think the americans are brilliant, okay? >> i think they are brilliant, too. >> but the last election is proof of that. >> this is crack for the bubble and it may get some of your viewers really riled up and see nothing come up it because there's no scandal here. this guy thought that but the individual mandate is not what liberals wanted. they wanted single payer. barack obama enacted the conservative plan conceived by the heritage foundation. >> so barack obama is a conservative president? >> he gave their plan into law. bob dole ran on the same in '96. >> okay. let's talk about the fact that they lied to us and said -- >> who is they? >> the administration, even the justice department said this is not a tax. it is a penalty. how does the i.r.s., how do you put on your tax return -- >> it's a penalty when romney
1:37 am
does it? >> oh, it's a tax when obama does it and makes us put it on the i.r.s. and the tax form. >> if you don't buy insurance, you have to pay the penalty. how is that different when you don't have auto insurance policy when you get pulled over? >> if the united states supreme court says it's a tax, now we know they didn't want us to think it's a tax and hired someone to say it wasn't. then they are wrong. >> in terms of lies i have heard about obamacare, this is somewhere below. it will cover illegal immigrants. and it's going to be -- >> john, they are in my ear. it was a pleasure. >> you love liberals. >> john fugelsane, thank you for being with us. my next guest, don rosenberg, opposes the president's executive action to hold deportation of millions of americans. and his reason, this is very sad, take a listen. the indications are that
1:38 am
president obama is going to issue an executive order in the next few days that will allow for many illegals to remain in this country essentially reducing the deportation of some estimations of 4 to 5 million illegals. you have very strong feelings about this that stem from what happened to your son, why don't you tell us what happened. >> well, my son was a law student in san francisco. he was coming home from school one night when a man named roberto gallo who was in the country illegally made a quick left-hand turn, illegal left-hand turn. they collided. my son went flying over gallo's car. had he stopped, wouldn't be here today. he would be fine with a couple bruises. instead, he accelerated driving over my son's body. his motorcycle helmet had come off and got stuck under one of gallo's tires. he backed up, running over him a
1:39 am
second time and then trying to get away drove over him a third time. by that time, a man had gotten out of his car and stood in front of gallo's car. unfortunately, one of his tires came to rest on my son's abdomen and five men had to lift the car off of his body. >> given the fact that the president is issuing this executive order is imminent, what would you say to him? >> well, the first thing i would say is, why don't you issue an executive order bringing my son and the hundred thousand or so that have been killed back to life before you reward people that are responsible for all those deaths. >> why do you think the president is doing this? >> votes. very simple. there's no other reason than he made a promise to get votes back in 2008. he couldn't live up to his promise then, so he's doing that now. because it makes absolutely no sense to give amnesty to 5
1:40 am
million now but eventually 11 to 20 million that have broken the law. >> all right. don rosenberg, thank you for being with us. and our hearts go out to you. i'm so sorry. we are all so sorry about your son and your loss. thank you. >> thank you very much. with me now, canelle county sheriff, paul, so sad what we just heard from don rosenberg. and illegal -- >> it's far too common. >> it is common. one of the things he told me, paul, was that if he had not constantly fought for the arrest and prosecution of this individual, it would never have happened. so now that it appears the president is about to grant am necessary toyty to 5 million illegals, how is that going to affect you, your job and the american people? >> well, my job and every law enforcement officer across the
1:41 am
country have a difficult job as it is when it comes to this because of the federal government saying hands off. yet now it is made that much more difficult, almost more impossible. when the law applies to you and every other american citizen, yet it appears there is no law because there are no consequences for these illegals who are here. and the president, just a wave of his hand says, hey, it's okay. and we see this horrific story, as we just heard on your show, judge, and others time and time again, last weekend a 3-year-old girl standing for ice cream gets run down. and this guy has, is an illegal. there's a domenick durton with the illegal who killed him was arrested for armed robbery, two dui convictions and kills another american. there are thousands and thousands of these. it is just tragic. and the president has to be held accountable for these crimes because he has knowingly
1:42 am
released them into our communities after all these prior convictions. >> and you know, paul, i hear about this over and over again. and yet, you know, last year when the president said, or the white house said they were releasing 2200, i think it was, or whatever the number was, immigrants and from incarceration and they were minor offenses, turns out like homicide, drug trafficking, sexual assault, you know, the ice agents are defeated. i mean, they are suffering from an incredible loss of morale. and now the president says, oh, i want to give them a raise now to make them feel better. how about you let them do their jobs? >> exactly. it's undermining the rule of law. you have handcuffed the very protectors of the communities. cops. and what you just talked about, we spoke almost two years ago when this mass release, this jailbreak that obama led across
1:43 am
the country, releasing thousands of criminals into our community happened in my county. releasing hundreds, two of them charged with manslaughter. we had several who were convicted of child molestation. and aggravated assault, armed robbery. and to this moment that we're talking on a your show, judge, we still don't have their names or their full criminal history or where they were released to. we all know they will never show back up. and they will never give us the names because then we can tie these names to other crimes they have committed just now in our communities. >> all right. sheriff, thank you for being with us this evening. >> thank you, judge. coming up, in nine days the obama administration is tote to conclude nuclear enrichment negotiations with
1:47 am
reports say that the u.s. and iran could be close to a nauk nuclear deal. my next guest says now the consequences are coming into focus. here to share the findings, president of the london center for policy research. herb london. great to have you here. what do we know about the negotiations going on between the u.s. and iran? >> they have been going on for some time. there's no question that the p 5
1:48 am
plus 1, the european nations have been negotiating with iran about whether in fact they can have nuclear weapons. >> is it nuclear weapons, actual weapons? is that what is being negotiated or the enrichment that will be turned into it? >> it's the enrichment that will be turned into nuclear weapons. clearly iran has enough oil and energy supplies that they do not need any kind of yuranium needs. they are trying to declare the desire to maintain control over the middle east. keep in mind very recently the iranians took over yemen and now control the gulf of ramuz and the straits of the red sea. >> okay, so why is it in our interest, the united states, to negotiate on behalf of or with these people. we heard last week the president is writing letters to the
1:49 am
iatola, why? >> since we won't put boots on the ground, we're hoping that in the letters that the president has written to the leader of iran, that the iranians will use their army to fight against isis. and in return we'll be flexible on the nuclear weapons question. or the enrichment question. >> all right, let me ask you this, do you really think that the shiites who supposedly don't like the sunnis need a concession from the united states to fight the sunnis? >> i think what they are looking for is the approval of the united states and having the united states' legitimacy stand behind iran that becomes a kind of stabilizer in the middle east, which allows them to pursue their goals, unrestricted by what is happening in the rest of the world. keep in mind that the sunni states, egypt, saudi arabia, united arab republics as well as kuwait and jordan will join together in a defense condominium because they won't stand for it and the united

voted don't want what barack obama's selling. you think we ought to go door to door to get more opinions? and tom says what are you talking about? take back america? 57 million voters elected him. aren't they americans? hey, tom, yeah, but they're stupid. just ask gruber. what makes you think the republicans will create any change? taking back america? we'll see about that. for starters the house passed the keystone pipeline bill, jobs for everyday americans sounds good to me. and mary landrieu in louisiana suddenly wants to support it. have faith, stay tuned. and now the results of the poll. we asked how do you feel about being called stupid by the obamacare architects. betty says about as much as a
