american people? >> pretty gutless. joining me now with the details of his confrontation, fox news contributor our friend david webb. >> sean, jonathan gruber has spoken honestly about the administration's tactics at universities, pbs and to leftist media. when i confronted him today on the m.i.t. campus, i wanted to press him on several key statements he's made about his involvement. at first he seemed willing to talk to us until i identified myself and mentioned your name. and let's just say for the record i don't think you're on his christmas card list. i asked him multiple times, sean. i gave him every opportunity to answer, obamacare just an elaborate hoax and truly believes the american people are, and i quote, stupid. sean,pe his response was loud and clear. it was no comment, no comment, no comment. sean, back to you. >> david, thank you. joining me now with much more on this is the host of special report our friend bret baier.

good to see you. >> hi, sean. >> let me put up on the screen for viewers gruber's details of visits to the white house. he had 19 visits, health care policy adviser on six occasion, economic adviser, larry somers, president obama and even brags about meeting with the president. and this is what he said. >> the problem is it's a political nightmare. and people say no you can't tax my benefits. it feels like. so what we did a lot in that room was -- talked about how would we make this work. and obama's like, well, he's a realistic guy. look, i can't just do this. it's just not going to happen politically. the bill will not pass. how do we manage to get there through phase-ins and other things. and we talked about it. and he was just very interested in that topic. >> now others want to distance themselves. is that going to work in light of all this evidence? >> no, it's not.

we've been covering it from the beginning of these tapes surfacing. but other news organizations are just starting to cover this story after the president talked about it. and clearly gruber was not just some adviser. he was intimately involved in the creation of the health care bill. and not only with the administration and the president directly as gruber brags about as you said on those video clips, but also with congress. you know, in president obama's debate press release with mitt romney back in 2012 they cited jonathan gruber. and the obama campaign says jonathan gruber, who helped write obamacare and the massachusetts health care plan, jonathan gruber, make no mistake, the affordable care act is based on massachusetts's success cited on the obama campaign debate press release. so this whole back and forth about some adviser and nancy pelosi saying i just don't know

who this guy is is really a farce. >> well, and he's on the white house website, number one. nancy pelosi was caught on tape, as i know you reported last week. we have the amount of money he was paid, pretty significant amount of money especially for government work in 2009 in march he got $95,000 and in june he got $297,600. that's an awful lot of money for one-year period of time for anybody in government service, isn't it? >> yeah. listen. this contract with hhs was negotiated and finalized in february of 2009. soon after that he was cited again and again and again on capitol hill, by the administration, as being this subjective analysis of the numbers of obamacare. and again and again he's cited by many journalists and columnists as an objective economics professor from m.i.t. no mention of a contract with

hhs. you know, sean, jane hampshire in 2010 wrote this in a post, she said, the contract is troubling and "the lack of disclosure on the part of the white house, the senate, dnc and other democratic leaders who distributed gruber's work and cited it as independent validation of their proposals orchestrating the appearance of broad consensus when in fact it was all part of the same effort." that is a left leaning blog saying that back in 2010. >> you know, i guess the only words you can use to describe this is this bill if you listen to gruber repeatedly was passed on manipulation of the cbo, the american people, with the predicated on assumption that the american people are stupid. then we've got the president now this week is going to move forward with immigration reform. i have a montage of comments

where the president is literally saying he c cannot do what he plans to do this week. let me let you listen to this. >> the notion that i can just suspend deportations through executive order, that's just not the case. for me to simply through executive order ignore those congressional mandates would not conform with my appropriate role as president. now i know some people want me to bypass congress and change the laws on my own, but that's not how our system works. that's not how our democracy functions. that's not how our constitution is written. the problem is is that, you know, i'm the president of the united states. i'm not the emperor of the united states. my job is to execute laws that are passed. >> i think he's very clear here, bret. he doesn't think the action he's taking this week, that doesn't

paul. senator, many americans lost their plans, lost their doctors and paying a lot more, in some cases 100% more. the white house knew this wasn't the case in 2010. they debated it internally and they decided to go forward and not tell the american people truth. what can congress do? >> well, you know, it's amazing. there was the public deception by the president and all of his henchmen and women, but also the deception of paid consultants. the one thing we can do is that this mr. gruber, this jonathan gruber, he was paid and now he's admitted he was deceptive and deceitful, i'm going to ask for an investigation from the investigator general and ask he return his pay. because how can you -- how can we pay someone to be a consultant to government who's frankly admitting they were dishonest? so i think he should be made to return his pay. the other thing we ought to investigate is there's about ten different states where he got between $200,000 and $400,000 for specific reports. who was sort of organizing this for him? is this some sort of thing that

happened within government? was he just able to market himself everywhere? or was this all coming as sort of an organized way to enrich obama consultants? but this is a disgrace. you know, now totals are saying as much as $6 million. i think we ought to talk about having him give it back to the taxpayer. >> the law, senator, is more unpopular than ever. it was sold on a foundation of lies. is there anything at this point that you can do to repeal? can you defund it? i would expect with the new senate and with congress that you guys have the constitutional authority to defund this. will congress have the willingness to do it? will they go with -- versus short-term cr? >> i think we're going to have the upper hand come january. we'll control both houses of congress. what i've been proposing is we take the appropriations process. not a continuing resolution or an omnibus bill.

this hasn't happened for nearly a decade. for nearly a decade we've been passing these continuing resolutions that are 2,000 pages long. no one gets a chance to read them and no one amends them. we can get rid of waste, reign-in obamacare, reign-in executive orders on immigration through the immigration process -- i mean through the appropriation process. >> listen, i think it's a duty for you guys to do that. i believe one of the reasons you were elected. last question, you heard the montage, the president himself has said repeatedly he doesn't see he has the constitutional authority to use executive action on this amnesty issue. what do you do in that case when he does? >> you know, he used to believe the same way on war making powers that he didn't have the authority without congress also. we can pass legislation, but legislation would have to be signed by him. there also have been instances -- there's a famous supreme court case youngstown steel where the supreme court actually overturned an executive order and said that the

or not it will press charges on darren wilson, the ferguson, missouri police officer responsible for shooting a black teenager back in august. now communities in the st. louis area are bracing for the worst as some protesters are now vowing to carry out violent and disruptive demonstrations if no charges are filed. fearing the worst missouri governor jay nixon has declared a state of emergency and enacted the national guard today. some protesters were in full swing over the weekend as they stage add so-called die-in where they laid down in the middle of the street and pretended to be dead. blocking traffic for many, many hours. here to discuss -- former new york city mayor rudy giuliani. >> good to see you. >> new york had a lot of protests. a lot when you were mayor. >> we had many. all handled however without violence. i must say i took over a city that had two major violent riots. >> crown heights. >> crown heights and washington heights. in eight years i had none.

and if i recall correctly mike bloomberg had none in 12 years. we had a lot of protests in sometimes situations like this. here's where a leader has to become an educator. i put this on the president, the governor, a grand jury is part of our legal system. the standard of proof in a grand jury is just probable cause to believe a crime was committed. and, you know, some likelihood of success on the merit. it's a small standard. if they don't find that standard, there's no reason of complaint here. there's no reason to believe that this grand jury isn't going to be fair and impartial and like every other grand jury. what really kills me all these civil rights people who always used to argue, you know, grand juries make snap decisions and you have to have rights for the accused and people have to be presumed innocent when they commit violent murders or rape. why isn't he presumed innocent?

>> that's a great question. >> where are the civil rights groups demanding civil rights for the accused police officer? police officer is a citizen just like everybody else. he doesn't lose his status. he does lose his status as a citizen. we're going to give more rights to a rapist than we are to a police officer? >> well said. unfortunately, if the president is wrong here -- remember he spoke out here. he spoke out in cambridge, the police acted stupidly, without knowing any facts. then he involved himself -- >> how does he know what happened? >> i don't know what happened. i wasn't there. >> i have a sense because, look, i spent my life being a prosecutor. i have the advantage of having been before hundreds and hundreds of grand juries, right? i have a sense of what happened here. but i could be wrong. and also i know how seriously people take their oath of office as jurors. i was a juror in a case, in a civil case. >> really? >> when i was mayor.

>> when you were mayor? >> the last year i was mayor. ti it was a civil case. >> were you the foreman? >> i was the foreman of the injury. >> i'm not surprised. >> i was the foreman of the jury. i argued in front of multitudes of juries. i have great confidence in juries. these men and women take an oath of office to do the best they can. >> absolutely. >> there's no reason to believe that they're not going to render a valid verdict. and we should all keep our mouth shut about it and if it goes to trial, let's see how the trial is. if they say no, then that's the ruling. >> now, they promoted it white police officer versus black teenager. if you believe the leaks from the grand jury and often there are leaks from the grand juries, but they're saying six black eyewitnesses that corroborated the officer's story that there was a struggle for the gun and that michael brown was coming towards darren wilson.

now, the "new york times" reports a meeting took place in the white house the day after election day with the president and al sharpton and others concerned about the issue and obama told them this, the following, according to the reverend al sharpton who appeared frequently in st. louis with the brown family and delivered a speech at his funeral, mr. obama was concerned about ferguson staying on course in terms of pursuing what it was that he knew we were advocating. and he said he hopes we're doing all we can to keep the peace. let's go listen to al sharpton who is an advocate. this is the guy he invited to the white house. >> if you're angry, throw your arms up. if you want justice, throw your arms up. if you want answers, throw your arms up. because that's the sign michael was using in order to establish peace you must have justice for everyone. we want real, we don't want to be told to shut up and suffer in

silence. we don't fight until we are tired. we fight until we win. the federal government must step in. >> that's the guy who was invited to the white house? >> you know, putting pressure on grand juries to indict in my view is un-american. a grand jury should be allowed to be fair and impartial. they shouldn't have people yelling and -- what is this the old west in which we're yelling and screaming for people to be killed? >> al sharpton at crown heights? >> of course it was. al sharpton during my administration with four police officers all of whom got acquitted by a jury with four blacks. and they were demonstrating for 50 or 60 days for me to indict the police officer. first of all as the mayor i couldn't indict the police officer. i didn't have the power to do it. they wanted me to prejudge them. and i said i don't know what happened. i will not prejudge them. they're presumed innocent.

if they are found guilty they'll get fired. if they are found innocent, they won't be. they were found innocent by a jury with four blacks on the jury. and these people conducted a 50-day demonstration in order to have innocent men -- men who turn out to be innocent indicted. >> i'm worried about what's going to happen here. i'm worried people have been -- >> when you start that language and that yelling and that screaming, don't tell me that doesn't incite violence. >> and the president saying stay the course. >> we have every right to believe that these men and women in the federal system is 23 grand jurors. i'm not sure what it is in that state. we have every right to believe that these 23 men and women are going to take their oath of office very, very seriously. and this is being carried out under a justice system that is the greatest in the world. if they indict, then there will

all this negative attention that his client has received in recent days saying in part "over the last several weeks, well, decade-old discredited allegations against mr. cosby have resurfaced. the fact they are being repeated does not make them true. mr. cosby does not intend to dignify these allegations with any comment." we've reached out to mr. cosby's lawyer to ask if he wants to come on the show and respond to this but our request was denied. joining us to share her story is barbara bouman. thank you for being here. >> thank you, sean. >> i like everybody else thought bill cosby's hilarious, great comedian, mr. huxtable. he was supposed to be a mentor to you. what happened? >> well, mr. cosby was certainly all of that and more in everyone's eyes. he was america's favorite dad. everyone wanted him to be their dad. i wanted him to be my dad. i didn't have a dad.

and he quickly caught onto that. and he latched onto that and wouldn't let go. knowing that that was one of my as a rule ner places, one of my weak spots so to speak. and because i was an actress and had been appointed his young o protege to mentor and groom for show business, one of the messages i got bright and early was i needed to tap into my vulnerability, that i needed to trust him, that he was going to lead the way, that because i didn't have a father in my life he was going to take on that role and that everything i did, everything that he said and did was all for the betterment of me and the relationship that we had in grooming me to come to new york. so it was very methodical, very slow, very calculated. and it was a very meticulous process of breaking down my barriers and chipping away at my

spirit and getting me to have utter trust and blurring the lines right from the beginning. >> and you told people at the time. you went to a lawyer. >> yes. >> and the lawyer said? >> we i went to the lawyer i told my agent -- i had a friend of mine from the agency who is also transitioning into new york city and i told her. and she said we have to tell joe, our agent. so we did. and she did nothing. i was pretty much told i was a liar and that bill cosby of all people and how could i tarnish such a delicate and fine relationship. and so i was not believed. i was terrified of her. and i was terrified of him. i did speak to the lawyer, but that wasn't until a couple of years later that another friend of mine convinced me that it was

safe enough to do so. and we did go and see that lawyer. and he literally laughed at me. he literally laughed at me. and escorted me out of the office telling me i was preposterous. >> and you said -- this is what -- i am shocked. we're talking anywhere between 13 and 16 women who have almost the exact same story you do about being drugged or having a drink and something was in that drink and you would pass out and you would wake up having been assaulted. >> uh-huh. >> and all these women tell the same story. and only now are people paying attention to this. and the statute of limitations has passed. >> yes. >> how many other women have you spoken to? >> none. i don't know any of those women. but i will tell you is that, number one, so much has developed in the last couple of weeks. my phone has been blowing up.
