romney back in 2012 they cited jonathan gruber. and the obama campaign says jonathan gruber, who helped write obamacare and the massachusetts health care plan, jonathan gruber, make no mistake, the affordable care act is based on massachusetts's success cited on the obama campaign debate press release. so this whole back and forth about some adviser and nancy pelosi saying i just don't know who this guy is is really a farce. >> well, and he's on the white house website, number one. nancy pelosi was caught on tape, as i know you reported last week. we have the amount of money he was paid, pretty significant amount of money especially for government work in 2009 in march he got $95,000 and in june he got $297,600. that's 329,600. that's an awful lot of money for one-year period of time for

anybody in government service, isn't it? >> yeah. listen. this contract with hhs was negotiated and finalized in february of 2009. soon after that he was cited again and again and again on capitol hill, by the administration, as being this objective analysis of the numbers of obamacare. and again and again he's cited by many journalists and columnists as an objective economics professor from m.i.t. no mention of a contract with hhs. you know, sean, jane hampshire the founder of fire dog lake.com, in 2010 wrote this in a post. she said, the contract is troubling and "the lack of disclosure on the part of the white house, the senate, dnc and other democratic leaders who distributed gruber's work and cited it as independent validation of their proposals orchestrating the appearance of broad consensus when in fact it was all part of the same effort." that is a left leaning blog

investigator general and ask he return his pay. because how can you -- how can we pay someone to be a consultant to government who's frankly admitting they were dishonest? so i think he should be made to return his pay. the other thing we ought to investigate is there's about ten different states where he got between $200,000 and $400,000 for specific reports. who was sort of organizing this for him? is this some sort of thing that happened within government? was he just able to market himself everywhere? or was this all coming as sort of an organized way to enrich obama consultants? but this is a disgrace. you know, now totals are saying as much as $6 million. i think we ought to talk about having him give it back to the taxpayer. >> the law, senator, is more unpopular than ever. it was sold on a foundation of lies. is there anything at this point that you can do to repeal? can you defund it? i would expect with the new senate and with congress that

you guys have the constitutional authority to defund this. will congress have the willingness to do it? will they go with -- versus an omnibus rule versus short-term cr? >> i think we're going to have the upper hand come january. we'll control both houses of congress. not a continuing resolution or an omnibus rule, but take each of the 12 different bills, and that we should describe how the money should be spent throughout government. this hasn't happened for nearly a decade. for nearly a decade we've been passing these continuing resolutions that are 2,000 pages long. no one gets a chance to read them and no one amends them. there are no new rules on how the money is spent. we can get rid of waste, we can rein in obamacare. we with rein in executive orders on immigration through the appropriation process. >> listen, i think it's a duty for you guys to do that. i believe one of the reasons you were elected. last question, you heard the montage, the president himself has said repeatedly he doesn't

see he has the constitutional authority to use executive action on this amnesty issue. what do you do in that case when he does? >> you know, he used to believe the same way on war making powers that he didn't have the authority without congress also. we can pass legislation, but legislation would have to be signed by him. there also have been instances -- there's a famous supreme court case youngstown steel where the supreme court actually overturned an executive order and said that the president cannot expressly do something that congress is telling them not to do. i think with regard to immigration reform he's doing something that congress has not instructed him to do and in fact has instructed him otherwise. so i think the supreme court would strike it down. that takes a while, but that may be the only recourse short of a new president. >> senator, thanks for being with us. appreciate your time tonight. coming up, a busy news night. in light of jonathan gruber's damning comment, democrats have been doing their very best to try and distance themselves from the obama care architect.

welcome back to welcome back to "hannity." the grand jury is expected to render a verdict soon on whether or not it will press charges on darren wilson, the ferguson, missouri police officer responsible for shooting a black teenager. that was back if august. now communities in the st. louis area are bracing for the worst as some protesters are now vowing to carry out violent and disruptive demonstrations if no charges are filed. now fearing the worst, missouri governor jay nixon has declared a state of emergency and enacted activated the national guard today. some protesters were in full swing over the weekend as they stage a so-called die-in where they lay down in the middle of

the street and pretended to be dead, all while blocking traffic for many, many hours. here to discuss what could be an explosive situation in ferguson over the coming days, former mayor rudy giuliani. good to see you, sir. >> good to see you. >> new york had a lot of protests. a lot when you were mayor. >> we had many. all handled however without violence. i must say i took over a city that had two major violent riots. >> crown heights. >> crown heights and washington heights. in eight years i had none. and if i recall correctly mike bloomberg had none in 12 years. we had a lot of protests in sometimes situations like this. here's where a leader has to become an educator. i put this on the president, the governor, a grand jury is part of our legal system. the standard of proof in a grand jury is just probable cause to believe a crime was committed. and, you know, some likelihood of success on the merit. it's a small standard. if they don't find that standard, there's no reason of complaint here. there's no reason to believe

that this grand jury isn't going to be fair and impartial and like every other grand jury. what really kills me all these civil rights people who always used to argue, you know, grand juries make snap decisions and you have to have rights for the accused and people have to be presumed innocent when they commit violent murders or rape. what about a police officer? why isn't he presumed innocent? >> that's a great question. >> where are the civil rights groups demanding civil rights for the accused police officer? police officer is a citizen just like everybody else. he doesn't lose his status. >> give him the benefit of the doubt? >> he doesn't lose his status as a citizen. we're going to give more rights to a rapist than we are to a police officer? >> well said. unfortunately, if the president is wrong here -- remember he spoke out here. he spoke out in cambridge, the police acted stupidly, without knowing any facts. then he involved himself --

our justice system. >> there were reports from the beginning this was an unarmed black teenager and a white police officer. now, that's the way they promoted that. if you believe the leaks from the grand jury, and often there are leaks from grand juries. >> there are. >> what they're saying, that there were six black eyewitnesses that corroborated the officer's story that there was a struggle for the gun an then that michael brown was coming towards darren wilson. now, the "new york times" reports a meeting took place in the white house the day after election day with the president and al sharpton and others concerned about the issue and that obama told them this, the following. he said according to the reverend al sharpton, who appeared frequently in st. louis with the brown family and delivered a speech at his funeral, mr. obama was concerned about ferguson staying on course in terms of pursuing what it was that he knew we were advocating, and he said he hopes that we're doing all we can to keep the peace. now, let's go listen to al

people to be killed? >> wasn't that the al sharpton in crown heights? >> of course it was. al sharpton during my administration with four police officers all of whom got acquitted by a jury with four blacks. and they were demonstrating for 50 or 60 days for me to indict the police officer. first of all as the mayor i couldn't indict the police officer. i didn't have the power to do it. they wanted me to prejudge them. and i said i don't know what happened. i will not prejudge them. they're presumed innocent. if they are found guilty they'll get fired. if they are found innocent, they won't be. they were found innocent by a jury with four blacks on the jury. and these people conducted a 50-day demonstration in order to have innocent men -- men who turn out to be innocent indicted. >> i'm worried about what's going to happen here. i'm worried people have been -- >> when you start that language and that yelling and that screaming, don't tell me that doesn't incite violence. >> and the president saying stay the course.

barbara bowman. barbara, thank you for being here. >> thank you, sean. >> i like everybody else thought bill cosby's hilarious, great stand-up comedian, mr. huxtable. he was supposed to be a mentor to you. what happened? >> well, mr. cosby was certainly all of that and more in everyone's eyes. he was america's favorite dad. everyone wanted him to be their dad. i wanted him to be my dad. i didn't have a dad. and he quickly caught onto that. and he latched onto that and wouldn't let go. knowing that that was one of my vulnerable places, one of my weak spots, so to speak. and because i was an actress and had been appointed his young protege to mentor and groom for show business, one of the messages i got bright and early right from the beginning was that i needed to tap into my vulnerability, that i needed to

trust him, that he was going to lead the way, that because i didn't have a father in my life, he was going to take on that role and that everything i did, everything that he said and dead was all for the betterment of me and the relationship that we had in grooming me to come to new york. so it was very methodical, very slow, very calculated. and it was a very meticulous process of breaking down my barriers and chipping away at my spirit and getting me to have utter trust and blurring the lines right from the beginning. >> and you told people at the time. you went to a lawyer. >> yes. >> and the lawyer said? >> well, before i went to the lawyer i told my agent -- i had a friend of mine from the agency who is also transitioning into new york city and i told her. and she said we have to tell joe, our agent. so we did.

and she did nothing. i was pretty much told i was a liar and that bill cosby of all people and how could i tarnish such a delicate and fine relationship. and so i was not believed. i was terrified of her. and i was terrified of him. i did speak to the lawyer, but that wasn't until a couple of years later that another friend of mine convinced me that it was safe enough to do so. and we did go and see that lawyer. and he literally laughed at me. he literally laughed at me. and escorted me out of the office telling me i was preposterous. >> and you said -- this is what -- i am shocked. we're talking anywhere between 13 and 16 women who have almost the exact same story you do about being drugged or having a drink and something was in that drink and you would pass out and you would wake up having been assaulted. >> uh-huh.

>> and all these women tell the same story. and only now are people paying attention to this. and the statute of limitations has passed. >> yes. >> how many other women have you spoken to? >> none. i don't know any of those women. but i will tell you is that, number one, so much has developed in the last couple of weeks. my phone has been blowing up.i' phone calls. it's just been a tsunami of outreach from people that either have stories, claim to have information on corporate cover-ups, victims, people from my past. and this is not just coming out for the first time. this is, you know, i've been trying to get this out and be heard since 2004. these stories are similar

because it's the same crime just perpetrated against different women. all of these women his m.o. has always been the same. the women that i know of, which is the 13 original women who i don't know any of them, ten of them are jane does, they're still too frightened to come forward. the other three, myself included, have released our name. when i found out in 2004 that we were slated to be -- to testify in a court of law against mr. cosby, that's when the news started to trickle out that all of our stories were either exactly the same or eerily similar. moreover, some of the women on threcord and off the record, are also from the same agency. so there's a pattern of behavior there. and some culpability. going on in other places. this man did not act alone.

intercontinental barbara, last question. >> i remember i interviewed juanita broderick. there seems to be in some cases if people are popular enough that nobody wants to listen. what do you make of that? i'll give you the last word on this. >> i think it's very unfortunate because people of bill cosby's stature, fame, fortune and celebrityism, they have a confederacy of safety nets around them. several layers of people in the inner circle that protect his identity. it has been brought to my attention that there may be some corporate cover-up and some very important influential people that he traveled with that made this all possible for him. so the message quickly, if i may, is to just as i reach out to other people which is really my goal here is to save some lives of some younger generations that are coming aboard here and wanting to enter the industry just to, you know, keep an eye out. and as i move through my

welcome back to "hannity." now yesterday, the islamic militant group isis released a video that reportedly show the terrorists beheading former army range and aid worker peter kassig. president obama called the killing, quote, pure evil. he referred to kassig by the name he took after he converted to islam while being held in captivity. the president also once again tried to separate isis from islam, saying, quote, isil's actions represent no faith, least of all the muslim faith. joining me now with reaction fox
