"happening now" starts right about now. ♪ jon: we begin with some bad news. three americans among those killed in an attack on a synagogue in jerusalem. the city already on edge. good morning to you. shannon: israel prime minister condemning what he calls the cruel murder and threatening to respond harshly. jon: two posting and presidents storming synagogue this morning. they were armed with meat cleavers and guns. live in jerusalem with the latest on this.

>> jerusalem is not no strangero violence. but this was an unusual attack. the violence showing no signs of letting up. >> as jewish worshipers gather for morning prayer, growing violence between israeli and palestinians arrived at the doorsteps of the synagogue. according to israeli police and eyewitnesses, two men armed with taxes, knives and pistols stormed the synagogue this morning started stabbing and shooting people just as they were beginning to pray. reporter: the attackers started to shoot. four people killed, several others wounded in the attack. >> they made sure they did the job he had very sad. reporter: the two attackers were palestinians in their 20s from east jerusalem. clashes between police and protesters erupted in the neighborhood soon after.

today's violence is latest in a series of attacks that have some fearing an outrage of widespread violence not seen here in a decade. the prime minister has said his goal is to respond harshly to these terror attacks and blaming policy and president for inciting the violence. the problem is to get officials say they appear to be individual tax and individually planned and secured officials in israel disagree with the prime minister about whether or not the palestinians are inciting the violence. the larger issue is how do they stop. they've ordered the homes of the attackers be demolished whether or not that would prevent future attackers is not clear but what we know is the tension in jerusalem continues to escalate. jon: white house had a statement from president obama strongly condemning the attack as you would imagine. live in jerusalem, thanks.

shannon: the administration downplays his connection to obamacare architect gruber, the mit economist had more than a dozen appointments to visit the white house since democrats began drafting the law back in 2009. live in washington with new revelations. >> president obama an in his ony remarks downplayed his influence in the decision-making over the affordable care act. ed henry asks the president if he misled the american people to get obamacare past. >> no, i did not. i just heard about this. the fact some advisor who never worked on our staff stressed an opinion that i completely disagree with in terms of the voters, no reflection on a process. >> in multiple interviews gruber has told a very different story.

he was briefed on the health care models. >> he clearly was not interested in it. >> once president obama was elected president was summoned again by the transition team and later by the president himself. he says the president was fully engaged and eager to pass the bill with mandate for the taxes that would eventually help pay for it. >> and then he gets elected and gets a lot of people telling him you can't make this on the mandate. he said okay, let's do the mandate. advisors since may not be the right thing to do. he says this is what the experts are tommy needs to be done, let's make this happen. >> also throw in some doubt in the downplay the significance is steve ratner who led the president's restructuring of the auto industry. today he said this.

he added the problem now is what he has said and how the white house is added it. jon: for more on this, let's bring the associate editor and columnist for "the hill" and editor for "the daily caller." what is happening here? all of a sudden dr. gruber we used to be a hero in washington all the sudden is a goat. why? >> in his own words in the videos we have seen now, he turns out to be kind of a jerk as smart as he might be. looking back on his relationship with the white house, i think your viewers should know $400,000 is a lot of money in this town. congressional staffers are not

making that, white house staffers are not making it. president obama chose precise words when he said just because some advisor who is never on our staff, he was more important than staff, $400,000, in president of meetings and named in president to campaign two years ago as a mean to defend obamacare against the public attacks saying it was the same as romneycare is brought into replicate romneycare. they should have been honest about this from the start criticizes comments and move on pretending he was not a part of the team is ridiculous. >> let's take a look at what the president had to say in answer to the question, and then i want you to parse these words. >> i just heard about this, the fact that some advisor who never worked on our staff expressed an opinion that i completely

disagree with in terms of the voters, no reflection on the actual process that is run. jon: what you take away from what he is saying there? >> he is trying to throw him under the bus after the talks have come out. this is no secret. they were very clear he was an architect of obamacare. very close and very important in drafting the law. what he feels is what we already knew in a deeper sense. last year it was reported even when president obama was going around trying to sell the bill saying if you like your plan you can keep it, administration officials knew millions of people would lose their plan, he is revealing more details of that. how deep this dishonesty was selling obamacare because the president knows if they told the truth of what would happen, the american public would revolt.

i think he is a very revealing what he has shown but we have already known the dishonesty of the heart of this bill was what was needed to sell it. jon: the latest poll shows 40% of americans think obamacare is a good thing. a gallup poll has even lower numbers of more recent vintage. what is the political effect of this? when it comes to the next congress and voting on whether or not to repeal at least parts of obamacare, does all of this play a role? >> it had a huge impact on those up for election who defended this law for three cycles in which democrats continue to lose and lose and lose over this issue certainly in 2010 and 2014. they're going to be asked to support repeals of certain parts of the law. it will be under supreme court review and his revelations about

the way they cynically chose to use the mechanics of the law in certain ways to the public is going to be a part of the court review and the legislative process certainly pressure from the constituents of those democrats up in the cycle to vote with republicans. the only need a think six of them, they will be asked these questions. >> he was asked about some of those comments and he said i was speaking off-the-cuff basically spoke inappropriately and i regret having made those comments. he doesn't say i was wrong or i lied or i was mistaken, he said i spoke inappropriately. our voters won't remember that? >> i think they will. we already know mr. gruber has no problem misleading people. he has made statements now and in the past saying those are on tape before. this was not some off-the-cuff remark. something you set up in the at

conferences. he said something similar with the case gone before the supreme court on obamacare. he called it a tightrope with regard to the case gone before the supreme court. he made that same argument. he has no problem lying on what he actually believes. jon: it will be fascinating to watch what actually happens. thank you both. shannon: are watching for a vote on the keystone oil pipeline visiting from canada all the way to the gulf coast. mary landrieu is pushing the vote hoping to gain favor with voters ahead of her runoff election next month. but she may be a vote or two shy. joining us this rich edson live on capitol hill. >> it appears they have 59 votes to get this through, they need 60 to get this done. thei have until 6:15 p.m. to get

the 60 votes they need to get the bill for the keystone pipeline on the president's desk. about 10 bills approving the keystone pipeline have passed the house already. the reason we talk about it in the senate is because of louisiana. the state energy industry is a big part of this economy but also a special senate election, incumbent mary landrieu cosponsoring this bill today, her only republican bill in the house sponsor last week so the reason we are discussing this today is because of louisiana runoff. take a listen. >> the american people sent a strong message earlier this month, they told us they want washington to get on with proving serious policies like keystone. >> it is not a good thing for the country, it is not a good thing for jobs or energy independence because it will be exported all that oil and it is actually dangerous.

on. his sense of the confrontation between ukraine and separatists that is going to involve russian troops from the russian federation itself. >> one of the reasons they are hesitating is because the u.s. wants russia's cooperation on iran. it is time to make a deal on nuclear program. thenegotiations resuming less tn a week from the deadline where global leaders trying to rein in iran nuclear energy program as feared it could turn into a nuclear weapons program. is that part of the problem here? the administration wants a deal with iran? >> i think it is certainly part of it. one of the reasons you don't see a more forceful stance on the part of the white house is quite frankly we need russia for a lot of things we want to accomplish on the world stage i and a nuclr deal with iran is front and center on that agenda. they hold the key to an

agreement with iran if one does materialize. the russians are the safeguards of iran's uranium enrichment and reprocessing facilities and stockpiles. that is essentially having the fox guarding the hen house. asking russia in a very aggressive imperial manner essentially guaranteed special security. jon: it seems iran has been stalling and holding off any results. how confident are you an agreement can be reached by november 24 deadline preventing them from building a weapon? >> the world peace caveat is a key term. demonstration wants a deal badly, and as a result the fear among many in could myself is it is willing to accept a deal less

than optimal on a bunch of fronts including allowing iran the capability across the nuclear threshold. a deal that safeguards american security and security of our allies will be harder to come by the negotiations suggest. jon: thank you for helping explain some of it to us. >> my pleasure. shannon: our first reaction on camera from the president regarding the attacks in jerusalem. for people left at including three: u.s. members. >> wants to make mention of the horrific attacks in jerusalem. we know that two attackers innocent worshipers in a synagogue during their morning prayers. we condemn the attacks. a number of people were wounded

and four people killed including unfortunately american citizens. our hearts go out to the families who obviously are undergoing, and is distressed. i spoke with prime minister benjamin netanyahu. they strongly condemned the attacks. this is not the first loss we have seen in recent months. many israelis have died and many palestinians have died. i think it is important for palestinians and jerusalem to work together to lower tension. the murders and outrageous attacks display extremism that threatens to bring all of middle east to spiral.

new york -- live in our new york studio with more. >> reporter: this was a robbery that paralyzed midtown manhattan. the area was especially busy because it was packed with thousands of tourists as well as new yorkers who'd come to see the veterans day parade. a police helicopter hovered overhead as cops that day searched door to door for the robbers as well as possible hostages. a little more than one week after crime, authorities are making their first arrest in this case. police have charged a friend of the store's owner with robbery and possession of a controlled substance. 37-year-old rhonda frizz by allegedly buzzed in one of the robbers through a secure doorway. the robber dressed as a deliveryman, then pulled out a gun, and the cops say he whipped the store owner's father. frisbee is slated to appear in court later today, the owner told "the new york post" that frisbee is, quoting now, not an

employee. according to a source who works nearby, surveillance cameras in that store were mysteriously not operating when the robbery took place. however, other cameras in the area were functioning. they recorded the alleged gunman. he is identified as 57-year-old leon finner as well as a lookout. both were caught on camera in the area before and after the robbery took place. now, as for the motive, well, beyond the loot, about half a million dollars, according to a published report a rival jewelry wanted the hold-up men to only scare the store owner. he says things went too far when they made off with about half a million dollars worth of jewels and cash. apparently, the rival jeweler had a personal grudge against the owners of this store. police continue to investigate. shannon? shannon: david lee miller, thank you. jon: breaking now, that horrifying terror attack that

claims the lives of three americans and one britain in jerusalem. two palestinians, police say, stormed a synagogue in jerusalem, assaulting worshipers with meat cleavers and a gun. eight others were injured before the attackers were killed in a shootout with police. joining us now, fred flights, a senior fellow with the center for security policy. so if two palestinian cousins get hold of a gun and these meat cleavers, go on the attack in a synagogue, does that become one of these lone wolf terror attacks, or does it have the hallmarks of support from hezbollah or one of the terrorist organizations over there? >> jon, it's good to be hoar. i think these attacks are driven by two things. first of all, i think they were probably inspired by calls by isis for muslims worldwide to commit acts of violence against so-called enemies of the religion. but i also think these attacks are driven by the palestinian

leadership. now, i just listened to president obama say that president abbas of the palestinian authority strongly condemned the attacks. i disagree. he also blamed the israeli authorities for being behind these attacks, for stoking up the situation. these attacks are driven by tensions over the temple mount. the israeli government had to shut down the temple mount last month after a rabbi who called for israelis to have the right to pray there was almost assassinated. protests broke out, and how did abbas respond? he called for a declaration of war because the temple mount was closeed. now, the mount was reopened on friday, but nevertheless, tensions are very high because of the situation. jon: well, what are the israelis supposed to do in, you know, in cases like the temple mount incident and this latest attack? >> well, there's been a long time understanding that people of other faiths could visit the top of the temple mount, but they could not pray there.

there are some jews who believes that show a lack of tolerance for their religion. i think this difference can be worked out, and i believe that's a what the israeli government is trying to do, but it doesn't help when the head of the palestinian authority calls for a declaration of war of an action that the israeli government had to take because of an outbreak of violence. jon: well, let's frame this in a larger context really. the gruesome murders that we were just talking about come as a new study reveals that terror attacks were up sharply last year, rising 44% from 2012 killing 18,000 people. what's behind this rise, fred? >> jon, there are many on the left who say that we're no longer at war with terror, that we're not at war with radical islam anymore. i think this is stunning evidence that we are. now, the president earlier this year said that isis was a jv terrorist group, and in august

he said he didn't have a strategy to fight isis, and i think this administration has been in denial about the threat from terrorism, the threat from radical islam throughout its administration. this is simply more data that this war's ongoing, and i've got to tell you, jon, when the data comes out for 2014, these figures will be much worse. jon: we have seen another isis beheading. there are a couple of, you know, western hostages still left in isis' hands. i just wonder, you know, has that group lost its ability to sway the response, i guess, by continuing to kill those that it holds? >> isis still thinks they get propaganda value out of beheadings. it's hard for rational people to understand that. but this video needs to be studied carefully. i read some expert analysis that said it was not as well produced, and it may indicate that isis is on the run or they lost the location where they

were able to film the last video. there's also some talk that they're running out of western hostages, and i hope that that's true. jon: well, we all hope that's true. we know that they are holding a young woman, a 26-year-old woman who, you know, went over to help and became, and became hostage. but they are aiming these videos at more supporters, trying to recruit more people who want to do the same kind of thing? that's what we find so unbelievable in the west. >> it's hard to understand, but they are finding that these acts of horrific violence have an effect in recruiting some dispossessed and troubled individuals who for some reason see siding with isis as the way they want to lead their lives. i think it's important to launch a campaign on the internet and in the news media to explain to these people what isis is really ability, but i think there's always going to be a small number of individuals who are

shot of an explosion and fire that firefighters are trying to get a handle on at a wastewater company. this taking place in santa paula, california, we are told. hard to know what could have, what could be on fire at a wastewater company, but it is described as a truck explosion. whether it's one of their, you know, tanker trucks, we don't know. maybe there was something onboard that truck that caught fire. obviously, early in the morning in california. you can see from all of that black smoke, that usually implies some kind of petroleum products are burning. what it is exactly and how long it's going to take to get them out, we don't know. no report of any injuries. it is located on mission rock road in santa paula, and i'm sorry, it is just coming to our attention now, a bulletin just crossing that two workers were injured, one was talkin' to a local -- taken to a local

hospital, one refused treatment. we'll let you know what happens, "happening now." shannon: a woman in virginia charged with lying to the feds about her support for isis after promoting support for that group on facebook. the fbi says she offered to connect someone with the terrorists. well, now she's in jail at least until tomorrow when a hearing is set. our legal panel is here for that, doug burns and lis wiehl, fox news legal analysts. good to see you both. posting all kinds of different things on facebook, different accounts, but, doug, what is she really in trouble for at this point? >> she's really not in trouble for what you're talking about, posting things, and it would set up sort of a free speech versus a crime debate. but we're not going to go there in terms of this analysis because she's charged with what martha stewart was charged with. everybody got confused with martha stewart. they thought she did a securities fraud crime. she didn't. she was untruthful about what she had done, and it's the same thing here. the fbi asked her, and one thing

i want to point out is that lying to a federal agent is in and of itself a crime. >> and that's exactly what happened. undercover -- good to remember. don't lie to a federal agent, and doug's exactly right. you know, you can post horrible, vile things on facebook, and it's protected by freedom of speech. but when you post something and then take that next step and lie to an officer about what you have or have not done, that's where you get into trouble. if you see a crime, for example, and you do nothing about it, you're not going to be prosecuted. but if a federal official asks you did you see is the crime and you say no, that's prosecutable. shannon: now, we have a second case that is so interesting. testimony in court now about a jailhouse confession in the trial of a man accused of hiring a handyman to kill his wife. the witness says that robert bashir, the guy accused of hiring the hitman, confessed to his cell mate, and then he said he wanted several other people killed which is why this guy's

in jail anyway. prosecutors say it was because of an alternative lifestyle. lis, he's in jail for hiring a hitman to kill the original hitman. >> and that hit match -- original -- that original hitman now has confessed to the murder -- shannon: of the wife. >> of the wife, and is now in jail. so now the husband who hired the original hitman, a handyman, is in jail and talking with inmates saying i want you to go and get this handyman, original killer, because he's the, quote, only witness to the crime. shannon: and, doug, how because this work? people always think, well, what's in it for the cell mate who's confessed? do they get some kind of deal? >> that's the standard cross-examination. i've been into murder-for-hire trials myself, and very, very common. it's like a leaky sieve. in other words, once you get the person who did the crime -- and by the way, who's more guilty? the person who sures the hitman or the person who does the

killing? >> right. >> the fact is that person will very often flip and become a witness, that's why he wants to have him killed. but back to your question, you know, we'll see how it plays out. shannon: lis, they'll have to work through it on the stand. >> they'll have to work through it, but it's credible because any witness is always going to be trying to get something. so the standard question that the defense lawyer will raise is what are you getting from this -- >> try and get a lower sentence, of course. >> they don't promise anything, they don't put anything in writing, but, of course, jurors can surmise. but you have to rely on these witnesses. you can't -- >> but any trial lawyer, any trial lawyer will tell you that what we call jailhouse snitch testimony, that's sort of the term, is extremely unreliable and generally boils down to whether corroborated. but often it fits into the overall storyline, and that's where people will believe it. shannon: well and, apparently, he wanted to do hirings for other people. we'll have to see what happens.
