statement from house speaker john boehner's spokesman. this is what he said about what he thinks will happen. if emperor obama ignores the american people and announces an amnesty plan that he himself has said over and over again exceeds his constitutional authority, he will september his legacy of lawlessness and ruin the chances for congressional action on this issue and many others. michael, what do you make of that? there are a lot of folks who think the president is baiting the gop. if they come back against some kind of immigration change, they're going to isolate and abandon their attempts to reach the latino voting block. >> well, yeah. those are fighting words from michael steele, the boehner spokesman. and i talked to michael earlier today. emthat they still haven't come up with a way quite yet to address what the president is planning on doing but they will fight and speaker boehner has said that. i think it poisons the well in a lot of ways. not just on immigration but

really on everything domestic policywise for the next two years. let's remember exactly what it is that we expect to see from the president on this. this is wide reaching. this isn't something that tinkers with the law or maybe it changes a small thing the way the president might execute the law. it basically writes new law. something didn't pass congress. i think this really causes a problem but also possibly splitting republicans in congress because they're not all in agreement about what exactly to do about it. >> yet we have article one and two of the constitution who have that spells out who has what power. legislative to congress. executive enforcement of the laws and defense of the constitution by the president, and there are a lot of folks who are arguing that he as a one-time constitutional law instructor, and it is something that is talked about numerous times, knows better. did the "washington post," my colleagues, they did a long story on monday about the legal

challenges that this presents. and they categorized it as murky uncharted territory. the white house and their legal counsel has looked this over. they say this is within the confines of the law. that they are able to do this. what they are doing is not so much giving anyone legal status. they're just prioritizing some deportations over others. so we'll see what people think when the president comes out with his announcement tomorrow. >> this has ramifications. there are immigration agents who sued the administration over the saying they're being forced to violate their oath to upheld to constitution and defend the laws of this country. if the president is saying you come across someone, they're an illegal immigrant, you have to let them go. you can't report them, turn them in or detain them at all. when you discuss that with the average american on the street, they have a problem with that. when you talk about this issue of deporting 11, 12 million, 20

million people, they think that sounds like nonsense. where do republicans find a sweet spot, can they? >> this is age old question. what to do about immigration. there's no easy answer here. i think that the murkiness of what we're about to see from president obama also gives us all these questions about what exactly to do to address this very specific issue of the constitutional question. can president obama change law by himself? and i think that's where you're seeing the republicans divided. some are saying target the funding. others say we don't want a shutdown. they'll go through courts. so before they can even, republicans can even sort out what to do about the immigration system as a hole, they haven't figured out what to do about addressing this particular executive action. and i think that that shows you just how fractious the republican coalition is on this issue of immigration. there are no easy answers. for their sake, it would be

good to be united on one particular strategy. whether it is taking hold of the funding or at least the public messaging. michael and cold by, great to see you both today. we'll stand by and see what the president has in store. >> also, republicans are looking ahead after the keystone pipeline failed to pass by just one vote. lawmakers vow they will take it up again next year when the republican controlled senate is sworn in. part of the pipeline is already finished. the southern leg opened earlier this year carrying froil oklahoma to the gulf coast. >> with all of this noise in washington over the keystone xl pipeline, a lot of people do forget what you were talking about. about 40% of the project is already complete and it is up and running. let's show you that map to put this into perspective. you have a 300 or so mile stretch that runs between steel

city, nebraska, and cushing, oklahoma. then you have the 435 mile line that was put down near the gulf. what was voted down yesterday, the blue line that you'll see added there. that blue line would connect alberta, canada to the 00 in steele city. oil has been flowing there for nearly a year without incident and folks in oklahoma can't understand why lawmakers did not pass this last night. many have been huge advocates of the pipeline because they say it was a big boost to their local economy. something other cities could benefit from. in fact, some feel keystone saved their small town. >> we are dependent in this community on the oil and gas industry and without it, we have no jobs, we have no businesses. the community in my opinion would be gone. >> but many environmentalists and land owners have been critical of the pipeline, as you

know. especially after other older lines have leaked or ruptured in some places, like an incident in michigan, not related to trans canada. >> 20 months after that spill they haven't cleaned up the river where it occurred. there has been $700 million and they have a long stretch of river that is off limits to the public. >> there are already about 2.6 million miles of gas and oil lines running, chris crossing the united states. >> reporting live from dallas. thank you. an intense hearing on capitol hill today after a series of embarrassing security lapses by the secret service, including this incident in september when a man was able to jump the fence and get all the way into the east room of the white house. the interim director of the agency admitting mistakes were made but lawmakers want answers, not apologies.

the corner. that's why we turn to our meteorologist live in the fox extreme weather center to fill us in. >> a couple more storms but a lot more snow to be had. the temps very cold. cold enough across the great lakes to get lake effect snow. this latest radar image over the last 36 hours, this really gives you an idea of what lake effect snow is. you see on the western side of the lakes, nothing is really happening. it is the eastern side where you have the winds move across and then on the eastern sides of each of those you end up with the very heavy snow. and this has been the one very persistent band that has brought us all that heavy snow. to the south of buffalo right to the south of buffalo. you can see it just very consistent there. and now over the last few hours, this has drifted and lifted up toward the north. the snow has had a little bit of a break. that's all about to change because we have another storm that will move in. water temperatures are still relatively warm compared to the air temperature.

our next guest writes in the boston herald, while there is likely to be another extension to the deadline, that's probably better than trying to bridge the current gap that's might hurt the united states, its allies and friends. plus, time is probably on iran's side. but with tehran in its difficult position, washington should hang tough in its nuclear negotiations, resisting the tantalizing american temptation to, quote, close the deal. peter brooks is the senior fellow and former deputy assistant secretary of defense. your fear, peter, is that the united states is going to want to make some kind of a deal, any deal. and therefore, come to a bad deal with the iranians. >> that's exactly right. john kerry is in europe. the secretary of state is expected to be in vienna this weekend. and as you can imagine, you know, the iranians are playing hard to get.

and if you want it bad, you're going to get it bad. i think they're betting the americans will cave in on our interests and sign a deal that will allow iran to move forward in some way or have the capability in some way to break out at some point and pursue, continue to pursue nuclear weapons. >> the deal under considerations allows the iranians to continue to maintain at least some parts of a nuclear weapons program. a program that they say they don't have and the world thinks they don't need. >> well, that's exactly right. what they, what we were talking about doing is iran says we have the right. and the obama administration is kind of agreed to this. unfortunately, that they have a right to enrich uranium. what they want to do is keep that ability. the americans are betting that they will have enough time or enough strategic warning that they will be able to at least a year, that they will be able to

so i'll be here from the white house and then del sol high school, i will see you on friday. thanks, everybody. >> in the way we've heard over the past week, some of the details trickle out here. last week, fox was one of the first reports, what was going to be in this executive order. possibly expanded visas for the high-tech sector. also more money for border security. something that the republicans actually agree on. helping to secure the border. and then the big issue is what a lot of folks call amnesty for four, five, programs even 6 million immigrants in the united states. something the president will announce and the republicans will not be him a with. >> that's almost a certain guarantee. more on that coming up. as we mentioned a moment ago, talks are underway to make a deal with iran over the nuclear program. global leaders fear iran's energy program could turn into a

weapons program. the deadline for a deal is monday. does it really matter? a new report says iran will be a threat, deal or no deal. here's the author of that report. matthew, the nonresident senior fellow, author of time to attack the looming iranian nuclear threat. a lot of disagreement would seem to require that the united states and the rest world trust the iranians. are they trust worthy? >> well, i don't think they're trust worthy. even if they are, what i pounlt out, even if we did a deal and even if iraq doesn't build nuclear weapons, it will have this threshold nuclear ability. that will pose all kinds of challenges for global nonproliferation efforts, regional security and democracy and human rights in iran. so what i tried to do in the report was lay out in policy recommendations for how we can deal with those challenges. even if we get a come pre henlsive deal. >> with relax some of the

sanctions on iran as the talks got underway. did that prove to be useful, do you think? >> it was necessary to do that last year but it complicated our ability to get a comprehensive deal. the iranians aren't willing to make the necessary concessions. as your previous guest a couple minutes ago mentioned, to get a deal by the 24th, it will require the united states to make major concessions which i don't think we're willing to do so i think likely we won't get a deal by monday and the negotiations will be extended. >> how anxious is this administration to do a deal? would they take a bad deal over a good one? >> well, they would very much like to get a deal. ben rhodes, the national security adviser, told a group of supporters that this would be like health care for us. which he meant to be a good thing. which he suggested would be a major political achievement. so i think they are very much

want a deal. but i don't think they're willing to make the kind of concessions they would make to get a deal by monday to allow iran to really just be a couple of months away from a nuclear weapons capability. that's not a deal that this administration wants, or that they could sell to the american people. >> we talk about their nuclear weapons capability. they are also working feverishly, so would it seem original bliss missile technology them might soon not only have the womenry but also the ability to deliver it. >> right. according to a pentagon report, they could have a bliss missile capable of reaching the united states by as early as next year. so that among other things really calls into question iran's claims. there is no question on earth, not even the united states that puts conventional warheads on these intercontinental ballistic missiles. so it raises the question why it is building them. >> we'll see what happenses by

executive action on immigration during a prime time address tomorrow. 8:00 p.m. from the white house. a special report anchor joins to us talk about. this this is what republicans have been fearing and perhaps predicting all along. if the president has the courage of his convictions on this issue, why did he wait until after the election to make this move? >> well, i think politically it was not feasible for some of the red state democrats, some of the democrats running in states that mitt romney won in 2012, and he was being asked by those people running not to do this until after the election. and you had even the homeland security secretary saying this was a political decision on timing. now, it turns out, that even delaying that decision until after the election did not help a lot of those red state democrats who are not coming back to the next congress. i think it is going to be interesting to see, john, what

the republican response to this is. i am not sure that there is a consensus at all about what the next move will be once this executive action is announced tomorrow night by the president. >> the republican party is up two minds on this issue. there are some who say that those illegal immigrants here now, that there is no way to deport them. that they ought to be allowed to say. stay. the argument, i suppose, is over the best way to go about handling those that aren't here. >> yeah. and i think the republicans want to show their political strength them want to slow their ability to get things done. there will be this temptation to push back against had on a constitutional ground on, a funding ground to make it so it can't be funded. but you run the risk of doing something that potentially affects the funding of the federal government.

i think that's what republican leaders are trying to deal with now. figuring out the way forward. one of the ideas is this recision idea which was, which would mean when you get to the new year, you pass a funding bill takes out all the money or anything tied to this executive action. you're still going head to when he had the president in that sense. >> they're still talking about doing a very short term continuing resolution on the budget side. and not giving, not doing a full year budget, right? >> right. that's the thought now. there's this spending bill would be passed. but more than likely it is another continuing resolution which is short term and gets you into the next congress. i think there will be a lot of fallout. i think the biggest challenge would likely be a legal challenge on the constitutionality of the action.

you have to have an aggrieved party who files. who would that be? probably congress. >> this is the same president who, you know, as a senator, condemned the executive actions that president george w. bush took time and time again. but now that he's president, i guess world looks a little different. >> sure. those cliffs are pretty devastating when you look at how many times he talked about how he couldn't do when he is getting ready to do. the white house says the dynamic changed after the senate passed the come pre henlsive bill and it sat there and the house did not act on it. they stay president is pushing for action. that if the house passes the senate bill or they move forward on some piece of legislation, that the executive action that he's going to announce would be torn up and thrown aside. whether that happens is really a long shot. >> there is thinking, maybe call it cynical.

but there is the thinking that the president is sort of daring republicans to take him on over this issue. that he wants the blowback to be so fierce that the republican brand is damaged or programs the democrat brand is enhanced for the 2016 white house campaign. what do you think about that? >> that is a thinking that is circulating a lot here in washington. and setting a tram for republicans. and you're going to have leadership making that case. that's exactly what is happening here. but for the leaders, speaker boehner and now mitch mcconnell, to be able to therd coots this issue is going to be pretty tough when it is this explosive, obviously, this emotional of an issue. >> i can't wait to see what your panel has to say about all this. >> the anchor of special report. 6:00 p.m. this evening and every evening on fox news channel. thanks. so how do members of the gop

admittedly congress has been dragging its feet and has been slow on this. the house is ready to act, and i think we ought to give them the chance to do it. it's the right way to do it. it's the legal way to do it. it's the constitutional way to do it, and the president by acting unilaterally acts like he is all three of those all wrapped up into one. he is the constitution, he is the judiciary, he is the executive, and that's not the way the constitution operates, but, you know, this president seems to think he can do whatever he wants to do and we'll just have to see what happens. >> all right. so if you view, as many people do, including those who were his supporters. i think of professor jonathan turley, a legal specialist who has been vocal about this doesn't just impact this presidency. this bridges a whole new sphere of executive power by this president moving forward the way he is, but what's to stop him? what will you do when the gop takes control of both houses come january? will you stop him with funded sng will there be another lawsuit?

what tools do you have, and is the gop united in a strategy? >> we'll have to see, but the executive order is only as good as the presidency, even if it's illegal, had this one i think would be. you know, if you want a lasting impact, we've got to do it the right way. we've got to do it through congress. i'm dedicated to doing that. i think most people are in both bodies. they just want -- they may have differences that have to be ironed out, but that's what -- that's why you do it through congress so you can iron out the differences. these are the folks -- the 535 of us are the folks that represent the people out there. the president has certain rights, but doesn't have the right to legislate from the oval office, and in this particular case seems to me he is way over extending himself. if you really want something that's going to last and be worthwhile and that the american people accept and that we can all get behind, it's got to go through the proper channels in congress. and not be just an executive order off the top of the head of
