as tensions mount in missouri and the country awaits a grand jury, we are on in ferg police chief who is say they're ready for anything. >> we have a plan and life is going to go on in the city of st. louis and the region. >> all of that plus mcdowel, mcguirk and geraldo rivera, "hannity" starts right now. welcome to "hannity." this is a fox news alert. ladies and gentlemen, it's on tomorrow night in a live address at 8:00 p.m. eastern time the emperor in chief of the united states is going to declare war on the constitution and grant amnesty to millions of people. president obama gave a short preview in a speech in a facebook video earlier today. >> everybody agrees that our immigration system is broken. unfortunately washington has allowed the problem to fester for too long. and so what i'm going to be

laying out is the things that i can do with my lawful authority as president to make the system work better even as i continue to work with congress and encourage them to get a bipartisan comprehensive bill that can solve the entire problem. >> now, while all the details of his plans to act without congress are still unclear, according to "the washington post" we do know that in addition to his plans to grant amnesty to up to 5 million illegal immigrants currently in the country, his plans include broadening visa programs for skilled technology workers and heightening security along the southern border. however, the post gave zero specifics on how he's going to accomplish that goal. and just to be clear after years of telling you, the american people, that taking such an action would amount to an unconstitutional because of power, it's now safe to say that all of that was one big lie. here with reaction fox news political analyst juan williams and the host of outnumbered and "the five," and dra tantaro. good to see you.

>> good to see you. >> juan, if a president knows something is lawless and unconstitutional, and he does it anyway, what would that say about him? hypothetically. >> that would be wrong, sean. you know that and i know that. >> yeah. let me play barack obama. because i don't think i could make as compelling case against what he's going to do as well as he did. take a listen. >> the notion that i can just suspend deportations through executive order, that's just not the case. for me to simply through executive order ignore those congressional mandates would not conform with my appropriate role as president. now, i know some people want me to bypass congress and change the laws on my own, but that's not how -- that's not how our system works. the problem is is that, you know, i'm the president of the united states. i'm not the emperor of the united states. my job is to execute laws that are passed.

if in fact i could solve all these problems without passing laws in congress, then i would do so. but we're also a nation of laws. i cannot ignore those laws any more than i can ignore, you know, any of the other laws that are on the books. what i said in the past remains true, which is until congress passes a new law, then i am constrained in terms of what i'm able to do. >> is there any ambiguity there, juan williams, any at all? >> no, i think he really put himself in a box there, sean. and i don't think that the intent is what everybody takes it to be. that's what he said. i think his intent was to say he would prefer to have congress act. i think everybody would. you know, in fact, he was wrong when he says that he doesn't have the authority because president reagan acted on exactly the same basis, took executive action for people under 18. you know, president bush did it, president clinton did it -- >> that was a tweak of the law.

very different from what this president is doing. >> no, that's not right. now i got you, buddy. because it was 40% of the illegal immigrants in the country who were saved from being deported under those actions. >> but, juan, not under the circumstances where he's wanted a dream pass, congress refuses to go along with it and he's now acting unilaterally. andrea. >> he says he's going to do this under prosecutorial action, which is not a tool. it shouldn't be a tool used to circumvent congress. why would president obama use a tool typically reserved for tyrants? this reminds me of seether crossed the rub con. i know a lot of folks on the left are probably going to argue it's constitutional because the precedent that it will set is a really ugly place i think for the office of the president to go. >> just to be fair, waub, i'm a conservative, andrea's

conservative. you even recognize he shouldn't do this. let's go to jonathan turley. george washington university law professor and a guy we've had on the program many, many times. and he says between making recess appointments when the congress is -- when the senate's not in recess. we know the supreme court weighed in on that. health care changing the law. welfare law's not being enforced, immigration law is not being enforced. here's what he says about all of this. >> we have a congress that is coming in with the full voice of the american people behind them. that's what an election is. now, you may disagree with the outcome, but you have to respect the outcome. what the president is suggesting is tearing at the very fabric of the constitution. >> previously said we're at a constitutional tipping point the way he's pushing this. do you agree with jonathan? >> no, i think jonathan's way over the line here. i have a great deal of respect for him, but what i'm saying -- by the way, i think the president is within his

constitutional rights. that's why i cited to you what reagan, bush, clinton had done in the past on the same exact basis. i don't think it's smart in terms of the presence being that congress which has a senate bill sitting there for a year and a half that we'll get this done, that's what john boehner said, and then zip. i understand why the president needs to act. >> no, he's doing this because he doesn't want to get boxed in by republican when they come back and they have the senate and they pass a border security bill simply clean, simply to close the border. president obama, sean, does not want that bill floating to his desk. because he wouldn't sign it. because he doesn't believe in border security. so he's trying to play on congressional republicans right now. honestly, juan, this is wrong. we have elections. that's the consequence of elections. and he's throwing a constitutional tantrum right now. and it will come back and bite the left in a big way. especially if the courts rule he cannot.

highest trusted and rated cable ne network in the country. and while we have been rightfully covering the obamacare architect jonathan gruber's remarks about democratic lies being used to push through the affordable care act. cbs first covered gruber's remarks on november 13th. nbc on november 17th. and the first time abc covered it was yesterday. it's also worth noting that the amount of coverage or the lack thereof for the networks since the gruber video surfaced on both morning and evening programs, cbs covered the story four times while nbc and abc only covered it once. and on cable tv according to politifact my colleagues and i have at the news channel referenced gruber almost 800 times from november 10th through yesterday. let's see, msnbc, well, they only referred to about 79 times, cnn just 27 times. they're too busy covering the

news people. and they take sides. >> right. it's not a conservative story, necessarily, sean. john gruber has been trending on twitter for eight days. so this isn't just a fox story and everybody else isn't covering it. look at a gallup poll taken in september and says the trust in media is at an all-time low. 40% of the american public says that stories will not be presented fairly -- or will be presented fairly, accurately and so on. if you go back to 1974, the same polls, sean, post watergate, 74%, 34 points higher of people said that. almost twice as much. and why was that? because people in power were held to account by the media. now the media has a different motto, sean. that's of the los angeles police department. you know what that motto is? to serve and protect. that's what we're seeing with this story sfwl those who have covered it have done a good job of whitewashing the record of

jury decision, st. louis police chief sam dotson, and billmore. good to see you. chief dotson, we have video of all of these stores all boarded up. is that generally the feeling of the people in this community that all hell is going to break loose after this decision? >> no, it's not. and unfortunately those are the images that people see. and the impact -- >> but it's every one. it's every store. >> it is relatively small when you look at the whole metropolitan area. it's unfortunate for that community that they feel they have to do that because they've been victimized. and the small businesss that are there, chief and i talked to them, they're hanging on by a thread and really can't afford this. it's the perpetuation of the fear of the violence we're trying to stop. >> chief, activists were caught on tape gateway pundit that first reported this. and they have this -- holding

training sessions of activists, some 6 hurkds of them. many of them not even from ferguson. we're telling the attendees i don't think we need to be on west florison. the people in the south look like me, the people in the west -- and then they have on top of that another group at ferguson, a protest group putting out a list of targets. and the list is three pages long single spaced including anheuser-busch and boeing and hospitals and airports and other businesses. how do you handle that? are threats like that legal? >> it guess it depends on what they're threatening to do. i guess what is unique about august is a six or seven-block area. we doept anticipate that this time. in fact, we spent most time in

front of the ferguson police station. that's where a lot of the energy has moved to as far as the threats on the big companies that we have out there, i think chief dotson is right. really our small businesses are probably going to be more affected than anybody else. >> you're doubtful something is going to happen but these agitators, these protesters are out there predicting in fact they will react. let me ask you this, are you hearing the leaks from the grand jury as i am that there was many as six eyewitnesses, the media makes this black versus white, unarmed black teen, white officer. there are black eyewitnesses that corroborate darren wilson's story. have you heard that? >> we really haven't paid a lot of attention to the leaks coming out of the grand jury because frankly that's not our case. we talk a little bit about timing from time to time, but i can't give any credence to those leaks. >> sean, that's part of the problem in the community is that has a polarizing effect. and so the grand jury has to go

through the process. and what we're doing is meeting with those organizers and really trying to work out those lines of communications, build those bridges to keep that violence from happening that you're talking about. >> well, it feels -- >> builds a lot of anxiety, i'll tell you that. >> do you have any answer to the question of time sng we keep hearing friday, maybe monday, maybe after thanksgiving. what do you know? >> you know, we really don't because it's going to be up to the grand jury finally to deliver and decide when they're going to release this. we don't know how long that's going to take. we expected this as early as october. then it turned into the first of november. now here we are. so we anticipate that it's around the corner, but we can't say exactly when. >> there are two diametrically opposed stories here. if the one that michael brown actually attempted to get the gun of officer darren wilson and tried to get it and then also ran towards him, if that story turned out to be true, then wouldn't it be possible that the president of the united states of america sent three white house representatives to the

funeral of a man that potentially was trying to kill a cop? >> we're going to wait for the grand jury to come out with all of that. because it's all speculation right now. i think anything's a possibility right now. >> well, let me ask as an officer when eric holder made his comments or the president makes his comments before the united nations and we give the benefit of the doubt and the belief people are innocent until proven guilty to other criminals, doesn't officer wilson deserve that same right, gentlemen? >> well, he certainly does, but i'll say this. this case for some reason has garnered a tremendous amount of attention. i know that's an understatement. but it seemed to really catch certainly the st. louis metropolitan area, ferguson, and now the nation. and there has been a lot of commentary on it. there's been a lot of commentary from a lot of high level positions regarding that. but frankly we're not really going to know that until the grand jury returns. so exactly who called this, who

didn't -- >> do you think the president was wrong to speak out as he did and meet with ferguson activists and al sharpton and say stay the course? do you find that inappropriate? or having eric holder compare what happened here to emma till? >> i think, sean, really what we're trying to do in our community -- and i hear those things, are to call people to be calm. comments that work the crowd up and polarize don't help us at all. that's why we meet with organizers. and i hear what you're saying. we're trying to bring calm to our community. >> listen, i pray for everybody in the city. i hope there's calm. but i think the president and eric holder and al sharpton, i think they've been terribly irresponsible, whether you will say it or not that's one thing, i will say it. and i think they have created an expectation in the minds of people in the community to expect a certain outcome that may not come here. that's a problem when the president of the united states
