executive power. >> but we begin today with the government version of lost and found. federal investigators have recovered as many as 30,000 e-mails of lois lerner, they had gone missing. he was the former irs official at the heart of the investigation into whether the agency unfairly targeted conservative groups seeking tax exempt status. this mattive e-mail recovery comes after the irs commissioner testified in june that lerner's e-mails had been lost for good. what in the world happened. molly is live from washington with more to try to explain. >> as you were saying, they were lost and now they are found. apparently 30,000 e-mails that the senate finance committee says may be important in the investigation into the irs's targeting scandal, irs commissioner told congress in june that the tax agency's i.t. experts could not recover the

e-mails. but now, the treasury department's inspector general's office says it has found the data on the irs's backup equipment. responding to that news, the irs put out a statement saying, quote, as commissioner has stated, the irs welcomes tigta's independent review. and expert forensic analysis. the commissioner said for some time he would be pleased if additional lois lerner e-mails from this time frame could be found. she is the former head of the irs's exempt office at the time when conservative groups claim therm targeted unfairly by the tax agency. critics have long been suspicious of the irs's claim that her e-mails were irretrieveably lost. >> we know this government lied to us repeatly about the irs. lois lerner said we didn't target anybody. we know they did. we didn't target just conservative groups and gee, the

dog ate my homework and happened to eat the homework of every irs employee who happened to have anything to do with this. >> lawmakers have not seen the e-mails yet. the senate finance committee says the treasury inspector general's office is trying to convert the data into quote, readable format before turning the e-mails over to congress. julie? >> molly, thank you. we're getting a report that president obama signed off on guidelines that allow u.s. troops in afghanistan to target taliban fighters. that's what sources tell the associated press. the new guidelines are broader than previous plans that limited the scope to counterterrorism. the white house insists the u.s. combat role in afghanistan is winding down and that the afghan government will be in charge. the president's decision also allowed the military to conduct air strikes and support for aft afghan operations. what does this mean for the overall war on terror? bob scales puts it in

perspective for us later in the show. >> the united states sending home another prisoner from guantanamo bay as the obama administration continues to try to whittle down the number of detainees being held there. the man is returning to the native saudi arabia. suspected former member of al qaeda who spent more a dozen years in u.s. custody. he is the 13 kt detain ee to leave gitmo this year, dropping the prisoners there to 142. we're standing by for a decision on missouri on whether charges will be filed against ferguson police officer darren wilson. it could come any day now as a grand jury reviews evidence of the shooting death of unarmed teenager michael brown. steve is live in clayton, missouri, we're getting word of arrests. what can you tell us about those and what else is happening there in terms of the atmosphere? >> reporter: two arrests friday, charged with weapons violations,

giving wrong information in the purchase of a hand gun according to the st. louis post dispatch. they are also members of the new black panther party and may have been attempting to get explosives. that's really the concern of law enforcement officials throughout this now three-month crisis here that perhaps radical groups could try to make a move to use the protest as cover for violent actions. over the past two nights we have seen a small smub of demonstrators in the street, anywhere from 15 to 50 people. those that block traffic often stopped by police with pepper spray and arrested but overall fairly calm now on the street as the city really braces for a possible grand jury announcement, kelly. >> calm is what a lot of people in the community are calling for. any sign that we're getting close to an announcement? >> reporter: the grand jury has been working for three months in secrecy. so there's no clear indication on when they will make their announcement. but we are seeing signs on the ground that led people to believe that announcement could be coming very soon.

judiciary committee calls for a hearing into what he calls president obama's power grab. angela mcgowan and christy zetser and president of new heights communications join us to share their perspectives. let's begin with hillary clinton. she's throwing her support fully behind the president on using executive action for immigration reform. during a appearance she said quote, i think the president took a historic step and i support it. then she added, this is about people's lives, people who serve us tonight and prepared the food tonight while she's showing her support of her fellow democrats is she also setting the stage for a run as president 2016? >> absolutely. i think this wasn't just a smart political move. she also thinks it's the right thing to do. hillary clinton is no late comer in her support for comprehensive

immigration reform. what i do think it says battle lines are drawn for 2016, i believe it puts republicans in a really difficult position. you have seen how they lost their minds off the president's executive action. they've called him a monarch and lawless and called for impeachment. and i think that makes really tough because it means that anybody who is going to win nomination for republican party in 2016 is going to have to reflexively be opposed to executive action and by extension opposed to immigration reform. that's really tough. >> angela? >> i don't think -- i disagree from the standpoint anybody has to be against the president's policies to win the republican nomination or to win the presidency. i wrote this book bam boozele where i have a chapter, latinos in limbo. you have some hispanics that did not want this to happen. also, you have some americans that don't want to have their

taxes increase to pay for amnesty. do we need comprehensive immigration reform? yes, we do. do we have people living in the shadows? yes, we do. but is amnesty the answer? of course, hillary is drawing battle lines because she wants to be president. but also, i think she has to look out for elizabeth warren or biden or maybe even kerry. now she stepped forward but she has a lot of alba tross around her neck before she becomes president. >> let me bring something that was alluded to. house judiciary committee bob goodl goodlatty. calling the president's actions unconstitutional and vows to hold a hearing on what he calls an unconstitutional power grab. what might the consequences be with this brewing fight we're seeing now between republicans

and democrats? zblo. >> i don't think we'll see much consequence from a hearing being held. the senate did part a bipartisan bill but the house has the opportunity to hold hearings before they decide they want to take up that legislation. the president did a threat if you don't act, i will do an executive order, that's his right as president to do an executive order. bush did it, clinton did it and even reagan did amnesty. having said that, it's ka bookie theater but at the end of the day, i don't think it's going to hurt republicans. i think the president's inactions help republicans win the house and senate. >> what do you say about this? >> i disagree. i think the republicans pitched rhetoric on this issue sends a pretty strong signal not just to people here as undocumented records but all latinos, important vote in 2016 and all people of color that says we don't really feel comfortable with you being in this country right now. i think it's a really dangerous position for republicans to be

in. i also again think that this pitched rhetoric is particularly dangerous because they are talking about how the president poisoned the well. come on, it was poisoned many moonz ago, maybe back when mitch mcconnell said his number one priority policy was to ensure obama was a one-term president. this only heightens it. >> speaking of people of color, not all people of color are supporting this amnesty -- >> it's not amnesty, angela. >> okay, they don't support -- let me finish, christy. >> they don't support this president's plan because back in the day when we're speaking about this, the economy was great during bush's time. talking about the temporary work release program. having said that, you have older people that might want these jobs that the undocumented workers are going to have and young people, people that don't have a job or people that need two part-time jobs to make ends meet. not only are we going to have taxes increase because of this temporary fix, but also people

won't be able to get jobs. >> very interesting conversation between both of you and the debate that is likely to continue for many months, perhaps even going into 2016. christy, i pose the final question to you, how will this impact the 2016 presidential elections for republicans and democrats alike? >> right, i alluded to it earlier. i believe it will be very difficult for a republican to win his party's nomination without having essentially an anti-immigration reform position. and i think by the same token it will be very difficult for republicans who win the general election by having an anti-immigration reform position. i think with this executive order, maybe i would go so far as to say that democrats have shown up to be the 2016 election. you heard it here first. >> rubio is pro immigrant and i believe he could win the nomination. you have other folks that are pro immigrant. just because you don't support

time now for the top of the news rkz the national weather service issuing a flood watch for buffalo, new york. forecasters say historic 7-feet of snow could turn into a wet mess as things warm up. i can't believe all of this, even before thanksgiving. the watch lasts from sunday through wednesday. allen henning celebrating his life at the private memorial service in london. the 47-year-old taxi driver was one of several western hostages executed in graphic videos by the terror group. and talks over iran's nuclear program entering the homestretch in vienna. negotiators have two more days until sitting a self-imposed deadline.

iran's foreign minister meantime says he remains confident a deal can be reached. >> we'll be talking about this for a while, the debate over immigration. now back in the spotlight on capitol hill, president obama signing a pair of executive orders delaying deportation for as many as 5 million illegal immigrants. a move republicans say that goes against the will of the american people. leland is reporting live with more details about this. good to see you. >> reporter: nice to see you as well. today president obama really doubled down on what he has been saying all along. he released his weekly address from his vacation there that he's on in las vegas. many say this latest executive action is now basically giving amnesty to some 5 million illegal immigrants. and the president talking points remain mostly the same and almost dares an angry republican

congress to do something. >> as you might have heard, there are members of congress who question my authority to make our immigration system work better. i have one answer for that, pass a bill. the day i sign it into law, the actions i've taken to help solve this problems will no longer be necessary. >> all right, while the executive action includes enhanced border security, long held as a republican demand when it comes to immigration reform, it comes nowhere close enough to offset the anger over the rest of the president's moves. >> we're going to try to do everything, whether it be legal approaches, states and those as members of congress and hopefully we will have standing. everything down to policy bills, spending bills. we need to actually reign in this type of unilateral executive action. >> now, friday, house republicans actually filed a lawsuit against administration officials over parts of obama care and obviously it has not happened yet over immigration in terms of a lawsuit as you just

heard. republicans say all options are on the table, kelly? >> thank you very much, we'll have more talk about this coming up later in the show. combat role in afghanistan being extended at least one more year. president obama approve being plans that allow pentagon to target fighters and air strikes when needed. it is supposed to wind up at the end of december, that's next month. it all changes though because this decision means u.s. troops will then be doing more than just training afghan forces in 2015. what does this mean for the war on terror? retired major general bob scales is a fox news military analyst. i'm confused as to what is going on. first president obama pulls troops from iraq and gone back to fight isis and now extending the troop stay in afghanistan. we have got the taliban and isis in iraq. had we stayed would that have

changed anything? >> i don't think anybody knows yet but the point is well taken. these two are linked, had it not been for the meltdown of the iraqi forces when overrun by the islamic state, this extension of u.s. action in afghanistan never would have happened because, remember now, this is a political not a military decision. the last thing the administration wants is in 2015 before an election year for the afghan forces to collapse. so the u.s. militargiven for la, a year-long extension to continue to assist the afghan forces both from the air and i think most significantly from the ground. the question is, what are these advisers going to be allowed to do. and i think that's still an open question. >> that is a good question. president obama signed off on guidelines that basically allowed u.s. troops in afghanistan to target taliban forces. it's interesting because similarly to what we're doing in iraq and syria.

the mission is to attack through air strikes. many experts would argue that air strikes are not strong enough to defeat isis. air strikes strong enough to defeat taliban. >> absolutely right. and what's so important about this decision is that the fear of air strikes will keep the taliban, perhaps from trying to assault a major city, to try to take over a province, say. but the real question is the danger that u.s. troops are going to be in next year when they are in the field still trying to advise and assist the soldiers. will the soldiers be killed or captured. what are the risks that they are going to be permitted to take. by the way, what's the taliban going to do? they know if they are going to take over this country, they have to push us out. >> what kind of message does this send to terrorists and taliban and isis and al qaeda that the united states is in then we're out. we're kind of in and doing air strikes but not on the ground.

what kind of message is this sending and does it hurt our chances of actually coming up with any kind of resolve in the countries against the terrorists? >> yes and yes. the taliban and isis aren't stupid. they know the united states is still on the clock. that's a political raermg than a military reality. all it does as far as taliban leadership is concerned. convince them to hang on, to continue -- >> we'll eventually pull out again. >> exactly right. they know that. these guys don't even have watches. they have plenty of patience. it's the americans who are ones who have watches and are inpatient about the future. the taliban is going to reset the clock and wait another year and try to kill americans to push us out and take over the country. >> it looks like it will take years before any real breakdown of isis occurs. the afghan government is going to be in charge.

if we're training afghan forces and iraqi forces, how are we to trust the afghan government and iraqi government to take care of isis and taliban. will there ever be a day when we're not involved? >> let's take iraq first. i don't think there's any question, this is a decades long endeavor. if you apply overwhelming force, you can shorten the clock and the united states military could wipe isoff the map in a couple of months but we're not going to do that. any time you increase the time and this could take a decade or more. as far as afghanistan is concerned, most people are reasonably sure we'll be out of afghanistan substantially at the end of 2016. >> then what about iraq and syria? how long is that going to take? >> decades. decades. isis is there to stay, trying to translate what in essence is a military victory into a political victory to establish a caliphate and keep iraqi forces

at bay. there's no hope that the iraqi military is going to take to the field before 2015, perhaps late in 2015. >> let's just say -- let's look forward to the presidential election. troops in both regions and president who said when he took office that he was going to pull troops out. he does hail himself the hero for taking down osama bin laden. what does the next president do because he's going or she is going to be inheriting quite a mess when it comes to this overseas disaster we're now watching unfold and foreign policy is something that democrats have not necessarily been praised about when it comes to dealing with this considering the mess we're in now after the back and forth on whether or not to send more troops or pull them back. >> well, of course, this is the whole point. this is what the critics of the administration are saying. all you're doing is just rolling the log. you're trying to push disaster beyond the election in 2016 and

next president who comes in is going to have to essentially start all over in iraq and try to continue the fight in afghanistan and both are enemies, islamic state and taliban are setting back watching this unfold. they are digging in. they are disbursing and holding territory. they are trying to convert the civilian population. they've got time on their hand and they know it. and i just can't imagine what it's going to be like in 2016 when the new administration comes in and it's going to have to start taking an active role in the region. i can't imagine that. >> we need to be taken seriously. i'm hoping that -- at this point, it's impossible for terrorists to take us seriously with the back and forth. >> absolutely. >> thank you very much, major general bob scales, always great to have you on. >> thank you. >> japan is hit by a strong earthquake, the 6.2 quake rocking the central part of the country. there are reports of several injuries, hundreds and homes without power and at least one

collapsed building. dominic is live from our west coast bureau with the very latest. >> yes, this certainly was a jolt. no tsunami warning, it happened far too inland in nagano prefecture, near the 1998 winter olympics. it was felt 110 miles away in tokyo. the military has been dispatched with an advanced party to assess the damage. more troops on stand by if they are needed. limited casualties so far, this happened late sunday night. ten injured and ten others rescued after being trapped in their homes. not many pictures emerging just yet. these are two shots that we have for you. no video coming out either at the moment due to power disruptions probably means broadband signals can't get video images out at this time. ten homes in and around the main ski resort have collapsed from the force of the quake.

reports of a landslide in the area has authorities fearing that more people could be affected. roads cut off for the time being. assessing what the damage is proving to be tricky at this time. the bullet train service was suspended in central japan and tepco, saying there were no immediate signs of problems in the nearby facility but they are still checking on that. japan has been preparing for more serious earthquakes after the magnitude 9 disaster which devastated the nuclear plant at fukushima. the country experiences around 1500 earthquakes a year. they are pretty used to it. it sits on the deadliest section of the ring of fire, which is a massive loop of tectonic fault lines. encircling the pacific region. it was followed by 21 aftershocks according to japan's

number of years. it's a very heavy least and technically difficult issue and emotional and politically difficult issue. there's no question the immigration system is broken. i don't think anybody doubts that. the question is what the president has done, will this make it better? does it fix it? number two, is it legal, constitutional? i have my serious doubts on both of those counts. >> quite a few people do. joining you with that aassessment as well. the senate passed a bill written by marco rubio, one of the chief sponsors of that. here's what president obama said during his thursday night address. >> meanwhile i worked with congress on a comprehensive fix and last year 68 democrats, republicans and independents came together to pass a bipartisan bill in the senate. it wasn't perfect. it was a compromise. but it reflected common sense. had the house of representatives allowed that kind of bill, a

simple yes or no vote, they would have passed with support from both parties. and today it would be the law. >> so congressman, how do we get beyond this issue, this stalemate, this stumbling block and get immigration fixed? >> well, look, again, as we were saying, it's a heavy lift. what i would have hoped is that the president who said in his own words that his takeaway was we have to work together. i would have hoped he would have done that and would have spent a little time given the new incoming congress a little time to try to get together in a nonpartisan bipartisan way to try to work through it. but what the president did is before the new congress can even come in and despite the leadership of the new congress saying they want to tackle it, he's decided to not give them one second, one opportunity, even though there's a new congress coming in in january and decided to do this on his own. but here's the interesting thing, the one who has faded that he does not have the legal

authority, the constitutional authority to do what he did. it wasn't republicans saying that. it was he himself who we've always heard and read is a constitutional scholar. how he can then now of a sudden not give a new congress any time, say he wants to get together but does something that he himself has stated he doesn't have the legal authority to do. now, i want to make changes. i agree with some of the specifics in his changes. but you cannot do things unlawfully. no one, no president, whether richard nixon or barack obama is or can be above the law. >> so congressman, are you in the camp that is going to move forward with some sort of legal action against the president for doing what some have called unconstitutional power grab? >> kelly, what i'm going to continue to do and get done, there are a lot of things that congress can do if in fact the president does exceed his or her power. what i think the best way to do is is to try to get legislation done. we're legislators.

just in time for holiday partying, one third of americans can be defined as heavy drinkers. for men that's five drinks a night or 15 and up in just one week. for women, it's four drinks a night or eight in a week. but good news, that doesn't necessarily mean they are an alcoholic according to the cdc.

here's dr. david samadi. you don't see very pleased with the study because it sends a negative message that you can drink all of this and it's not bad for your organs and we don't want to necessarily relay that message to the viewing audience. drink all you want. >> especially this time of year, all of the holidays are coming in and christmas and new year's people start to drink. this is the worst study that can come out. what we're telling men, if you're having 15 drinks a week -- >> that's a lot of drinks. >> that's a lot. it's all in the labeling, excessive drinking versus alcohol dependence. so 15 glasses a week cdc saying only excessive but to be dependent that means it interferes with your work and you're out of control. can't function without alcohol -- >> therefore considered an alcoholic if you are dependent and it does interfere. there is that saying,

functioning alcoholic. would that person fall under this umbrella of excessive drinking. >> you put them into functioning alcoholic. it's a matter of labeling people in a different way. what they have done, they have taken about 130,000 adults out there and they have done a survey. what they found is that only 10% of excessive drinkers are real alcoholics, meaning they wake up and have to reach to the alcohol, otherwise they cannot function. >> you have a real problem. >> the truth is that we as doctors and big message out there, alcohol just like smoking it affects your whole body and pancreas and causes inflamation and can cause diabetes and affect your leiver. the hormones that communicate the cells, it slows it down your brain doesn't function that well and can lead to brain cell death. one or two drinks socially with your friends, it's fine.
