latest on the trial. the court will reconvene tomorrow morning. rod, what are you seeing? >> reporter: i was in ferguson up until 12:00 midnight and there was not a lot of activity going on. there was about 50 to 75 protesters so you and the viewers know at the ferguson police department across from where the main police department was. they were chanting with a few signs but no trouble whatsoever. right now i'm in front of the st. louis county courthouse. there have been a few changes made since yesterday. let me just share with you what those are. the police department has erected a number of barriers directly around the courthouse in anticipation of the decision coming down this week. they have actually moved the media back a little bit. so they are telling people to stay away from the building, but

other than the few changes, they seem to be pretty normal here. >> so again, they will reconvene tomorrow to talk about it again. we'll have a decision, right? before thanksgiving? >> reporter: well, that's what the hope is, mike. what they are saying is that the grand jury is going to come together in this building hopefully tomorrow. they have not said whether or not that decision will come down tomorrow. real quickly, what will happen when they reconvene? the jury members can ask to hear more evidence or talk to more witnesses. so it could, in fact, go past the holiday. we just don't know that quite yet. >> rob, we'll check back in with you next hour. thank you. we are getting hmore detail on the obama administration's priorities with all the immigrants coming in after the president's executive amnesty. his first announcement he said, look, the key is to bring in

families reunite families, but also to keep america safe. here's what he said his priorities were. >> we are providing more resources at the border to help law enforcement personnel stop illegal crimes and send home those who cross over. we'll focus enforcement resources to those threats to our security, felons, not families, criminals, not children. and we'll bring more undocumented immigrants out of the shadows to play by the rules, pay their fair share of taxes, pass a criminal background check and get right from the law. >> that's from his saturday weekly address. >> right. >> they used to call it radio address and now it's an internet address. >> we are starting to get an idea of the president for the apprehension and attention of the undocumented immigrants. this sounds good, terrorists, felons, new illegal border crossers, out of here. but priority two, this seems to be up there, convicted drunk drivers, sex abusers, drul

dealers and gun offenders. not priority number one. >> and priority number three, immigration violations. so in other words, if you completely ignore the rules, you are not in the top two -- you are not going to be touched. nobody is getting deported. >> no. >> no one has been deported. that's totally false. they are ringing every last drops of politics out of that they can. >> sheriffs and police officers are weighing in all over. this is just one, thomas thompson of bristol county. >> our job is to make sure we don't let people in to victimize people. and this sets up the opportunity for people to get out the door and be able to get away from i.c.e. before they have the chance to cost taxpayers more money to track these people down and hope they don't do something to hurt somebody in the meantime. >> bristol county,

massachusetts. >> that's exactly right. an illegal immigrant can spend a year in prison for a violent crime, and once they get out they are not number one priority to get out of the united states. it doesn't make a whole lot of sense. and try telling families of people who have lost loved ones in drunk driving accidents from illegal immigrants that these people, these felons aren't going to be the number one priority. >> we had one on the show yesterday that was killed by a drunk driver. but the theme here is volume. there are going to be a lot more people coming illegally from foreign countries. don't believe it? ask the department of education in new york. they have sent out an alert to principals throughout the school system here in new york city. >> on "the post" today the city is warning. >> as of today, 12% of those in city schools in new york are here illegally and being educated at very high expense. >> they call it cram session.

>> right. because they don't have english as a native language. this is really expensive to taxpayers. >> on the other side, they are supposed to pay taxes now, too. >> but that's silly. the majority of people who make $40,000 a year don't pay taxes. you don't pay income taxes because you are below the threshhold. in fact, you get money back from the government. nobody say that is but it's true. we have other headlines making news this sunday morning. we start with this fox news alert. overnight former washington, d.c. mayor marion barry died. he served as four terms as mayor for washington, d.c. no word yet on a cause of death. and overnight, an earthquake rocks north texas. a 3.3 quake hit the epicenter just outside of irving.

no major damage was reported and nobody was hurt. the strongest quake to rock the area since 2009. and a navy admiral's poker face didn't work. the former second in command of the nuclear arsenal now working a desk job after allegedly taking casino chips to seize his gambling addiction. admiral timothy jiordina turned $100 chips into $500 chips with paint and stickers. he's been demoted of conduct unbecoming of an officer. and celebrities and loved ones say their final good-byes to oscar winning director mike nichols. marl marilyn streep is one who was there. his wife was diane sawyer.

>> he had a great movie way back in the day before you came to fox. rick, are you around? >> i'm right over here, guys. warming up a little bit across the eastern part of the country. 50 degrees right now in minneapolis. that is going to feel absolutely balmy compared to where you have been. enjoy it because it is not sticking around long. the eastern seaboard is where we'll have most of the problems today. we have scattered showers moving through buffalo with temperatures on their way up. that means flooding concern from the melting snow is with us. and then down to the southeast, this is where we have the chance for severe weather and more intense rain showers. and some of this could cause a little bit of localized flooding across the carolinas with two to three inches today. a little spot of orange is the enhanced level of risk today where we may see a tornado or two. take a look at temperatures, all the green on the map here across the eastern part of the country. take a look at what happens by the time we get to tomorrow. 60 degrees in buffalo. 60 degrees after all the snow

have kept them since december of 2012, and then the backup tapes are recycled. never did i say they disappeared, i said they were recycled. >> well, now they have been found. thousands of e-mails. what can we expect to find once they are read? we'll ask jordan seculo, who is representing dozens of the victims of the i.r.s. abuse. jordan, good morning. >> good morning. >> this is kind of an amazing story. all of a sudden 30,000 e-mails surfaced. what do you think we'll find once they are read? >> in six months after the commissioner of the i.r.s. made the remarks about basically them all being destroyed, there was always talk that some forensics teams could find the tapes, but the doj said this was too onerous for them. the fbi wasn't doing it. here we have the treasury inspector general during their review of this scandal to ultimately put the forensics team together to uncover the tapes and are now going through. they have informed congress and the committees have been investigating the i.r.s.

scandal. they believe they have the e-mails. they are not 100% sure if it will cover all the missing lois lerner e-mails. and they have to go through the decoding process, but the whole idea these were missing has been debunct. they weren't missing but they didn't want us to see them. >> once they are decoded, what happens next? >> then the investigators are able to, they first get decoded, then they have to take out the private taxpayer info so individual taxpayer information isn't exposed to congressional committees that don't have oversight to see that. then it will go to the congressional committee. and i do believe what this does, every time -- we're fighting in federal court, but every time it comes to a point where you think, what else can congress do? especially the new congress that is coming in, republican senate especially, but new leadership of the house committees as well that have been investigated. what else can they really do

here? and now they've got 30,000-plus pages of documents coming their way of e-mails likely that were missing during the key time. this goes back to 2009 to 2008. when the groups we represented were being targeted. we represent a group that's been waiting five years to get response from the i.r.s. >> it sounds like they could be waiting longer because it needs to be decoded and scrubbed of classified information. those are opportunities for the administration to slow-walk this even more, no? >> i think there is to a point, though the inspector general's office has been much better than the i.r.s. the i.r.s. has been impeding this investigation with their help from the friends at the department of justice. the inspector general has been doing what they can. obviously, he had the resources to go and recover the tapes. but again, i'm hoping this is for the new congress anyway. there's not a lot of time with the current congress. the new congress has said, even senator mcconnell, who will be

the majority leader of the u.s. senate, said this will be a priority in investigating this and it will be a priority. so there will be fresh information, fresh eyes on it and new committees with new staff to try to help all of us get to the bottom of just how involved lois lerner was with other officials in the government. that's what we are hoping to see in the e-mails. because it was the key beginning of the time period. >> this is going to be so interesting. this will not be the last conversation we have on this, i have a feeling. jordan, thank you for coming on this morning. thank you, tucker. coming up, the courtroom has lost the lax order. continue to fight the taliban in afghanistan. and is china secretly building a military base? look at this, french satellite imagery reportedly showing construction on an island in the south china sea believed to be the future home of a very big army airstrip. here's anna. mike, thank you so much. a win in the fight for faith. after years of having to sensor prayers at public meetings, a north carolina county gets back their religious freedom. joining us from the alliance defending freedom is the attorney who won the case, brett harvey. good morning and thank you for being with us. >> good morning, anna. thank you for having me. >> those in forsyth county had to sensor the way they prayed, anything that was too christian, you couldn't say jesus christ during the prayers. can you breakdown that case for us? >> sure. after seven years the federal court confirm what had the supreme court said earlier this

spring, that the freedom to open public meetings with an uncensored prayer is protected by the constitution. >> right. so this decision that came down and made from the supreme court of the united states, this was the grief versus gallaway, our tradition assumes that adults can tolerate and perhaps appreciate a ceremonial prayer delivered by a person of a different faith. so basically just respect the different religion, correct? >> absolutely. the way we affirm diversity is not by censoring speech but by opening up the opportunity to everyone. and in forsyth county, that's exactly what the county did. they opened it up to any religious group within the assembly, within the county, and invited them to deliver an invocation of their own choosing. that's the freedom protected by the constitution. >> in forsyth county they said this, they have to make sure it

does not discriminate against minority religions and nonbelievers. so you have a problem with that or think that's fair? >> i think that's fair and that's exactly what the county does. this is a freedom to protect all americans. the county opens it up to any group within the county that wants to get an invitation in and are allowed to volunteer for themselves and pray within their own conscience. there's no discrimination going on and the judge affirmed that when he lifted the injunction against the county. >> do you think there's ever a reason that prayer should be sensored? does the aclu have a point at all? >> well, as the supreme court said this past spring, there's a limit on what people can say in prayer, but in the praisers that open the public meetings, that's based on the setting. is it an appropriate tone? the court says you shouldn't denigrate other faiths.

you shouldn't threaten damnation, preach conversion, but that's not what is happening here in forsyth county. what you can't do is sensor prayers based on the theology of the prayer giver. that's not what the constitution permits. >> after the decision was made on thursday, how do you expect the tone of the meetings to be going forward, brett? >> i expect them to continue as they have traditionally. congress has been doing this for hundreds of years. they have started even before the first amendment was authored. this is something that happens in every country around the country. and it's an appropriate tone that the constitution protects this freedom and i'm sure that will happen in forsyth county as well. >> brett harvey, thank you for your time today. >> thank you for having me. coming up on "fox & friends," ferguson officials are already canceling classes in

we have some other headlines to tell you about. a deadly ambush when a florida man lures officers to his home. the gunman shot another deputy before being killed by another officer. the second wounded deputy was saved by a bullet-proof vest. the man made threats to officers beforehand. and a new york city high school teaming up with the city's civil liberties union to host a two-day training session to teach kids how to interact with cops. the new york post is reporting 450 students were coached to be polite when stopped by an officer, keep their hands out of their pocket and to show identification if they have it. this stems from the shoot ining michael brown in ferguson,

missouri. and this showdown occurred after a driver killed his 2-year-old daughter. >> the little girl and her grandparents were killed last year while riding bike, hit by the 33-year-old defendant after losing control of his car. the officials say he got a lesser charge because he had no criminal record, wasn't intoxicated and was driving under the speed limit at the time. and the entire town was turning into a bunch of grinches because of their christmas tree. >> look at it, it's just ugly. >> looking at it, the lights are just dangling. it just reminds me of charlie brown. >> well, folks in reading are not pleased with the town tree lighting this year. the 50-foot spruce was a last

just absorbs it like a sponge and will add a lot more weight to the roofs and bring more additional threats for roofs collapsing. so big threats there in buffalo. to the weather maps, you're at 41 this morning. and putting this map in motion, we'll see scattered showers today but not really heavy until tonight. tonight we could see a few thunderstorms, windy conditions and heavy rain with temps climbing to 50. then towards noon tomorrow, 60 degrees still with scattered showers. and then we see the cold front come through to drop temperatures back down during the overnight hours. so a big change, a roller-coaster ride across the buffalo area. but in the short-term, the warm temperatures and rain will cause problems. a look across the northeast, today is a better day with rain moving in tonight. all the rain you see here in the southeast, a big stormy day with temps, 59 in charlotte with heavy rain. >> 82 degrees in melbourne, florida. doesn't that sound good? >> it will be 70 around here tomorrow. >> bring out the shorts and the

tube tops. a fox news alert, the community of ferguson bracing for the grand jury's decision in the michael brown case. >> but as one school district closes in advance out of caution, one mom is taking action. >> she has three kids. a few months ago she started a facebook page called parents for peace. thank you for joining us this morning. >> good morning. >> so what is your reaction to the school closure, do you think that's an appropriate response or is it going too far? >> well, my district, the ferguson school district, has not closed. there's one school district in north st. louis county that has chosen to close monday and tuesday. i don't know what went into that decision. i feel comfortable that our school will be -- that our kids are heading to school monday and tuesday. >> in the jennings district, that's the one you're mentioning, the superintendent said there were masked

individuals handing out fliers telling students to be disruptive and not to respect cops so they decided to close school monday and tuesday. so you and your cohorts, the facebook group, have decided you're going to try to have school in a library or some other churches, things like that, correct? if school is canceled in your district? >> yes, there's a coalition with some local churches. and they'll have opportunities for kids, educational opportunities, opportunities for lunches, and then our facebook group has organized as we did in the summer when we were out of school, to have a school at the ferguson library. again, an opportunity for kids to have an educational opportunity and lunches for some of the kiddos that might not otherwise get it. >> we are hear in new york, 1500 miles away from you, what is the feeling there? is there tension? and what is your ultimate message here? >> i mean, sure, there's

tension. it's always the unknown that's the worst. so we'll be happy when the decision is made and we can see what is happening in our community. but i think for our kids, our primary goal is to create a sense of community. and i think that is what we have done. we have had a lot of opportunities for families or community members to volunteer for places for people to serve. and that is really our primary goal is that. >> it sounds like a lot of people making trouble there aren't from ferguson or the surrounding communities but from completely out of town. anarchist groups, for example. >> i'm sorry, i had a lot of trouble hearing that. >> it sounds like those making trouble in ferguson are not from ferguson but are from far away and are making ways for their political agenda.

to make it worse. we have new detail that is dhs released deportation guidelines. the president gave the executive order last week to 5 million illegal aliens in this country that are allowed to stay. the question is what do you do with those who commit crimes? >> there are different levels. >> there are tiers according to homeland security. let me put them up on the screens. the top tier for terrorists, severe felons and new illegal border crossers. >> that's good, but you would think that the second tier, the second priority group would also be priority number one. let's take a look at those as well. convicted drunk drivers, not charged, sex abusers. >> that should be on the top level. >> drug dealers, gun offenders. then tier three is other immigration violations. here's what the president said saturday during his weekly address.

them to make it harder for them to find jobs. do you think he hears those concerns or are they real? >> no, i think this could backfire on him. i think it will. think about a hispanic immigrant who is here legally and immigrated legally and is already having a hard time finding a job. or if you're a minority or any american in this country having a hard time finding a job, you need 5 million more jobs. you don't need 5 million more people to depress wages and make it harder to find jobs already as it is in this economy. everything about it shows us that he doesn't care. what he cares about is politics, how he looks and what he portrays out there. and it shows that liberals love this issue and love to make sure everybody is at odds always and immigration but they do not want a solution. if they wanted a solution, there's been moments to fix it. look, the immigration system works in this country. is it the best?

and so i think this pope is saying, look, marriage, this is the complexity of the men and women, but recognizing all humans have dignity. that's the marriage from this pope. >> in the united states the numbers are getting worse and 50% of kids being born out of wedlock and the consequences are poverty among many others. what can we as a society do? what can the catholic church do and you all do to encourage people to get married before they have kids? >> well, that's a great question, tucker. that's how i actually got involved in public policy, this whole marriage issue back when i was in office 20 years ago. or about 15 years ago. i offered donations to the first covenant marriage law. and that was the focus of this conference. marriage and family are in crisis. and not just an american problem, let's say it's a global problem. and so we have a responsibility to do something to give the past possible environment for

i don't think we should take it -- let's not start guessing at what's going on. we have a lot of security in place here because we are expecting large crowds and we're just ready to deal with those crowds. >> so we interviewed store owners last time violence broke out in ferguson and they said they were told directly by law enforcement that police wouldn't protect their stores and they were looted. if that happens again will law enforcement step in and prevent looting? >> well, as you know, during the first events that happened in august there was changing of m command and brought in and politics got involved and i'm sure your viewers are aware that sometimes you involve politics where politics doesn't belong. it doesn't help the situation. we had a few issues but we work tlud the issues. we had a lot more time to prepare. we have a unified command in st. louis. that's the chief of st. louis city. captain from the highway patrol and the chief in st. louis county. now they're working together to

make sure that we're ready for any circumstance that may occur. it's not just necessarily here in clayton missouri where the grand jury announcement will be made but also ferguson or areas in st. louis city like the shaw neighborhood that has seen uprisings because of police activity. >> i'm sorry we're a little short on time. i want to be sure, so there will be no looting or you're saying law enforcement will actively protect businesses from looters? >> we will actively protect those businesses as best we can. remember i mean this is a huge county and -- especially the more violent protestors are individuals that are actually looking to cause trouble or loot they can go anywhere they want but i can assure you that our unified command is prepared to respond throughout the entire region and of course we have extra protection and extra precautions put in place in some of those areas most likely expecting the concentration of problems or violence. >> detective, thank you for joining us.
