wilson and michael brown collided on a street after the teenager stole items from convenient store. officer wilson shot brown six times killing him. the grand jury comprised of three african-americans and nine whites. charged with deciding whether officer wilson broke the law or was defending himself. some facts have leaked. mr. brown tested positive for marijuana at the time of the confrontation and there was a physical altercation between the two men in the police car. unfortunately, speculation has run wild leading to violence, looting and injury. tonight gist the facts as we await the grand jury announcement. we begin our coverage with fox news correspondent mike ferguson, missouri. what's going on there right now,z mike?

now. we have seen them at the command center in large numbers. in terms of coming out in front to where the demonstrators are it seems right now, bill, they are trying to avoid having friction with the crowd of investigators. relatively small forming now. >> we understand more than a thousand officers deployed. 100 fbi agents. so, if the crowd is less than 100 right now. that should be enough to contain any kind of violence. i'm wondering about the masks, you know, here in new york city, after 9/11, we're

not allowed to wear masks, and you couldn't even have finted wind chills on your cars. still cannot hear because of terrorism and things like that they are allowing demonstrators to wear masks. you have asked them why they are wearing masks. what's the answer? >> well, they say that they are part of the defense. by the defense meaning defense against an oppressive government. that's really the position that they are taking. why they are covering up heir face. a lot of that is symbolism with guy fox and the association with the anone news movement. a lot of other people are wearing the mask over their face so they can't be identified. some will tell you it's just because it's cold. in the summertime we saw them with the masks on the face and it wasn't cold. >> explain what it is to the audience, rick. >> well, that's a little tough to put your finger on. a group that operates a lot over the internet. they are a group of hackers. and they say that they are fighting back against an

oppressive government. you see a big presence with them on twitter. particularly throughout this process. it's tough to describe exactly who they are. but they are show up at the g-8 movement, show up at operations like this. show up at different causes that they choose selectively. >> when you asked them, they do freely admit they are part of the anone mus movement, they are not hometown people. they are not from ferguson or from around that area. they come in from all over the place. >> >> they certainly want to show that they are part of that anonymous movement. as far as people from out of town, what we have seen in the weeks leading up to this or days leading up to this a lot of the people being arrested are people from out of town. why have got a lot of people showing up at these things saying that they are from out of town. as far as reports of people being bused in from out of town, i haven't seen the presence of buses but we have seen clearly a lot of out-of-towners. >> if you want to drive into ferguson.

i understand it's not easy, that the police have barriers and checkpoints and things like that. you can't just show up with your car and just get out and cause trouble; is that correct? >> i think i can if you want to get to the courthouse in clayton you can't because there are a lot of barriers up. again, the local authorities are trying to minimize the amount of friction that they have with the general public. so the traffic is coming and going freely. on this avenue and then west -- where we saw all of the destruction over the summertime. we drove by there before. no slow down of traffic at all state police, missouri state police are they with the local ferguson police? >> we saw a big cadre if you will of the state police a long convoy of state trooper cars. they were backed by the command center.

in terms of coming out here to where the demonstrators are it seems they are making an effort to keep a low profile. where is the command center as opposed to where you are right now? >> as the crow flies, i would put it about a half a mile in that direction. it's in the big target parking lot. and most of what the police are doing is in back of the shopping center there. again, trying to keep themselves out of the line of sight. they don't want to have large police presence. >> the crowd hostile to the media? >> so far, nothing. we have seen in the crowd that there are weapons. some of them are decorative. some of the kids in the anonymous gear. one at least we saw has brass knuckles on the back of his backpack. it was a batman set of brass

knuckles. looked like more decorative than anything. that said some of the security people have identified more serious weapons like knives in the crowd. >> the anonymous uniform. that's that white mask with the nose? is that what you are talking about there? that that's the guise fox mask. you can't see who is a member and who is not a member. can you see who is dressing the part when they wear that stuff. >> check back in with mike tobin in a little while. joining us from the clayton courthouse where the grand jury sat for about three months, fnc correspondent steve harrigan. what's the headline from your view, steve? worry about 10 miles away from clayton the courthouse behind me the situation here very calm like a ghost town if you can see behind me. at the same time only about 20 people, clayton is about 80% white and most of the

people standing out here are are white. there is heavy security presence. metal gates around this courthouse and then a second row of plastic barriers. they are filled with water. we have seen a heavy police presence and national guard, too, putting on uniforms as far as stores and the shops go. they have pretty much all shut down. the main street is dark. streets are blocked off. so here, 10 miles away, there is almost no crowd presence. no demonstrators. the people here seem just pretty much amused by the media they are walking behind us. trying to get in the shot. waving their cell phones, so no tension no, angry protesters, but a very heavy security presence here in case something might happen. bill. >> now, where is the announcement going to be made? how is that going to come down? >> the announcement is going to be made through press conference probably about one hour from now. they have taken media credentials dr. they are letting in a small number of people. it's going to announced one way or the other at 9:00. even top officials claiming they don't know what's going

to happen. and this grand jury now for the past three months has worked largely in secrecy. we know they have reached a decision. and that decision could range anywhere from letting the officer walk free to charges of involuntary manslaughter to even charges of murder. so, a real mystery here about one more hour and this whole place, this whole region, really, afraid and been waiting now for three months for an answer, bill. >> now, the announcement is going to be made in the courthouse where you are in that facility? that's what we expect one hour from now. speculation no matter what way it goes there could be protests.1xorñr >> anone folks out there are into the press conference. have our producer inside. i will be out here. keep in mind, the numbers,

they don't reveal the full list of witnesses. i'm sure this prosecutor and these grand jurors knew the public scrutiny that would be on their final. so better to do too much than too little. >> only once a week that he came in. >> yeah. >> six hours with lunch break. >> every wednesday, 12 people. mostly white but three black members of that jury met and deliberated on this case. they had been together for months prior though. this weren't put together for just this case. evaluated a lot of cases and been with this prosecutor through a lot. presumably they trust one another and they hard it out and came up with what they think is the right result. >> nine out of the 12 have to agree before a decision is made. >> what would be nice is if it's not man news. 9 white people against three black people that wouldn't be help. if it's split. hopefully they will tell us how it's split. >> they are not compelled to tell us anything. >> correct. except for the results. >> they can keep everything

secret if they want to. >> if he gets indicted they will release only the indictment just to tell us what he has been indicted on and what's going to happen next. >> use that at trial. >> just to let us know what he is charged with. if he is not indicted, the prosecutor has said that he will release the evidence in the case when they said he has right to do under missouri law. today some questioned that saying the judge had not signed off on that. our earlier information was the judge does not have to sign off on that. so we will wait to see what the truth is on that. >> i think you would have to if he is not going to be indicted. you would have to tell the public in fairness and the family. >> what the evidence was. >> but you don't have to tell what the grand jury number was: certainly along racial lines. the grand jurors then are free to speak themselves. >> if they want to. it's general lay secret proceeding and i don't know why a grand juror would want to bring that upon themselves arches free ticket here. you know he what they do.

sometimes they stay silent. >> i can't remember the last team it? >> happened recently. i'm trying to remember are the one. none of the jurors came out and i thought good for them. good way to keep the scrutiny off yourself. >> it will not happen here. >> it is going to happen sortly. finally going to know. the reason this case has become such a big deal is several fold. number one, it came on the heels of the travon martin case acontracted to much. calling george zimmerman a white hispanic nonblack man killed unarmed black teenager. and then now here is another situation in which a white man, a police officer shoots and kills an unarmed black teenager who is 18 years old. and, in the first case, george zimmerman was found not guilty. people felt he wasn't held accountable. and in the second case they are wondering whether the same result might happen. there is also bias against the police in ferguson. in the african-american community to some extent because they feel there is a bias by the police against

them and there is some statistical evidence to support some of those claims. i mean, you could make the argument if you wanted to sort of go there. there is plenty of today defend the police too. you can be selective in the way you view this case. >> what exploded the case is the the looting and violence. that had shades of l.a. violence. >> also cops left michael brown's body lie there four hours. >> that was wrong. >> black kid dead on the street for four hours and nobody covers him up. >> i don't know whether you agree with this. i have been sharply critical of the ferguson police department. i said that they were amateurs and amateurs dealing with my staff and certainly you don't leave a body in the street for four hours. you don't do that. >> correct. >> there is plenty of drama. sur rounding this deal. it comes down to whether we are going to respect our system or not. these anonymous people don't respect our system. they are going to causes a much trouble as they can. the new black panther party

callers call in? what do you say to them? >> i actually, bill, try and just stay to the facts. i understand there is a lot of emotion in this. we know so little of what's going on bob mccullough's office has not leaked anything. they have come from the federal. when eric holder says shut up, stop leaking. is he talking about his office and his administration. so i just try and keep it to the facts and we know enough to at least have somewhat of an intelligent conversation. >> okay. this anonymous crew that's out there now, driving the demonstrations, do you know anything about them. has that been a topic of discussion on radio program. >> protesters in large. nonviolent protesters, there are the agitators and there are the spectators. at any given time one is the other.

what really upsets saint louisianaians these people are from out-of-town. who cares if your store is being looted does it matter that the person lives in california? it doesn't matter. all they are is coming into st. louis to do damage and to do destruction. we don't care where they are from. and what they call themselves. >> i wanted to pound out ferguson is suburb of st. louis so there is interconnection. bishop, you are a man of god and a compassionate man, that's why i chose you to come on the program tonight when you see racial agitators whipping up the crowd what do you think of that, bishop. >> put them in the kkk. support staff says their numbers have gone up. the enrollment has gone up. i put them in the same category. i mean, i think someone wrote a book about wing nuts. so maybe we got a bunch of wing nuts in those agitators

and on the other side bottom line we have got to be peaceful. other guests say agitators, spectators and people protesting peacefully. that's where we have got to be, bill. in this particular instance drive towards justice in a peaceful way. >> does your congregation, generally speaking, bishop. >> feel aggrieved by the country color of their skin means they don't get a fair shake in america? generally speaking, does your congregation believe that? >> i think my here is the time i can speak to the facts. there is not a fair shake in many areas and then on the other side, there are fair shakes. you would say, i would say, my congregation has that sense of, you know, still in america it's a great country

as i said. i wore the uniform of my country. but the bottom line is that as you know, we still have a long ways to go. we have come a long ways. but we have got a long ways to go. >> okay. mr. millhaven, final question for you it there are people on the right and i get their letters and, you know, who are just viscerally can't side with the police officers, law and order. do you hear from them? >> yes. and i think bill this is most important point. most st. louis residents agree. the system is broken. next town over is a town called pine lawn. they have half a square mile. they have 3200 people and they wrote 17,000 tickets last year and 25,000 warrants. the system is broken. north county is broken.

thank you for staying with us, i'm bill o'reilly in the personal story segment tonight. emotions running high in missouri. with with us here in new york city nelson hughes author of the new book "roor the new conservative woman speaks out" and in washington juan williams. i thought the bish shop did a nice job. honest guy, patriot. >> i thought he was spectacular. especially when he was clear about the line of emotion and feeling versus evidentiary material that can be introduced before a grand jury. >> here is the question for you, many african-americans believe the deck is stacked against them they do not get fair treatment based upon skin color. many, many believe that. do you? >> yeah. you do? >> i do. i think that, you know, it's part of our society,

american society, given our history and all the rest, racial profiling is part of the ticket and i think this is especially true for poor black people, those who are most often in the kind of in the streets and, you know, i think in a sense, the police act to protect everybody. including middle class blacks like me from poor black people high level of violence, bill. black on black. >> as rudy giuliani pointed out, with statistics, the crimes that are committed in the poor black precincts overwhelm the society that lives there. but, what i want from you is you have got a grand jury in place that have obviously been diligent. they have had it for three months. you say that you believe people of color don't get a fair shot. does that extend to this missouri grand jury? >> it's it a larger context here. the reality is as you heard

earlier from megyn kelly, you know, a kid is shot six times. unarmed kid. body is left in the street. then the police won't say what happened for weeks. they won't even tell you the name of the officer who did it a high level of distrust. then you have a prosecutor, robert mccullough who has some background with his father having been killed by a black man while the father was a policeman. why is it so difficult to get an indictment when it would seem like well, an unarmed kid is shot. >> you, juan williams don't trust this grand jury is what you are saying here? >>. no you asked me about the entire system. the grand jury. >> do you trust this particular grand jury yes or no? >> i don't know. anybody on the grand jury. i don't know what was presented to the grand jury. but i have questions about the way that this was done. >> and hopefully they will all be answered. now, ms. hughes, juan williams and the bishop, i mean, they are speaking from the heart. >> um-huh. >> all right. how do you reply to that? >> i think it's real interesting the selective points that juan just decided to point out. if you just listen to what

juan pointed out you would think, yes, we have a problem here. but the truth is he forgot to point out the convenience store and report going out that this convenience store had been robbed by someone that we now know someone we now know as michael brown. >> when this all happened we did not know what the exact course of things that happened. so he pointed out things that would make it seem like yes, this officer was guilty. but left out the parts of, man, this officer was taller than the police officer. >> juan williams and the bishop both have suspicions. >> right. >> about this grand jury. >> right. >> do you? >> you know what? i hope it's a jury of their piers. that's what i'm really hoping. the truth if they lay out everything like the attorney general says he is going to do then we should have that confirmed. >> only if there is no indictment. if there is an indictment, that evidence will not be laid out so they need it for trial. >> here is my question, did this jury actually get influenced? we have to he will realize unfortunately these kind of

cases happen and never get thed me attention that's happened. they don't have the al sharptons coming in and olingering rallies. they don't have people sitting there and grand stag this. has that helped or hurt race relations in the united states? >> it's an important question, juan. these jurorsy not sequestered. they were home six out of seven days. surely they know about all the looting and all the violence. all the controversy and that has got to seep in to anybody's mind, right? >> i don't think there is any question about it. normally that's why you sequester jurors and tell them not to read the papers and the like not in this situation apparently. >> no. >> so what you have here is a situation where they are exposed to everything that's come forward including the potential for political pressures. i just want to quickly respond to scottie here, bill, and say scottie, i'm well aware that this kid, given what he did in that convenience store looked to me to be a thug and his behavior may have been aggressive toward the policeman. i still think if it was your

anything change in the 50 minutes we talked to you? >> i can tell you what's changed, the energy level and the number of demonstrators has changed quite a bit out here. a few more hundred demonstrators have shown up here on the road in front of the police department. they're getting whipped into a frenzy. i got the speakers going, i got the chants going. they have blocked off south florison road that goes in front of the police department. they've got cars in the road that aren't moving. what's interesting is the police aren't doing anything about it. they're letting the demonstrators block the road. the only police presence that we've really seen, we've seen a little bit in front of the police department itself. and then there was kind of a tense moment where they identified one person in the crowd as kkk, the demonstrator just said he was kkk. well, that started a bunch of friction. and we saw the police kind of materialize, a platoon of them if you will, injected themselves into the crowd, got the one guy who looked like he was a friction point, got him out of the crowd and now the police are

back to low visibility. so we're starting to see some of the tactics of the police. in the meantime the energy level out here, bill, is definitely growing. the number of people here are increasing and number of people is increasing. standing on top of the cars right now with a bull horn american flags upside down. i talked with one guy who identified himself as part of the black panther party, he said they're not going to give you justice, so we have to go get it. >> all right. now, i understand there are intoxicants in the crowd as well? >> yeah. we're seeing booze. you can smell a lot of the pot in the crowd. not as much as it was over the summer. but definitely getting a little bit of intox here in the crowd and starting to get that block party feel again like they had last summer and whip into a frenzy over time. >> stay safe out there. we appreciate it. >> thank you. >> that is it for us tonight. tomorrow we will be back to our regular format with an update of course on ferguson. thank you for watching "the
