breaking out monday night minutes after officer darren wilson would not face charges in the shooting death of michael brown. mike joins us live from ferguson this afternoon. mike, what are they bracing for there tonight? >> what they are watching for at the moment, what is developing downtown st. louis. and we can show you live pictures. what happen with the particular demonstration, they moved through town and blocked a couple of intersections and this is complete with a lot of theatrics and went through things like the mock trial in the center of town. things got tense and they moved up to the federal building and the police are not allowing that. they stoot in the front of the building with the riot gear and that's where the stand off is. the demonstrators are seeming to want a conflict with the police
10:09 am
and the police won't them to move away. >> mike, thank you. >> and throughout the coverage. we have gotten a lot of pictures from ferguson and all over the nation. in los angeles, we are getting new pictures of a small crowd that is blocking the 101 freeway. you know the 101 freeway is popular and a lot of people use that to get around the los angeles area three miles north of downtown l.a. officers told us they removed the protestors and opened up two lanes of the southbound 101. they are taken in custody by the la pd. we heard from former mayor julianna and he said someone starts to get out of control and affecting law enforcement, they need to arrest them and take them away and knock it down before it gets out of hand.

10:13 am
president obama for his executive order and the earned income tax credit was removed from the draft. and everyone is fighting over this. and now announcements on new climate rules and ozone regulations and at every turn the president is fighting the republicans and not coming together to create a sense of harm no and honeymoon. it is an interesting question to someone like harry reid. put our heads down and get to the lame duck and do the tax extender deal and finding the president digging in as if he was running for reelection. >> it is curious. that he will veto it. that's the way the system works i guess. >> a white house official is admitting that millions of immigrants may be eligible to

10:19 am
iraq, thoses numbers are not as great as thousand plus that are from the united kingdom. and it appears, heather, the young people are motivated and inspired by isis would rather go there and fight than be here at home. there is not much of that activity, but to stop that flow, defeat and destroy isis. >> to that extent, you feel we are not doing enough. we all know you are a popular face on fox, but i didn't realize you commanded the 101 airborne and 18th airborne and so many viewers know about what those divisions did and you are responsible for. when you look at the air strategy, is that adequate and should we do more? >> we should intensify the air campaign and remove the
10:20 am
restrictions that the white house imposed in an attempting to avoid civilian casulties, we are passing up targets we should be hitting and secondly, we need to strengthen the weak hand of the indigenous forces in iraq and syria and put advisors on the ground with front line units in the fight. to date, the president has refused the advice and counsel he received from the department of defense. >> i wonder how much impact will the next head of the department have on the president. >> that is a good question. we had three secretaries of defense on different pages with the administration and felt that the white house, and particularly the national security team has been meddling
10:21 am
in matters that are under their province and under their duty description. frankly, i think that is one of the reasons that someone as esteemed as michelle floun oy renowsed the position and jack reed. >> they took their hats out of the ring and we are hearing about jay johnson, head of department of homeland security. i wonder what you think of these candidates and what you think of him? >> i don't think he has the experience as the other candidates that have withdrawn. he was the general counsel in the department of defense. i think the obama administration will likely try to find somebody who is not independent of them as the throw previous secretaries voiced different opinions given the fact that they are trying to control the strategy in isis. my recommendation would be

take a look. >> you can hear gunshots ringing through the streets. the robbers hit a hair salon and took the manager hostage and eventually released him and taken into custody without a struggle. >> things seem like they are calming down in ferguson, missouri following the announcement that the grand jury would not indict officer wilson. it is now stirring up a lot of legal debate especially the lawyers that like to argue and they are talking about the role of the prosecutor in the drama. our experts are here. tom kenneth and keisha. >> and some of the lawyers are saying it is a rigging game and that the prosecutor didn't want to indict and he led the grand jury in those ways. are they unfair?
10:27 am
>> they are unfair. to understand what happen here it is important that the american public understand the role of the grand jury. it was inclubbeded in by our founding fathers but to protect defendants and people from rogue prosecutors and rogue magistrates that might be accused of a crime and no problemable cause to have committed. the people are critizing the way the prosecutor conducted the grand jury and critizing two of the paradigmses. neutrality and transparency. legal scholars prosecutoring for being neutral and transparent. >> yeah, one of the things i want to point out, the doubt of the prosecutor is to seek justice and not convict. a lot of people think he is on
10:28 am
the state side. >> we are so accustomed to a prosecutor going in there and getting an indictment if they are arguing for it. >> the problem that is causing the chaos in this case, prosecutors are not neutral in the grapped jury proceedings and can get an indictment. and t that's why people are outraged. but had the prosecutor not remain neutral there would have been a back lash. he presented all of the evidence to the grand jury. >> two cases in the federal level now that will go forward potentially against officer brown. they will look at the police department as a whole in ferguson and asking the question of whether or not officer wilson violated michael brown's rights. what is the burden of proof there? >> if you look at the facts. the notion that anybody will
10:29 am
prove, especially given the grand jury presentation and sworn testimony on the record that the officer violated michael brown's civil rights is preposerous. michael brown was in the aftermath of committing a violent felony. he attempted to get the police officer's gun. in that situation, how can they armchair quarterback this and say that he didn't reasonable fear. >> eric holder said we have to restore trust. and seems to me, if i am working on the case i know what my boss want. >> in order to succeed, it would have to be proven that race was an issue and as to why the officer shot michael brit is di i seriously doubt that the officer said because he is a black man i will kill him.
10:30 am
i think the circumstances need to be looked at and police departments do need to be assessed and determined whether there is a height eped level of fear. and do they need be trained better or screened before they are hired. i doubt there is that. >> and we will have you back to talk about a second legal topic in just a bit. stay right here and we want to get your thoughts on another case. that is quite a case. >> another show down looming on capitol hill with the obama administration proposing strict rules on ozone emissions and raising concerns that businesses will be hurt and jobs in jeopardy. and what could flight delays be a thing of the past. what new technology allows pilots to do and giving a new view of a travel. @oyu0x?hy@p

he was protecting her from a criminal charge. >> they had a relationship. and there were thousands of text messages and his mother found these and racy pictures of the tutor in lingerie and she called the cops. >> i think it is it a statutory rape case. it was a consensual situation, but the minor doesn't have the mental capacity to voluntarily to enter in the relationship. >> have you ever seen a case where her argument wins? >> it is a tough case for the defense. it is not a slam dunk. one thing is jury nullification. and the jury believes that the prosecutor proved it beyond a reasonable doubt and because they feel sympathy for the defendant and don't see the damage from the alleged crime they may give her a pass. that is the issue in the case.
10:42 am
