so far, the protests have been peaceful. st. louis county police now telling a rifle was taken from one of its patrol cars. there may be a lot of tardy guests arriving for thanksgiving dinner this year, if they can get there at all. blame a nor'easter and a frigid storm threatening the upper midwe midwest. air travelers aren't fairing much better. h hundreds of flights have been canceled. "hannity" starts right now. welcome to "hannity." and this is a fox news alert. darkness has fallen on ferguson yet again tonight as law enforcement is bracing for yet another round of possible violence. now, on tuesday st. louis county police report that 58 arrests

were made in ferguson. now, while that number is down from what we witnessed on monday, tensions remain very high tonight. and new questions are being raised about why measures were not taken to contain those demonstrations from the very outset. in addition tonight we want to investigate some of the rhetoric that was used by key figures that were on the ground as well as the actions that have been taken by federal, state and local officials in recent days. and we begin with this disturbing outburst from the stepfather of michael brown who was captured just moments after the grand jury's decision was announced on monday. remember this. [ bleep ] [ bleep ] [ bleep ] [ bleep ]. >> as unfortunate as those remarks were, the naacp, they still refuse to condemn them.

take a look at this. >> he was in a lot of pain. he was in the moment. but do you think that served as a call to violence? >> no, i don't think that that was a call for violence or it calls violence. the fact of the matter -- a single set of violence sent this consequence in motion. that would be the shooting by officer wilson. >> i wonder what business owners in ferguson have to say about that now that some of their stores have been destroyed or completely lost. remember back in august minutes before michael brown was fatally shot and killed by officer darren wilson the teen was caught on surveillance tapes stealing cigars from the ferguson market. he was seen strong arming the clerk. after the grand jury was

announced and started wreaking havoc, that stoim store was targeted by protesters. you can see in a "hannity" exclusive video there are looters from inside the store. you get a perspective, nobody seen, literally stealing and looting and destroying property. surveillance video also caught one of the demonstrators lighting the store on fire with axel rant. watch this. you can see right iin ining acc. here to explain more on what's going on there is the attorney for the owners of ferguson market. and that's jay canslor with us. i'm sorry to the owners. please express my condolences to them. >> thank you, sean. >> they did have their store boarded up, correct? >> this store was boarded up.

you can see the steel bars across the doors. the boards were on the inside as well. and it didn't stop them. but that's what you get when you have a 37-minute head start on the authorities. >> yeah. and as we're looking there in the video right now that's sort of like the potato chip rack that michael brown kind of pushed the store clerk into when he was robbing the store, right? >> that's correct. >> yeah. now, as all of this -- i mean, what is left in the store in how much damage was done? have you been able to assess the damage at this point? >> i was by again this morning and they finally cleaned upmost of the broken glass, the trash. it was worse than august. it will be in the hundreds of thousands of dollars. and it's devastating. this is the second time in three months that this store has been rampaged by looters. >> how many employees do you have working at the ferguson market? >> well, you have the owners -- this is a family-owned business. but in addition to that there are probably five or six employees that work with the

family. >> yeah. and i don't know if they're able to get insurance a second time after the first incident here. i had on last night -- we're going to have him back on tonight, darrell parks, the attorney for the brown family. and i was asking him about the robbery, asking him about the struggle for the gun, asking about the eyewitness testimony before the grand jury saying that michael brown, you know, was charging like a football player full force on officer wilson. you know, as you watch this, what are your thoughts about -- this isn't about michael brown. these are opportunists. how do you describe them? >> well, i call them anarchists, opportunistic criminals. they came there knowing exactly what they planned to do. and they accomplished it. >> now, this one guy that we're looking at -- this one guy, jay, what he's doing is he's spreading accelerant and

starting a fire inside the store. we're going to see somebody comes and tries to put that out. he's spraying more, shooting it into it almost like you do with a grill and charcoal. maybe he was using that type of accelerant he was using. >> that lady who was a resident of ferguson and a regular customer of the store went in there for the sole purpose of putting out that fire. she was not going to let this happen again. >> oh, you mean this woman that we watch pouring the milk went in there not as a looter but as a good samaritan? >> she's from the neighborhood. literally you can see her she's pouring milk and anything basically she can get her hands onto put that fire out. if that woman didn't do this, that store would have burned to the ground like others, right? >> absolutely. that's how a lot of the fire

started. and yet she said you're not doing this to my community, not to my store. and my clients can't thank her enough. >> wow. in the midst of madness and cay yacht, you know, you get those good people that just come out of the woodwork. you can see there that the fire went out. any way, we really appreciate you being with us. thank you so much. and our best to the owners of the ferguson market, sir. >> my pleasure, sean. thank you. more video coming up exclusively here on "hannity" tonight. beyond the inflammatory words used on monday by michael brown's stepfather, missouri governor jay nixon has become the subject of heavy scrutiny over his failure to deploy the national guard that he had called up earlier this week. and my next guest says he believes the obama administration could have played a role in all of this. here now to explain himself is the republican lieutenant governor of missouri peter kinder. peter, you were not part of the decision but applauded the decision to call up the guard. but yet the guard wasn't

deployed on monday, the night when ferguson needed them the most. why? >> i did aplau the initial decisi decision. it's more in sorrow than in anger now that we assess the effects of the failure of leadership of the last 48 hours. sean, the governor had the foresight to issue the emergency declaration to call out the guard last week. we all thought, okay, we're going to be ahead of the game this time. and then at the critical moment about this hour on monday evening it all fell apart when the guard was kept away. and i don't know the decision making. again, it's been a long week already. and it's only wednesday evening. >> yeah. >> missourians are scratching our head saying where was our governor and where was the leadership? >> and while the city of

ferguson is being looted and all of this is unfolding before a nation, shots fired, cars being burned, businesses being destroyed, looting and bottles and rocks being thrown at cops. while all that is unfolding the mayor of ferguson is desperately trying to find the governor, the governor's spokespeople. cannot find them. and we have since discovered that the white house, valerie jarrett was on with jay nixon all night. why wouldn't that by talking to the mayor of ferguson? why weren't they talking to the obama white house? >> that's fascinating, sean. and it has emerged that valley jarrett has multiple conversations with the governor of missouri, ts chief executive and commander in chief of the national guard when he was not communicating with the mayor of ferguson where the trouble happened in august and where we knew it was likely to happen again. the mayor, james knowles, who would be a good interview for your show, told me he's had two

conversations with the governor over maybe a hundred days and they were in a room with 40 or 50 people and the governor would give him a few seconds of his time. there's been no communication -- regular communication -- >> but the governor denies the white house pressured him to resist sending in the national guard. what possible excuse could there be for not sending in the guard as all of this is unfolding? >> you know what, sean, in his press conference yesterday afternoon the governor issued what i would call a nondenial deny, it was not really a denial. he denied that anybody's motivation was political. well, no one alleged that. okay. the governor of missouri owes the people of missouri a whole lot of answers that he has not given to date. and i'm going to tell you something, the news media in this state is starting to figure out that they're being stonew l stonewalled and hoodwinked. and i think it's going to come to an end. i think they're going to start demanding answers. >> do you have the ability legally, sir, to get to the

e-mails, contact, anything, freedom of information act for example, any contact he had with the white house in terms of what was being said on that night? >> funny you should mention that, sean, because i've been on the phone with legislative leaders in both the house and senate. and we will be filing a request. and i want to put down this marker on your air, remind everyone working for the governor and the executive branch that the destruction of e-mails is an offense punishable under our criminal laws. and they should not be doing that. >> well, tell that to lois lerner. listen, i appreciate what you're doing -- >> well, but they're turning up. hers are turning up. >> that city did not need to endure what it endured monday had the governor done his job and send in the national guard like they did last night and things were much better. lieutenant governor, thank you for being with us. appreciate it. >> you're right. thank you to the good people of

st. louis and missouri. >> thank you. joining us live on the ground in ferguson, missouri, is the city's police chief, thomas jackson is with us. chief, i know this has been a very trying time for you and your officers. and i know a lot of the nation had you guys in our prayers. have any officers been hurt? >> no, none of our officers have been injured. thankfully. some county officers and i believe a highway patrolman were injured. i don't think anybody was seriously injured. we're very, very thankful for that. and thank you for the prayers. we all feel them. >> chief, i got to tell you between the rocks and bottles being thrown and the shots being fired, it's almost a miracle that nobody got hurt here. there were two men indicted last week on federal weapons charges. and they apparently had a plan to bomb the gateway arch and kill not only the st. louis prosecuting attorney robert mccullough but also you according to the post dispatch.

were you aware of that threat on your life? >> i was aware of it, yes. >> and what about the threat there was a bounty put out on the head of officer darren wilson? i've been shocked there's never been any movement to get the people who put that bounty out there on this officer's head. is there any way we can get to the bottom of that? >> well, we're looking into that, not us personally but the intelligence authorities are trying to get to the bottom of that. that's a terrible, awful thing to put that officer under that kind of pressure. >> or you under that kind of pressure. you have a death threat on your head. i want to go back to this video tonight. it's the ferguson market. i want to go back for one specific reason. because as you see people now going into this market looting, robbing, stealing, et cetera, well, some of them have their faces covered and some of them don't. that would tell me that over time the police department would have the ability to identify

many of the people that are involved in this lawlessness. is that something that you intend to pursue, sir? >> absolutely. and we have officers -- we do in st. louis county and the federal authorities have officers combing through these videotapes both for the looting and the arsons. and we are systematically going to seek these people out and make sure they're prosecuted for the horrible crimes that they've committed against the citizens of this community. >> i mean, anybody that could be identified or maybe this guy that was spreading accelerant, certainly we can see his face and maybe we'll go back to that videotape. he tried to put that store on fire. there was one good samaritan who went in the store and said not my city, not my town, and put herself at risk and put out that fire. but the guy that was spreading the accelerant, i hope you can find him. one final question, chief.

i'd like to know your reaction. why wasn't the guard that was called up sent to ferguson on monday night? >> i don't have an answer for that. and i can't really get an answer for that. i was surprised. we had an original plan in effect. and i was really surprised when that plan was changed. so i think we were left just confused why we didn't get national guard when we so desperately needed them. >> it's almost unforgivable in my mind. do you expect over the thanksgiving weekend more of these protests are likely to pop up? >> yes, yes, i do. i think this is going to go on for a while. >> all right. sorry to hear that, chief. thank you for being with us. all your best to your officers under these difficult circumstances. appreciate you being here. coming up also, we will speak for the attorneys for officer darren wilson. that's coming up after the break. does he fear for his life especially in light of the fact that the "new york times" publicly put out his personal

pointed out that michael brown was the aggressor. why can't the family look at that evidence? >> i don't want to be real graphic with what i'm about to tell you, except for i happened to be at the autopsy we conducted. so i know the true path of the bullet that went into michael's head. >> he kept charging. i understand -- >> but -- >> there's no sucuch thing as somebody killed with gunfire it's going to be a pretty sight. he said officer wilson would stop shooting and michael brown kept charging. i go back to my question to you yesterday, what kind of person robs a store, tries to steal a cop's down and charms a police

officer and won't stop? >> obviously going back to what i was telling you, the officer had to shoot his gun down like this to shoot him in the head. this officer had a chance not to use deadly force. that's what the true evidence in this case shows. >> nor did the grand jury see it that way. one more important question. >> i saw the bullet path. you can't tell me -- >> i saw the autopsy report too. here's my final question. eric holder has said he's going to continue to pursue civil rights charges. the standard, the legal standard for a grand jury's probable cause, if he was indicted, it would be beyond a reasonable doubt. you have to prove that he

intentionally wanted to violate the civil rights of michael brown. based on all the eyewitness testimony, you can't possibly get there. don't you think we're creating false hope for people who want to agitate and have agendas here? >> i think if you look at the attorney general holder's statement, he said it was heightened standards. the governor still has the opportunity to apoint another special prosecutor -- >> oh, my gosh. the eyewitnesss are consistent. the -- you will never get a guilty verdict in a court of law. it's impossible. the evidence is so overwhelming. >> it depends on the jury. >> i got to go. appreciate it. coming up, why did the "new york times" release the home

and this is a fox news alert. there are new concerns tonight over the safety of ferguson police officer darren wilson just days after a grand jury decided not to indict him in the shooting death of miebl brown. there you have it, the "new york times" so-called paper of recordin explicably made the decision to publish the officer's home address in its newspaper. meanwhile, there's growing speculation tonight at this hour about what the future holds for officer wilson, and whether or not he will remain with the ferguson police department.

here with more on that and many other issues two of darren wilson's attorneys. guys, good to see you. thank you for being with us. >> thank you, sean. >> thank you, sean. >> why have we not found the person that put the bounty on officer wilson's head? neil, start with you. and number two, what do you make of the "new york times" recklessly and irresponsibly putting his home address out there like this? >> i'm glad you put those two questions together, sean, because that's what the issue is here. i don't know why anyone would do that. this is the second time now that it's happened. i don't know how it furthers the story to say this is the house he lives in, here's the address that he lives in. all they're doing is putting this man at risk. all they're doing is putting this family at risk. now, here's a man who's a police officer. here's a man who has done everything he can possibly do to cooperate in this investigation.

we finally get a decision. there's a great relief that's lifted from his head. but the risk is still there. why would you do this on the tail of that? i don't know. i can't answer that for you. >> i'll take it a step further. if anything god forbid happens to officer wilson, his family, that community, i blame them directly for what they did knowing the tense nature of this high profile case. let me ask you this question, greg. i want to go to the issues and the facts of the case that i was discussing with dar ill parks. i've read all of the eyewitness testimony. it is overwhelming -- overwhelmingly in support of officer wilson's story. it'sin controvertible. they would never get probable cause. they would never get reasonable doubt. but yet the attorney general of the united states says the civil rights case is still open. what is your reaction to that considering you'd have to prove

intent to violate the civil rights of michael brown in a case like that? >> sean, you hit it right on the head. that's the attorney general's prerogative to keep the case open. but you are absolutely correct. intent to violate his civil rights based upon race. like you said, grand jury proceeding, probable cause. didn't get it there, beyond a reasonable doubt, probably wouldn't have gotten it at trial. and here in the civil rights violation very high standard to prove. i don't think they can get that as well. >> that barre is so high. there's never been any -- neil, let me go back to you in it sense. you just heard the comments from dar -- i'm sorry, from michael brown's mother that he intended that day to go out and kill somebody without any evidence being offered to corroborate that. what do we know about officer wilson's state of mind that day? i know he gave an interview with george stephanopoulos, but that really wasn't addressed. do we know anything about that?

>> we do. we know a lot about it. we know he started his day early. we know that his now-wife is pregnant, was pregnant at the time and was having trouble with heartburn. they were texting each other back and forth. they were teasing each other back and forth. every text ended with honey or babe. everything was a term of endearment, sean, is the point i'm making. this was not a guy who was mad. right before he encounters michael brown he's at a call that he volunteered for. he didn't have to go on this call, but there was a call of a 2-month-old sick baby who was having trouble breathing. they send a car over, he knew that the officer whose sector this was in was involved in something else and he said, no, i'll take the call. now, is that some indication of a man who's angry? i take her words as the words of a grieving mother, i do. but again, what we know about him is that this was anyone -- this was someone who was anything but angry.

he wasn't that, sean. he was simply out there working that day. and he's told people this. i mean, this is information that he's provided to the feds, he's provided it to anyone who will listen. >> greg, let me ask you. there have been reports that officer wilson may retire, may get off the force. can you confirm or maybe deny those reports? what are his future plans as it relates to police work? >> well, sean, i think it's quite obvious for the good of the community, for the good of his men and women in blue, he will never be able to go back to ferguson. now, what he will do with his life, that's going to be a lot to decide for him. he's going through a lot of decision making at this point in time. with regards to talks of resignati resignation, we are in initial talks, i will tell you that. >> let me ask one question and either one of you can weigh in here. now that we've had an opportunity to see the evidence that the grand jury has seen, i keep using the words, it is so

overwhelming, and iin controvertible. you would never get a guilty verdict if this were to go to trial. what do you make of those high profile politicians, without mentioning names, and agitators, that created in the minds of residents there and around the country the impression this would come out a different way when in fact it was never going to come out that way. any words for them? >> go ahead. >> sean, i will tell you, i was with officer wilson approximately one hour following the incident. when i take my statement from my client, i draw a line down the center of my paper. i took his statement. he was subsequently interviewed by st. louis county detectives. normally i have to fill in some blanks, add some things. the story was consistent. the following day we gave the statement to the st. louis county detectives, audiotape statement, same consistent statement. i believe it was august 11th

when i was talking with darren and i said, darren, i'm very confident in our case. i know you did what you were trained to do and pursuant to the law. what scares me are these politicians making these statements. >> and, sean, the agony of listening to all of these people who coopted in the end was a fairly simple set of facts. these people coopted this for their own opportunities. and, again, listening to that and not being able to respond because we couldn't, we couldn't openly respond because of the pending case. >> yeah. >> it was so hard for darren. it was so hard to listen -- >> so it was irrelevant. >> say again? >> it was irrelevant for so many people. they never wanted to hear the evidence. there was a rush to judgment. but i will say this and gentlemen i'll have to let you go. maybe i'll have you back next week and expand this. but the fact in my mind it is a tribute to our justice system, a tribute to the grand jury, a tribute to those in the
