you for watching, i'm paul gigot. hope to see you right here next week. as we know, the white house promised action on immigration and eventually the president delivered. but now we're getting an inside look into what we are months of closed door meetings during the secret high level talks, administration officials including homeland security secretary jeh johnson were instructed to quote, use the president's legal authorities to the fullest. the big news and thanks for joining us this saturday, i'm leland vittert. >> nice to be with you as well. >> you as well on a saturday, a

lot of work. >> but we love it. >> we do indeed. thanks for joining us at home. what resulted from those meetings, that is the plan that the president announced earlier this month altering deportation policy, for an estimated 5 million illegal immigrants. peter doocy is following from washington. >> at an office inside the office of homeland security this summer, johnson wrote the executive orders that president obama announced on november 20th according to a "new york times" report which details five different meetings president obama and johnson had this summer as the president probed johnson for clear guidance on how far he could go using the legal powers to the quote, fullest extent, with a goal of stopping deportations for 5 million people without congress and without breaking the law. this article also cites senior officials as saying every time

the speaker of the house and president crossed paths, the president would have questions when the house was going to move on immigration reform. it wasn't until then house majority leader eric can tore lost his election partly because of voter concerns over his immigration stance that the speaker told the president at a white house event for pga golfers, there's no chance of passing immigration reform in the house. that blunt assessment came at about the same time unaccompanied children from central america were surging across the border, putting a burden on overwhelmed southern states and three months after a tense meeting in the roosevelt room at the white house between the president and immigration activists upset about the rate of deportations during his tenure. the president got tired of waiting and didn't think he could get any help from congress, even if he did wait, after the midterm elections passed, he announced steps that his dhs secretary told him he

could take on his own. >> interesting we're hearing about this at this time. thank you, peter. >> a judge has overturned the nfl's indefinite suspension of ray rice for attacking his then fiancee in an elevator. the former raven is now eligible to sign a new contract but the question remains whether any team will actually pick him up, especially considering there's a molest now in the regular season. dominic picks up the story from the west coast newsroom. >> hey there, yes, this happening yesterday, an arbitrator dismissing the suspension saying the nfl decision back in september to up the suspension from two games turning it into an indefinite suspension was arbitrary and abuse of discretion. he is eligible to play as soon as a new team signs him up. he has been a top notch running back and still has a lot of appeal but the residual

reputation he has for beating his then fiance could ride other him. his wife has been explaining how furious she was immediately after he hit her and they had to drive home together. >> i didn't speak to him the entire ride home. he tried to talk to me, i didn't want to hear anything. i knew he hit me and i was completely over it. of course in the back of my mind and heart i knew our relationship wouldn't be over because i know this isn't us and it's not him. >> so she's forgiven him. who else is going to forgive him now? you might say he's already been forgiven by people online at least. 168,000 people on yahoo!'s fantasy leagues have added him to their teams. it turns out he's by far the player most in demand online, someone somewhere thinks he's going to return before the season wraps up but certainly no indication so far from any real

nfl teams whether they are interested. we'll see how it rolls out. leland, back to you. >> there will be a lot of discussion on both sides of this one. dominic, thanks. >> we're going to ferguson now where the focus is shifting to funding. missouri governor jay nixon calling for a special state session to address resources for the national guard and state police. troops and officers are putting in overtime as they try to restore calm after the violent protests. mike tobin is live where he has been throughout all of this. mike, what about this additional funding? >> well, additional funding, a lot of it needs to go to this very area. really where the worst destruction happened on monday night, tuesday morning. and we can kind of give you a tour. it looked like the whole street was on fire during the worst of it. over here is the auto zone. that was completely consumed by
11:36 am
flames, flames that grew throughout the evening. the taco bell didn't get it as batd as we thought. people came in and ransacked the store but it is open for business now, only the drive-thru. across the street when the worst was happening on live television, the looters inside auto tire. looked thik they bashed cans through the windows. they ransacked the inside and tried to start fires and tactical teams came and moved them and arrested a few of them. it's interesting in auto spot, the car wash place, it was never locked up and no one ever made an effort to break in. right next door you've got the fashions r boutique, that was a life goal to make it their store, livelihood. that was smoldering on monday night. it's burnt to the ground and advanced auto parts store looks like a total loss. you have people out today cleaning up, trying to make the
11:37 am
situation better. you've got a number of marches planned and as you mentioned before, a lot of focus on funding and rebuilding. >> let's hope people can get in there and help those folks rebuild. all of the people that worked in those business and lost their jobs as well. coming up later this half hour, a pastor resists pressure to enter the ferguson debate until now. his take on the racial unrest and why he is breaking his silence. >> and coming up now, we'll turn our attention to turkey where government officials deny isis used their territory to launch an attack on the syrian city of kobani. according to the turks, a truck bomb targeted a border crossing but exploded on syria's side. kobani has been under siege for months now. most civilians managed to escape that town but a small number of syrian rebels continue to battle isis for control there.

>> and leland, at least two people are dead in a taliban standoff in afghanistan. fighting is under way at the foreign guest house in kabul after taliban homicide bombers and goounmen stormed the building. fox news can confirm the insurgents have control of the guest house and they are still inside. the building is near parliament in the afghan capital. this attack is the latest in a seerpryes of deadly assaults targeting the diplomatic district. >> charges were dismissed against hosni mubarak, on trial for the killing of protesters in 2011 uprising that tossed him from power. here's video from those protests. charmgs today were dropped against mubarak's two sons as well and also dropped against a former number of staffers as well as wealthy supporters. it is not clear if mubarak and his comrades will be free to go. the former president is lshd

11:45 am
of getting back into congress there in washington, d.c. what can the republicans actually do? >> hey, leland, it's a very good question, especially given the context of this part of the calendar. right? most americans are coming out of their turkey haze at the moment looking forward to christmas. the american people according to polls aren't that excited to put it lightly about what the president has done here. they've opposed the executive action and big political fight at the end of the year often doesn't get that much attention or type of attention republicans want. i think that while there are a number of options on the table, none of which are particularly great for republicans, they can keep in mind that starting in january, they are going to have an enlarged majority in the house -- lower house and take over the senate as well. so they'll make some chess moves here. i'll be interested to see what they do on tuesday at the conference meeting behind closed doors talking about tactics. >> jessica, speaking of a tactic, the so-called nuclear option might be the issue of a
11:46 am
government shutdown september 11th, you need a continuing resolution to continue to fund the government. conventional wisdom says if the government shuts down, it does not bode well for republicans in the house and the president can use that to his advantage. are democrats hoping at some level that republicans pull that one out and willing to go toe to toe with them? >> i don't think so. i think in general democrats are hoping that some sort of compromise can be reached that we get the continuing resolution passed and keep the government funded because certainly that was the issue before. it hurts more people than it helps. and hopefully once we get back into session in january, we'll see some sort of movement and get some work actually done that hasn't been going on in washington for quite some time. >> guy, to that point, you spend a lot of time on the hill and a lot of time talking to the incoming senate class and those kind of folks. are you getting a sense there is a desire to work together or is there a desire to score more
11:47 am
political points than there are making legislative progress? >> i think the republicans have a very compelling argument to make that they want a mandate. it was an overwhelming red tidal wave for them. one of the issues that was add jude indicated was the immigration issue, was the crisis from summer with unaccompanied minors, a lot of republicans ran on it or ran against the president's potential executive order. there were warnings from speaker boehner and leader mcconnell, if president obama took this action, which he himself said he didn't have the authority to do. if he was going to do it, which he now has, that would immediately burn any bridges towards progress and cooperation that republicans were willing to perhaps come to the table with. >> i want to get jessica to come in and separate this for a second. you have democrats in the house and senate. you have a real thumping, pelosi and reid embattled at this point in their leadership positions.
11:48 am
is there sne chance they are going to run away from the president on this one and say he's a lame duck, two more years, we have to try to win elections come 2016, he doesn't, we're done and going to start cutting deals with the republicans? >> well, you know, it will be interesting to see what happens going forward. sadly we just went through the whole process where there was actually a tax deal worked on with the republican chairman ways and means committee and senator reid's office and unfortunately this executive action blew up that agreement. it would be something that would be positive for the american people as opposed to what we'll now have, another one year extension that affects about 55 different tax breaks for everything from small businesses to individuals. so you know, that sort of brinksmanship is something that i think everyone wants to avoid and it will be interesting to see what happens not only with senator schumer but senator reid and pelosi and other democrats in the house as they try to navigate these waters going
11:49 am
forward and actually find issues where we can do things that will actually create laws and help people and fund the government and come to some sort of agreement that isn't just on an immigration argument. >> then we have to figure out if the president will sign any of those or use his veto pen as he has not done much during the first six years. thank you both for joining us. >> thanks. >> don't forget, peter king is on the homeland security committee. he is also going to sit down with maria bartiromo on sunday morning futures tomorrow before hearings on border issues relating to the president's immigration actions. you can catch it 10:00 a.m. eastern right here on the fox news channel. growing cries for intervention as unrest continues in ferguson. one pastor who resisted calls to get involved breaks his silence. his take on ferguson and why he's speaking out now. hey matt, what's up?

comcast business. built for business. hi, there. welcome back. community leaders in ferguson and beyond facing criticism for their response to the ongoing crisis there. and one texas pastor who chose to remain silent is now speaking out on the growing unrest and the mounting pressure to join the conversation. the pastor is of great baptist church and author of "family shepherds." thank you so much for joining us. we appreciate your time. >> thank you for having me. >> first of all, tell us about the pushback that you received when you did not respond initially and why are you responding now? >> well, initially i was out of the country. i was actually in africa at the time. when all of this occurred. so when i got e-mails and
11:54 am
tweets, people saying i need to respond to ferguson i didn't know if it was a person or a place or what. i then became aware of the unrest that was going on and i since followed the issue. i felt like there did need to be a response, but not the one that people expected because they expect for black pastors, black leaders, to all respond to this in the same way. i don't see it the same way. and felt like it was important to say so. >> and why do you think your perspective is so different from others? >> well, i don't know that i can speak to that, but i know that there's this collection sense among many black people that, you know, we know what really happened there. there's this idea that we are besieged by the injustice of police and so on and so forth. i don't believe that. the problem i see is that there is this celebration of criminality. there's this acceptance of criminality and thuggery and that's a problem.
11:55 am
this was a young man who engaged in a violent robbery and then engaged the police officer in a violent confrontation and lost his life. i'm raising seven young black men and what i'm telling them is why is why you don't behave that way. this was not medgar evers, this was not emmett till. this was a criminal. >> yeah. out of your piece, i found this statement very telling. you said if a few black men being killed by cops requires a national dialogue, what in the world does the overwhelming number of black on black murders require? >> yeah. look at what's happening in chicago. it's just -- it's unspeakable and the numbers are outrageous. people will say, well, of course, most white people are murdered by white people as well. number one, the murder rate, the sheer number of murders for people -- a group that make up

terrifying moment when a suspect takes a hostage at gun point. you see it play out. we'll tell you it ends. but we begin in ferguson, missouri. that's where officers are making more arrests overnight after protesters there blocked traffic near the city's police and fire department. following the grand jury's decision not to indict officer darren wilson in the shooting death of unarmed black teenager michael brown. mike tobin is live for us in ferguson with the latest. so how are things today, mike? >> reporter: well, the sun is shining and we are getting a look at west florissant avenue. look at all this burned out damage. this was the o'reilly auto parts store. i want to show you something we found out in the damage. this is a flammable motor treatment that kind of ended out in the parking lot. hard to tell if this was used as an accelerant or exploded and flew out in this direction.
12:02 pm
look across the street, you see the advance auto parts store. you can see most of the structure is still standing. right across the street is title max loans. if you remember some of the live pictures, that building was engulfed in flames and the chinese food place initially people broke out the window and by the end of the eventing that was burning. we had a lot of people out here. we have seen today cleaning up in the aftermath. some of the business owners, people who worked in the businesses, wondering what they'll do. how they'll earn some money now that the holidays are coming and they're out of work because their vocation went up in flames. beyond that, you have a lot of people out here participating in different marches that were planned for today. so that's it. the community trying to get back together and a lot of people trying to determine what is next, what will come from all of this. >> mike tobin live from ferguson, thank you. and the fox news alert to

yet another taliban attack in afghanistan against western targets. fighting underway right now at a foreign guest house in kabul after suicide bombers and gunmen stormed into the building. so far at least two people believed to be westerners are dead. fox news can confirm that the insurgents have control of the guest house and they're still inside that building. the building is near the parliament inside the afghan capital. this is the latest in the series of a deadly assaults targeting the diplomatic district there as the coalition mission in afghanistan approaches its end on december 31st. a surprising ruling out of egypt. more than three years after that country's revolution. an egyptian court has dismissed murder charges against its former president, hosni mubarak.
12:04 pm
the 86-year-old former president was charged in connection with hundreds of deaths during the 2011 uprising that ended his nearly three decade rule and now many think the decision shows that corruption and mubarak's influence has not changed much since. now we have more from john huddy. >> reporter: heather, hi. there's been both celebration and anger about this ruling. you know, the judge dismissed the charges saying that they're quote/unquote politically motivated and that there were technicalities involved. that's why he dismissed it. and of course the courtroom as we showed you earlier burst into both cheers and applause when the charges were dropped. mubarak as we know was accused of ordering the death of hundreds of protesters during the 2011 arab spring uprising that ended his nearly three
12:05 pm
decade reign. nearly 900 protesters were killed during the 18 days of demonstrations and after the ruling today mubarak said quote/unquote i did nothing wrong. now outside the courtroom mubarak supporters celebrated the judge's decision. but others, detractors including relatives of those killed by security forces held pictures of their loved ones and screamed that mubarak should be executed. the ruling as we have reported comes just a day after deadly protests and demonstrations against current egyptian president, a political ally i should add of mubarak. but the 86-year-old mubarak will not walk free just yet. he's still serving a three-year sentence for embezzlement. heather, back to you. >> 86 years and in three years he'll be 89. thank you so much, john. brand new details in the

12:07 pm
$6 billion tradition. now here at annie's blue ribbon general store in brooklyn, new york, they really enjoy small business saturday because it gives them a jump start that some of the larger chains have been enjoying for decades. store owner ann told me she loves country general stores growing up and she was inspired to open her own in 2007 around the start of the recession. now, a quarter of the things she sells are made locally. half the things are made by independent makers. trinkets and household items like stocking stuffers and children's toys and fun custom clocks. >> it's really a movement to after, you know, going to the big box stores and to shop your local independent stores. you know, if we don't do that and don't support the local independent stores then we're going to look like every town is going to look like one another. instead of having the unique, individual element.
12:08 pm
>> yeah. who wants that. nearly 94% of u.s. consumers says it makes them feel good to shop at small businesses. shoppers know the store owners and bottom line, it is all about the products. we have been showing you products all day. you can't get some of these products in these big chains. this right here is a unique clock that's actually made in massachusetts. it's -- you know, a children's clock, hand made. one of the many great products that they offer here at the store. bottom line is about 70% of the money that you spend at a local business goes back into the community much more than about the 40% that you spend at local -- at big chains. go to your local stores today, that's the message. >> i think i hear some bee gees in the background there. is that what they're playing? >> they are. great music too. >> no excuse not to get him a christmas present this year, he

leland? it has started, the clock is ticking on the 2016 race for the white house and texas governor rick perry is already taking steps to bulk up his national credibility by hosting a series of meetings with experts as well as donors. but how early is too early to crank up the old campaign bus? john fund is a columnist with "the national review" magazine. obviously, rick perry didn't do so well in 2012. you called it a belly flop that happened. is this a smart strategy to all of a sudden bring the campaign rhetoric up so quick, so hot, so early? >> well, there are second acts in american politics. ronald reagan lost the presidency twice before he was lexed. -- elected. i think rick perry is doing a smart thing, he's bringing experts and donors and activists to texas before he leaves office. almost half the private sector jobs in america have come out of

base available to him. he has national name recognition that works both ways and he has a great record as governor of california. but he's rusty. the last time he ran for office was 2002. so if he runs he has to show his campaign skills are honed and ready. >> and he's not -- he does not exactly love campaigns as a candidate. how much does this come down to money? we have a large field, is it the money that makes the candidate or will the right candidate find the money? >> the primaries calendar is compressed this next time. there are fewer debates, fewer free chances to get media. i think you have to have table stakes. if you can't raise $50 million it will be really tough. there are surprises in american life, but if you don't have a real fund-raising base, it will be tough. >> and we will see what happens. especially when you talk about the tier two candidates, people like marco rubio, scott walker. $50 million is a lot of money. >> they have been able to show they can raise it. scott walker and rick perry have been fund-raising machines in

12:29 pm
this process? >> well, we are learning that the president was working very closely with the homeland department secretary johnson to make sure that every ounce of executive power was exerted. johnson wrote up the orders on the work computer at dhs and remember it was dhs that dealt with the housing and taking care of all those unaccompanied minors who snuck in from central america. johnson met this summer with president obama at the white house five times according to a "new york times" report. johnson also told the president at some point that he couldn't stop deportations for 7 million illegal immigrants the same way that the comprehensive senate bill would have, but he could protect 5 million. "the new york times" report details a few moments that changed the president's calculus from wanting to wait around for congress to pass legislation to just going around the entire legislative branch.
12:30 pm
one moment was a tense exchange with activists in the roosevelt room back in march. they were upset with the rapid rate of deportations. another moment came during an event honoring pga golfers at the white house shortly after eric cantor, then house majority leader lost his electioned by -- re-election bid. that's when speaker boehner said there was no chance that the house would ever pass immigration reform legislation. >> peter, as we heard from the white house pool, the president left the white house there, went out to a bookstore today for the -- a little christmas shopping and inside he was heckled evidently. >> yeah, for small business saturday, the president took his daughters to a bookstore here in d.c. and someone shouted out, i hope you can close guantanamo. he jokingly asked everyone else in the shop if they had concerns they wanted him to address. he noticed a new chuck todd book

indefinite suspension. this coming after months of fallout over a controversial video where rice was seen hitting his then-fiancee in an elevator. after weeks of appeals and arbitration, rice is free to sign with another team. now we're learning it's because the acting judge didn't buy the lead commissioner's claim that the events in the elevator seemed ambiguous. that was a quote. the real question though, why was it overturned and who really messed up? joining us to discuss it is defense attorney and a criminal defense attorney, former prosecutor and trial attorney. thank you for joining us. >> hi, heather. >> so this federal judge, barbara jones said amongst other things the only thing this was was an abuse of discretion is because goodell failed miserably. so the abuse of discretion i want to talk about that first of
12:33 pm
all. david, explain what that is. >> well, in the initial hearing of course ray rice testified he says that's factually what happened. if you recall, they had the video from outside the elevator when ray rice was simply dragging his wife around. well, what happened was later on we find out -- there's more video because tmz made one phone call and got the video inside the elevator. the infamous video where he actually knocked his wife out with a left hook. well, roger goodell said you know something, ray rice didn't testify as to what happened in that initial hearing. so instead of the two-game suspension, we're going to give him an indefinite suspension because this video is so horrible we can't let it go with two games and the judge said you know what, i reviewed the transcript of the hearing he said he hit his wife and knocked her out. so you had what you needed in the hearing so increasing the penalty after in which there was no new evidence was simply an abuse of discretion.
12:34 pm
and the sentence was changed. >> abuse of discretion on the part of the nfl, but not talking about abuse or domestic violence. and let's take a look at this full screen from his now wife janay rice. she says the video didn't make me rethink our relationship, but i did want more of an explanation from him. i asked him why he left me on the floor like that, i asked him how he felt when he saw i was unconscious. he said he was in shock. i asked him what happened when he got out of the elevator. he said he was terrified because security was there. i asked him how he felt seeing me like that. he said he was thinking, what did i just do? i didn't watch the video again. so david, your response to that, and how the judge is able to split these two issues? >> well, i'll defer to my co-counsel here?
12:35 pm
>> yes. i'm dealing with two davids here. >> what happens is the judge splits the decision very easily. one is an issue with domestic violence. and i thought something that was very, very interesting in what the judge had written in the opinion specifically that it was clear that the league was not taking seriously the issue with domestic violence. that is a wholly and completely separate and different thing than what david just originally stated. we have rules of law, we have standards, we have hearings and we make decisions based on the facts of laws. just because as the commissioner noted that people in the court of public opinion were disappointed about that decision does not from a legal standpoint bring us to the place where we reconsider the decision. that would be an anathema to what we'd consider as far as due process is concerned. two separate things are going on here. the judge is saying you should take domestic violence more seriously and i think the commissioner was between a rock and a hard place here. he was trying to address this more seriously and he did a very
12:36 pm
good job of doing that, but when the public outcry was there. he's concerned of the well-being of the nfl and made a decision at that point that he immediated to go back at roar -- he needed ke was ack at ray rice. made. >> i want to get both of your responses to this though. what about the outcry from the public and has this become something that's being led by that, these decisions that are being made? david? >> well, both roger goodell and ray rice are frankly in a world of hurt. roger goodell because he's lost all credibility because it comes off as though he's done this in a way to save his rear end as a sort of pr move. the second sentence of the basically indefinite suspension and now ray rice, now he's free to sign with a new team. but the reality is from a public relations standpoint, any team that signs him at least this year would be doing themselves a tremendous disservice. i can't even imagine without a long-term domestic violence
12:37 pm
counseling class and a favorable report from the psychologist, psychiatrist he'd be accepted back into the nfl. but look to next year he'll probably be signed by a new team. >> yes, in addition to what david said, because i agree with completely, like in every other area of the law, we have codified policies about domestic violence. treatment. and attempts to be able to determine what the punishments will be. but we need to do something else that's different here. and in our society, we are getting more and more to the point where the rule of law is being abandoned for the rule of public opinion. i find this to be very dangerous in this case and many other cases and i would just ask as a former prosecutor, a person who's in court trying cases all the time, can we at least start getting recordings of the things so we don't have to go into the he said, she said, what was testified to or not testified to? i don't understand what the ambivalence about having a full and complete record and set of facts so we can judge the things appropriately. >> very, very good point.
12:38 pm
>> televised. >> david wall and robert bianchi, thank you. >> thank you, heather. it is happening with two years left in the obama administration, more cabinet members are seeking distance from the president. as secretary of defense chuck hagel leaves his office at the pentagon. how could it affect the president's foreign policy going forward? could protect you from cancer? what if one push up could prevent heart disease? one. wishful thinking, right? but there is one step you can take to help prevent another serious disease- pneumococcal pneumonia. one dose of the prevnar 13 ® vaccine can help protect you ... from pneumococcal pneumonia, an illness that can cause coughing, chest pain, difficulty breathing, and may even put you in the hospital. prevnar 13 is used in adults 50 and older to help prevent infections from 13 strains of the bacteria that cause pneumococcal pneumonia. you should not receive prevnar 13 if you've had a severe allergic reaction to the vaccine or its ingredients. if you have a weakened immune system, you may have a lower response to the vaccine.

lot of controversy over that. panetta, you had gates' books and mrs. clinton's comments about don't do stupid stuff is this normal second term sniping inside the administration or is this indicative of some kind of larger failure? >> well, i think you hit it on the head there certainly a lot of -- you know, problems in the second term. people begin to be bored. i think appointees are upset that they haven't had more power. so a lot of this is very typical. but what's not typical, leland, what we have seen from the inner circle of president obama is a very tight, political group that is still intact. you see valerie jarrett, ben rhodes, others -- i would put susan rice in there. if you remember, susan rice was the 2008 obama campaign foreign policy spokeswoman. she was speaking on the campaign and knifing hillary clinton all

12:45 pm
outside of the box and picks somebody who has enough standing to take on the political team as you said, or does he stay inside the box and what are the pit falls if you will of doing that? >> you know, actually, i don't think it matters. unless he changes the inside political team which is really too insular and keeping out the debate. i mean, what the theme of all of these outsiders -- by the way, were people who very much supported barack obama, these people are saying, we can't get to him to offer differing advice. he doesn't want to hear differing advice or he's hiring people who don't want to give the president differing advice. that's a problem. so whoever the white house -- whether it's valerie jarrett or joe biden or barack obama himself, whoever decides who the next secretary of defense is i don't think it matters unless you shake up the political team inside the white house. you cannot have a team that is
12:46 pm
that insular. you know, the national security adviser's role is to settle differences between pentagon and the state department. right now, we have the white house and national security agencies at odds. it's not even an interagency fight, but the white house and all the others. >> when you have the white house versus everybody else, obviously the white house wins that fight. but you have so much sniping, so much politicking that goes on between these agencies. what does that mean frankly for what's important? which is the national security of the united states? >> well, let me tell you, i spent eight years at the state department and i spoke over the last couple of days with a senior state department career foreign service officer who told me unequivocally that the state department is a mess, our form policy is a mess. everyone is realizing that. we are at a critical juncture. you look at this pivot to asia which turned out to be nothing because it was a political
