tax dollars helped build has been payi ining tens thousands troops who deserted or simply don't exist. that's according to the iraq prime minister who reports he's cracking down on the corruption. he said the military paid salaries to about 50,000 troops who were not reporting for duty. the money likely going to corrupt officers. the news comes as iraq's military struggles to fight off islamic state terrorists who have taken control of enormous sections of the country and neighboring syria. as the him assistants seize city after city many commanders demeanored. soldiers stripped off their uniforms and ran and many cases left their american weapons in the hands of the islamic state. iraq's prime minister forced out two dozen government officials. the shake up meant to revamp iraq security forces that try to hold back isis. the challenge made even more clear today in a deadly attack on iraq's northern border. officials say at least 15 iraqi troops died when islamic state

fighters assaulted a border check point. fox top story and jennifer griffin is live for us. what more to we know on the attack? >> the pentagon said the situation along the border between iraq and syria remains fluid. there are not a lot of details emerging about the isis strike that killed 15 iraqi police on the border with anbar province in the west. at least five iraqi police were woundened. the u.s. carried out 11,000 air strikes against iraq and syria in the past four months since the u.s. began targeting isis from the air. a pilot crashed and died shortly after takeoff as part of the air campaign against isis. the pentagon is not releasing the pilot's name and investigating the cause of the crash, which early reports suggest was mechanical. >> there have been talks with the kurds for awhile actually with turkey about using their

air bases. i wonder what the progress on the talks is. >> there is no deal, according to u.s. officials as of yet. these officials addressed reports of a possible deal that appeared in the wall street journal this morning. the white house pushed back on reports that the u.s. was considering setting up a no-fly zone in syria. >> we do not believe that a specific no-fly zone proposal, at this point, would best serve the interest that we've identified in terms of trying to resolve the situation in syria. >> the turkish president meet with vladmir pew contain week after meeting with vice president joe biden. he criticized the u.s. strategy to sbat isis. said the west doesn't like muslims adding he was tired of criticism from 12,000 kilometers away, quote, believe me they don't like us. they look like friends but they want us our dead.

in which assad remains in power in syria and then you have a lot of syrian population flooding into turkey. they end up with immigration crisis. that's why they want the know fly zone. they want us to end up in a battle where the u.s. has to take on assad. they're trying to set up the dominos so we get roped in and have to go toe to toe. i understand it from their perspective on the one limited aspect. the flip side everybody agrees that isis is bad and too extreme. even if they're sunni brother with the president in turkey, isis has to go down. and the fact they're a nato ally and not allowing us to use the bases to make it a safer, better more efficient operation is disgusting. >> the iraqi government has taken a lot of heat for the way it handled things. we have a relatively new government there. 50,000 ghost troops. we stopped paying them now and trying to show they're pointing out corruption. i wonder how much is -- your reporting is real.

>> yeah. it's rampant. it's absolutely ridiculous. the amount of corruption. every dollar that flows over there estimates 30 to 40 cents is somehow lining the pockets of various people. everything from defense contract ripoffs to military people showing up and saying, you know, they have more soldiers under their command than they're providing. that's why you see the military eroding. the corruption is endemmic in that part of the world. fortunately the u.s. government seems to have figure it out we're focussing on mauler fighting units and direct training of smaller groups. you end up up with people lying. when they lie at the different levels it ends up being significant numbers of folks as you're reporting here 50,000 maybe more that are getting paid but don't exist. >> it doesn't sound like the group you can bring together to fight off a well committed and certainly -- women -- well, on the move like isis. >> that's right.

it's similar to the stuff we face in afghanistan. the enemy is focussed on their activity, which is to gain ground and every day they hold it it's going to harder to dislodge them. we're busily trying to build up the countries. their militaries while most of the locals are trying to basically war profiteering. they're trying to get the money so they have some means in case things go sideways for them in the future. where as the enemies are grabbing territory and starting to take over sections of the country. >> mike barrett from washington, good to see you. egyptian militants linked to the islamic state claim they killed an american oil worker. they posted pictures of the victim's passport and identification cards on twitter. the worker was 58 years old a named william henderson from texas. the group calls itself the sinai province. last month it pledged allegiance to the islamic state. breaking now we've been watching this in new york city. hundreds of demonstrators marching in midtown manhattan.

these live pictures coming to us from times square in the cross roads of the world. they're protesting the grand jury decision not indict the white offer who shot and killed the unarmed michael brown 18-year-old who was black in missouri. the demonstrators are yelling a chant comparing the nypd with the ku klux klan. they appear to be marching peacefully. there's a similar case in new york city a case where a young person was put in a choke hold and eventually died and new yorkers have put the two together and the demonstrations have been large and loud. earlier today on 14th street, which is the lower end of manhattan and crosses over union square traffic was brought to a complete stop for more than an hour. now they made their way to times square what proved to be a familiar rate -- -- we'll go

speech? the court is hearing the case on a man who went to prison because of posts he wrote on facebook after his wife left him and took their two children. prosecutor say the manmade threats about smothering his wife and dumping her body in a creek. and in another post, the man wrote this. he said he had enough explosive to take care of the state police and the sheriff's department. that post reportedly came after his wife sfiel filed for protection from abuse. in defense he calls himself an aspiring rapper. he claimed they were not threats at all but song lyrics. his attorneys argue he has a first amendment right to make the statements and he wants the court to overturn the conviction. shannon, how do the justice seem to respond to the arguments today? >> well, they heard the posts you referenced and many more including shooting up classes of kirnd gardener and slitting the throat of an fbi agent and everybody seemed to agree that the language was offensive.

it was criminal? we heard from justice alito saying he's an aspiring rap artist. haven't you created a road map for somebody who wants to terrorize a spouse or ex-spouse and say it's a expression of artistic vision. this court has been protective of the first amendment. a couple of years ago they gave the west borrow baptist church the right to continue what they're doing. today justice sotomayor said we're creating exceptions to the first amendment they're struggling with that. >> as is often the case of free speech decision. this brought together a interesting group of people. >> it has. they see it as such an important issue. on the one hand we have the american civil liberties union. here is what they argued in their brief they filed.

breaking news into us cops in west virginia are hunting for a man accused of killing four people in a string of shootings today. here is the suspect jodi hunt is his name. aside from that, the police haven't given us any information about him. the shootings happened about three hours north of charleston west virginia and a local media report that the schools are in lock down across. we'll bring you updates as we get them. also, in west virginia a television report eer was coverg a shooting when somebody shot at

. live pictures coming into us again from new york city where the number of protesters is growing. it's my understanding they're now in multiple areas of the city. lots of people have walked from what amounts to 14th street to times square. along seventh avenue they have walked from fifth avenue and 14th street. they have come a long way. now we have cameras on the ground. many with the hands up don't shoot symbolism we've been seeing over the days. we have live pictures coming to us from los angeles. the demonstration -- l.a. is now flying away. i didn't have any way to know that. i couldn't see that. anyway, it's about more than ferguson, obviously. and a lot more than ferguson. and demonstrators, again, now live in new york city with signs up and hands in the air and continuing coverage throughout

the afternoon. president obama holding a series of high profile meetings at the wours centered around the violent protests in ferguson, missouri that lead to this and the demonstrations across the nation. the white house said the president is sitting down with lawmakers and law enforcement officials plus other community leaders to try to talk over new ways to strengthen neighborhoods. earlier today the president met with young civil rights leaders to discuss what the white house calls mistrust between police and minorities. another meeting focus order the administration's federal programs that provide military style equipment to the police. the white house said the review has shown, in many cases, the programs are useful and help protect communities. >> what is needed, however, is much greater consistency in oversight of these programs. primarily in how the programs are structured, how they're implemented, and how the programs themselves are automated. >> a report shows the president proposed spending more than $260

million on body cameras for law enforcement. protesters in d.c. blocked traffic. nothing like the rioting and looting that we saw last week when the grand jury made the decision not to indict officer darren wellson for -- wilson for killing unarmed 18-year-old michael brown. officer wilson resigned on saturday citing threats against the police department. he said staying on the job could put other officers at risk. in addition he'll leave the job and do so without benefits or any severance pay. he said he shot and killed michael brown in self-defense. we are live in ferguson, missouri. what is the latest on those burned and looted businesses there? >> shepard, we're seeing a range of different businesses behind . the windows were smashed in. it's boarded up but open for by. you see a laundry mat closed up.

people will shop online today. more people are shopping online on black friday and thanksgiving now so they don't need an extra cyber holiday. the analysts say black friday could soon become the biggest online shopping day of the year. gerry willis is here. 5:00 eastern time on our sister network. i keep reading that sales they were down from last year. >> black friday sales were down. that's the four days around thanksgiving. thursday through sunday. now down 11%. retailers pushing back from the national retail federation. they're extrap lated. they don't have the exact sales total. cyber is monday is something different. that's today. you shop online maybe at work. what we saw from midnight to 10:00 a.m. our numbers are coming from adobe. these are real-time numbers. the numbers up 17%. keep in mind they're from a lower base, much smaller black

gerri willis, we'll see you in hour and a half now. the u.s. supreme court is us hearing a case this week that could affect workers. the court is set to consider whether companies have to make special accommodation for pregnant women. if those companies also make accommodations for other employees who have issues that prevent them from working. exactly like they did before. for instance this woman in virginia was pregnant with the daughter she's holding here in the picture. while working as a part-time driver for ups. her doctor wrote a note saying she could not lift heavier than 120 pounds. she claims coworkers could have handled the packages but her bosses told her she could not continue working in her current job. she lost her pay and she lost her benefits until she gave birth and returned to work. the spokeswoman said ups did not

intentionally discriminate against the woman. they offered temporary light duty assignments but not pregnant employees. ups changed the policy. on wednesday supreme court justices are scheduled to hear arguments to determine whether the old policy was constitutional. what they decide could affect millions of other workers that companies with similar policies. dianna, were pregnant women singled out was it unconstitutional? >> i think the important issue here is whether or not the law protects employees that are pregnant as far as the way it works with the law protects only discrimination against pregnant employees. so what that means if there's a policy in place, and it is applied to pregnant employees and nonpregnant employees in the same way, then that is fine under the constitution. here the situation was that ups did allow for some employees to be placed on slight duty the

distinction they made was the employee had to be injured on duty and obviously pregnancy is not a condition created on duty. >> not always. >> that's why the high court and appellate court. that's why the trial court and appellate court held it was nondiscriminate story and it's up to the supreme court to decide whether they were correct. >> ups changed the policy. i wonder if that's indicative of anything. >> if anything, it's indicative of the way it should be. pregnant employees should be accommodated. for public policy reasons, obviously, we want pregnant women to feel like they can continue working for they're physically able to do so. there are plenty of opportunities to have light duty within ups like the kind of jobs that are being offered to employees injured on duty. >> is there a danger in your mind that if you say to these companies you have to do right by the pregnant women that in the end companies might start not hiring people of that age

and ones who might become pregnant because it costs so much more money. >> that would be unlawful, obviously that would be a form of discrimination. gender zrimgts. they could be sued. there's that few if you place certain restrictions on companies they'll react in a way that is unfavorable to the person you're trying to protect happened back in 2006. it's my understanding this woman's case she tried to get pregnant twice. she was in the middle of in-vitro her doctors were concerned that this pregnancy wouldn't work out. if she did too much too late in her pregnancy. she and her lawyers seemed like a normal accommodation to ask for. a kind of thing that mom and pop business has been having to deal with forever. >> that's exactly right. there is nothing unusual about her request. there's nothing overreaching about the kind of work she was asked to do as far as, you know,
