there you go. >> just leave me out. >> me, too. here we go. capitol hill showdown. man said to be the architect of the president's executive action on immigration, homeland security chief jay johnson, on the hot seat. in the first big public clash between the white house and republicans over the president's plan to shield millions of illegal immigrants from deportation. earlier the chair of the house homeland security committee asking this question. watch. >> the president said over 20 times that he did not have the legal authority to do this, to take this executive action and that this is not how democracy works. do you agree with that prior statement? >> chairman, i know from 30 years as a lawyer that when someone para phrases remarks from somebody, i want to see the fum -- full q & a to know exactly what they said. >> as the republicans vow to

stop the president, they're noting to use any funding to pass the bill. scenario g.o.p. leaders like senator mccain say they want to avoid it. >> we need to rifle shot the programs to keep from a government shutdown. as far as the other aspect of it, you know, we shouldn't shut down the government but at the same time, there are certain things we just shouldn't compromise on, either. so it's very tough decisions that are going to be made in the next few days. >> he said we need to rifle shot these programs, kennedy. >> as long as they're not rifle shooting with dick cheney. >> look at you. >> you have to take it incrementally and you can't make the big, sweeping measures and i think there needs to be congressional input and we have to be careful because republicans will sound a little hypocritical when there's a

republican president and they're in love once again with executive action. but there definitely has to be more of a rounded, wholesome debate on immigration because there are so many elements to work out and one sweeping piece isn't going to do it. >> i was watching part of the hearing today. in two years, they can just undo this, i guess, if they want to with congress. the president's bill really with only his executive action would last two years. what are your thoughts on that? >> how can you undo it? and i think everybody knows what president obama is doing is wrong. he knows it. he said it. he only said it about 14 times. >> 26. >> i don't want to hear the whole context of what he said. >> a lot on tape, by the way. >> he knows it's wrong. democrats know it's wrong but they think it's going to benefit them. republicans know it's wrong but they are afraid. they're running scared on immigration so what are you going to do? they think that they're going to lose hispanic votes. they're hiding.

>> what is to politically scaring about immigration? >> shutting down the government, we've performed at this rodeo before, haven't we? we know how it turns out. the reason president obama and the democrats want to fight about this is because they know that it's a fight they will win. and so that is why you hear charles and others saying that's not the way to go. i'm in agreement with him. i don't think this is the way to go because president obama knows he'll have the media in his corner and he can present republicans as being anti-latino, anti-family. that is exactly what he wants. so republicans need to start passing wildly popular bills that have over 70% of support like a border security bill. they need to keep forcing democrats to vote on that and keep forcing president obama. >> isn't that the problem? i was going to refer to you, andrea, on this. we're looking at choices to try to prevent this from going through but why aren't we

hearing a plan right now moving forward? >> there's four plans in the house republicans have put plans forward. they couldn't get it through harry reid's senate. now they have the opportunity. they're going to have a republican senate when they come back. >> is that the on agenda? >> the problem is the party is so deeply divided. >> i want to talk about that a little bit. >> the republican party didn't have a unified strategy what to do except close the borders. >> let's watch this and then i want to get more thoughts on it. let's watch. >> the republicans are finally ahead of democrats in the poll about who do you favor. this would be the worst time to blow it. i understand the pent up ang he were and the rage over the president's unconstitutional action but the key to that is see a psychiatrist. not to vote in the congress and shut down the government. >> as normal charles does not mince words. what do you think about the republicans and the split that democrats love to describe

that's happening in the party. how real is that? >> i think it's very real. i don't think everyone has to disagree and i think that's where the democratic party short changes themselves when they think they have to be in lock stop and that's also why they have a shallow bench. the fact there is an ideological -- you know, call it infighting, disagreement. people coming to terms with their own belief, evolving on things like immigration. i think it's going to be better for the country if you have that kind of robust debate. i don't see that as being problematic but it is true. >> the one thing that i don't hear it called most often and watching the hearing this morning, like sandra was saying, you didn't hear anybody say as i'm asking this question, let me put forth my own plan. what about anti-productive? that's sometimes what division is. >> what are they supposed to do? they have -- republicans are not going to -- they're not going to be able to get all republicans on board to pass.

they're divided down the middle, aren't they? >> down the middle, is it fair? can't they come in agreement on something? >> it's a little more conservative than moderate, i would say, but the one thing they can come together on is border security. it needs to be a clean bill. not some giant monstrosity. i want to kick it over to andrea. jeff sessions was weighing in and they said they need a humble and honest populism and he brought up all the jobs taken. he said we need a preference for a smaller pool of labor in order to drive up wages for workers and wheat people off welfare, unemployment and good paying jobs. i think it's a winning message and right now, with the way the economy is going, i think it's probably the best one they have in front of them. >> i'm looking at words from jay johnson saying that the reality is undocumented immigrants have been raising american families and developing ties to the community so they're getting the

metsage across. isn't that the point? republicans are not getting their messages across, andrea. we're facing an economic situation where this is a tough pill to swallow right now. still their message is winning. >> just very quickly, it's a tough message for republicans because it can be a losing message. at least that's how it's perceived and that's the problem. are you racist? you know, do you want economic gret in this country? and i think there's a way that if you're talking about conservative republicans, you can appeal to socially conservative hispanics if you're going to lump people into groups, which i don't necessarily like doing. everyone loves economic gret and, you know, i think a lot of republicans need to sit down and see that immigration on net creates jobs. >> another part of this, though, that jay johnson, the secretary was talking about this morning that i thought was interesting, because he almost got out in front of republicans on this issue and that was for security. he wants people to come out of

shadows and go into the background check mode. what are your thoughts? >> that's a good argument on their side. >> they've had that choice all along and haven't done it. >> the populous message isn't a good one for republicans because they're divided down the middle of that. the business end of the republican party -- >> how are they divided in the middle? everyone is for jobs for american workers and do you know the brilliance? it's a wedge issue for democrats. blue collared democrats, that's the way to split them in the middle. that's where you peel off democrats and get the independents the way that reagan did. it's the smartest thing they could do to be for legal immigration and be for a robust guest worker program and not painted out as uniphobic. >> the president has obviously taken out the magic executive pen. is there anything that would pass both these parties? >> i think you could. i honestly think people are at a point where they're so over the conflict, they don't want

>> welcome back to "outnumbered." america's national debt passing a new milestone. now over $18 trillion. topping that mark for the first time ever. that's a nearly -- that's 70% increase since president obama took office in 2009 when the national debt was just over $10 trillion. republicans have already said debt reduction is critical and as you know, the g.o.p. will be in control of congress in the new year. andrea, what will they do? >> well, they need to start with -- >> they need more money. sorry. >> that's a very good point. you can't just hammer democrats on spending. republicans spend a lot. they just don't spend as much as democrats. >> it's government. >> it is and it's very seductive to hand out lots of free goodies. >> i like that word. >> and people that will vote for you, like people with medicare and social security.

>> entitlements are breaking the bank. there's some interesting proposals. the president hasn't touched it but it was a bipartisan plan that would be an mrent starting point. they could dust it off. it already has some support in both chambers. it has to be entitlements. >> they came with all the financial ideas and everybody is like, wow. these guys are brilliant and the president had none of it. >> he burned it in the fireplace or used it as toilet paper. >> we don't know that for sure. >> isn't this the opportunity republicans should seize on where we don't want to hear, my gosh, you know, debt is up 70% under obama and just complain about it. this is an opportunity to say, this is how we're going to address the problem. >> he doubled the deblt. obama will do the same exact thing. obama in 2008 ran as a guy who said that much debt was un-american. so what is he now, like a card

tax a lot and really drain a lot from our entitlement programs. president obama said initially we're not going to let them collect obamacare, collect benefits, collect entitlements. now he's back pel pedalling. >> there were report the president changed a number of bills like upwards of 300. not bills but -- >> regulations? >> regulations within obamacare and we don't know how much of that is going to cost money. >> house speaker john boehner and mitch mc connell said this will be a top priority in the new year. >> president said last year was the year of action. tough to see. >> it's tough to take goody as way from people. >> on the money front, could we see big changes to overtime pay in america? president reportedly will announce new rules next year that would force employers to pay workers more overtime by limiting which ones can be called managers.

the new rules would also increase the $23,000 minimum amount a worker must earn before their employer can exempt them from federal overtime rules. one group close to the white house calling for a $50,000 minimum. i'm going to go to sandra first on this. this break it down, the president butting his nose into what business owners should be doing. this sounds completely disastrous. >> the first thing you're going to hear me say is i'm also in defense of business in this country. small business, big business. we need our businesses to grow. that's how we create jobs. government does not create jobs. businesses create jobs. when they're growing, they're hiring. anything that we do that is anti-business or business unfriendly in this country, it halts the jobs progress in the united states. i just don't understand this rhetoric, andrea. i don't. and the president says that he's sitting down and meeting with c.e.o.'s which he does.

i don't understand how he did not get the message this prevents them from growing. it prevents our economy from growing. if you can't tell it frustrates me a bit. but this has proven to be a very business unfriendly administration when it comes to taxes and regulations and rules and the level of uncertainty that businesses face. >> and harris, this is only going to slow that down as sandra points out and make it harder for business owners to do business. >> the one thing that concerns me is the quality of life for the individual. now we have a huge percentage of people who got back to work since the great recession, having to work two and three part time jobs to just get back to where they were financially and that's exhausting and puts a lot of pressure on families. what this does is potentially sets up a situation for wes owners to try to get around this and having their payrolls balloon by giving more people little jobs. >> and creating more part time jobs and that puts people in more and more positions of just pressure at home. >> can i say one thing about this? it just shows how insensitive

this administration is. they have no idea how particusm businesses are run. talk to people who have 20, 30 employees or less. are they going to pay people $50,000 a year, every single person? labor is -- >> they don't care. >> the economy is growing. >> but they're going to give exemptions. it goes hand in hand and they will give exemptions to the largest corporations. >> a lot of business owners say we spend so much time trying to comply with regulations and make sure we're in compliance with all these new rules, it's -- they have so little time to spend on actually running their business. >> once we're arguing about how high should, you know, when should overtime kick in, once we're arguing that, democrats have won that issue. instead of arguing it, how do you argue that the government has no place? >> for example, my husband has a snow board company.

if he has to pay all employees $50,000 a year, what's going to happen to his board prices? he has a factory in the united states. you know, he's going to have to charge $700, $800, $900 for a snow board but someone who is a mass manufacturer will charge $400 because they get them made in china where labor is cheaper. that hurts middle class and lower class people. >> can a politician articulate that? >> yes. that's the populous message. >> they can drive down the hours -- >> drive prices up. >> it takes them out of that category of a managerial position which is what the president is trying to do. it creates more part time jobs. >> which means more people are forced to shop at places like wal-mart which liberals -- >> we have to go to break. today the captain of the costa

media. he committed a crime. when it happened, people were calling it an incident. >> he was never charged with it. >> there was an adjudication. he was arrested for it and he went to trial and there was a sentence so i said at the time, and i said it on "outnumbered and" and people were tweeting me about this. i said he and his wife were going to get past this. i said if his wife supports him, he's going to get through this and people said you're crazy. it's over for him. i don't think the nfl should have been involved with punishing him. i don't trust the nfl or organizations to give out punishment so i said let the criminal justice system handle it. they handled it. as far as i'm concerned, it's over. i don't need these a popology tours. >> and the question is whether or not the fans should get over this. should a team take him on board, andrea? i will just give you my point of view, that i believe that nfl fans are so dedicated, they love

their sport, they love their tv, they love their sunday football and they don't want to hear about it. while they might be fully against it, they don't want to hear about it and they'll applaud him out on the field again. >> i think you're right. we talked about this before. they're very, very forgiving. we're a forgiving nation and they love their football. he'll probably be able to move forward. if i were a team owner personally, i would not have ray rice playing for me. he should be in jail. what he did was a crime and we had a failure in our court. that was a weak prosecutor that didn't throw the book at him when he should. i'm shocked if a coach would take him on but i agree. if a coach decides to, the fans are very, very forgiving. in that interview when he was asked specifically if they had been violent before, he didn't answer that question directly which told me everything that i needed to know. >> she did. she answered the question and said no. her mother answered the question which i thought was interesting. but he didn't.

their hands against pregame festivities. war of words begins with an email from the county police chief to his staff saying the rams chief operating officer called to apologize to our department but he begged to differ saying, quote, in those conversations expressed, i regret that players' actions were construed negative the against law enforce mth. at no time in any of the conversation with i apologize for the actions of our players. rams do believe it is possible to support both our players' first amendment rights and the efforts of local law enforcement to make this a better community. but the last word for now appears to be from the police who tweeted the definition of apology and what the rams' official said. kennedy, on this one, you saw the footage of the players coming out. police asked for an apology. should they have come out with their arms up? >> i think that it's such a

tense situation in missouri right now, in the st. louis area, and they were -- you know, i think it's a form of pandering. i don't think they need to be disciplined for it. there's an ongoing conversation and a lot of protests about this case and, you know, people and communities that feel that they are unfairly targeted by law enforcement, it's not a settled issue. it's ridiculous because the grand jury testimony and all the evidence that we've seen shows that the phrase hands up, don't shoot doesn't apply to the ferguson case. >> it was a manufactured narrative by other news networks and such but should the players have apologized for what they did or should the rams? >> there's a place and time for everything. if it was rams management that were to apologize to police, fine. if police misunderstood or whatever the case may be is a sign of times for this topic. you're right. it's just a sticky topic. why not, and i challenge the

players and lawmakers or anybody else who are going to put their hands in the air over ferguson, why want change the conversation? how about sign languaging a j for jobs for ferguson? >> you mentioned lawmakers. a couple yesterday taking to the house floor with their hands up as well. helpful? or not? >> well, it just shows you can't police a gesture. so yes, the football players should be able to make a gesture and they should not have to apologize for it because that's what they think. so what you do is if you're a police officer or a police officer's representative, you say, well, it doesn't apply in this case. okay? so yeah. people can do whatever they want and a lot of people, a lot of my friends are the hands up crowd but people on the other side of the issue should say, well, the police -- >> what is the hands up crowd? what is that? because if that is if you don't hold your hands up that you don't love the people of

>> hey there. welcome back to "outnumbered." atheists are out with a new campaign in a handful of southern towns taking direct aims at christmas and faith. billboards mounted near churches by american atheists mocking a little girl's letter to santa that reads, dear santa, i'll i want for christmas is to skip church. i'm too old for fairytales. group claims the billboard targets closet atheists who are pressured to observe religious traditions. i think the atheists should just say, we're competing religion so what we're trying to do is get some of your followers and bring them over to our religious camp. i've always maintained and i honestly have a lot of friends who are atheists that atheism is in itself a religion and they're very dishonest about that. >> absolutely. they need to build a church and give away free coffee afterwards. >> the atheists need to build a church? >> they have to get the free coffee. that's what people go to

"happening now." >> thank you. >> thanks. >> all right. i may be outnumbered but now it's my turn with this masculine story. more than half of women won't let their partners see them without makeup until they've been dating for at least a year. that's according to a survey of women between the ages of 18 and 30. 54% saying they wouldn't let their significant other see them without cosmetics. 51% of the same women surveyed say they would bare their bodies after six months. wow. that's -- that is surprising. >> okay. so they're not going to the beach or the swimming pool or just coming up out of water. >> you can't do anything physical. you can't do anything outdoors, you can't do anything wet. what's the point?
