sent a signal not only for the president but everyone gathered around that he plans to be his own man, whether or not he clashes with the white house as his predecessor had. >> he sets a strong tonight. he will be the fourth that the president had under him and will that give him more leverage. >> reporter: maybe after looking around and the other potential candidates bowed out, it is clear that the president was struggling to get a new defense secretary. it will be hard to push ash carter are out when he is pledging to be his own man. and republicans like linsay graham said he has great credit essentials and they think he will be confirmed, but the republicans like buck mckeyan raising questions about the president's leadership.

as a vietnam soldier himself i think the troops liked the guy. this man is a defense intellectual and will he have the support of the soldiers and marines out in the field? >> he has the respect inside. and seen as competent and belongs as secretary of defense given that the president chose to nominate him and there is no question of can he do it. but the further we have gotten in the president's administration, we have seen tighten the noose around foreign policy and military policy and it is made outside of the state department and outside of the pentagon and with him and a few advisors in the white house. and the nomination of ash ton carter reflects the fact that what the president his people want, is somebody who

>> new information in a mysterious death. investigators are launching state and federal probe in what happened to the student in wisconsin. she was a 21-year-old and found dead inside of a dumb waiter in's restaurant on monday night. yesterday, we told you about a local paper detailing 911 calls and including one from an employee who thought her co-worker was caught in the dumb waiter. ndenver police are investigating a protest in which several officers were hit by a car. hundreds of students skipped the protest this week. they were hit and reports of students laughing and chanting

hit them again. they are following this story from the denver newsroom. >> four officers were on bikes at the time of the accident and one is in critical condition according to the last update from dpd. the nine year veteran was escorting students who staged a wake out on the busy street. witnesses say a car accelerated and went up and hit the four dpd officer and dragging them behind. denver police said the driver of the vehicle had a medical condition. some in the crowd cheered. immediately after the accident injuring four denver police officers. several parties chanted and cheered hit him again. they are reprehensible and the disturbing thick they had heard.

>> for two nights in a row, we watched protestors in new york city and in the nation on the decision of the grand jury not to indict the police officer in the death of eric garner. and how does the media coveraging compare to that of the ferguson case?

howard, how dow break this one down? >> it is a stark difference when you look at the range of people. glenn beck to al- sharpton and watching the videotape of eric garner choked to death are outraged and critizing the police and expressing increddousness that there was no indictment. and the ferguson case is very, very different. you had dispouted evidence and no question that michael brown had gone in the police car and wrestled with darren wilson. you don't have the usual racial and idea logical divisions in the media. >> howard, the folks who tend to be more liberal on other network are calling it as they see it and here at fox, we are calling it in what we view a fair fashion in terms of the comment

>> and another story we are following, that is university of virginia, they had shut down all fraternity activities and a series of accusations reported in rolling stones magazine and an article written by a woman who reported about a woman who was gang raped by seven men. we were told that rolling stones is standing by the reporter, but what raised a lot of eyebrows, that reporter didn't interview any of the men accused of rape to get their side of the story and now the lawyer of the uva fraternity is challenging the story and the rolling stones is now questioning the story itself. in the face of new information there appear to be discrepancies in jackie's account and we have

comto the conclusion that our trust in her was misplaced. wow, this is really something else. that rolling stone put out a story that they could not corob rate. it is journalism 101 that you do not do this. >> this story is falling apart at this point. i don't know what happened. when you have officials close to the fraternity saying that the fraternity party where the alleged gang rape took place didn't happen on the night it was supposed to have happen. and the accuser changing her story to the rolling stones as from 5 to 7 assailants. why did the reporter sabrina, not get or try harder to find out what the men were accusing the men on the campus.

they knew who the guys are. and we have basic details questioned and jackie's own friends not believing her account. and rolling stones brushed away the questions and what you read is not a retraction, but throwing up your hands and saying we are not sure we can believe that story and it absolutely rocked the university of virginia campus. that story happens to be on their website at this hour. how normal is that? don't you usually take that down when there are questions of this magnitude? >> i think we are seeing the final stages here, the lawyer for the fraternity who is coming out with a at the same time and i think we, the rolling stones
