7:00 p.m. eastern. if you watch live, use your dvr and follow me on twitter at the brand new handle@greta. up next, the tonight on "red eye." >> coming up on "red eye" a dude who can paint elaborate pictures with his tongue. is it super creepy or super sexy? we report. he blows your mind. plus, did the president praise tom shillue for his first little commercial work and more? >> people said tom is hollywood's every man, but tom isn't just known for his characters. he is known for his character. >> and finally, did the president immediately regret praising tom shillue for his versatile commercial work? >> that was a one-time thing. that was a fluke. >> none of these stories on "red eye" tonight.
12:01 am
>> i'm tom shillue filling in for greg gutfeld. now let's welcome our guests. if she had a nickel for every time she played quarters, she would still owe her dad money. i am here with joanne nosuchunsky. before the show, he said any snide intros and you are dead after school. so, here is tv's andy levey. you might know him from mtv's "guy code" a show about guys who code, andrew schulz. and next to me is a first time guest. he is author, journalist and the sunday times washington bureau chief. his latest book came outlast po. it is called "dead men risen" an epic story of heroism and war in afghanistan. >> a block. the lede. that's the first story. >> rome stone continues to atone. the magazine revised its apology over the uva rape story admitting that mistakes were its fault and not the woman's. the editor originally wrote of

the alleged victim, quote, our trust in her was misplaced. that line has now been removed. the mag said it should not have agreed to jackie's request no not to reach out to the alleged attackers out of sensitivity to her. jackie's roommate has come to her defense writing in the school's newspaper that she wholeheartedly believes jackie experienced a traumatizing sexual assault. finally on monday, school officials said uva won't lift its suspension for greek life activities at the request of several national fraternity and sorority organizations. toby, you are a real journalist. first time guest here. what did "rolling stone" do wrong? whose fault was it? >> it was" rolling stone"'s fault. they did everything wrong. >> give me names. >> we don't know the names. we know who edited the story and who wrote the story. >> but is the fault on the editor or the person who wrote the story? >> both, but i think primarily
12:03 am
the editor. >> primarily the editor. the editor has to ask the questions. when a story seems too good to be true, sometimes it is. >> aned dore's responsibility is for editing the story and getting it right. their responsibility is to the magazine, right? >> right. >> selling copies and making headlines. they have to walk a fine line. >> the reporter wants the story to work. particularly when it fits a preconceived narrative, you believe it is true and you believe in this issue. you want it to be true. you like the subject, but it is the editor's job to stand back and say, hang on a minute. what about the alleged perpetrators? did they have an event that night? >> that's what would happen in any story you were a part of. that's what would happen. is it the culture of "rolling stone" where it is not a real journalistic magazine? >> it has a good reputation. i have seen great reporting from iraq and afghanistan.
12:04 am
>> they have been making a name for themselves. >> on this occasion clearly there is something wrong with the culture there. clearly there is something wrong with their editorial system. this is disastrous. it is journalism 101 that goes to the other side and check these facts. the thing that started unraveling quickly what "washington post" did is what the "washington posted" dore should have been doing before publication. a 9,000-word article about a subject like this is serious stuff. >> it is huge. you are nodding your head, joanne. is it this story -- this is the kind of story where you are not supposed to question anyone, right? if you seem to question someone who has been abused, is that where the sensitivity came? >> this rolling story gathered a lot of moss. >> yes, it did. quickly. is that why you are noddings your -- nodding your head? >> this is awful for any sexualu
12:05 am
always want to side with the victim. you want to believe them. when there is inconsistencies in a story like this, it is hard to condemn the person that she is saying did something wrong to her. i am going to worry about other victims coming forward and having the bravery if they don't remember anything. a lot of them suffer from post traumatic stress which apparently jackie does have that. you might not remember every detail, but it should have been the reporter and the editor's job to make sure they ironed out the details and made sure they were accurate. >> i know we are supposed to be sensitive. you have to be sensitive to victims of alleged crimes. but this is a huge story and it was very detailed. it was kind of a -- it was a major gang rape that was being being -- you do have to push a little, don't you? you don't have to be that
12:06 am
sensitive. you have to check her story out. >> i think you have to check any story. especially if someone says don't check my story. that is the most important time as a journalist to check a story. if they say please, whatever you do, make these are facts. >> "rolling stone" said we shouldn't have put as much trust. then they said, it is all on us. isn't some of it on her? >> nobody wants to say that because they are blaming the victim. if she gave the wrong facts, those are the wrong facts. we are not saying she wasn't a victim here. she was giving things that weren't facts. she accused people that maybe should not have been accused. when it comes to rape especially , the second you are accused of rape you are guilty in the court of public opinion. the second you are accused. >> but there is no names. >> it doesn't matter. every fraternity guy is a rapist now. anytime somebody said i am in pie kappa, whatever.
12:07 am
are you a rapist. where do you go to school? are you in a fraternity? you are a rapist. if it comes out that she lied in the back of our head we say they probably raped her. >> they followed the duke guys around for years. andy, will you can sell your subscription to "rolling stone"? >> i would, but then they would have no subscribers. >> you like the paper version, right? you don't like the on-line thing. you need the paper. >> the bright screens, the glare, the whatnot. i am in the sun a lot, tom. the glare is not good. i just want to start off by saying i am offended you referred to toby as a real journalist as if i am not. >> look, good for rolling stone for making it clear that the mistake was theirs and not jackie. even if it turns out she is 100% lying it was their reporter's responsibility and their fact checkers' responsibility and editor's responsibility to verify
12:08 am
everything that was verifiable. >> is it bad to say? so was there -- they said it is our responsibility, but we should -- >> they published the piece. >> but what is so bad? >> i don't think you should be able to speak on rape until it is in the courtroom. i don't think any media outlet should be allowed to say we think this person might have raped. the second you say he might have done it, he is a rapist. >> the media reports on alleged crimes all the time. >> it shouldn't be rape and maybe even murder. both of those you have to wait until the police go we are going to indict. >> you just put every newspaper and network -- >> there is no first amendment. >> good! let's talk about puppies stuff. that's why pome watch this show. that's why people watch this show. >> go, andy. >> i think the piece that shea wrote has to be taken seriously. people assume that because some of the facts are wrong that it means nothing horrible happened to jackie that night. i don't think people should assume that. many people report assuming that. i don't want to say everybody
12:09 am
is assuming that. some are i can making that assumption that i think at this point is wrong. i hope that people at rolling stone and anywhere else she wrote are now using a fine-tooth comb to go through all of sabrina's stuff. sloppy journalism like this, i don't think it happens one time. usually what happens is it gets caught one time, and then it turns out that there is a pattern. >> just like men. it is a pattern. >> i have a question. do you think there is any prejudice here in play? you have a bunch of kids who are probably music nerds growing up and maybe they were bullied by the kids who were in pro -- fraternities. >> is that a comment on uva? >> i am talking "rolling stone" and all of a sudden these frat guys who maybe bullied them in high school or college and there is a big rape story and they say i will get these guys back. >> i think you are putting too much into it. >> you think everything is the nerds against the jocks. >> yes, tess! -- it is! >> i don't think that is
12:10 am
entirely fair. you are on to something. it fits the narrative of the evil fraternity guy and that made it easier to not check the facts the way they should have. it fit preconceived notions. it is a jackie victims of sexual abuse -- >> alleged. 1kwr50 -- >> alleged sexual abuse. they say why would anyone lie about being a rape victim? why would anyone exaggerate? if something terrible happened, edge zang -- exaggerating -- >> sometimes people -- there is an element of fantasy and reliving it in their own mind

12:12 am
concern about the campus climate. clemson is better than this. we asked one of the fraternity brothers to comment. >> please, defend your heros. >> as you may know, i spend a lot of my free time counseling college women. one thing i always tell them is i usually tell them this in the first session. across the board -- >> it is pro-bono that work you do, right? >> yeah, well, something like that. let's start with the name -- let's start with cryptmas. it is a horrible pun. >> i think it is a play on
12:13 am
christmas. >> i think as punishment that all of these fraternity guys and girls, they should be -- they should have to be dropped off in south central while dressed like that and just have to wish everyone a merry cyptmas and let it be their punishment. >> it was in bad taste. was it a real crime here, andy? >> i am not saying they should go to jail. >> it was in bad taste. andrew, you went on this rant about the nerds and the ducks. i can't even tell which you are. >> that's why i do it. >> i am androgenous. you will never know. >> would you have attended this party? >> absolutely. >> would you have crashed this party? >> absolutely. >> would you have planned the party? >> i would have planned it better because they know crypts wear whriew and not red.
12:14 am
>> is that true? >> crypts wear blue and bloods wear red. west coast, los angeles they started a way to police the neighborhoods because the police wouldn't go there and they became rival gangs. >> i know about all of the thug things. >> how do i feel? i feel fine. there is not much difference between fraternities and gangs. they throw up their hands and doing drugs. what is the difference? >> leads to my next question. bunch of guys, bunch of guys. there were plenty of women crypts at that party. >> who do you think decorated for the party? >> you know, this is absolutely iewfl, boys and girls should be ashamed of themselves. the university does president have to punish them. they punished themselves by

putting these photos on social media. good luck getting that internship at johnson and johnson and the student teaching position that you have really been wanting because no employer is going to hire you. >> wait a minute. how bad is this, toby? it is not like it is native headdresses. they are dressed up in costumes. why is it so offensive to flash the symbols. they are not sacred. they are gang members. >> what is the difference between a gang sign and a frat sign? >> what is a frat sign? >> what if gang members had a party and dressed up as fraternity boys. would they get in trouble? >> this is kind of stupid stuff. young men doing silly things. in my country prince harry dressed up as a nazi for a party and he got in a lot of trouble for that. >> and they probably had a great time at the party. >> it was a bad idea though. >> how does that not get checked. how does it not get stopped?
12:16 am
not one person was like, i don't know, a little insensitive. >> that's why they need andy. they don't have advisors. >> that's why i give a lot of counseling. >> toby, shouldn't we be glad there was no black face? >> that would be worse. >> we have to say there is something good about this. a couple years ago it would have been all black face. >> did you see the mayor listening to all of the angry students around him, he is taking over. >> his quote, we are better than this. what evidence do they have to prove they are better than that? >> both guys weren't better than that. >> coming up, greg thinks i am a murderer. greg isn't here tonight. coincidence? i don't think so. but first, who is in the running for time's person of the year? my money is on me. ç
