intelligence committee has released a damning report on the cia's interrogation techniques that were used after the september 11th terror attack. the report claims that the tactic used to gather information from our enemies were not effective and were, quote, brutal and far worse than the agency alleged. in a moment, former cia official jose rodriguez who oversaw the so-called enhanced interrogation will join us to respond and lieutenant colonel ralph peters will be here. we turn to fox's own ed henry who has details on how the obamaed a trags is responding. by the way, one quick question as we start, ed, let's see, isn't this the same administration that's responsible for the killing of how many people with drone strikes including civilian casualties in pakistan and elsewhe elsewhere? >> i can tell you that josh earnest, the white house spokesman got a question at the white house briefing from an arab journalist who was basically saying, you know, what's the difference. some would argue that the drones have been worse in terms of

civilian casualties, folks being killed on the ground without any compensation from the american government. that's something josh earnest pushed back on. it's been a very thorny subject for this administration. what we've also seen along those same lines is a contradictory response to this senate report from the president and his top aides. the president today releasing a long written statement saying on one hand he understands that former president bush had to make very tough choices after 9/11, hailing intelligence officials who had to deal with that environment as patriots, but on the other hand, the president said that the tactics that those same patriotses used were contrary to american values. a second contradiction is that we saw chuck hagel say he told the centcom commanders to be on high alert for threats against american interestses. john kerry called democrat dianne feinstein and expressed concern about the timing of this release, that it could lead to

violence, even though today vice president biden said something different. he was hailing the release of this report as a big victory for transparency. listen. >> i think it's a badge of honor. every country, every country has engaged in activity somewhere along the line that it has not been proud of, but think about it. name me another country that's prepared to stand up and say this was a mistake. >> now, biden's immediate predecessor, former vice president dick cheney lashed out today at what he sees as second guessing, telling "the new york times" that this senate report is a, quote, crock, as well as a bunch of hooey. cheney saying that he believes intelligence officials deserve a lot of praise. as far as i'm concerned, they ought to be decorated, not criticized. adding to the split within the obama administration, it's interesting, the current cia director john brennan put out a statement that seemed to agree more with dick cheney than with other obama officials because

brendan's statement was that he believes the tactics, while mistakes were made, he also said he thinks it brought in good intelligence and that it saved american lives, something that dick cheney has claimed as well. >> ed, it's a good point. john brennan rips the democrats' torture or enhanced interrogation report. you have then the secretary of defense, leon panetta, he claimed at the time that it didn't lead to intelligence that led to bin laden. and a third thing is this committee, 6,000-page document, they never once spoke to key people involved including george tenet, michael hayden or jose rodriguez who i'm going to interview in a second. >> dianne feinstein pushed back and saying she didn't want to interview them and they're basing it on that. there's been a lot of criticism of the process. it got to the point that officials have told us that john brennan, the president's own cia director, was so upset with the

process that he threatened at one point to resign over what was being declassified, what information was getting out there and what damage that might do to the country. white house officials today were trying to tamp all that down by saying the president still has full confidence in brennan and that he's going to stick around. >> ed henry at the white house, thank you. earlier today dianne feinstein and john mccain took to the senate floor to defend the declassification of this report. watch this. >> there are those who will seize upon the report and say, see what the americans did, and they will try to use it to justify evil actions or incite more violence. we can't prevent that. but history will judge us by our commitment to a just society governed by law and the willingness to face an ugly truth and say never again. >> i rise in support of the release, the long delayed release of the senate intelligence committee's summarized unclassified review

of the so-called enhanced interrogation techniques. i have long believed some of these practices amounted to torture. as a reasonable person would define it, especially but not only the practice of waterboarding. >> joining me now exclusively here on "hannity," former head of the clandestine services of the cia, jose rodriguez. sir, welcome back. glad you're with us. did i just hear dianne feinstein acknowledge this report may cause more violence that we can't prevent that? well, that would tell me they didn't release the report, it could prevent more violence, could it not? >> yes. i mean, i think it's a very dark day for the cia. i think the cia's been thrown under the bus. and you know, the cia is the country's paramount intelligence service, and it has a very

important mission, and the mission is to protect american interests, to protect the homeland, to safeguard american lives, and it needs to be held accountable when it screws up. you know, there's a lot of moving parts and a lot of risk taken when we do very complex counterterrorism covert action. in this case, i believe that, you know, we've been thrown under the bus, and the politicians are playing political football with the cia. >> let's go to dianne feinstein back in 2002 when she said the following, this was quoted in "the new york times," where she said, you know, it took that real attack, i think, to kind of shiver our tim bers enough to let is know that the threat is profound and that we have to do some things that historically we have not wanted to do to protect ourselves. you were there. you knew these senators, these lawmakers. do you remember any specific meetings? was dianne feinstein told

specifically what the cia was doing in terms of enhanced interrogation? >> there are about 40 instances where we briefed the senate and the house intelligence committees over the life of the program from 2002 to 2009. and we briefed dianne feinstein and nancy pelosi and rockefeller and many others all the time. and we at the outset, at the beginning, back in 2001, i remember very clearly them telling me, you know, the problem that you guys have is that you are risk adverse. you need to use the authorities that we have given you to go out there and destroy this organization and to kill bin laden. so we feel that we briefed them and briefed them thoroughly, and they are, you know, hypocritical. >> they claim that more people

were waterboarded than the three that had been previously acknowledged. you were at the waterboarding of khalid sheikh mohammed, right? any other waterboardings that you saw. >> we waterboarded three people during the life of the program. that's it. three persons. i don't know where they get the other numbers. >> would we have gotten bin laden without the intelligence of ksm during the waterboarding released to you guys? didn't he open the door to the courier which led us to bin laden, is that true, sir? >> actually, the initial information came from a facilitator called hassan ghoul going back to 2002 and 2003, he actually told us about the courier. that's when we first heard about the courier. al-libi told us that he knew about the appointment to become

the chief of operations through the courier and then ksm, of course, we intercepted a message that he sent to his fellow prisoners in which he says do not say a word about the courier. so we gained a lot of insight from our prisoners at the black sides about the importance of the courier, which eventually led to the takedown of bin laden. >> so in other words, you're saying that the accusation that these enhanced interrogation techniques were used beyond what we had already been disclosed you're saying is false, number one, and that, in spite of their suggestion that they were not successful, you're saying that, in fact, that's not true. you were there, it was successful? >> it was a very successful, and for those of us who were there, it's just amazing that they could have come to this conclusion. those of us who read the intelligence coming out to the black sites every morning and acted on that intelligence know

the value and basically it led to the destruction of the organization. in terms of whether we exceeded the authorities that we had, this program actually has been subjected to very intense investigations by justice department and, in fact, from 2009 to 2012, john durham, the special investigator, conducted a thorough investigation and he basically found no prosecutable charges to be made for anyone. >> you know, i talk a lot on this program about selective moral outrage, jose. let me give you an example. we have, under president obama and his drone program, we have the estimated death toll at 2400. in pakistan alone, the death toll is estimated between 450 -- i'm sorry 400 and 950 civilians including 168 to 200 children. can you explain to me how the drone program under obama is not

far more morally problematic than enhanced interrogation? and what do you make of dianne feinstein's silence on that issue in comparison? >> yeah, it's very interesting because, you know, this administration actually does not take any prisoners. they prefer to kill them from afar using drones. and somehow they feel that because they kill from a distance somehow it's more ethical. more ethical than the difficult and messy and unpleasant task and mission of actually interrogating a prisoners. i think it's a distortion of what our values are. you know what our values are -- >> i'll give you a choice, get waterboarded or get drilled with a drone strike. i think i'll take the waterboarding. >> i think i'll take the waterboarding, too. >> it's sad that you have to go through this, jose, because i view you and the work that you

of lies. here now to take us inside that hearing is house oversight committee chairman california congressman darrell issa. let's go back and let's go to gruber's comments where he called the american people stupid, among other things. listen to this. >> to get a law which said healthy people are going to pay in sick people get money, it would not have passed. okay? just like to have people transparent -- lack of transparency is a huge political advantage. and basically, you know, call it the stupidity of the american voter or whatever, but basically that was really, really critical to getting the thing to pass. americans are too stupid to understand the difference. very clever basic exploitation of the lack of understanding of the american voter. >> where is the real gruber here? have you been able to ascertain in your mind which gruber was telling the truth? >> well, i think it was pretty transparent to all of us that this was an incredibly smart

educated individual that made millions of dollars directly and indirectly duping the american people and now he wants to say that all those comments that he made, if you will, in academia, where nobody said there was a problem with lying, tricking and deceiving the american people didn't mean anything. but he said it again and again and again. and he said it in front of large audiences and only now are we realizing that, in fact, part of the plan from day one of getting the single payer government-run health care was in his hands, a man who believes the end justifies the means. >> yeah, clearly. and for me, i guess, the issue is here the involvement of the white house. what did they know? when did they know it? because we know in february 2010, the president and his staff internally debated whether to tell the american people the truth. what have you been able to ascertain in terms of his time spent with the president even in

the oval office? >> well, he was clearly key both to the earlier romney care and then to obama care. and they relied heavily on his numbers, his analysis. and, of course, today he was very bad at remembering any numbers, even the numbers of contracts and dollars he received. he's pretty uneasy about the fact that he made a lot of money, federal and sate, delita delivering data that so far isn't turning tout be tr-- out true, even that comment about cbo had to push and constrain to make it look balanced, he couldn't seem to understand that they collect taxes for ten years and only give services for six years and that was always part of the plan. >> so he lied to the cbo, he wrote the bill purposefully in a tortured way. everything about this, keeping your plan, keeping your doctor, saving money, the mandate's not a tax, do you believe that this

was a conscious, orchestrated lie and that everybody involved in the white house on down knew about this? >> i certainly believe that everybody on both sides knew that this was not going to lower the cost of health care. it would lower how much some people paid, exactly as he said, but overall the american people are paying more for health care, getting less and nothing in obama care actually drives down the real cost of delivering care. he knew that, the president knew that, nancy pelosi knew that, and now the american people know that it was part of a plan to get to single payer, and that's where they're going to end up. they're going to vilify the insurance companies and eventually we'll get to single payer rationed care. >> we sent david webb to confront mr. gruber. very quiet then, a guy who obviously thinks a lot of himself. watch this tape. >> you've had lots to say to the media. what about talking to us? we just want to talk to you. >> no thank you. >> do you think the american people have actually bought into

"rolling stone" has stepped in it once again. last month the magazine published a sensational student about a female college student named jackie who claimed to be sexually assaulted at the university of virginia fraterni fraternity. now reports are calling into question details of that story leading to an apology from the magazine saying we published the article with the firm belief that it was accurate. jackie's former suitemate came to her defense. while i cannot say what happened that night, i cannot prove the validity of every tiny aspect of her story to you, i can tell you this story is not a hoax, a lie
