"fox & friends" starts now. >> good morning. it is tuesday, december 16. i'm elisabeth hasselbeck. a fox news alert, breaking overnight the taliban attacks a military-run school in pakistan killing more than 100 children. and here at our home our president says it's time for a leaner u.s. military. but is this the right time to gut our military? we report, you decide. >> meanwhile the c.i.a. torture architect says our enemy knows us better than we think they do. >> khalid sheikh mohammed told me personally your country will turn on you. the liberal media will turn on you. the people will grow tired of this.

shelf and how it's polluting your kid. >> first we want to bring you this fox news alert. a horrific attack on a pakistani school leaves more than 80 children dead. now the army says they may be hostages there. the army now working to get taliban hostages out of the building. peter doocy is live in washington with the latest. gruesome details coming in. i know there are updates you have for us. >> elisabeth, we're hearing from officials in pakistan that 84 students have been killed and about that many have been wounded as well. those numbers are included in the latest associated press bulletin along with details about what happened at this school which is run by the pakistani military for students in first grade through tenth grade. the assault apparently began in the morning when gunmen associated with the

taliban entered the facility and began shooting at random. the pakistani military responded with gunfire of their own and there may have been as many as half a dozen gunmen because as the taliban was taking credit for this deadly attack today, their spokesman claimed six suicide bombers participated, and a quote -- "the government is targeting our families and females. we want them to feel the pain." the first account we're hearing from inside the school are gruesome. one student says -- quote -- "then i saw children falling down who were crying and screaming. i also fell down. i later learned that i had got a bullet. all the children had bullet wound. all the children were bleeding." the most recent information we have is that the fire fight between terrorist gunmen and the pakistani military is still ongoing as we speak. >> more trouble ahead.

>> here we are fighting a situation with isis, still trying to get ahold of what we left in libya where isis is training. >> look at the taliban in that picture right there. >> we have the taliban. believe it or not the pakistani government called us about six months ago said why don't you help us kill off the taliban in our country. it might go better and they have had a lot of success but this is the response. they wait and kill children. >> all the children are hurt, all the children are bleeding. when you hear that, you think would this be the time to maybe decrease, lean out our military? our president's new year's resolution now. >> to brian's point, there's trouble all over the world. is this the time to be drawing down? yesterday the president was in new jersey at joint base mcgwire dick's lakehurst. he was talking about how we're at a turning point.

there were 150,000 deployed. at the end of this month there are going to be about 15,000 at such a time of peril. is it appropriate? the president says yes. here he is. >> the time of deploying large ground forces with big footprints engaged with nation overseas is coming to an end. going forward our military will be leaner. as your commander in chief, i'm going to make sure we keep you ready for the range of missions we ask of you. >> the president is talking a little bit like donald rumsfeld did when he first took over. he wanted a leaner quicker reaction force. when he responded to the challenges in the middle east said i've got to get a little bit bigger and stronger. the times report showed the morale of the military is down to 53% of those who say i'm happy to be in as opposed to 84% where they were about three years ago. you look at one thing people needed to hear in lakehurst, new jersey, and

boarded khalid sheikh mohammed. it was great to hear from him. we've heard it's so bad. he was talking about how it actually takes a toll on the interrogators. but he made it very clear that at one point khalid sheikh mohammed himself turned to the american and essentially said that we don't know ourselves as well as we should because the media will turn on the good guys. lirch -- listen to this. >> shows al qaeda and the al qaeda 2.0 folks -- isil -- that we're divided and we're easy targets, that we don't have the will to defeat them. in fact, khalid sheikh mohammed told me personally your country will turn on you. the liberal media will turn on you. the people will grow tired of this. they will turn on you. and when they do, you are going to be abandoned. >> mitchell also has a c.i.a. background. he was asked to do this. at first he said no.

then he said yeah, i'll do it. meanwhile he was discussing what's legal and what's not. when it came to the actual water boarding, he says we practiced. then i realized they told me i could put a certain amount of water in, he goes i decided to cut that back. when people say we water boarded khalid shake muhammad so many times, he goes. it was five seconds at a time and in order to do it in a more humane way, much like our training with special operations. >> it is a difficult job for anyone to do. if you want to get into the mind of the motivation and what's necessary to extract this information, take a watch. >> the 9/11 victims are the reason that i'm here. when they first asked me if i would be willing to do this, my initial thought was i don't want to do interrogations. that's not who i am. and i knew for a fact that my life as i had previously

designed it would be over, but i know the exact instant that i decided to pony up to this. the exact instant was a person there had asked me if i would do these, and i was hemming and hawing a little bit. either him or another person said after you've seen all the intel i saw suggesting the second wave was coming and there was going to be a catastrophic attack and all that sort of stuff, if you're not willing to do this, how can we ask somebody else? and that picture of that falling man flashed into my mind. >> keep in mind all these guys were doing what they did at that time because they were positive there was another attack about to happen. they heard that there's a possibility of a nuke device, that there was anthrax. they didn't know what it was. they were just trying to stop it from happening. there's a brand-new pew research poll out shows that a majority of americans feel that what the c.i.a. did was

gunfire you hear there when police stormed that cafe after the 16-hour standoff. we learned the gunman man haron monis had a long rap sheet including 40 sexual assault charges and was accused of assisting a woman to kill his ex-wife. the self-professed radical cleric who said he was inspired by isis wrote hateful letters to families of soldiers killed in afghanistan. monis was free on bail when he took 17 people hostage at gunpoint. an intense manhunt underway for the former marine accused of murdering his ex-wife and five of her relatives in a shooting rampage in pennsylvania. schools in doyle center are closed today and people are urged to stay inside after sergeant bradley stone tried to carjack someone last night. he wound up running into the woods when that driver pulled out a gun and fired at him. this is the first reported sighting of stone since he left his children with a

a crash in new jersey send fedex packages flying, not something you want to see days before christmas. hundreds of packages scattered across the highway. a second truck was called in to pick up those packages and hopefully prevent delivery delays. a trio of burglars knew they picked the wrong family to steal from when they found themselves held at gunpoint. the three caught on surveillance video stealing two tv's and other christmas gifts from this alabama home. a few days later the owners recognized the thieves driving past them and wanted to make sure they didn't get away. >> when you stopped them, what did you say at that point? >> oh [bleep]. they tried to say they were lost and we corrected them where they were. >> police believe the trio had just come from another home invasion since their car was full of stolen items. and those are your headlines. back to you guys on the sofa. >> the story of the most lethal sniper in the united states military's history hitting the big screen in a

about that is that that evidence has been in the possession of the government at the time of the court-martial and at the time leading up to the court-martial. we think that had that evidence been presented to the chain of command and to the -- and/or the jury, that they may never have had a court-martial or had we had a court-martial, that the outcome with have been entirely different. >> john, general richard clark was a well regarded general, head of the 82nd airborne, a great soldier is going to make the ultimate decision under the cold of military justice. why is this case particularly suited to clemency, this allegation there was not disclosure of terror ties. there was a failure to disclose evidence that it was an unfair trial, that there was a lack of due process. why is this particular case involving lieutenant lorance suited for clemency? >> i think that is the question for this case. it strikes at the very heart of clemency. that being major general clark con -- congratulations on your

recent promotion to general, he has the authority to take this case and he can dismiss all charges, all specifications and he's particularly suited to do that for many of the reasons you just articulated. he knows things that the judge and the jury and those officers who recommended court-martial never did. because of that superior knowledge, he is rightly and correctly able to substitute his judgment as the convening authority for that of judge and jury and do right by clint, his family, the 82nd airborne division, the army, and the country. >> you had the capacity to find out the people involved with this potential attack may have been scouts. they may have been jihadis. they had business in the past in terms of i.e.d.s and you reference in your papers ten different intelligence sources, computerized sources, that showed this. why didn't the prosecutor present that evidence to lieutenant lorance and then his

lawyer? >> that would be speculating on that part. i wish they had. had they, the entire process may have been different, and quite likely would have been different. i can only speculate that a, on the one hand it could be an oversight or negligence. we hope that to be the case. b, it could be something else, maybe perhaps a little more untoward. i think it's probably more the former than the latter. but in any event, it never occurred. the prosecution should have developed this evidence, presented it to the defense. the defense should have been able to prepare. had the defense received this evidence, the entire proceedings would have been different and in the larger sense, what would have happened is had those officers from the company battalion brigade and division been presented with this evidence, they quite likely would not have recommended court-martial. >> sure. it's not too late for the army to do the right thing and i hope that general clark does watch this and looks into the evidence. we thank you very much for bringing this to our attention and peter johnson, jr., you as

targeting our families and females. we want them to feel the pain. the pakinstani prime minister is on his way to the scene of this morning time massacre and already condemned what happened. and the first accounts from inside this military-run school from survivors and eyewitnesses are that the gunmen fired randomly and that a big fire fight followed soon after when the pakinstani military responded trying to protect this school for students in first grade through tenth grade. one of those students tells the a.p., quote, then i saw children falling down who were crying and screaming. i also fell down. i learned later that i have got a bullet. all the children had bullet wounds. all the children were bleeding. and the last update that we got is that the fighting between the pakinstani commandos who responded and the taliban gunmen who attacked is still going on. back to you in new york.

thousands being cut. we saw the scandal with the v.a., the way our returning veterans have been treated. a lot of them homeless, don't have job opportunities. now the ultimate insult is that a lot of them are going to be replaced by illegal immigrants who seek a pathway to citizenship. so all of this should be very sobering to this country as china is on the rise. china continues to build its military. china continues to threaten america's interest, both with our relationship with russia, with our dealings with iran and the south china seas, taiwan, hong kong protests. all of this is happening and america grows weaker and weaker and weaker thanks to the president. >> intentionally. donald rumsfeld talked about a leaner, quicker military. but when you have situations pop up, you have to get troops on the ground, the president doesn't want to do that. it's amazing how he skated over the fact that the big issue was we ended the war in iraq and scaling down in afghanistan. what's he going to say now that isis came up? his new line is, i pulled most of the troops out of iraq. we don't want many anyway.
