shelf and how it's polluting your kid. >> first we want to bring you this fox news alert. a horrific attack on a pakistani school leaves more than 80 children dead. now the army says they may be hostages there. the army now working to get taliban hostages out of the building. peter doocy is live in washington with the latest. gruesome details coming in. i know there are updates you have for us. >> elisabeth, we're hearing from officials in pakistan that 84 students have been killed and about that many have been wounded as well. those numbers are included in the latest associated press bulletin along with details about what happened at this school which is run by the pakistani military for students in first grade through tenth grade. the assault apparently began in the morning when gunmen associated with the

taliban entered the facility and began shooting at random. the pakistani military responded with gunfire of their own and there may have been as many as half a dozen gunmen because as the taliban was taking credit for this deadly attack today, their spokesman claimed six suicide bombers participated, and a quote -- "the government is targeting our families and females. we want them to feel the pain." the first account we're hearing from inside the school are gruesome. one student says -- quote -- "then i saw children falling down who were crying and screaming. i also fell down. i later learned that i had got a bullet. all the children had bullet wound. all the children were bleeding." the most recent information we have is that the fire fight between terrorist gunmen and the pakistani military is still ongoing as we speak. >> more trouble ahead.

there were 150,000 deployed. at the end of this month there are going to be about 15,000 at such a time of peril. is it appropriate? the president says yes. here he is. >> the time of deploying large ground forces with big footprints engaged with nation overseas is coming to an end. going forward our military will be leaner. as your commander in chief, i'm going to make sure we keep you ready for the range of missions we ask of you. >> the president is talking a little bit like donald rumsfeld did when he first took over. he wanted a leaner quicker reaction force. when he responded to the challenges in the middle east said i've got to get a little bit bigger and stronger. the times report showed the morale of the military is down to 53% of those who say i'm happy to be in as opposed to 84% where they were about three years ago. you look at one thing people needed to hear in lakehurst, new jersey, and

he would do it again. he chose to protect his troops. please do the right thing and release my son and let him come home. >> that is a possibility. but the army said the men killed that day did not have ties to terror. but now his attorney is seeking clemency as new evidence has come to light that may prove the men do have terror backgrounds. joining us now, peter johnson, jr., fox news legal analyst and john maher, the lawyer fighting for his freedom. you have in evidence that apparently these other guys who he ordered to be engaged turns out they were bomb makers, right? >> we did submit evidence to the commanding general of the 82nd airborne division of fort bragg and that evidence indicates the individuals on the field that day are associated with ied terror networks, ied placements and are potentially jihaddists. what we think is very important

about that is that that evidence has been in the possession of the government at the time of the court-martial and at the time leading up to the court-martial. we think that had that evidence been presented to the chain of command and to the -- and/or the jury, that they may never have had a court-martial or had we had a court-martial, that the outcome with have been entirely different. >> john, general richard clark was a well regarded general, head of the 82nd airborne, a great soldier is going to make the ultimate decision under the cold of military justice. why is this case particularly suited to clemency, this allegation there was not disclosure of terror ties. there was a failure to disclose evidence that it was an unfair trial, that there was a lack of due process. why is this particular case involving lieutenant lorance suited for clemency? >> i think that is the question for this case. it strikes at the very heart of clemency. that being major general clark con -- congratulations on your

recent promotion to general, he has the authority to take this case and he can dismiss all charges, all specifications and he's particularly suited to do that for many of the reasons you just articulated. he knows things that the judge and the jury and those officers who recommended court-martial never did. because of that superior knowledge, he is rightly and correctly able to substitute his judgment as the convening authority for that of judge and jury and do right by clint, his family, the 82nd airborne division, the army, and the country. >> you had the capacity to find out the people involved with this potential attack may have been scouts. they may have been jihadis. they had business in the past in terms of i.e.d.s and you reference in your papers ten different intelligence sources, computerized sources, that showed this. why didn't the prosecutor present that evidence to lieutenant lorance and then his

lawyer? >> that would be speculating on that part. i wish they had. had they, the entire process may have been different, and quite likely would have been different. i can only speculate that a, on the one hand it could be an oversight or negligence. we hope that to be the case. b, it could be something else, maybe perhaps a little more untoward. i think it's probably more the former than the latter. but in any event, it never occurred. the prosecution should have developed this evidence, presented it to the defense. the defense should have been able to prepare. had the defense received this evidence, the entire proceedings would have been different and in the larger sense, what would have happened is had those officers from the company battalion brigade and division been presented with this evidence, they quite likely would not have recommended court-martial. >> sure. it's not too late for the army to do the right thing and i hope that general clark does watch this and looks into the evidence. we thank you very much for bringing this to our attention and peter johnson, jr., you as

targeting our families and females. we want them to feel the pain. the pakinstani prime minister is on his way to the scene of this morning time massacre and already condemned what happened. and the first accounts from inside this military-run school from survivors and eyewitnesses are that the gunmen fired randomly and that a big fire fight followed soon after when the pakinstani military responded trying to protect this school for students in first grade through tenth grade. one of those students tells the a.p., quote, then i saw children falling down who were crying and screaming. i also fell down. i learned later that i have got a bullet. all the children had bullet wounds. all the children were bleeding. and the last update that we got is that the fighting between the pakinstani commandos who responded and the taliban gunmen who attacked is still going on. back to you in new york.

subjugate and intimidate anyone from acting and responding. that is an intimidation and fear tactic that they're going to use. >> it's absolutely gruesome and pure evil as you just said. so is this the time then -- because the president seems to think so -- to lean out our military? listen to this and i'm sure you'll is a strong reaction. >> the time of deploying large ground forces with big military footprints to engage in nation building overseas, that's coming to an end. and going forward our military will be leaner, but as your commander in chief, i'm going to make sure we keep you ready for the range of missions that we ask of you. >> so less people doing more. >> yeah. again, none of this should surprise anyone watching "fox & friends" this morning. he had a goal to transform america and part of that transformation was to re-engineer the military, both socially, culturally, and now cutting forces back tens of

thousands being cut. we saw the scandal with the v.a., the way our returning veterans have been treated. a lot of them homeless, don't have job opportunities. now the ultimate insult is that a lot of them are going to be replaced by illegal immigrants who seek a pathway to citizenship. so all of this should be very sobering to this country as china is on the rise. china continues to build its military. china continues to threaten america's interest, both with our relationship with russia, with our dealings with iran and the south china seas, taiwan, hong kong protests. all of this is happening and america grows weaker and weaker and weaker thanks to the president. >> intentionally. donald rumsfeld talked about a leaner, quicker military. but when you have situations pop up, you have to get troops on the ground, the president doesn't want to do that. it's amazing how he skated over the fact that the big issue was we ended the war in iraq and scaling down in afghanistan. what's he going to say now that isis came up? his new line is, i pulled most of the troops out of iraq. we don't want many anyway.

>> yeah. well, as isis has total control in mosul, third largest city in iraq. we have to acknowledge this, brian, and everybody, that the country -- the years during the bush administration, the country grew sick of war. they didn't see how it was making america stronger. they saw america get weaker after year after year after year of deployment. that is a fact. and we have to understand that. we have to have a smart military and we have to conserve our military might. >> we weren't weaker. >> luckily there is nothing going on in the world where we need a big military. >> how demoralizing. >> off the list, north korea. north korea right now is in the news because it looks like their computer experts hacked into sony's computers, got all of the e-mail. earlier this morning over on another morning show, aaron sorkin, a famous producer.

>> liberal. sank at this moanious liberal. >> he's a liberal. he's behind the west wing. he says that news medias should not be putting these things on television. listen to this. >> there are certainly times when the press should have an obligation to publish things that were stolen. talk about the pentagon papers, but you don't even have to use that as your standard. loosen the standards a little bit. is there anything in these e-mails at all that's in the public interest that points to wrongdoing at the company that helps anyone in any way? there isn't. there is just gossip there. you can -- ultimately you have to dispense with standards entirely in order to be okay with publishing these e-mails. >> well, laura, what do you think? >> you know what's hilarious, is hollywood exists off of pr and gossip. and what aaron sorkin is mad about is this is one occasion where the pr got away from them.

so you have amy pascal and all these liberals who are making these racially intense comments who nobody was looking and all of these comments about how ticked off they are, they're not part of the loop of information, new comment about someone who talked about being like the black baby, all the people adopting black kids. so aaron sorkin doesn't want the dirty laundry of hollywood out there because they're always wagging their finger at conservatives or fox news or tea party people. but when the light is on them, they're like oh, you can't cover this, this is outrageous. it's so obvious when they're doing. >> you kind of did right there. it's also interesting, too, because it seems as though they're giving not only just want to go sweep it under the rug, but giving them the sort of entitled pass to racist remarks. and even oprah is saying, only certain people deserve this pass. take a listen to this. >> that we would not stand in

judgment in such harsh judgment of a moment in time where somebody was hacked and their private conversations were put before the world. there are things that you say in your private conversations with your friends and with your colleagues that you would not want to be broadcast on cnn. >> you know, i have a problem with this story and that is, north korea hacked in. they wanted to embarrass sony. and then by us publishing this, we're helping north korea. >> we're no better than north korea. and did ultrasay that about paula deen or the seahawks owner -- was she defending all of these individuals who were unfairly tarred with this? i should say, back in 2013, oprah gave an interview to the bbc where she talked about how old racists just need to go off and die. that there is this generation of racists who are just it -- but
