commands about specifically some options to bring him back. bill specifically, there were three major primary options to bring him back. one of the three i was playing a healthy support role. let's leave it at that. >> there were three. let me stop you, there were three trade scenarios, there were three things they could have done, right? and you were trying to work that out. >> not all of them involved tray. one of them involves my aspect which was not again a trade. something working the issue obviously the one the president went with was the a billion to cut qatar trading the taliban. >> the report of the did he did i setter is he a trader. did he collaborate? why isn't he being released? we are a free society. the pentagon is not supposed supposed to be political. why hasn't he been released? >> bill, i understand that general doll, the investigating officer did a corrected job there was a

existing investigation' back in 2009. i understand he basically confirmed what was in that report. and effectively. >> what did he confirm? >> well, based on the classified briefings have i had on the original report, he did i settered. do i believe. >> so wait, again, you are saying tonight that you believe the current investigation confirmed that he is a did i setterrer; is that correct? >> the fact's that are stipulated in the 2009 report, done by ncis, i hear was essentially confirmed by the new investigation. so that would be desertion. >> where is the report? the pentagon is not supposed to be under the thumb of the obama administration. they did the investigation. it's now been more than 60 days. i think the investigation was wrapped up in august. but officially it was wrapped up in -- they are keeping it back. >> yeah. there is no question. i think it's going to get released i believe like january 16th.
5:17 pm
>> january 16th? >> i think so. >> why that date? >> it's right about a week and a half after congress comes back. put it on the friday. it gets quiet. it gets covered. as tony said, confirming the investigation in 2009 which he was a did i setterrer. >> that's what you are hearing, too? >> absolutely. yes. he left a note. all the facts. so this report is confirming. >> that is he a deserter? >> yes. the issue is going to be whether he is also going to be a traitor. they are going to give him less honorable discharge. he was given $300,000 in back pay they can't get back. it's embarrassing for the army and department of defense. >> embarrassing for the united states. embarrassing for everybody. i want to recap and be precise here. you are hearing that the report will be released on january 16th. >> yes. >> the report as considerable shaffer mentioned will say the man deserted his post. >> yes. >> nevertheless, he will be allowed it keep his back pay at $300,000 because he was held by the taliban for five years.
5:18 pm
and he will get not a dishonorable discharge. he will get something in the middle like a general discharge, right? >> yes. >> that's what you are hearing? >> yes. >> would that be okay with you if that's the way it comes down, considerable shaffer? >>. no bill, let me be very clear on this. this individual, bergdahl, did as much damage as private bradley manning, and his damage, bergdahl's damage is more direct. people died looking for him and he gave essentially and let me be clear on this. i feel he gave aid and comfort to the enemy, the taliban and forced us to do some really stupid things. >> it's not going to be okay with you. is it going to be okay with you? >> of course not. no. absolutely not. >> you believe there will be outrage in the military about it? i don't know the public are -- i mean fox viewers will. it probably won't get covered on the other networks. you know how they are. the military will be outraged. >> outraged in 2009. and outrage now when this comes out. we will see how you guys, if your prognostications are correct. we wish you a merry christmas.

frightening scenario. >> absolutely. >> number 8? >> number 8 is the missing malaysian jetliner, terrible tragedy. but a great mystery story. number 7, president obama's decision just yesterday to restore diplomatic relations or to normalize them with cuba, after 50 years. that's a big deal. >> how is that playing in miami where you live? >> well, you know, there are two groups of miami cubans. the older ones and the younger ones. older ones like when i first came down here in 1969, the older ones would have blown things up over this and think did blow things up in those days. the younger ones don't feel the same way. so,. >> divided scenario right now? >> yeah. number 7, no, that's number 7. number 6, ebola. not just because of the tragic loss of lives in west africa. but because of the frightening effects it had had here in america. number five is a biggie.
5:25 pm
because of its implications. vladimir putin and the destabilization of the russian economy. who knows what putin is going to do next to try to get things right with oil prices. that will continue into 2015. number 4, another biggy. cyber terrorism. i fear that what we're seeing currently with sony, not only isn't going to be the last. i'm pretty sure of that, but may wind up being trivial compared to what else some foreign power may decide to to do. if they can do this with sony and cause this much havoc what could they do with the grid system, our power system. >> this is emerging as one of my big stories of the year because of the intensity of the destruction. and it's going to be interesting to see what congress and president obama do. can't allow north korea to get away with it. you can't. so, if they prove it, that they did it, then there has to be reprisal from the

u.s.a. against north korea. has to. >> exactly. and i am not trying to foment any crazy stuff, but if they decide to knock out our power system. >> try to. >> crazy people to do that or try to. that's an act of war. that is an out and out act of war. >> what will president obama and congress do to north korea to send a message that if countries mess with us this way, all right? they are going to feel some pain. so it will be interesting to see. all right, you have got three more left. go. >> number three, doesn't need much explanation, ferguson and its aftermath. number two, the rise, that's ferguson and the aftermath is what you are watching right now. number two is the the rise of isis and the depravity of radical islam. whether it's chopping off the heads of innocent people or, as the taliban and pakistan did just this week,
5:27 pm
killing more than 100 children in retaliation for something the kids had absolutely nothing to do with. that's depravity. and number one, because it's a political story. that will effect the rest of president obama's presidency, the g.o.p. tsunami in the midterm elections this year. >> okay. >> and, of course, bill, of course, not only can reasonable people disagree on the list. but the order is totally, you know, anybody can disagree with that. >> okay. what is ferguson tell you about the u.s.a.? >> well, i'm troubled by the liberal reaction to ferguson. when people and have you spoken of this quite well. when football players come out with the hands up, don't shoot. which apparently never happened. that's troubling because people aren't -- they don't care about the facts. >> no. they have just made up their mind. very simply they have made up their mind that this is a racist country with lotted
5:28 pm
of racist cops. and an innocent kid in ferguson got killed. now, it's a tragedy that he got killed. but on that day, he wasn't an innocent kid. >> that's for sure. all right, bernie goldberg, everybody. happy hanukkah. happy new year. all of that. >> merry christmas to you. merry christmas to you and your viewers. >> stay out of the sundown there in miami. >> i will do my best. >> plenty more ahead as the factor moves along this evening. gutfeld mcguirk on the human beings who annoyed them the most last year. laura ingraham on the story she believes is most important for the year 2014. hope you stay tuned to those reports. goodnight. goodnight. for those kept awake by pain... the night is anything but good. introducing new aleve pm. the first to combine a safe sleep aid. plus the 12 hour strength of aleve. for pain relief that can last

5:33 pm
behind the computer screen they hired someone. they hired a team of people. it's obvious. it's clear. and they have been hesitant to declare what they're going to do about it. are there going to be sanctions? what are they going to do? >> now does earnest get up there and go and to be fair, you have got to give them a little time to formulate the unintended consequences of whatever action they are going to take. >> sure. are you convinced they are going to do anything. >> sanctions against russia. you are right. he took his time and now it looks like that the sanctions are hitting russia's economy too hard to the point that it might boomer rang around the world. yes, they deserve time for that what are they going to do about it? obviously it seems more like being sanctioned. >> sanctions? there is no sanctions. the place is isolated nobody does business than with china. >> right. >> they can't force the chinese to do anything. have to more than that. >> that's why i asked josh earnst are we going to normalize relations with north korea. under the theory with cuba. we basically said look, let's talk to them rather
5:34 pm
than isolate them where clearly he said no he we are not going to do that there is some key differences such as nuclear weapons and north korea. but the bottom line is, yes, there is no easy answer in terms of what to do to stand up to them. >> got to do something. they have got it punish them some way or this is as goldberg said this is going to become an epidemic and they will attack all kinds of infrom a structure. so the president now, he is wrapping it up. is he going to hawaii for christmas? what is he doing? >> he is going to be in hawaii for a couple of weeks. i think he is obviously exhausted after a long year. but also, pretty bruising midterm election. but the white house aids feel pretty good coming into the end of the year they think starting with that trip in china climate change deal. the economy has been picking up. the job situation. and they think the executive action on immigration, a lot of noise about it but so far, you know, he has gotten away with it. it's moving forward. republicans talking a big game about stopping it next year. so far the president has gotten his way though. is he going to have to recharge the batteries because there is big battles ahead. >> he gets a couple of weeks

miss laura. >> thank you. >> what story do you deem most important this year. >> bill, there are a lot. i think probably it's going to be the g.o.p. stopping of the democrats of the midterm election cycle. for a couple of reasons. when you look back over last year, year and three months or so, we remember all of the scatter walling about the government shutdown and that the g.o.p. would never recover and that it was the end of the g.o.p.'s chances to try to realign the country in the midterm election cycle. and pretty much all of that faded away. and the republicans came back. they won historic victories. not just in the house and the senate, but in state legislators as well. governorships that were deemed to be very vulnerable. that was a huge story. >> let me ask you this. >> yeah. >> up top of the program, andrea tantaros both said that the election, okay, yeah, it was probably economics more than anything. but they don't see a come back by traditionalists in

this country i dissented i think there can be a traditionalist come back if there is a leader that emerges here's what the progressives have done. it's not working out. and here's why traditional governance is better. do you believe that? or do you believe it's far too late for that to happen? >> no, i don't buy into the pessimism and cynicism that all hope is lost and genie's out of the bottle. that's the same type of thinking that said, well, obama's election in 2008 and then in 2012 was a sign that the country had moved forever to the left and that there was a complete shift in realignment in american politics. bill, remember after 2012 presidential election there were all these conservatives on television saying it's over, we're never coming back? and then a couple years later the country gives obama a 38% approval rating, says that the

>> it never works. bill, i think people should take a look at what's happening around the world, right. a lot of the polls and the changes in politics in britain and france, even places like sweden, switzerland, is showing that as long as you have a middle class, a working class, who are unhappy, right? their lives aren't really getting much better, we have a lot of people making a lot of money at the top. but the middle, the working class spirit, they're beleaguered. the independence party in britain realigning politics in britain. >> even though the european economy's worse than our economy. you know what's driving a lot of that conservatism in europe is the anti-muslim. >> the eu and immigration. >> and people are not catching on, look, if you're going to flood the zone with muslims -- >> cheap illegal labor -- or cheap labor. working class people's lives doesn't get any better, bill. we can't have a situation where

for 15, 16 years in a row people's lives aren't getting better, wages aren't going up and we can expect this situation's going to hold. you were right in the talking points memo. a figure will ultimately emerge. it's either going to be someone on the lef or someone on the right who taps into that discontent in middle america and among the working class. and i hope it's someone who comes at it from more of a traditional conservative perspective because i actually think that works and it's very renewing and positive. it's not negative or, you know, intolerant. >> have a good time. we appreciate.
