charges? a manhunt for the guy who shot the tv weatherman. gretchen just mentioned this in brief. investigators now releasing a sketch of the suspect so let's get to it. good afternoon goon, i'm harris falkner. north korea caused a lot of damage and we will respond. those words from president obama himself from the podium today, who used his end of the year news conference to confirm that north korea was indeed behind the devastating hack attack on sony pictures. the president had tough words for the country's leader, kim jong-un and said sony made a mistake when it canned its comedy film "the interview" following threated of violence. president obama said he wished the sony people talk to him first before the scratched the movie. the film lampooned kim jong-un and ends with his assassination.

sparked outrage in north korea but president obama suggest ode kim jong-un needed to be offended. >> we cannot have a society in which some dictator someplace can start imposing censorship here in the united states. because if somebody is able to intimidate folks out of releasing a satirical movie, imagine what they'd start doing when they see a documentary they don't like, or news reports they don't like. >> president said his team will respond in a place and time and manner that we choose. he did not go into details but said that any response would be proportional, just as his spokesman said previously. even before the president spoke, some republicans accused the obama administration of failing to keep north korea in check. the chairman of the house foreign affairs committee, the republican ed roast, said, and i quote, american lives could be lost as a consequence of cyber

attacks against our critical infrastructure. unfortunately the administration has been slow to respond. he called for tougher economic punishments on north korea, and we're waiting for the republican reaction to the other big topic the president tackled during his news conference, everything from the historic relations with cuba to america's knew war on the islamic state terrorist us. a lot to go of with chris wallace, live in wad. they made a mistake, wish they called me first. you have to figure that before the president said that at the podium today, sony got a heads up he was going to say that and i would have loved to be an eavesdropper on that phone call. >> but there are an awful lot of people in the hollywood community, particularly the creative side, as opposed necessarily to the business side, very distressed with this decision by sewn any to -- sony to pull the movie and feel, exactly as the president said, you have a satirical movie, not some searching undercover

report. a satirical movie about kim jong-un and by acyber attack and then threats, the dictator of north korea is able to stop a movie from being shown in your local neighborhood mall, that's a very chilling prospect for the country. i thought it was an interesting statement of the president and certainly a strong defense of first amendment rights in this country. >> everybody says, president kim, dictator kim, likes attention too wanted to be noticed. he is probably popping back the hennessey and looking at things with new fervor. >> clearly they won in this case. >> h. >> they did. >> to question they won. they hacked -- when you think about it, shep, it was a brilliant campaign. they hacked into the site, released a lot of embarrassing material, which made sony look kind of foolish, if not worse, and caused i'm sure a lot of

people in the hollywood community to say, let me stay away. then they proceeded to threaten they would blow up theaters or take actions, 9/11 actions, if anybody showed the movie, and people were not at that point disposed to rush to sony's defense. interesting development today on a related note. george chroney. >> he let them have it. >> he put out a petition that basically said, we got all stand with sony and stand for freedom of expression, and he is a very influential guy and his representatives put it out to all the top people in hollywood. they couldn't get one person to sign it. so that gives you a sense of just how toxic this whole issue is, and how scared hollywood is, and unwilling to touch this for fear they're going to be next. >> i'm going to move on from it. it was interesting to me that everyone in the government has told everyone who willies ton them on camera, off cameraen on the record, off the record, there's nothing planned. nothing planned.

one of the other things they talked about is christmas surprise, according to the hackers. they have more information you. wonder what else they have, what e-mails they had that soapy -- sony was like, we bet deer what you say. anyway, the president talked about the fourth quarter of his presidency, and clearly if you want to make that metaphor we're there. he can take a break go to hz, and then he's going to come back and say interesting things happen in the fourth quarter. get the feeling he is just getting started? >> yes. well, think two things. first of all, i think you have seen, if you haven't notices already, he is hell bent on taking executive action if he can't get his way with congress. we saw it on the deal on climate change with china. we saw it on cuba this week, with executive action to start diplomatic relations with the country after half a century, saw executive action on immigration. so i think the president is

absolutely prepared to take more executive action, and looks like there's nobody in congress who is either able or willing to stop him. they may end up having to go to the supreme court. on the other hand i think he also is looking at the possibility, with a divided government, with the republicans in control of the house and the senate, the possibility that you could get some congressional action. the way we all learned about it in civics class, and, look, the funding of the government, at the end of this year, during the lame-duck session, you had a bipartisan coalition of republicans and democrats who passed funding for all of the departments except dhs, home lean security, because of immigration, all the way through september of next year. and the president of course signed that. >> some of these things that the president has proposed are -- overall they're pretty popular with the country. they have bipartisan support, some of them. immigration reform is popular, depending on how you present it. a number of other things. and you wonder if the

republicans have any concern that if they continue to block they will just continue to look like the party of "no" and that might hurt them in 2016. >> two things that are separate there they don't agree with a lot of the president's agenda but on the other hand i think they're concerned about showing they can show they can govern. they've been given an equal share of the power in washington. they control capitol hill. the president control thursday eend of pennsylvania avenue. they've been given an equal share of responsibility and you're going to see republicans trying to pass a number of bills, some of which will clearly be political stunts like repealing obamacare, that will go nowhere. >> they're very good at that. >> pardon? >> they're very good at that. lots of approximate in repealing obamacare. >> you can argue that this failure to compromise goes both ways. >> certainly. certainly. >> and i think you're going to see them also try to pass some individual things, for instance, doing away with the excise tax on medical devices, some trade

authority, perhaps some forms of tax reform, areas where they and the president actually might agree and you might see them passing the measures and getting to the president's desk and he signs it, the way we heard it was supposed to happen. >> can't believe what i just got here. one of the producers here just said there's been a major invitation from the russians to kim jong-un, just happened. quoting reuters and the "washington post" newspaper, officials in moscow confirm that the north korean despot, as they put it, kim jong-un, may attend ceremonies next year commemorating the end of the world war ii. the kremlin confirms it invited kim jong-un to come over and look at stuff. >> well, you know, it is interesting -- >> i >> we have poked the russian bear, as vladimir putin it yesterday in his three-hour -- talk about this president talking long -- three-hour news conference yesterday, vladimir putin, and i think he is upset

and wants to blame the west and sanctions and over ukraine for the economic problems there and maybe this is a way for him to poke back at us itch at us. i don't know it makes much difference if couple ongoing ewan goes to moscow or not. >> just got breaking news, this is real, chris. breaking news in from "the wall street journal." it is now reporting that washington is officially considering putting kim jong-un's north korea on the list of state sponsored terrorist states. that would be a real ratchet up. the president didn't mention it but the white house just confirmed it. "the wall street journal" sources at the white house are telling us that. that would be an escalation. >> well, yeah. the interesting thing was that they were on the list of state sponsors of terrorism and then taken off as part of a deal when we thought we were going to get involved in trying to limit their nuclear program.

information to hold kim kim jong-un's government responsible for the cyber attack on sony pictures. in a statement the fbi writes, and i quote: north korea's actions were intended to inflict significant harm on a u.s. business and suppress the right of american citizens to express themselves. it continues: the fbi takes seriously any attempt, whether through cyberenabled means, threats or violence or otherwise to undermine the economic and social prosperity of our citizens. with that we turn to catherine her around for the latest. do we know how the fbi was able to lock this in on north korea? >> well, shep, this fbi statement says there is enough evidence to conclude north korea was responsible, and they cite three pieces of specific evidence. they cite the technical analysis of the deleted data, saying it has links to malware north korea used in the past. there was significant overlap between several ip or intermet protocol addresses sim layer to

those used by north korea, and the sony hack appears to have striking similarities to an take against south korean banks bankd media outlets. the president said that the u.s. must make it a priority to develop rules for cyber warfare, amounting to international principles and norms because the u.s. can no longer afford to be on the defensive. >> this point0s to the need for us to work with the international community to start setting up some very clear rules of the road in terms of how the internet and cyber operates. right now it's the wild west. >> an intelligence source pointed out that the fbi statement appears to be carefullycrafted, saying north korea was responsible for the attacks but not specifically that it executed the cyber assault which salves two campaigns of destruction with multiple players, shepard. >> interesting. thank you. >> you're welcome.

if it's coming from a state. in this case, they actually caused a lot of damage, sony caused damage to itself. had it not cancelled the picture might have been the all-time record-setter. so, in terms of box office receipts. so you just don't know. but the point is, the president was right when he said we have to really define this issue. problem with cyber is that all nations, almost every nation, has some capabilities. they're constantly probing and checking others. they're doing what you might call cyber reconnaissance. when you say states can't do anything in cyber, and we comply with it, we're hampering ourselves. so this is going to be a real tough problem to address. but, shep, what i'd like to see us do, with hey have these capabilities, i'd like to see is translate this movie into north korean and show it on north korean television. >> you wonder -- it's leaked out, parts of it leaked out, the scene where kim jong-un or the north korean leader is

assassinated, had leaked, and whoever the hackers are said you have to get this back in there or the christmas surprise is coming. at some point, this time or the next time, all this is going to come to a head and we'll see what people can do, and that might be a weird day. >> well, there's no question about it, that theoretically, cyber attack can cause real material damage just like a kinetic attack could. if north korea were to send missiles and bomb hollywood theaters and so forth like this, with intercontinental ballistic missiles, that's an act of war. what we haven't arrived at legally and politically or even technically is understanding what all these cyber capacities mean and where the dividing lines are. but this is the kind of act by a state which comes -- it suggests with the threats accompanying it, it's really close to being

something that could be retaliated for, not only by listing with state sponsored terrorism, and take though u.n., and demanding financial restitution, and other, either cyber or kinetic means. >> general, sure ily we know more about what is happening inside of north korea and it's weirdness than our government lets on. surely that's not a place we haven't been able to penetrate. that's just not true, is it? >> we know a lot about what is going on in north korea. i think china knows even more. and this is a case where we should lean really hard on china. >> china doesn't seem to be willing to play at all on this matter. >> well, it's in china's interest to condemn this strongly. japan also has a strong interest in this. ah after all, sony is a japanese corporation and we have not in the american news cycle heard anything about the japanese government response, and we should. >> are we prepared for a day when a state actor, kim jong-un or anyone else, like him, comes over here and does something that really disrupts us, in

other words, blocks bank sites or turns off the light or stops the water from flowing. we're led to believe we're vulnerable. are we ready. >> we have done a lot of preparation for this, but are we totally prepared? no. i think, shep, what we really need is -- i hate to say this -- but we need american business to ask the government for systemic help in extending the cyber protection from cyber command beyond the walls and confines of u.s. government. we have a very, very effective cyber capacity, but it's limited to protecting the u.s. government assets, and so for u.s. businesses they can consult, as the fbi says, please come to us and tell us what you need and we'll try to help you. that's different. when it comes to a corporation like sony, which did nothing, or banks and internet companies who do a lot in cyber security, nobody quite has the oversight,

the breadth and the power of the u.s. government in this sector, and our businesses need to be less shy about it. we need legislation to enable them to share the attacks, to collaborate with each other on defenses, and to work more closely with the government. that has to be under the power of law. >> we are at the very beginning, no doubt about that. general, thank you. merry christmas, happy holidays. >> thank you. same to you, shep. >> a father is in some serious trouble today. after his daughter crashed his suv and killed three teenagers. she is obviously in big trouble. but he is facing jail time even though he was not in the suv. this is one for parents and grandparents to hear. the details are ahead. plus, the olympic hero, michael phelps, in court today. the punishment the judge gave him after his second drunken driving arrest. that's coming up on "shepard smith reporting."

a fox report now and more headlines. the parents of the colorado movie theater shooting suspect say their son should not get death penalty. they wrote, he is not a monster. he is a human being, gripped by a severe mental illness. he is james holmes, and police say he killed 12 people and wounded dozens more back in 2012. he pleaded not guilty by reason of insanity. somebody deliberately started the massive fire at an apartment complex in los angeles last night -- last week. that's according to the fire department. investigators say they're still looking for two possible witnesses who appeared in surveillance videos seen here. the fire did an estimated 20 to $30 million in damage. and four people have died from eating carmel apples taint with bacteria they have confirmed cases in these ten states, and that people should avoid prepackaged carmel apples.

bottom of the hour now time for the top of the news, officials in pakistan say they hanged two militants todays' launched an air and ground offensive that killed more than 70 epeople, all after the taliban's attack on a school there those officials say they approved the death penalty for six hard-core terrorist they put it, with past convictions. those handings are the first congratulationses in pakistan in more than five years. taliban terrorists ambushed the school in northern pakistan on tuesday. investigators say gunmen walked from class to class, shooting students and teachers. nearly 150 people died in that attack. most of them were children. >> a teenager upset? new york told police that two masked men broke into her home, pinned her to the floor, kidnapped her five-year-old cousin, but investigators now say that wasn't true. and they're charging her with the child's murder. this is the little boy. his name was kenneth white.

cops say this began yesterday afternoon outside albany, new york, when the boy's 19-year-old cousin first reportedded the kidnapping. the rest of the story is a sore -- sordid one. >> this is a sad and tragic case. the five-year-old has a twin sister and a four-year-old sister left in the trail home, said to be devastated as well. they are without their beloved brother tonight. the 19-year-old woman who claims the men snatched him was charged with murder in second degree this afternoon. she pled not guilty and was sent to jail without bail. authorities say she left him buried in snow in a culvert, across the street from the trailer where they lived, then called her mother and said he was abducted. >> a five-year-old taken in a senseless death, and quite honestly, basically thrown away

like a piece of trash. and it's sinful and it's sad. >> the sheriff says the five-year-old died from asphyxia due to strangulation followed by blunt force trauma. he was found by a k-9 unit near the trailer where we was living with hi aunt. >> what do we know about the parents. >> the aunt was the legal guardian of the boy. the father lives in massachusetts, his mother in amsterdam and has been notified. authority says the little boy was being watched by his 19-year-old cousin. after interviewing her, investigators say things didn't add up. the disappearance launched a search effort and the county sheriff says there are several dissis in -- deficiencies in the homes that put lives in jeopardy. so the story is ongoing, very sad. >> thank you. a father is now facing manslaughter charges after a deadly car crash even though he wasn't in the car.

prosecutors say the reason is, he let his 15-year-old daughter drive his suv. she didn't have a license. or even a permit. they say the girl was tearing down a road in the poconos in northeastern pennsylvania when the vehicle flipped over and killed three teenaged passengers. the daughter and two other teens survived. investigators say passengers had pleaded for the girl to slow down but she ignored them. this happened labor day weekend, few days before school started back there. police say the father owns a vacation home there and that he and his daughter live in a wealthy suburb of new york city. investigators also say this was not the first time he allowed her to drive that suv. they say she drove to the poconos the day before the crash, again no license no permit. but the father's lawyer says his client did not give her permission on the day this actually happened. of course, teenagers disobey their parents all the time. the father's lawyer calls this case a stretch and says prosecutors are proposing a, quote, sensational legal theory.

let's bring in another lawyer, drew findley, a criminal defense attorney and is live from atlanta. the father can be charged for the actions of the daughter in his absence? >> yeah, shep, he can. they're going with involuntary manslaughter. that says in pennsylvania in this aggravated misdemeanor charge, is if illegal conduct, which if you can prove he let his unlicensed daughter drive a vehicle, that is illegal, was the cause of somebody else's death that would be involuntary manslaughter. i don't find it too unordinary to do a charge like this. what i do find interesting is how are you going to prove he gave permission? because remember, shep, you have people that are clearly going to be filing lawsuits right now, and a motivation may be the fact that this guy is wealthy and probably has big umbrella policy and lawsuits will produce millions and millions of dollars. >> seems to be no disputing that he allowed her to drive the day

before on the drive to the poconos, but does that action have any bearing on the actions of the next day? >> i think you're going to have to show that on this particular occasion, he gave her permission, and here's why this case is difficult for the defense, and that is, you're not going to get to the ordinary car accident analysis. in other words, okay, she was driving, but was see speeding, being reckless? because it doesn't make a difference. she didn't have a permit, didn't have a license, therefore she is not permitted to drive. even to me, if she were going 25-miles-an-hour, if you can show he gave permission, he is still in hot water. >> interesting to me, at least, maybe not out of the ordinary -- let me know -- they're going to have different legal teams with completely different goals, this father and this child are going to basically be opposing each other. >> absolutely, shep. that is why win i read about this case i'm like, holy cow, this defines conflict. this is something they'll teach

in law school using this case. the lawyer for the father is going to have to say, as he already has, i didn't give the kid permission. i had no idea she would do this. the kid's lawyer will say, she just did what daddy let her do. she didn't understand the law. she just assumed that if her dad give her permission, well, she did what daddy permitted her to do. they absolutely have nothing in common. they're complete conflict with one another. >> there's no child who is about to be old enough to drive who doesn't realize, i can't drive right now, soon i'll be able to drive. i don't have freedom. if there's a law they understand, surely it's that one. >> except when it comes to the law of the father who says -- as the allegation says -- the allegation is she went to go pick something up for her dad to eat. i she turns around with her lawyer and says, daddy sent me out for a chicken biscuit and a coup of coffee. i just did what daddy said. >> thank you, man.

>> thank you. >> a man who has won more gold medals in olympic history is not going to prison for drunken driving. michael phelps pleading guilty to driving under the instance nuisance. a judge in baltimore sentenced him to a year in prison but suspended the punishment and gave him a year and a half probation. michael phelps has won 18 gold medals but this is not his first time in trouble. he has a previous drunk driving arrest from 2004 and in 2009, there was that photo of him hanging out with the bong there. i don't their were any charges, lea has more. tell us about the court hearings. >> if you remember, prosecutors charged michael phelps back in september, when he failed the sobriety test after a police officer clocked him going nearly double the speed limit. today phelps arrived in court wearing a suit and tie and pleaded guilty to drunken driving charge. u.s.a. swimming suspended phelps but that ends in march. after his sentenced today he spoke with reporters.
