hours in you? molly: i do. we'll keep going. jon: but in an hour from time. molly: we get an hour break. we'll prep and freshen up. jon: see you back here then. molly: "outnumbered" starts right now. >> again with a fox news alert. we are waiting to learn more about the condition of our nation's 41st president. george h.w. bush was taken by ambulance last night to methodist hospital in houston, texas. he was experiencing shortness of breath. bush's former chief of staff, gene becker, says, it is just a hiccup and he should come home in a few days. mr. bush, who is 90 years old, is the oldest living former president and vice president. you may recall he spent nearly two months in that same hospital two years ago for bronchitis related cough and other health issues. doctors are keeping him in the hospital as a precaution. the bush family says they appreciate all the prayers and love and concern. we'll epdate you as we get more

funerals. some taking extreme measures comparing police to the kkk and heckling officers near the vigil that were set up for officers wenjian liu and rafael ram most. congressman peter king is blasting the mayor. >> this was 18 months while running campaign for mayor. he divide the communities, police from the minority community. i never seen, my father was a cop for 30 years, i've known cops all my life, i never scene a failure of leadership with commander-in-chief of the police department. >> father jonathan, you would think people, especially this time of year, in the wake of two police officers getting their lives taken from them christmas week, you would think some people would have self-respect, dignity, the grace to not protest. and especially not protest using such atrocious vitriolic language. >> sure. >> how do you heal a city on christmas week when there are

such tensions? >> first of all to the point of protesters, there will always be some at the very fringes of society, in this case i think some of these people, are willing to do something so nasty and vitriolic as you said, andrea, in the very time of suffering for families like this. some might have good intentions, and i'm not judging their intentions, obviously this is not the time to do what they are doing. how do you heal a city? that requires leadership. it requires leaders to stand up and say i am going going to do something that is hard. the mayor here, mayor de blasio, i think would probably recognize now that he has made some mistakes. he has said some things, he has done some things that were not the best. this would be a great time after christmas sometime, after the funeral, to get together all of thinks police people, his policemen and women and say, hey, i made some mistakes. i have messed up. and then, this is what we're going to do going forward.

i think he is, at the very heart, a good man. i hope he has that sense that i have to pivot at this moment. >> harris, he had the opportunity to do that the other day. mayor de blasio took a completely different tack and went on to blame the media. bill de blasio is not happy, the media, we, are reporting on protests. remember that was his big issue. if you guys would stop reporting on it, it wouldn't happen. >> we're not making say the things they're saying or carry signs written with some of the words on them. what the father is saying so true in terms of coming clean about were the mistakes have been made. i would take it a step further. i think he need to do it in public and not just with the policemen and will. >> sure. >> the reason is, we're kind of going down a road now there is degradation if you will of respect for authority and we can not let that happen. see, that will bleed, that will bleed on to the military. that will bleed on to other authority figures in our lives.

we need somebody to sit on the fence to protect us. there has to be sober conversation what has happened between police and sit currency iry. -- citizenry. we can have the conversations post all of this going on, but for those protesters not to respect the authority no matter how they feel about the mayor right now, pit down their signs and angry rhetoric for just a couple of days to show respect for these officers who gave their lives. it pains, because we don't want authority respect to degrade. >> this is disgusting. jedediah, this week we're looking not just christmas. then you have new year's and people in new york city and across the country rely on the police especially in times square and other places. i think the mayor has lost control of new york city. i really do. i think he has completely lost control. we keep having conversations about having conversations about race and healing the country but nobody is stepping up to do it. >> here is the thing, no one is listening to him at this point. now you have a mayor the police are not listening to and turning

their backs, and protesters he encouraged in the beginning are not listening to him either. he is saying hold off. this is not the time for this and they're going out there and equating kkk with the nypd. he has completely absolutely lost control. my question, at this point, can he regain it? let's say he comes out and apologizes, this has been bad politics for him. ideology this is where he stands. he is not apologizing for his ideology. his anti-cop stance is ingrained in everything he has said and done. it doesn't matter at this point or has he lost police and protesters and lost confidence that new yorkers feel that he can keep things under control and prioritize security? i have friends that live in various areas of new york are really worried the police will be afraid to do their job to get out there to protect them. that is very scary reality right now. >> he stoked the flames, mayor de blasio. must be pretty tough for him to come out. i don't anticipate him

apologizing. even if he would, it would be pretty tough to washing it back. protesters know how he feels. >> he has a slice of humble pie and washed it down with bitter could havefy. i know what he need to do. these protests are reaction. at some point reaction has to turn into action. there is organizations where police officers and inner city youth have a conversation to better understand each other. de blasio needs to support these groups. which by the way receive no government funding. he need to say, we need more of these organizations within our communities. >> take some of representatives from those groups to the news conference. he has to keep the conversation. if he goes couple days without conversing with the city he will lose his authority. even if he has to fumble he has to stay out there. >> instead of the -- we'll see if he can wake up in time.

he has a problem oversleeping. meantime chaos breaking out, not far from ferguson. [shouting] >> this is the seen in berkeley, missouri, after a white police officer shot and killed a black 18-year-old. the cop says that the teen pointed a gun at him. police say it happened late last night as officers conduct ad routine business check at a gas station. a crowd gathering at the scene shortly after and it got violent. two officers were injured. police cars were damaged. and a fire set to a quick trip store. this all happening a few miles from ferguson where officer darren wilson killed michael brown back in august. the mayor of berkeley saying this is nothing like that case. >> not a policeman in the city of berkeley, as we say, black

lives matter. this was not the case. this is you couldn't even compare this with ferguson or the garner case in new york. >> all right. harris, i want to go to you, because this story is getting some coverage today. even though the mayor says, a completely different scenario, as ferguson was from the situation in new york with garner, do you think that people will jump on this to try and capitalize the race-baiters, al sharptons of the world? do you see this added to already existing storyline? >> we already know that people are not necessarily watching for the facts in these situations, right? so is there a tinderbox standing out there with people waiting to glom on? we know that from ferguson. half the people coming from other areas didn't know who the heck michael brown was. what we have today is interesting. this police department did something very smart. they released surveillance video immediately, right? they said it looked like this

guy pointed a gun at them. you go and you google it and watch it for yourself. and you then make your own good choice about what you see. and then, i want you to consider another picture that you will see online today. and that is the line that police formed to protect that crime scene, so that they could investigate. it has faces that represent everybody on this couch. this is very decidedly different from ferguson. we have to make the decision to talk about the facts now and hopefully people will absorb them. we don't know. we can't be responsible for what people will believe. but we'll put it out there. >> father jonathan, harris makes a good point. seems police departments and cities and localities learned from errors of ferguson. you have to be somewhat critical how the police in ferguson handle it in certain ways. they were criticized for bungling release of that video. questioned on releases timing of that michael brown video. whether you agree or not you could probably learn from what happened? >> it is always a tragedy when

somebody dice especially an 18-year-old in this case sound like but there is a long tradition in ethics, in moral theology of ability to defend one's self. and also rule of law. if you pull a gun out at a cop and point it at a cop, you will get killed. that is exactly what, or at least should be stopped in some way and sometimes the result is dying. a police officer has the right, the moral obligation, to stop that person and i think that is so important. that is why we need the mayor and not just mayor de blasio but others to be constantly reminding us, of the rule of law as being a very foundation for the rest of, i would say, flourishing as human beings. >> rather than misstate the facts, jedediah, which we've seen so many times, done by other news networks as well, painting storylines that weren't even true, this is opportunity to educate. you see trending on twitter,

black lives matter. black lives matter. all lives matter. >> exactly right. now is the time. whenever i think of this i think of kid who watch these things happen in real time. the importance of teachers. the importance of parents. the importance of community to come together to explain what's happening. you're responsible. the unity we talk about all the time we want from the president. it starts in the kitchen table and starts at classroom and starts very young. kid are recall toking opinions. they turn on the news. they hear media reports. they're incredibly aware. we under estimate them. they're processing all this it is important they understand there needs to be togetherness with law enforcement, with community and people who want safety and security and prioritize that and don't prioritize violence. >> if you resist arrest, if you pull a weapon on a cop -- >> that is a crime. >> that is a crime. i think we're losing that in this debate. >> that's why i called it a crime scene. >> we're quick to, many people are too quick to jump on the police, but when you stop and

"outnumbered." a former gitmo detainee is once again a wanted man. the u.s. offering a $5 million reward and putting him on a global terrorist list. he was released from guantanamo bay in 2006 in a saudi rehabilitation program. he is now you a leader of up with of the most dangerous al qaeda affiliates. this comes after they announced they transferred four detainees to afghanistan. this is part of the controversial plan to gitmo down for good. this is what we talked about. what, i don't know what a saudi arabian rehab program looks like. but obviously it is not successful. you put enormous trust in these other country as and we have try to get them back. >> it should be. you brought up money. $5 million they're asking for information on the return or anyone to assist with the return of this prisoner. we could save ourselves a lot of mon if we kept them, contained.

i know people say it is too costly. but how much is an american life worth or any life worth? because we know the recidivism rate is about 30%. i think it is probably higher now that isis has grown and is recruiting in mass numbers. but yes, the most dangerous and violent criminals are being released and they're doing it on the down low. we have seen this, what, christmas week, they release ad couple more prisoners this week and doing it without preconditions. we saw a transfer to uruguay. and different from what we saw in qatar and gave them one year to keep them and monitor them which i'm still not confident in. but in uruguay they could have walked out of country and gone back to the middle east and uruguay president said the same thing. >> it costs so much money to keep these people in gitmo bay. all of sudden he is interested in fiscal discipline. he brought that up. if we have to spend five million dollars to get this guy back -- >> so disingenuous to talk about

the way the government spend money. we have hamsters on spin wheels. whatever it is, it is a money that, clearly we have money. how you choose to use it, you know, that is up to the government i suppose but we should weigh in on that as taxpayers as often as possible. al-baghdadi heads up isis right now. this guy, can't even call the name i'm thinking on television right now for him, right? we had him. we had him for five years in iraq. we have had these guys before. i mean our recidivism program, if you will, we, are bad at this. for whatever reason, we're not winning at this. so we have these guys. we turn them over to one of the camps in iraq. he walked out of there. what did he say on his way out? i will see you in new york to the captors? this is not just about the -- >> may i jump in here? >> please. >> my line of work is all about mercy. >> okay. am i not being merciful, father?

>> andrea was about to have a heart attack. >> whole end. couch. >> we have to think of mercy for those who can be harmed by a person who could be an aggressor. i'm not in favor of the death penalty but the death penalty in catholic social teaching and other denominations as well is actually accepted when it is the only way to stop somebody from harming the public. okay? now in, in our society today those cases are very, very limited, if any at all. but that means you have to keep people in prison who are a danger to society. you can't say, hey, listen, you know what? you've been in long enough. now let's hope you don't go out and hurt somebody. i think, that's a type of moral thinking that we have to have when we're making these decisions and the government can't do it for political reasons. >> national security rates pretty high on people's priorities. you see exit polling for midterm election when you look at national security, a stunning

single loco ran. >> you're watching outnumbered and we are glad that you are. the man who says he faced criminal prosecution, robin o'neill, is under investigation for leaking secrets. he recently conducted other news and now the criminal investigator service known as ncis is looking as whether he disposed classified information. in his account has been called into question and others feel that he has said that he was the one who killed the al qaeda leader and he, too is under investigation. so i will start with you. >> i just think that the priorities, it's interesting that everyone will rush in and say let's investigate this. i'm not saying that couldn't be a security problem, but the government is not excited about

investigating denier as that is corrupt or "fast and furious", but if you're looking about being excited about transparency, i think that's great, but be excited across the board even when it involves your own corruption that hurts the american people. harris: i see you shaking your head. >> in this christmas season i am so grateful to live in a nation of the united states of america where there is the rule a lot. where there is investigation. whether or not a former navy navy s.e.a.l. was done in this way, i hope that was not done in a retaliatory way. how awful great that we live where there is rule of law. we always stand up on we think that it is out of bounds, but i think that we don't have any reason to believe that this will be done in a bad way.

harris: are there any politics that we need to be looking out for when it comes to this? >> no, not at all. [laughter] not with this administration. will they be it leasing the details of this raid? remember that reign oh, yeah. >> it was the first to release the details, the classified details, controversially to folks in hollywood so they can make a movie right before election time on the bin laden rate. so i am a bit skeptical, but i do think that there is politics behind it and if they are going to investigate, i don't need someone at the cia or how they got this, i'm just glad that they did. but if they are going to go a after him, let's take a look at the folks to release that information first.

harris: is this a case of who told the story first hassan rouhani. >> i like a bit of a performance. i usually believe who over has more detail and is wearing a costume. and i think that he should be able to share it. and i think that this is 2014 and it is the year for apology and so maybe ncis just wants to share and i'm sorry and then we can move on and we can focus on these issues. harris: he deliberated to come out and do that. and he came forward only after books were released on this rate, there is tons of details put out there. it's not like he went out there initially and was the first one to talk about this. he waited to deliberated by the time he came out we had the most information, the most of the information that was out there.

>> at the case of who told the story first. in terms of all those other investigations that you brought up, we do have a few things on the ballot sheet, if you will. >> oh, yes. and people -- the problem is that people get really excited in the moment about "fast and furious" and then somehow this administration pushes things under the bug until long enough for you to forget and for another scandal to arrive, which is why we are still talking about dirs. and if you are interested in truth and honesty and transparency, i don't have a problem with that. if you're worried that some incorrect information came out and that could hinder national security, i understand. but don't be saying that when you are the government who has hit in everything from people. harris: one thing that hops into my head, i don't want robert o'neill to be put in any danger because of this.

they told a story, andrea said 10 different ways the story was out there before he spoke about this. but sometimes when you single people out -- that's part of it. >> isn't the country a little backwards? this man is being investigated and lois lerner is doing what? drinking eggnog on our dime? >> we are just a few hours from christmas mass at the vatican. just a few hours ago many have forgotten about what brought them to the priesthood in the first place. the pontiff accused the cardinal bishop of using their vatican careers to grab power and wealth. say that they live hypocritical allies. vatican watchers saying that they never heard such a message from the pope before. okay, so it is this a holiday

message the were hoping for? >> what is money is people asked what did you make of it and i said read it. he gave 15 points of how they could be better christians. and that is a holiday message three days before christmas. he meets with his staff. that is the way that this guy is. and you know, i'm 87 years old, i don't know how many years i have left, i'm going to make sure that this bureaucracy becomes a model for christian living in a model for service for the people of god. so when you read them, we could all use a. not gossiping, being willing to sacrifice for other people rather than seeking your own

harris: "the interview" will go on as scheduled, sort of. it stars seth rogan and james franco and will be released in select theaters tomorrow. 300 cedar siding on which centers on the movie plot to assassinate kim jong-un. so now we are learning that sony and youtube will also stream it on christmas day. he canceled the film after reds against u.s. theatergoers. north korea was likely behind the threats, which hong maca denies. theater managers say they cannot wait. >> i'm glad to see that they change their mind. i think it's definitely sad when

with that one. okay, what's interesting is that we asked this question online yesterday at our 3:00 p.m. hour. and the question was will you see the film now that it's been more widely released and now i think it is in 300 theaters around the country. but people may or may not want to do that and it has nothing to do with the threats or patriotism or any of that, those reviews are deadly and money is tight. if you're going to spend money on a movie, some people felt they want to do that. >> wouldn't have been amazing if it would've been a cause of all of this? >> there is a film about the stone, i think that would be great. and i love options and choices and this is awful. and now there are eight films

premiering. how my going to decide? why i think we should support freedom of speech and expression, we need to support musical theater because it doesn't have a lot of followers. everyone should see this. >> talking about christmas movies, i went with my sister and brother and a bunch of relatives who movies they had never heard about called the local ball straight. >> oh, no, you didn't. >> in the front row, i don't know if you guys remember that. but everyone -- all of my relatives were just sinking into their seats. >> so you land on christmas last year. >> yes, we did. >> did you stay for the whole movie? >> that is the real confession, yes, i did.

experienced a time for families to gather. a new survey shows that the traditional family unit is becoming a thing of the past. a pew research center poll findings is 46% of children, children younger than 18 live in traditional families. headed by two heterosexual parents and her first marriage, compare that to 1981 it was at 61%. in 1961 it was 73%. so i don't suggest that all those traditional families were just one big happy family, because all families are dysfunctional. but tell us about your this functional family. >> it's only an hour show. >> that is because humans are imperfect. but here is will be contrite to do, we can try to love her quickly. what i find troubling about the

it is the government and the policies that we see coming out of washington. obamacare this incentivizes couples from getting married and staying married. they call it the obamacare divorces because of cheaper to be single. people are saying why would i even bother getting married and i do see the government stepping in and playing the role of husbands to wives. remember the obama campaign. it is replacing them and people are becoming dependent on the government. and they typically work on their husbands or their parents were that type of thing. and that is scary. >> isn't something that which we should be fighting to defend and to have children to raise children? >> i think i'm a traditional girl, but i'm okay with the family changing. i think that we can still raise happy healthy kids in a setting that isn't so traditional. but i think that i want to stick around is a home-cooked meal where everyone in our family,
