tv The Five FOX News December 27, 2014 1:00am-2:01am PST
1:00 am
i'm kimberly along with juan, and tom. we hope you all had a very merry christmas. and we're going to tell you how we spent ours, but that's a little later in the hour. but first, it was of course a very difficult holiday for family, friends and colleagues of two fallen nypd officers, rafael ramos and winjian lu. funeral arrangements have not yet been finalized for officer lu.
1:01 am
during christmas midnight has at st. patrick's cardinal timothy dolan recalled for renewed faith in a shaken city and delivered this message to its mayor. >> i guess that's why you're here, mayor de blasio, as we face tensions and divisions in our beloved city, as you and so many other leaders tried your best to invite us to dialogue, to listen instead of shouting, to work together instead of accusing. >> and since the assassinations, police have been on high alert, two officers have led to at least six arrests, one suspect in custody was overheard talking about killing cops and when his parent was searched, they found in disturbing arsenal of weapons. take a look there. is so the city on high alert, david and now they're following up on some of these leads, they're taking it very seriously, if you make a threat against a police officer to do them harm or cause them harm, they're going to come after you.
1:02 am
>> it's not just the threats, i got a text before i walked in here from a police officer on duty, they have loosened the lug nuts of their personal cars, they have done this to transit police, there are reports that have been filed. this arsenal is the big danger, in the city where they have some of the toughest gun laws in the country, you can't stop illegal guns from getting into the hands of criminals. and those guns that are fired indiscriminately can hit passers by and civilians. >> we're facing a lot of challenges right now in new york city, but so are other cities across the country, juan. your thoughts on this and how we have handled it here. >> new york is such an unusual arena, but it is the arena for the nation in some ways, if you look at ferguson and what happened in ferguson, it's a very different situation, and
1:03 am
just what happened in that other city in missouri. we just have to look at it and say, well, i don't understand why there's any violence at all. there you have a black mayor who said there's a taint, the guy pulls a gun and the police officer has every right to defend himself and fires. so what you get here is different. i think in new york, you have had a very difficult political situation with stop and frisk, which has divided so many people in this city, when you go back, there's mayor giuliani, it's mayor bloomberg and you look at the response that mayor de blasio, it's overwhelming, the black community supports mayor de blasio. the white community -- >> i have to disagree on this. one, stop, question and frisk, which is what it is, has been around since the '60s, it's been through the supreme court. the problem is, i do agree you can isolate, there are differences in each city, but you have an overarching
1:04 am
narrative of police. in the case of berkeley, you have misinformation that were sent out -- 300 people showed up and started rioting. so this environment has been created largely by the attacks on police, largely by the race industry, by sharpton, by holding a community relations service, by de blasio telling people his son has to work a different way or he has to teach him a different way, and what ends up happening is you have this hatred of police. >> that is so simple. the fact is that -- it's not true what you say. what's true is that a white judge in negotiations ruled against stop and frisk. that's the fact. and that was under mayor bloomberg. you can bad mouth the judge, i'm just telling you that's the reality. this has been a situation for young black men in this city and i think it's generated a lot of
1:05 am
tension -- >> all right, we're going to take this discussion around the table because you can see that emotions are very high about this and there's a difference of opinion, but let's remember there's a law of the land, stop and frisk is legal. >> i'm concerned about leadership, you talk about new york and how that's an example for the nation in many ways. look at bill de blasio, he was absolutely horrific in this. i'm concerned about why politicians from the president on down to local community members aren't realizing they absolutely must step forward and make a point to unify right now and bring people together. bill de blasio has been outrageous and now police don't feel supported so these police have to go out there and risk their lives and they feel that their mayor doesn't have their back and that's a huge problem in many communities. i'm sure the police feel that if they step us if someone pulls a gun on them and they have to defend themselves they're going to have to answer to the media
1:06 am
and some political figures who are going to make them out to be the bad guy right off the bat, from day one. >> we should support good p cops and agree with you, most cops are good cops. but you should not be sitting here and defending badded cops. >> nobody's doing that. >> grand juries always give cops discretion and leeway, that's not the issue. >> this is the narrative that's been polluting part of the environment since the grand jury in ferguson. now grand juries are the bad guys. we have got to stop with the small ball. >> let's play big ball. >> i don't think i can criticize the cardinal anyway, i'm catholic. i like the address he gave, i like when you turn down the
1:07 am
temperature. i'm so pro cop, but i didn't like when they turned their backs on the mayor, because to me that's just turning up the tem temp. if i'm going to -- this whole thing was premised on a false premonition that black lives are in more danger from the police than they are this neighborhood. mayor giuliani got in trouble for it. he said these youth out there are more in trouble from other youth in their own neighborhood. not the police, and he was attacked for that. >> part of the reason that happens is because it's not about dealing with the issues. we have all death with the issues and we may feel different about some things. i have been in these rallies, i have been in these marches, i have been in this rallies, in ferguson or d.c. with the national action network. you're looking at people who are
1:08 am
a collection of hardcore progressives. there are people that protest peacefully, fine, take them out of the mix. who do you hear from the organizations, the communists, the national action network, all of these groups that are out there taking over. >> i like what the archbishop -- i like what the naacp said. i just think that is terrific and that's part of the rising temperature. >> let's say i was not in ferguson or here in new york city. >> i want to tell you these are not hard -- if they were interracial. >> let me finish. let me finish. most of them in fact were young people and college students. i'm walking through. most of them are college students, i have never seen anything like this, i wanted to
1:09 am
participate, wanted to get involved. that isn't any hardcore -- >> yes it is, one, i spent hours, not a couple of hours, not a couple of minutes, i went there from the beginning before the march, through the end of the march in d.c., there are college kids. the problem is you have too many of the hardcore groups. >> the problem is the people who are calling for -- for example, reverend al sharpton who was print at that protest who was saying we want dead cops, when do we want them, now. >> i have no idea. for me, i don't have any idea. >> bill de blasio was supporting protesters. >> are you an american? do you forgets that we love protests? we are tea party people? we love a protest. >> that's a problem.
1:10 am
>> you're right, go out there and protest. >> but i'm not out there calling for cops to be killed. >> just keep it within the law. whatever problem with this is, a lot of this is, we don't have statistics, the government should produce statistics on police shootings, police injuries. >> and police hires. so we're going to get out of into somebody else's because earlier on cnn jeffrey toobin had this to say. >> i think one of the reasons things new york are actually going to get better, most of the new hires to the new york city police department are not ramos, lu, are not typical of what's happeni ining in the new york c
1:11 am
police department. >> so is that a racist comment? >> well, i mean, i don't know if it's racist, but it is kind of silly. if you look at the new york police department, it is very integrated and i feel that a lot of my friends on facebook, there are a lot of protesters on there. i agree with juan, that most of these protesters, there's people who want to believe in justice, but the people who are running these things, groups like answer, you laughed when you mentioned communist, but the answer is a communist. and they're heavily involved. >> they have weekly meetings, tsl website, go to rev com. i can list them, they were all sponsors of weekend of resistance in october. >> everyone in david's life is common nis. >> they're the ones ginning up the business. >> people have been using
1:12 am
communists throughout american history, through the civil rights -- >> there were dozens of them, hundreds of them. >> but the point is, there are people who are using that to further their own political and part -- young people who want to be part of a movement. >> al sharpton. >> he's not my pal by any stretch. >> i can't even tease you. >> you're scaring me, juan. >> what about this comment from jeffrey toobin? >> it's so much about race. white on white violence doesn't exist? black on black violence doesn't exist? there are people that are criminals, there are people in the wrong, there are cops that do good things and cops that do bad things, stop making everything in this country about race because you need to sell a story. >> dial this back to the point
1:13 am
our politicians, political leaders and public leaders out there, i the citizens are the people with families. >> ramos and lu, their families are agreeing with it right now. ramos was actually on duty for the most part at a school named after another policeman who was killed in the line of duty. these are american citizens, your friends, your neighbors with who are police officers. they choose to do the job. >> your family members too. >> my cousin, former chief of police as well. puerto rican, the point is why do you have to judge somebody by the color of their skin. it's not going to be white officers hired? why would you ever -- that is a
1:14 am
racist statement. you know what it's saying? you shouldn't hire white officers because they're going to be racist. that is a grotesque statement. >> wait a minute, you should hire the best officers. the chinese, the black -- the police union, the firefighters union, that's a fact. but when you get to the toobin thing. >> yeah, you forget the history? >> it's been a long time. >> my point to you is we now have a police department in this city, where we have some racial integration. >> i'm saying that's because people push to say let's get the best police officers. >> you got to apply for the job. apply for the police, there's tremendous opportunities to be able to work in government positions, to work as first
1:15 am
responders, embrace it, don't complainal all the time, be part of the solution. if i don't do it, who will? i want to give back, i want to be part of the community, that's the deal. and officer ramos, working an overtime shift so he can support his son that is in college, his 13-year-old as well. they're americans, they're people, they're first responders and they're putting it on the line every day, especially in high risk communities, like i used to live in when i grew up in san francisco in the mission district. when you're in trouble you're calling the police and hoping they come. >> next what president obama told u.s. troops on christmas that a lot of people might find very hard to believe. and later, we have got an update for you on president bush who spent christmas in the hospital, details on 41 coming up.
1:19 am
1:20 am
and women in the american armed forces, afghanistan has a chance to rebuild its own country. we are safer, it's not going to be a source terrorist attacks again. >> obama is confident -- this year's been the deadliest of the 13-year war. nearly 10,000 civilians and 5,000 afghan forces have been killed. 6 senator john mccain just spent christmas in afghanistan and he delivered this warning before he left about what will happen if america pulls out too soon. >> it's going to be a lot worse unless we leave a force behind, rather than removing everybody from afghanistan, we'll see the iraqi movie again, and it will be tragic, because again, we wasted too much american blood and treasure. >> so will we see the iraq movie again? this is a political decision, tom, it's been a decision where
1:21 am
the nation, you hear the nation war weary, our soldiers by the way are not war weary, we ta. here we have a political precipitous withdrawal as many on the right say, many on the left say it's not. what do you say? is this a case of pulling out early and not considering the consequences? >> didn't president obama run on this is the good war? remember he ran -- we took our eye off the ball, wasn't that the rallying cry at the time. he said we have got to get back there, but then it all reversed, and president obama has a knack for saying, everything's fine. >> has he declared victory? >> he did and he said we're safer, and it's not going to be a launching pad for terrorism, but based on what? >> well, let me ask you this, juan. we just gave four terrorists from gitmo back to afghanistan, we have already called our facility there for holding them.
1:22 am
we have given them back, these are people that agree with the same kind of people that attacked a school, killed 150 mostly children, we're talking about terrorists that indiscriminately kill, does that guarantee safety? >> that's not what happened, what happened was the new president of afghanistan asked president obama as part of the reconciliation for a new atmosphere between the u.s. and afghanistan, remember, how difficult president karzai was for the u.s. government, that these four who had been clear to be sent away be returned and that was the deal. so that's what happened there. now you say these guys support the killing of 150 children? >> the same ideology that -- >> i don't know about that. >> terrorists don't separate. we only kill children, we only blow up bombs in markets, we only kill troops.
1:23 am
the president karzai that juan mentioned-- >> they realized they can't go it alone, they have asked for more security forces to help stabilize the situation in afghanistan. we still do have troops and men and women in afghanistan, we're going to need this more. this isn't a reality conversation we're having. so president obama can hold up the v sign all he wants, that's not what's going on in afghanistan right now, that is an area that can really teter in the wrong direction really quickly. all the people that i know in the intelligence forces that have been in afghanistan in the last few weeks say it is amongst the scariest times they have seen in afghanistan in the past ten years, in 2er7terms of the threat level and instability. so this is the -- they're not ready for show time in afghanistan. because we have men and women there who are going to need security forces to keep them safe as well. otherwise we're relying on the afghter afghanis to do it as we.
1:24 am
>> the caveat, the warning is be aware of everybody around you, not to go along with -- not just the troops that kimberly mentioned, but contractors and people who work in afghanistan. the lesser the numbers, the higher the propensity of attacks, that's the way it plays. >> the number of troops that risk their lives, some lose their lives. what do we do. . >> whether you get to walk away scot-free, he doesn't get to blame that the situation on somebody else. he's goingaround saying the world is better, it's safer, if you ask people and you poll them, people have large national
1:25 am
security concerns. they're very worried when you poll people coming out of the national election, they're worried about syria, they're worried about afghanistan, they're worried about the fact that people are beheading american journalists. i don't know if this president gets it. >> can i speak? given that it's the christmas season, i don't like to have to do this, i want to speak to the audience tonight for republicans and conservatives, and let me say that most republicans and most conservatives according to almost every poll think it's time for us to get out of afghanistan. and they join with democrats on this point. and when it comes to nation building and staying until, oh, gee, they have every school, every road paved, everyone is safe. that's not our issue. these folks here, i don't know what they're representing. but for conservatives, we say enough. >> you're a conservative now? >> i didn't hear any conservatives speaking on this
1:26 am
panel. >> it's a bizarre wean. >> we're on fox news, we need a conservative point of view sometime. >> he's right, there are a lot of conservatives that they -- >> because we're not being allowed to do the job correctly. >> you're right, it's not a conservative or democrat issue, it's a national security issue. >> it is. >> and anyone can position chur left or right or anyone can poll left or right. but until the attacks are out are largely gone. until -- >> is the middle east going to be a day where there are no attacks. >> i said until they are largely gone. the bottom line on this is this is not a conservative or democrat issue, and our troops are not wary, they were not given the tools to do the job. >> they're ready to serve. >> they need tools to do the job right. >> to save time, president obama is releasing all these gitmo prisoners. i'm wondering why are we releasing everybody from gitmo
1:27 am
1:31 am
it's the day after christmas, some of you are still opening presents, others of you returning them. we hope you all had a great christmas. we're going to share with you now what we did on the holiday, and, you know guys, i want to start because i want to show you all a tape of me being abused on christmas day. >> it's just like being here. >> ooohhh! >> where are you? oh, my gosh. >> oh, who is this? >> that's a good question, who is this? >> since i was buried, i couldn't see a thing. that was pepper, that was wes y wesley, they're the twin girls who are 2. and that's their brother in the
1:32 am
green, that's elias. we were in washington on christmas day, they had such a bonanza of gifts, as you can imagine, i just got buried. >> what is that sweater you're wearing? >> that's an old bullets movie. >> i did fox and friends at around 8:00 and then i went over to their house and, boy, the party was on. i tell you. >> but how much fun, though? they're so cute, there are four of them. >> what happened at your house? >> we had a good time, we went to the god parents and had dinner with the grand parents. they had an 11-foot tree u that made mine look like minimouse and jasper is a big eater, that's his telescope that he got from his dad, so it was a good
1:33 am
day for row dog. >> you have to tell us about the t rex. >> one of the things he got was the t rex, in the bed, like scared at night. not exactly my idea of company, if you know what i mean. >> i know you had a great christmas. >> i did, i went home to staten island. lots of italian food. i usually don't drink. kimberly knows i don't drink. but i did have a cocktail or two. this is why u i don't drink. i had a little bow on my head. i was a little low on cash this year, so i created one of my own. >> those shoes kimberly wore.
1:34 am
>> fuzzy bedroom slippers. >> you look great. you look very separatory, calm. >> christmas, a great tradition, in our home it's the same as when i was a kid. my two daughters, opened up their presents, it's hard to compete with santa, because he brings all the best gifts, but we try to get a look at all those smiley faces, after we go to church, look at all those faces, they're not as happy. i got to spoil their fun, haul them off to church. that's what happened to me and my brother, we would open our presents. even if you're not religious, take your kids to church on christmas morning, it's the only thing that gets them out of that christmas daze of gifts. >> you're right, it's kind of hard because they don't understand, i think, what this is about. david? >> what is going on here? >> i'm kidding. >> let me ask you something, now, david. i know you had a party on
1:35 am
christmas. >> look, i'm a single guy. >> wait a minute, are you blushing? >> i had a nice christmas at mom's. we have a picture of the christmas tree up there. she does a great job. i have got all the ornaments on there from my grand parents. and she always makes my favorite dessert, trifle. so that means with lots of brandy. you see the drinks come in the dessert in my home. >> that's very nice. >> very quickly, though. any of you guys returning gifts? >> no. >> no, you just regift them. >> you open it up and you look in, it's a sweater. it's a very personal choice, you know, what kind of pattern you're going to wear, but you can just kind of close up the box and give it to someone else.
1:36 am
1:40 am
peanut butter and jealous. >> stop saying that. >> haters going to hate. >> that is not a natural thing that people say. >> it is the movie that north korea did not want americans to see and it made history yesterday. the it is the first studio film to premier online. it also debuted in theaters on christmas stay. seth rogan couldn't contain his
1:41 am
excitement. >> we thought this might not happen at all. we just want to say thank you to all the theaters like this and for people like you guys, this literally would not be [ bleep ] happening right now. >> the movie isn't getting rave reviews from critics, but did any of you guys happen to see it yet? >> the dr. evil, $1 million. >> $1 million is not a lot of money. >> considering the obstacles that it faced, we were thinking that no one was going to be able to see this movie at ail. they went to great lengths to get people to be able to see it online. >> i don't go to movies and i don't know why anybody does. two hours out of your life? they're too long. everything should be an hour. i only watch tv shows now because they're an hour long. and when you have a lot of energy. when you have kids you don't want to stay up for two hours. if you've got a lot of energy
1:42 am
you can watch another one. but going up to the movie, it takes a half an hour get there, you watch all the previews. it's too much. >> do you know how much they charge you for a coke and popcorn? $7 for popcorn. >> very expensive. >> look at juan. >> i like movies, but it's too long. >> go to north korea in the time it takes to go to the movies. >> despite the variety, it was an evening of cinematic waterboarding, i don't think that's very nice. but do you think americans will plunk it out. this is an act of patriotism. like we're standing up for free speech. >> it's not a hard personal statement, but it's a personal statement that we're not going to be bullied. i they's exactly right. hats off to them. i wish sony had done this earlier. it's not just american critics,
1:43 am
but they love it. they think it's a great movie. guess what? they like the criticism. >> this is the best thing that happened to sony and this film, the criticism, otherwise it would have been just immediately released to video and pay-per-view. >> what are they celebrating? i hope it's a funny movie whenever i get to see it on home video. >> you're just waiting to see it for free. >> i'm a businessman, you spent $40 million, you made 1 milli$1n on it's first day out of the box. >> you know what? we're not going to be silenced. america is going stand up p for america, you're going to stand up for free speech. >> i think we're going to find out that this was the greatest pr ploy. it's not the first time the white house has worked with amy pascal and sony. >> what do you think about seth rogan showing up in the theater? >> that's cool. i have nothing against these
1:44 am
guys. i just think it's funny that we're celebrating one million on a $44 million investment. i think you ought to wait a little longer. >> a million people downloaded it illegally as well. >> kim jong-un watched it first. >> we're losing david web, i don't know if you heard these last commentary. getting a little crazy. well coming up, want to ride around in president obama's motorcade? i do.
1:48 am
one of t ---even she can't believe it, posting photos to facebook captioned wondering why anyone would trust me with a 15 passenger vannal full of reporters, well, we wouldn't anymore. >> out of a job. >> one of them said zoomed through the empty streets, people took my picture but they didn't realize it was just me. the secret service defends the use of its volunteer drivers saying it's been standard
1:49 am
practice since at least the 1980s when i was just a baby. >> that's a big duh, dummy, bad idea. >> this is the worst, i think it's a total security breach. you want kids, it's going to come, drive your car around, post selfies on facebook. >> it's got to be -- i'm sure she's going to get in trouble with this. >> we just lost her job for her. >> she's carrying around the reporters, does that say that the reporters are less valuable? they don't care that there's a 15 passenger van full of reporters and they got some student driving them arrange. >> how many politicians want to get rid of the reporters and the press pool all together. i have to say i covered president reagan for "the
1:50 am
washington post." the people who drive reporters around often times are people who just work for whatever transportation company. so she just made this thing very public and foolish, but it's nothing different. and i will say when there is an emergency, the people in the bubble, they are all driven by -- there is the president, the staff who are critical folks are in a small group that's all very protected and local police then are guiding people like that woman and the streets are empty, it's not like she can have an accident or anything. >> david, these people are democrats, what are they doing with volunteers. shouldn't these be union jobs? >> nbesides the fact that she just ruined it for every other donor who wanted their daughter to drive the reporters off the cliff. and juan's right, they have been doing this practice all along and inside the bubble, they're all driven by secret service, trained drivers. but, you know, this comes down to where are our secret service
1:51 am
being used where they're being pushed aside and why aren't we hiring more of them to go drive the president around? i'm just trying to get back to the union argument. >> listen, look, this is actually a dangerous job, driving around in these motorcades. 2006, an officer lost their life driving president george w. bush. 2007, a police officer gets in a motorcycle crash. this is dangerous stuff. >> why not just train her? if you wanting to just use regular people, if that's your argument, train them, and she said she had never driven a fan, forget a van in this kind of capacity, she had never driven a van before. like me, i have never driven a stick shift, give it a shot. >> i'm always nervous when i'm with any driver, even these limo drivers, i never think that they're safe. >> but your bubble is only as
1:52 am
good as the perimeter around it. i would want to make sure that i was extra secure and anybody that's in that situation. not to hurt volunteers or to cast aspersions. god bless volunteers. i don't think this is the best spot for it. you're supposed to have certain classes with a license to be able to drive different vehicles, so i don't understand how anything goes and just because we have been doing it for a long time, doesn't mean that we still should. >> one more thing is up next. há
1:56 am
time now for one more thing, and we want to take a moment to send our heart felt wishes for a speedy recovery to george h.w. bush. i think you heard, he was admitted to the hospital for shortness of breath. we have heard from the family and he is doing well and is in great spirits. keep in mind that his 90th birthday in june, when he was doing the high dive, doing the parachute jumping, what a guy. all the best, 41. okay, what do we got next? >> it was a big basketball christmas day all across the

>> a mama kangaroo who's very protective of her young. comes in for a closer look. >> oh, my gosh. >> yeah, you want to protect your drone, don't mess with kangar kangaroos. >> i am going to make your life, are you ready? >> whoa. >> you're going to sleep better, j & d foods, they have launched bacon scented pillows. it's very tempting. it's a great idea. >> it wakes you up. >> do you gnaw on your pillow at night? >> you wake up and your hair
1:59 am
smells like bacon? >> i don't know. what do you bathe with regular cream in the morning? >> you wake up, you get a site of eggs and some pancakes. >> it's getting weirder by the minute. i don't know what to say, david. >> i love this story, this is the story of the night. this passenger that got on american airlines, they said merry christmas to him before he boarded. he said don't say merry christmas, this is the christmas grinch, he gets on the airplane, he gets greeted because they say merry christmas. what really got me w why don't you get me the name of this guy so i can tell everybody the name of this christmas grinch. i'm glad they threw him off the airplane. it's christmas, dude, get over yourself. >> at least we have still some christmas spirit here. juan williams. absolutely.
2:00 am
>> well time to go. that's it for us. have a great weekend, everyone. "special report" is next. you. breaking tonight, president obama suggesting the u.s. is less racially divided than when he took office. despite the growing protests and threats against police in new york city over the death of eric garner and the new racially charged outrage over the death of another black 18-year-old in missouri at the hands of a white police officer. good evening. welcome to "the kelly file." i'm shannon breem in for megyn kelly. demonstrators staging a die-in at the st. louis airport chanting "your silence is violence." the scene far calmer than when the violent protests first erupted after surveillance video showed a white police officer
