some of the things we saw in the comprehensive immigration reform bill that passed the senate in 2013. which had 14 republicans vote for it and the president wanted to sign. but that bill also had a pathway to citizenship for many of the undocumented immigrants living in this country. so i think the president is going to be unlikely to sign anything that doesn't also include a pathway to citizenship and the republicans taking a piecemeal approach and especially if they decide to dismantle his executive action, the president might veto. >> do you see him ever relenting on the pathway to citizenship? let's say you have a legal status that does not grant you an automatic or a way to become a citizen, but while you still work here potentially pay taxes, you know, you just don't vote? >> sure. i mean, the advocacy groups in the latino groups are steadfast on there being a pathway to citizenship. they have the ear of the president and the ear of many democrats right now. i don't see him relenting on
12:20 pm
that. of course, anything could happen maybe him and mitch mcconnell and the republicans that are in charge in congress will be able to sit down and hash something out. i think if the republicans go after his executive action that's a poisoning of the well on the other side. they said that the president poisoned the well granting executive action in the first place. if they go ahead and try to dismantle it or do a piecemeal approach without also trying to bring democrats on board on some of the other priorities, we could see the whole thing fall apart again. >> oh, man, they already said that the president would veto any potential dismantling of the executive order. so if the republicans -- are the republicans going to lob stuff up there that the president will veto or do you think that finally anything substantive will actually get passed? >> it's tough to say with this congress, eric but right now when we first get back in january they're looking at the homeland security spending bill which is something that is going to expire in february and they're hoping to use that as a negotiating tool to get the executive action dismantled.
12:21 pm
again, the president is not going to stand for that. and if they did decide to not fund homeland security, the president could say, well everyone in homeland security is essential and keep them working anyway. the republicans don't have a lot of leverage to work with. this could go through the courts but i think if any of the tactics are taken it's not going to be helpful to getting anything larger done. >> sometimes it's good to be on vacation. that the president doesn't have to think of this stuff. thank you. good to see you. >> thank you, eric. after a scandal-filled 2014 the irs has been left reeling from the recently passed budget bill that cut nearly $350 million in funding that staffers warn could delay tax returns. now new evidence of how deeply the irs was involved in the targeting of conservative groups. chief congressional correspondent mike emanuel has more.

>> reporter: it wasn't just about lois lerner. so says the report on the irs targeting of conservative group. there were eight leaders who could have stopped the harassment of groups seeking tax exempt status. >> it was in fact all the way to the top of the commissioner level this was allowed to continue. i think that gives a good reason for the next congress to continue the investigation until they have looked at all documents and put in the reforms to make sure this never happens again. >> reporter: an agent was e-mailed in 2013 -- quote, i think there's a number of ways to deny them. let me talk to sharon light tomorrow about it and get some ideas from her as well. this sounds like a bad org. and then from stephen miller to chief of staff, when he considered telling a subcommittee about the irs targeting of conservatives

the ability of taxpayers to get the assistance they need is going to be more difficult things like that. >> critics say that the agency should work on its efficient. >> i all that happened is the budget is budget for the irs. perhaps they should try something like become more productive like the rest of the world does. >> reporter: before the scandal the irs had a positive rating of 20% with the public. now after the fact it's likely to remain an easy target. somewhere to cut at budget time. in washington, mike emanuel, fox news. well coming up, we'll look at this story. a tweet that was posted by one of eric garner's daughters on christmas day. it's upsetting a lot of police officers. we'll have what she tweeted and why this is causing a controversy. plus, it is an emotional day of tribute and respect. new york city honoring the first of the two police officers so savagely ambushed by that anti-police mad man one week ago. officer rafael ramos, remembered and honored by thousands at his funeral.

12:31 pm
this? >> what we hope is there's never any, because if so then laura, what we're faced with is potentially she could have been the cause of any act against his family or the police officer themselves. in other words whether it's a civil or a criminal case you have to prove this connection of what we call causation. did this tweet cause damage to the family? at this point, no i don't believe civilly there's any action whatsoever. but god forbid if somebody would do that and they could link this to be a cause not easy, then surely she could be implicated. >> on the criminal side of this, something that god forbid were to happen to this officer at the hands of someone who wanted revenge for the garner family what about a criminal charge or what about cyber harassment? >> well, those are really good points but frankly, there has to be aside from causation, you also have to show some sort of complicity. yes, she put out the information, but it was public information to boot. the defense is going to say,
12:32 pm
wait a minute, this is public information. if someone wanted this address they could get it. trying to link this to the criminal act is not possible. because there's just too many attenuating circumstances and because it's public knowledge to begin with those individuals out there that want to do harm to this police officer can certainly do so. >> well, you know, she also tweeted out there were also other family members linked to the link she put out on her twitter account. bob, on the civil side of this, could eric garner be held liable, did she violate the officer's rights? take a look at emotional distress. >> that's a real stretch. i don't think you'll get that far but i think the commentary and i think we would all agree this is the danger of the legal side of social media and the availability of information and the no longer really invasion of privacy because of how free agent is given. in situations like this when we
12:33 pm
see this horrific act that happened and how many lives it's destroyed and the emotions that will never be the same for these families, we have to look at this and see how do we -- what can be done? in the area of social media, to sort of regress a little bit and sort of look at this in a different fashion because i'm afraid as this continues to expand the legal ramifications are going to happen down the road. it's a concern i think for all of us. >> yeah, mercedes, what's the take away from this, free speech versus public safety? of course such a hot topic right now? what should people know before getting on social media and tweeting out such information? >> really be very responsible. and the bottom line is this. even though you think this is an innocent act maybe that innocent act can lead those who are already have an altered state or have mental illness to go forward and do something as a result. but it really boils down to if you have your private information, try to make sure that private information remains private. remove your addresses.
12:34 pm
keep your -- you know, caller i.d. should be on private. lots of ways you can protect yourself and those are certainly -- lessons to be learned if that public information is out there, someone can retweet it or it can lead to harm. >> bob, no doubt this woman probably did not tweet out a link to his address so that people can send him a christmas card or a fruit basket. this was -- she said this man was there when my father was arrested and died. >> and that's -- yeah, that's the problem, laura. that the act was reckless on her part. and it's -- you cannot -- you have to know that her state of mind is such that wanting the people to know where this guy is, maybe, maybe, you don't want to be judgmental. and this is hoping that something could happen. but again, exactly what mercedes said, the lack of responsibility today in the social media area, in the law we are in, and these are the first things you go look
12:35 pm
for when that's a civil or a criminal case, what's out there? you must act responsible, if you make a statement, whether innocent or intended the consequence you could be held responsible for. that's what we have to take away from this. >> all right. thank you so much for being mere. we'll keep a close eye on this story as it develops. thank you. >> thank you, laura. >> happy new year guys. >> you too. well you know, laura not really a happy new year for those in the boston area, because a school department made a massive payroll mistake yesterday. nearly 1,300 employees of the plymouth public school system, well, they woke up to find out that instead of seeing their salary deposited in their bank account, the money was actually taken out. yep, withdrawn by the school system. well, the school system says a human error caused this snafu. officials are working to fix the problem, but turns out that some banks can't make any corrections until monday. >> yikes. >> how would you like that? >> i don't like that. sony playstation and

sony's playstation service went down on christmas day. a hacking group called lizard squad claimed responsibility. meanwhile, microsoft said theirs is mostly restored. besides the breach at sony pictures hackers stole information on 77 million playstation users back in 2011. well, some new developments in the fight against a radical islamic terrorists of isis. the u.s. led coalition carrying out 12 air strikes today against the terror group in iraq and syria. this as we're told the targets destroyed included some buildings, fighter positions and vehicles. meanwhile, a monitoring group claims that isis is losing ground around kobani. that's the key town along the turkish border. we're told kurdish fighters now control more than 60% of the territory around there. so the big question today -- could those gains be repeated?
12:41 pm
we have a former spokesman for four ambassadors to the united nations and a fox news contributor from california. rick, always good to see you. i mean, it seems that kobani could be a turning point. do you think the coalition victory there could eventually pave the way for a wider defeat of isis in the region? >> we have to hope we can defeat isis. right now we're working on a deficit as you know. it took us a long time to get focused on the growth of isis. we only started air strikes in late september so you have to remember that. the only way that air strikes are going to work is if we have specific intelligence. it seems like lately what we have had is air strikes without the intelligence. so we're hitting isis, but like a balloon they're going to pop up in another area. we have seen this lack of intelligence be a major problem for the united states. if you remember, just last month, u.s. special operations forces tried to rescue hostages
12:42 pm
in yemen and when the u.s. special forces got there we found out that the hostage takers -- the terrorists had picked up and moved on and we didn't even know it. the same thing happened in syria in august. so we're working on a deficit. we are having problems with specific intelligence, and yet, we have the democrats who keep attacking intelligence gathering. so this is a real serious problem for the obama administration. >> well, how do we fix this? we don't have forces on the ground. you don't have the rebel trained forces, 5,000 a year. this will take a year to get 5,000 deployed out there, so how can we fix this? >> well, again, we're working on a deficit because we have just really ignored the isis problem and this growing radical islamist problem. that's i think the story of 2014, the growing problem we have ignored. we can fix it, we are the best at this. what we have to do is first have the will to do it. we have to have an administration that says we're going to take the hit from the

criteria, you are really making americans unsafe. so what we need to do is a better job of communicating to the american public that yes, we all want the troops home. but there are things that we have to do like intelligence gathering which require u.s. troops on the ground. that is what it's going to take to defeat isis and this growing radical islamic terrorist problem. >> finally we can eventually -- we can defeat the radical islamic terrorists. you have the increasing number of foreign fighters, you see the disaffected young men who are attracted to this twisted philosophy. 12:45 pm
how do we change this mind set? can we change this mind set and this philosophy to make us all safe? >> yeah, we have to change this. this is a growing serious problems of individuals being radicalized. they can be radicalized in our own u.s. cities. the thing that we have to do is we have to start from the top. the president needs to be able to say the word, radical islamists. we have to be able to know what we're fighting. we cannot hide from this. it doesn't mean that all followers of islam are radicals. it means that there are radical islamists that are trying to kill us. we need to point that out. we need to have policies that go after them. and we need to not be afraid to call things terrorists. it's not -- you know, not just vandalism. it's not workplace violence. we have to call these problems out and then fund them and all go after it. whether or not there are campaign promises that somehow look like, you know, they're up
