controversych hi will. >> hi, eric. north korea issuing that statement earlier today which, in part says that president obama quote is reckless in his words and deeds in hurling that racially charged insult towards the president. a state department spokesperson quickly fired back saying the north korean's statement was offensive, ridiculous and absurd. now this comes as a report that the isolated nation is having more problems today with its internet and cell phones. that's the second time this week. it's obviously not a tech savvy country. but going dark does have an impact on forth korea's leadership. they have been quick to blame the united states. at the same time viewers take in "the interview." many theaters so far has made more than $1.5 million roughly shown at 300 arthouse theaters. before it started it was supposed to open up between 2
3:06 pm
and 3,000 theaters. profits are far less than what was initially expected. the numbers do not include online sales, which are harder to track. it is safe to say, so far the movie is nowhere close to the $44 million it took to produce and tens of millions more spent on promotions. while they continue to add up all the dollars, tray having other problems eric. >> that is that there have been hundreds of hows of illegal downloads in the past two days since the movie made its debut on christmas, eric. >> a lot of people watching. thanks so much. meanwhile, sony is working to restore its play station network after another cyber attack on christmas day. sony says the services are gradually coming back online. a group calling itself lizard squad claiming responsibility for this attack. meanwhile, microsoft says it's x-box network is now mostly restored after getting hit by the same cyber attack. and there has been a win in the war on terror a wanted extremist leader with more than

opposition groups will take part. . well well. well, as he gears up for the run, we learn more about jeb bush. american bridge released e-mails about the time he was in office. those e-mailles suggesting he has been quick to defend his conservative principles even from some of his harshest critics. we have the details on what those e-mails show. >> hi, any jeb bush campaign is going to be full of decisions his dad and brother made during their white house tenure, rather a day after the defining moment of his brother's presidency, september 11th 2001 one of these bush e-mails reveals a personal struggle about whether or not schools in florida should close. he writes this. it is an interesting question and real dilemma. it needs to be done for the historical impact of 9/11-01. then there is the 2000 florida recount brought a lot of e-mail
3:10 pm
traffic bush's way. in one note, he wrote to the now chief justice of the supreme court, john roberts, quote, thank you for your time today. i really appreciate your input on my role in this unique and historic situation. there is also a lot in there about his heart break over the federal raid that returned elian gonzalez to cuba. he rights, i believe that a dad has rights that outweigh all others. republican strategists are looking at these e-mails, saying they were released by a democratic pack, they are going to help george bush or rather jeb bush. he was intimate with his constituents and respectfully disagreed with them and explains why. it shows he can make a strong stand and he chose leadership. >> experts on the left are saying more problems for jeb bush because they may not work
3:11 pm
with the conservative party. >> the problem with conservatives, we see that in the e-mails in the issue of abortion, in the issue of immigration, we see that in the issue of ed categories. i mean, he has got a real problem on the right flank. >> bush also declined an interview request from barbara walters in one e-mail from 2000 saying he's not really a big fan of the national spotlight. eric. >> well, that potentially could change pretty soon. tanks, peter. right now, president obama is on vioxx in half. but, when he gets back, he's facing potential battles with the republican party tax reform and obamacare are just two items on the agenda. dan springer traveling with the president live from honolulu, half hello dan. >> reporter: hey julie. i know this will come as a shock to you, nobody is predicting kum bay a. president obama showed a
3:12 pm
willingness, some say a desire to go it alone. his executive action a few weeks after the mid-term election infuriated republicans. it came right after the incoming senate majority leader met with president obama at the white house where they pledged to find common ground. but then instead of waiting and working with the new congress on immigration, mr. obama signed an executive action which could grant amnesty for up to 5 million illegal immigrants. another area of deep disagreement is obamacare. expect congress to pass laws that chip away at obamacare. one that could get to the president's desk is eliminating the tax on medical devices. an area where the president seems poised to work with congress is corporate tax relief t. goal is to keep jobs and profits in the u.s. . >> it's a complicated issue. it's a big issue. so there will be a lot of sticking points there. but that does seem to be one area where the president has offered, is looking at and certainly republicans are. free trade is other. there is a bunch of free trait
3:13 pm
agreements that could potentially be hammered out. again, that's an issue that divides the president's party, more so than the republicans. so it might get a little sticky there. >> reporter: and another area that the gop really wants to attack right away is the keystone xl pipeline. now they have the majority in the senate. it looks like that can pass that chamber and get to the president's desk. will he veto? that's the big question. back to you, laura sorry my good friend. how are you? i can't see you. i have the sun is blinding me. i'm so sorry. >> oh it's understandable. i love the background o your live shot. hello to your crew in hawaii. thank you for your report, dan see you later. more than 50 years after washington cut ties with communist cuba, the u.s. is planning to turn a huge seven-story mission into a full-time embassy. according to diplomatic sources, washington hopes to expand its staff in havana by more than 200

people. the move coming after president obama's surprise announcement, he is trying to normalize relations with cuba. experts think it will be a powerful symbol for the u.s. wanting to revive diplomatic relations there, this even though the political prisoners has quad dominican republicled in recent years. human rights groups say the castro regime continues to imse i imprison 57000 in work camps and upwards of 70 fugitives, including cop killers remain fugitives from justice here in america. laura. >> and we have another one major trouble for a former child star. the actor better known as screech from "saved by the bell," in trouble with the law. we'll tell you why. >> tax season, a few months away. the irs the warning of major slow downs. what does that mean for our tax refund? >> plus, president obama face agnew battle come january, republicans ready to act on immigration.

workers' bank accounts instead of depositing paychecks. the man known as screech in trouble with the law after dustin diamond in the tv show "saved by the bell" is now charged with stabbing a man christmas day. kodak is set to make a big comeback following its 2012 bankruptcy filing t. company is announcing return to store shelves in the u.s. with a new smartphone next year. the irs is getting slammed again over accusations of political targeting. a congressional report revealing new evidence how deeply it says the agency was involved in the scandal of going after conservative groups. chief congressional correspondent mike emanuel has more. >> reporter: it wasn't just about lois lerner says a report on the irs targeting of conservative group. the report says there are eight senior leaders in a position to prevent or stop the harassment of groups seeking tax exempt
3:20 pm
status. >> it went all the way to the top of the commissioner level that this was allowed to continue. i think that gives a good reason for the next congress to continue the investigation until they've looked at all the documents and then put in the reforms to make sure this never happens again. >> reporter: tax law specialist e-mailed an agent in cincinnati quote, i think there may be a number of ways to don't them. let me talk to sharon light tomorrow about it and get ideas from her as well. this sounds like bad org. this gives me an icky feeling. deputy chief miller to his nicole flax when he talked about conservatives seeking 501 c 4 status. . >>. >> i think with this ever changing story it's obvious he was misleading the ways an means committee. he had information he was
3:21 pm
considering putting out that would have enlightened the american people before the election. he with held it. >> reporter: the panel top democrat elijah cummings is critical of the way it was handled. quote, it is revealing that the republicans, yet again are leaking cherry-picked excerpts of do you means to support their preconceived political narrative without allowing committee members to see their conclusions or vote on them first. it was cut in the $1.1 trillion funding package. the agency is warning there may be a delay in processing tax refunds and other services. >> there will be a price to pay as there already are for the revenue that we're going to gain from irs enforcement is going to go down. the ability of taxpayers to get the assistance they need is going to be more difficult. things like that. >> reporter: critics say the agency should work on its efficiency. >> all that happened is the budget is going to the 2008 budget for the irs. programs they should try something like been more
3:22 pm
productive, like the rest of the world does. . >> before the scandal the irs had a rating of 20% with the public. after the fact it is likely to remain an easy target, something to cut at budget time. when president obama returns from his christmas vacation he'll be dealing with the gop controlled house and senate for the first time of his presidency. now republicans are poised to take action on immigration. this after president obama's executive action to shield some 5 million illegal immigrants from deportation. so let's bring in tammy browse radio talk show host and fox news contributor and jessica ehrlich, a democratic candidate and democratic strategist. >> hi. >> i want to start with you you say there is plenty the gop could have done already and still could do. i read this you said this with immigration reform but the gop is behind on all this. so what do you think should be
3:23 pm
at the top of the list, a priorities list in. >> look. obviously, there was a point here before this all got implemented. there was the budget battle. you know, they wait to the last minute. the argument is, oh, the government will shut down. what we've got here is an implementation of the hiring of a thousand new slids, blowing up the bureaucracy, another building they are paying rent on to fast track all of this dynamic through with the work permits and social security cards, et cetera. so that's already in motion. so we're already behind the 8-baum if you will, with an establishment of a bureaucracy that i think a lot of people on the democratic side i hope gets established so that the republicans won't be able to you know, get rid of it. i think that when you've got newbies coming in with the new individuals in the mid-terms, this is a great opportunity at this point, really, the budget is the key. they chose not to do any of that with this budget. there is some opportunities they can do now with money to stop immediately this moving forward
3:24 pm
and, obviously, other legislation that they've got written, that they can do piecemeal to make a difference to show the american people where they stand on the issue. >> jessica, gop leaders in both the house and senate have said president barak obama had quote poisoned the well when he acted without congressional approval last month to shelter those illegal immigrants from deportation. the white house has promised to veto legislation that changes his vision. so where do you see give and take on this? >> yeah i don't think the well has been 100% poisoned him. because we've already seen where you got multiple of the republican members in this house as well as in the senate and democrats coming together and starting to work on some legislation here. i think the first place they will start, which the republicans have said all along is with border security and we really would like to see a comprehensive immigration package, based on the one already hammered out in the senate hopefully that will be
3:25 pm
able move forward. i think what we will more likely see since it's been 30 years tinkering around with something comprehensively, we will see these bills. in particular, there will be a big focus on low wage workers who work in agriculture and highly skilled workers in the high-tech industry, because the business community in the u.s. is really clamoring for that. so we've already seen a bunch of bills, in committees as well that they're going to be coming out in the new congress. >> tammy, really quick if there is truly a feeling of chaos, as has been zrierksd how can this be solved in a way to cause cohesive leadership? >> there has to be obviously leadership. you got leadership like mia love and joanie ernst in the senate. you see old leadership not coming back, making up these decisions drawing up this legislation which is inherently unfair. it's not what the american people wanted. the person people wanted it
3:26 pm
stopped and this solved. obama's actions doesn't solve any of the issues. i think john boehner has to invite in new leadershipch we have to see a completely different direction for the gop. >> jessica, to you quickly, same question. >> yeah, i don't disagree with tammy in the sense there is definitely going to be new leadership and movement that needs to happen. hopefully, some of the new members can come together and work on this and urge the old leadership to actually get something done for a change. this has been an ongoing problem. it behooves everyone, republicans need to be seen as taking the lead here, not only for their own voters but for industry as well. >> tammy jessica thank you so much for your perspective. always a pleasure to have you on. see you next time. >> thanks,. she hasn't announced yet for 2016. at least not officially. lots of democrats are running to dock hillary clinton for president. what co you would that a professional clinton campaign and who could still challenge
3:27 pm
her? also, sergeant bergdahl accused of abonn daning his unit in afghanistan. it turnings out, he is far from a low. how many soldiers like him are ever really charged. some stunning new data ahead. >> they say it can fly 1,000 miles, carry bombs and hit potentially new troops. iran's new weapon. they call eight suicide drone. so how big a threat is it really? coming up, we'll ask ambassador john bolton next.
3:30 pm
3:31 pm
. >> they warn it's a new threat from iran. its military saying it has deployed a so-called suicide drone for the first time during military drills near the strategic strait. the commander describing it quote as a mobile bomb designed to strike at air, ground and naval targets that can hit 1000 miles away from tehran. so what does this possible new threat mean to us? a former united nations ambassador to the united nations and a fox news contributor. ambassador, always good to see you, you know, it seems this new drone, i mean they claim it can carry eight warheads stay aloft for eight hours, does that mean it can hit our assets in the middle east? >> i think obviously as we've discussed many times, you take everything iran says with
3:32 pm
several grains of salt. but it's also a mistake to underestimate tear capabilities. they've been fascinated with drone technology. they claim to have downed or they simply have gotten american drones that had mechanical failures. they've worked with china and russia on these technologies over the years. and they're very sophisticated when it comes to aerospace and defense kind of technologies. they've had tens of thousands of graduate students in the united states studying physics and math over the years. so i wouldn't, even though i don't believe it juz because they say it, i wouldn't underestimate their aspirations. >> i'mstory interrupt you. should we let tens of thousands of yiernian students? they may be fine people, should we let them study and take that back to tehran? >> i was at the justice department at the end of the reagan administration when an fbi agent came to talk to me. i was stunned then. i think while we have cut back over the years, a lot of
3:33 pm
iranians have graduate degrees from prestigious american universities. so it's important not to forget that. but i think what iran wants with this is a capability to act against our forces in what what i call the persian gulf and against the arab states on the other side of the gulf as well potentially against israeli, using not just conventional weapons but biological and chemical weapons as well. >> they claim they've captured three eagles, those are our potential drones. remember back in may? they had this drone. they trotted it out, claimed they had a fancy drone and you are right, they say it was a fake balsa wood and some elmers glue and spit and band aids put together. i mean should we be afraid of them? you got the nuclear program going full tilt the nuclear talks have been delayed until june. it seems nothing is stopping them from potentially building a real nuclear bomb?
3:34 pm
>> no i think they're well on the way to that in terms of the drone technology stealth technology it may be they're not exploiting it all themselves, if american drones have gone down inside iran whether shot down or mechanical failure. i have no doubt iran has given these pieces of the drones to china and russia, for them to reverse engineer and that iran has gotten the product that perhaps and either their own drone technology or actually purchase of drones from china and others. we know that iran has a very active program of cooperation with north korea on ballistic missiles. who knows, maybe in the cyber warfare area as well. iran is exploring every option it can to use against the united states against israel and against our arab friends in the region. >> talk about ballistic missiles, it's stunning, those aren't a part of the ongoing nuclear proliferation, they said
3:35 pm
there will be a vote on sanctions in the senate against iran in january, do you think that will deter iran's behavior at all? >> i think it's important because any economic sanctions effectively enforced do put pressure on the regime and the long-term answer is to get rid of the ayatollahs. unfortunately, there is no news that it has slowed down, i think it's an important political signal and it shows america is not united behind president obama's diplomacy, which i think is on the verge of a very, very bad deal that will legitimize iran's nuclear weapons program. >> finally the head of the yiernian opposition the national council of the resistance is saying about tehran and their behavior, quote, in the name of islam, they came to you -- 12k3w4r6r7b89s
3:36 pm
ambassador, can tehran's behavior really be changed? >> well i don't think this regime's behavior can be changed. i think that's why many others in the iranian resistance are determined to try and overthrow it. i think the united states should be helping the resistance in many ways. because ultimately, that's the only long-term answer. >> ambassador john bolt good to see you. see you tomorrow at 12:00 noon eastern time. have a good night. >> thank you eric. >> of course. laura. new data shows despite thousands of army deserters have few soldiers have actually been prosecuted for walking away. the information coming from a stunning new report, from the army. we have more from washington. >> laura, the bergdahl case has drawn attention to the issue of army desertions, how many are there? what happens to soldiers who leave their unit t. army
3:37 pm
confirmed to fox that more than 20,000 soldier versus deserted from 2006 to 2014. keep in mine they are less than active soldiers each year. the army has only prosecuted about 1,900 deserters. military analysts say that's because usually soldiers desert for family reasons and not to go over to the enemy. >> they could bereleased from the military administratively, perhaps given a less than perfect discharge. everybody goes on tear way. the soldiers go home, leave the service and the military is able to muster them out without without, without putting them on trial or the agony of a court marshall proceedings. >> reporter: whether sergeant bergdahl will face a court marshall is up to the head of u.s. army forces command. one former army lawyer says in general, those are looked at very harshly because commanders
3:38 pm
have a unit of other people who are looking at that soldier and saying, "i don't want to go, either." so, obviously, there has to be an example made. sergeant bergdahl was released be i the taliban earlier this year in exchange for five top commanders being held at gitmo. laura. >> all right, thanks. laura, you know, she hasn't even announced yet she is running for the white house, but the support is already pileing up for hillary clinton. so how big is her edge over any potential democratic opponents?
3:41 pm
crunch! a garbage truck backs into it. so,you call your insurance company, looking for a little support. what you get is a game of a thousand questions. was it raining? were your flashers on? was there a dog with you? by the time you hang up you're convinced the accident was your fault. then you remember; you weren't even in the car. at liberty mutual we make filing a claim as stress-free as possible. see car insurance in a whole new light. liberty mutual insuranceght, so this tylenol arthritis lasts 8 hours but aleve can last 12 hours. and aleve is proven to work better on pain than tylenol arthritis. so why am i still thinking about this? how are ya? good. aleve. proven better on pain.

. the man who shot pope john paul, ii making a surprise visit to the late pontiff's tomb today, a specs person said it lasted a few minutes. he targeted the pope in may of 1981. he initially claimed he acted alone and eventually suggested bulgaria and soviet secret services masterminded the attack him pope john paul, ii forgave him and later worked for his release in 2000. some high profile democrats are lining up to endorse hillary clinton even before she's announced she is running in 2016. this is the former first lady and secretary of state enjoys a huge read in the polls. take a look at the real clear politics average.
3:43 pm
it shows mrs. clinton leading, more than 61% take a look it's almost fist i 50 points ahead of her next closest potential challenger. massachusetts senator elizabeth warren who insists she is not a candidate. so is hillary a slam dunk or can someone else stop her? a professor of law and science at usc susan always good to see you. one of the great nuggets i think right now elizabeth warren, the opponent of the latest fox news poll is now two years before the next presidential election, also had 12% against hillary clinton, a freshman illinois senator named barak obama. should we read anything into that or is this hillary's for the takeing? . >> hillary's for the taking. it's a completely different landscape. >> that number. i love fun numbers and i'm a great elizabeth warren fan. but i don't think elisabeth
3:44 pm
warren is going to get into this race unless hillary gets out. i think the significance of the numbers the significance of the democrats, the last democrats rushing i was joking with somebody. rushing to get onto the crowded booths the clinton train is the democratic party has no appetite for primary fights. no appetite for any battles here. everybody is ready to line up behind hillary and focus on trying to win this general election. democrats have been very grownup. it's so unusual. >> but maybe not completely grown up. you have a couple candidates making noises. elizabeth warren says she's not running. governor o'malley governor of maryland, clearly is indicating he may run. you also have former senator james webb of virginia who is a democrat but happened to be the secretary of navy under ronald reagan. what kind of trouble can they
3:45 pm
stir up? can either of them grab this? what do you think will happen especially when it co himself to o'malley and webb who seems to be >> well, o'malley what o'malley said at lost i have heard. i've known him for years, i'm a great fan of his, he is there because there ought to be somebody out there if hillary should decide for some reason not to run, but that he is first and foremost a supporter of hillary. so i think the threat to hillary in a hypothetical world would be a threat from a well financed leftist organized billionaire backed you know, hillary, establishment, hillary's too conservative. hillary's not anti-war enough. >> that would be the sort of if you were doing the movie version or the hypothetical version. that would be what you are looking for. you don't have that, bernie
3:46 pm
sanders isn't going to put that together. that's not martin o'malley. webb doesn't have that, that itself not where he comes from in the party. in fact the liberal when in the party is not anti-hillary. it is most assuredly pro-rilry right now. so as long as hillary wants this thing, i think what you see is every democrat with any stake at all wants her to have it and have it as quickly and easily as possible. >> so finally, how does this thing play out? what does she do? you got a year-and-a-half, iowa? we are sitting back here. how does she sit back and maintain interest potentially keep this front running lead. she went down last spring by 7 pointsch warren went up 3. she declined a bit. what is she doing? when is she announcing? >> she is giving speeches and makening money. it seems to me to get through a long winter. she's got to not slip.
3:47 pm
that's the first target. i think the truth is that whatever she does, however small and obvious will be news because it's her doing it. and very few candidates in truth have been helped by primary fights. you could arc you that barak obama on screen right now, he was helped by besting hillary clinton. by and large, i teach this to my students, you can go all the way back and the faster you lock up your party nomination as a general rule, the more likely you are to win. so for the democrats and for hillary, she'll find plenty of good things to do other than have to be involved in divisive and ugly primary battles which she probably would choose not to be in. >> i predict lots of no cos with her new grandchild. >> thank you 100%. >> as always thank you.
3:48 pm
of course, don't forget can you read her syndicated columns. it's the newspapers across the country. it appears every wednesday and friday. laura. here's a question for you, how do you like to do it? in the heat or in the cold? talking about working out with you in new year around the corner, lots of people vowing to lose weight. what is more important? exercise or the temperature in the gym? the calorie burning details next. .
3:52 pm
if you're hoping that exercising might help keep you from gaining weight this holiday season, you may want to dial up the thermostat. british scientists finding the colder the air is when you work out, the more food you'll want to eat when you get done. the small study says it found that people who walked in the cold tended to consume more calories and more carbs after their workout. to tell us more assistant professor of an es theseesthesiology is here. >> i see people jogging in the cold thinking they were tougher braving the elements. why does working out in the cold
3:53 pm
undermine our efforts? >> there's a couple of different reasons. the first thing is in terms of burning calories. the thing these researchers found out if you work out in the cold you actually burn fewer calories than if you work out in the heat. so that's surprising what you said. because people do tend to exercise in the cold. i think part of the reason this is the case when you're cold your body tries to hold your blood supply tries to hold that heat close so it can warm your heart, your lungs, your brain, all the critical areas you don't actually get that blood flow to the skin as much and that's where you lose the heat you find in calories. your ears and nose and limbs get cold. you want them to be warm to burn off that heat. the other thing interesting about this stud yes, the reason why i think it's a good study is because they checked blood levels. they looked for hormones which control how hungry you are. they found these people who worked out in the cold actually had an increase in bad hormones. and that's probably why they ate

more. >> okay. so if i go out in the cold what if i bundle up and put on the ear muffs and the next gator and the warm hands and all that? does that help? >> exercising in general is better than not exercising. it depends what's better for you. if you stay warm of course that's going to be better than if you're hot. for most people they work out at the gym or at home. in those cases you want to turn the thermostat up. you don't want to be too hot to be dehydrated at the end of all this. at the same time if you're trying to decide if both conditions are equally good for you, it is better to work out where it's a little bit warmer. now, this is especially important especially after new year's. that's when people usually have these new year's resolutions that they want to lose weight. what happens to most of us you do start exercising more. this has happened to me before too, where you exercise more where then you eat more >> yes. >> so this is a nice study looking at why does that happen. >> right. and it really goes against that traditional thinking that you might burn off your calories in

the cold because you're shivering more. >> exactly. >> has all that been false all these years? it's a small study right? >> right. it's a small study. you want to see data from a lot of people to have a stronger study. at the same time it was a very well-done study in terms of checking. they checked a few different things. they looked to see how many calories people actually burned. they found that the people who worked out in the warmth actually burned more calories. then the also looked at how much did they actually eat. the people who worked out in the warm weather ate less. then they looked at the blood hormones. from a few different aspects, which actually made it a better study. in terms of what you were talking about with the shivering, if you shiver of course that's muscle movement. you're going to burn more calories shivering. but you have to look at everything in relationship to each other. so if you're shivering you're going to burn more calories than just sitting there not shivering. but at the same time if you're exercising want to make sure you get less food in. >> real quick i wanted to ask the number one exercise we should do.
3:56 pm
is it hot yoga? where should we be doing our workout really quick? >> right. i don't know if i would say hot yoga in particular. i mean the best exercise is something you can stick with. so i would say things like elliptical tend to be better with people with arthritis can still get aerobic exercise and weight loss out of that. whatever you can stick with is the best option. >> a little bit does it more than anything at all. that's true for the new year for our resolution. thank you so much, doctor. >> nice seeing you. >> nice to see you. that will do it for us. >> i say when it gets cold take a that get a big blanket. >> that may work against you but you'll warm up. >> thanks for watching. up next is "the fox report." in my world, wall isn't a street... return on investment isn't the only return
