he'll need that rest as he looks forward to a year where the republicans control not only the house but also the senate. there's been a lot of speculation about how much he will use executive order. we know he'll use it some and we know he's already done so compared to wheaf we've seen on immigration and cuba. he won't be sitting down with republican leaders any time soon because as soon as he gets back to washington he'll be leaving again. the white house says the president will take off wednesday for a trip to detroit to talk about the rebounding auto industry. from there he goes to phoenix to speak about housing and then it's on to tennessee for a speech on college and education. all themes he'll hit in his state of the union address. deputy white house press

the 40-hour workweek for middle class families. from there, more good ideas for job and growth will follow. if the president is willing to work with us we'll have a real chance to address our nation's most pressing challenges. >> reporter: and there certainly are areas where the gop leaders and the president agree. one is on trade. another is on cutting the corporate tax rate. but it would look like the president might get his veto panel a little bit more in 2015. he's only used it two times in his six years in office but he signaled an interview with the npr that it's likely that pen will come out a bit more in the next two years. >> dan springer thank you so much dan. >> yep. well the u.s. hitting north korea with sanctions in response to the alleged cyberattack on

sony pictures stemming from the controversy over the movie -- the comedy movie that is "the interview." the sanctions affect three north korean agencies as well as ten officials barred from using the u.s. financial system. now, the u.s. has already imposed tough sanctions on the regime's nuclear program. peter doocy has more. >> hi, arthel. since north korea is already the most heavily sanctioned nation in the world, some of the president's critics are wondering why the white house still relies on economically driven punishment. >> everybody in the world has seen how he's handled putin and iran. he goes in and makes nice with the worst people on earth. so i don't think they have any real fear that he's going to do anything substantial. it may tweak him a little bit

economically, tell people they can't come into the united states and get their bank accounts accessed but do they really fear this is a president that draws a red line and keeps it? he hasn't so far in six years. >> the new sanctions are especially remarkable since some private security firms have unearthed new evidence suggesting the sony hack was an inside job that had no origins in north korea. because we see now, the only administration obviously not sold on that story, continuing to blame the kim regime. the white house press secretary says there could be more on the way and that, quote, our response to north korea's attack against sony pictures entertainment will be proportional and attack place at a time and in a manner of our choons are the first aspect of our response and when senior administration officials talk about this they stress t. is the first time that sanctions have been levied in response to a cyberattack on a u.s.-based company. arthel? >> peter doocy, thank you so much. and now to the brutal search

for the wreckage and victims from the flight 8501. airasia was not given permission to fly the route that it flew over the java sea before crashing last sunday. the indonesian transport industry has banned airasia from flying that route. airasia is reporting recovery crews may have found the primary wreckage from the flight. sonar has picked up four massive objects on the bottom of the java sea, including one piece that could be from the main fuselage. an incredible story of survival out of kentucky. a 7-year-old girl getting released from the hospital after surviving a small plane crash that killed four members of her family. >> she's done a hell of a job, as far as i am concerned. and she was scared when the emt put a neck brace on her and when they put her on that board, she was pretty shook up. she wanted me to go with her but they wouldn't let me go with

her. now i'm praying for her. she's lost everything. >> we're all praying for her. the faa says the plane reported engine trouble and lost contact with air traffic controllers as it was flying over the southwestern part of the state yesterday. and mourners paying their respects to fallen nypd officer wenjian liu. at his wake today, two weeks after his partner rafael ramos were executed as they sought in their patrol car. now friends, family and a very grateful city are remembering his life and service. brian is live in brooklyn. hi, brian. >> reporter: hi, arthel. we are just a 20-minute drive from where wenjian liu was murdered. we've seen a nonstop stream of nypd officers and officers all over the country as far as california louisiana and arizona come here to pay their respects. among them police commissioner bill bratton and mayor bill de

blasio who walked into the funeral home here in brooklyn a few hours ago. officers saluting them as they went inside for a little over ten minutes. new york governor andrew cuomo coming two days after his own father mario cuomo died. he would have wanted him to come today. cuomo also calling for an end to tension in the city. >> what makes new york strong is that we take our diversity and we make it a strength and not a weakness. and we're always good at coming together when things are at their worst. and that's what we have to do now. we have to stop any fights within the family and we have to come together as the family of new york. >> reporter: in an open casket viewing, liu has his badge pinned to his uniform. inside, there were about 30 family members, many who traveled from china.

among him, his widow. liu was murdered it three months after being newly married. liu always dreamt of being a cop. many officers turned their back on de blasio and bratton said i make no threats of discipline but i remind you, when you don the uniform of this department, you are bound by the honor and dean see that goes with it. liu's funeral will take place tomorrow at 11:00 a.m. and will be laid to rest at the cemetery where his partner now lays. arthel? >> bryan, thank you. the affordable care act is causing some headaches this tax season. why some may owe refund. the irs might be happy about that. plus, the head of a georgia

a startling 911 call being released today giving us an idea of just what the moments were like after a georgia police chief shot his wife. >> how did you shoot her? >> the gun was in the bed. i went to move it and put it to the side and then it went off. >> is she breathing? >> yes. >> you are with her now? >> what's that? i'm the chief of police. the gun is on the dresser. >> you're the chief of police in

peachtree city? >> yeah, unfortunately, yes. >> william mccollom has since been put on administrative leave pending the outcome of the investigation. mccollom has been cooperating with the investigation. as of friday his wife is listed in critical condition. the affordable care act may cause headaches during tax season. millions of people who received only subsidies may owe money to the irs. the aca is going to result in more confusion for existing clients and many taxpayers may very well be disappointed by getting less money and possibly even owing money. the whole implementation of obamacare will be frustrating for tax preparers. that's an end quote there. phillip coin is with us. he's a commentary editor. good to see you. >> thanks for having me.

>> as we know, accountants expect confusion whenever you have to incorporate new laws. taxpayers, never happy if it is going to mean smaller refund or perhaps owing money. is this going to affect all obamacare recipients? >> not necessarily. what basically happens is that this is one of the trickier parts of obamacare. obamacare gives out subsidies to millions of people and those subsidies are adjusted oh based on individuals' income. when you apply for obamacare and base it on your income they tell you how much subsidies you get. the lower the company, the higher the subsidy level. but the problem is people's income fluctuates over the course of the year or maybe somebody reported one income and it turns out to be inaccurate. so what happens is that when it comes tax time and they have to report your actual income if that turns out to be different than what was used as the basis for those subsidies then you

could end up with this situation where people could have gotten hundreds or even thousands of dollars more in subsidies than actually they should be entitled to based on their company. >> they are calling on taxpayers, they are going to contact them this month urging them to file electronically to get a quicker refund. do you know if they are going to give advice for those affected by the obamacare situation that you just pointed out? >> well, it's unclear what guidance the irs is going to give but i think that anyone who has received the obamacare subsidies should definitely look into it and sort of factor this in in terms of when they are budgeting, whether they are going to owe or what kind of refund they have. >> oh, boy. well, the new congress, as you well know is set to convene this tuesday january 6th. tackling obamacare is one of the first items on their agenda. what do you think their angle is going to be? >> well, i think that

republicans will have a two-pronged approach. now that they have control of the senate, it means that the house can pass things and unlike what's happened in the previous few years when the democrats controlled the senate and everything went to die in the senate, the senate can now actually pass what the house passes and put it on the desk of president only. so i think that they are going to try two things. one, they are going to try to get bipartisan support on certain aspects of obamacare that are broadly unpopular. things such as the medical device tax. they may alter the requirement on employers of having to a purchase certain insurance for their employees. and beyond that what we might do is try to pass legislation that highlights some of the more unpopular aspects of obamacare. that even if obama vetoes, they

have the case in 2016. this is why we need a republican president. >> okay. i see how they are going to tee that up. let me get a quick question from you on this one. the house is working to improve the keystone pipeline. i want to know who is going to lead the charge. will it pass the senate and ultimately do you think the president is going to veto it if it makes it to his desk? >> based on the vote that we saw last month when democrats were in control of the senate, it looks like it's going to pass the senate. and it's going to be a difficult situation with obama because it pits environmentalists versus job creation. basically his own administration has come out and said there's no environmental impact. so it's going to be sort of difficult for him to veto it but this is what i'm sort of talking about, where republicans are going to pass legislation that's sort of if it gets passed it's a good thing.

they have accomplished something for their constituents and if he vetoes it, it makes a case for why you need a republican in 2016. >> i've got to go and then i would imagine the republicans have to be careful not to send stuff to the president's desk that they know he's going to veto and that could possibly backfire on them. i don't know. we'll talk about it later because right now i have to go. philip klein appreciate your time. >> thank you for having me. >> absolutely. the flu is already becoming a killer early in the season. why even with the flu shot you could still be at risk. a doctor is going to he can plain what is happening and what you need to do to keep your family and yourself healthy.

17 deaths from the flu in north carolina. seven in washington. six in kentucky. four in arkansas and three in south dakota. so how can we protect ourselves this flu season? dr. da sew at thats is a board certified internist and medical weight loss specialist. good to see you. >> thanks for having me. >> this is really horrible numbers. i want to clarify the flu normally does reach epidemic proportions. but it's earlier. >> it seems to be. last week the case doubled. i think that's what's scaring a lot of people at the c d.c we're just at the beginning of this. the flu season can extend until may. many times in new york, we don't really see a lot of flu cases until february march. >> then there is this whole notion of the current vaccine, it doesn't really work against that strain of flu that's out there. so a, is it even worth getting the flu shot? otherwise how do you protect flu? >> i think everyone should still get the shot. everyone over the age of six

months should get it. if they haven't already gotten it, there is still a lot around, so get it. it may not be 100% protective, but it will at least protect you to a certain degree and you'll have a milder case. you might get over it faster. >> i want to talk to manny alvarez. i want to jump off on something he wrote. the question he posed is how long is someone contagious? also, can you give someone else the flu even before you start to show symptoms? >> you can be contagious for a long time after the flu. president-elect obama after you begin to feel better, you're probably still a little contagious. but it depends on the strain. the problem with the flu and the reason why it spreads so quickly is that before you know you're sick, you might be feeling okay. you're carrying it and the germs are all overt place. they're coming out of your nose, mouth and eyes and on surfaces. go in and touch an elevator button and someone else goes in a couple minutes later and scratches their eye and they get

infected. highly contagious. >> the whole thing of washing your hands very, very important. >> very important. and always keep your hands clean and wear gloves when you touch other things. like elevator but thetons and surfaces. i focus on more than giving the flu shot. you can really boost your immune system with probiotics keep vitamin d level between 60 and 80. make sure you have vitamin a taking that. if you feel you're coming down with something. all these can naturally boost your immune system so you don't get sick. >> how do you get the probiotics? >> there is very good products out there. some doctors carry them. we have our own brand in the office which works really well. they have to be powerful and they can really help your gut get healthy and there are so many immune cells that sit right underneath your gut. in they're unhealthy because of
