the ultra conservatives. they have to focus on getting control. we have control right now. we don't know if we will in two years. you have to get it done. the supreme court is working on the issue as far as what the obamacare can do. this whole obamacare thing has to be dealt with. not on the conservative side ora moderate but as a group together. we have to utilize the support of the good democratic conservatives also and get them on board and pass things. if we have to overdo a verdict we need two thirds >> i don't see any compromise jedediah. if you look at the conference and caucus on both sides the

republican side is more conservative than ever. on the democratic side, a lot of the moderates lost so they are more liberal. i don't see any room to come together and get a lot done >> i don't either. and i think keystone is interesting. if you see push back from the president right way you know forget. that is bip bipartisan and a lot of democrats are behind it. if he rejects it right out and uses his pens forget it when it comes to regulatory action and obamacare and bigger issues he said he is not budging on >> when i ran for the united states congress back in 1986 i had the republican conservative nomination. but when i got in there i was told would you vote for a three billion -- and i said i will vote for national health care

after the age of 65 because they parents were old. the ultra conservative and the moderates have to come together and get things done in this country. people are frustrated and congress has a 12% rating. >> on fox news sunday, they had the best chance to for republicans to get things done is in the courts. if obama uses his pen do you see the republicans going through the road of lawsuit to get things done? do you think legal action is the best way for republicans to make real points on the board? >> they might think so because of a couple rulings from the supreme court on executive power. any time you get a 9-0 vote from the supreme court you should pay attention. so it is likely they would

understand the lawmakers and thinking between the branches there has to be boundaries. we have the house lawsuit with respect to the affordable care act and the changes they made without going through congress. and there is a lawsuit with 25 states about the immigration executive action he took on friday. they are definitely looking at the courts as a possible way at a shut hill down. >> kennedy, how do you think republicans should handle this? they can anticipate the border security bills and obamacare will be shutdown by the president. the president doesn't care what the public or the polls thing or anyone besides his progressive base. what do you say to the republicans battling this? >> it is all about jobs. and i think that is one thing the gop has gotten right. they have to keep focusing on that. people are upset with

washington. and a lot of constitutionalist within the republican party are not hard-core conservatives but they have been given a mandate by the people that voted them into office and they don't want people spending money and giving them only so much of a head's up on 1600 page regulations. >> all of the regulatory stuff and the regulations so corporations can't do anything. they want to close down coal mines and these are things that have to be debated. regulations are great but they could be restrictive for corporations. >> quickly, let's take it around the couch. there is an election for speaker of the house. but it looks like speaker boehner will hold on to his speakership. should we? >> i think he absolutely will. i would be up for new blood to be honest. i think the conservatives and

libitarians do feel they have been ignored by him. i would be up for someone that gives confidence. we say republicans need to stand together. stand together and move toward what? and that need to be conservative principles in my opinion. >> i think the fact boehner is on notice again -- i hope he doesn't punish the people that put their names forward because they have legit complaints that boehner is spending money we don't have and bowing to the president. >> remember what happened to the people that opposed him previously. >> they should get on make the vote and let's not stagnate it. vote and see if he is going to stay or don't vote. >> and what you were mentioning was a lot of people that didn't support speaker boehner lost their chairmanships. >> they didn't get great assignments.

advised obama on it are now paying more. they are saying they have to respond to the national trend of rising health care cost. members of the faculty voted down the changes in november but it was too late. one person is saying the out of tax is equivalent to taxing the sick. they supported letters in the beginning supporting the president and now calling it deplorable and regressive and it is a punishment/pay cut. >> they thought it wasn't going to affect them. harvard researchers didn't do their research and realize you are part of the system, too. this happens when we try to reform thing and people say don't take my stuff, it should not affect me. you will see people seeing the cost rise, options decrease,

♪ >> welcome back to "outnumbered." vice president joe biden swearing in senators on capitol hill right now as gop takes control of congress, both houses officers time in eight years. kentucky senator mitch mcconnell, the new senate majority leader. meanwhile, we are a straighting a vote whether house speaker john boehner will keep his job. we'll take you there live of course when that happens. well, tensions are rising here in new york city as a manhunt is underway for suspects in another police shooting. two cops were wounded while responding to a robbery last night. they were part after group of five plain clones officers at the scene. there is no evidence they were specifically targeted.

this point? and why would he make a comment on police officers turning their backs on him in that way? does he realize that doesn't help matter. >> he disgusts me. i call him mayor big bird. like the guy from "sesame street," a big bird. >> oh. >> he has an idea that this police department needs retraining. that is the first thing. this is the most professional police department in the world. there is over 25 million interactions between police and civilian. out of 25 million interactions last year, there were 5500 civilian complaints, people made against cops. that is .2 of 1% is the complaint against cops. another fact is there was 81 shootings in the course of one year. that means 1 out of 330,000 chances of a cop being involved in a shooting. this is with guys with knives. these are taking action. when this mayor degrades the police department the way they are, and i talk to cops every day, that turning of the back, first i thought it was a bad

correct, this is the way the laws work in the state of new york. this is like a lot of times i have to tell people about supreme court decisions they don't like. as an officer of the court i get when it within the letter of the law and doesn't feel good or meet the common sense test but the judge did within her duties were and judges have discretion and that is something you need to think about in this case. >> no, no, no. we have an environment where we had go officers assassinated the week before. now this guy here is putting our video of shooting cops, the environment, this changes all the rules now, as far as his flight. did he have a job? when you do a bail thing you have to see if he has a job roots in the city. i guaranty you, if you have an open wanter, this guy should have never been let out that's it. the d.a. in brooklyn, the good d.a. in brooklyn wanted $250,000. they knew, this environment right now is a powder keg in new york. by her doing it, it only feed to big bird again.
