news' own mike emmanuel. a lot of drama there. >> sean, good evening. a lot of tension on the house floor earlier today. but after earning 216 of the 408 votes cast, the house clerk announced john boehner had won re-election as speaker. >> therefore the honor able john a. boehner of the state of ohio, having received a majority of the votes cast is duly elected speaker of the house of representatives for the 114th congress. >> three conservative congressmen challenged him daniel web sister with 12 votes, lou louie gohmert and ted yoho. >> people are calling us today they've been calling us since this morning saying we're going to support somebody other than mr. boehner. you'll see the numbers grow. >> conservative critics rick boehner who are accepting the bipartisan bicameral package

congress passed before christmas. they wanted to fight more on immigration and funding obama care. once it was resolved boehner laid out his vision for the new congress. >> we'll begin our work on this common ground taking enough measures to restore the hours of middle class workers and help small businesses hire more of our veterans. >> you can expect much of the early focus to be on passing the keystone xl pipeline project which has been much studied. also some focus to be on repealing the last popular parts of obama care, testing to see how often president obama intends to use his veto pen. >> mike on capitol hill thang thank you so much. today's vote for speaker did disappoint me for a number of reasons. for starters, the elected representatives, they didn't listen to you the american people. according to a brand new poll

only 25% of republican voters wanted them to re-elect john boehner as their house speaker. guess what? 60% wanted someone else. during his time in my view he's been too timid and weak to stand up to the president and the democrats. he seems scared almost paranoid of being blamed for the government shutdowns and he's not willing to use -- and this is a key point -- the constitutional power and authority of the purse and we've seen devastating results. the day that boehner became the speaker of the house, on january 5th, 2011, the national debt was more than $14 trillion. now that debt is a whopping $18 trillion. that's more than a 29% increase. that to me is not leadership. i want a conservative leader who will stand on principle who is willing to fight. republicans, if you're smart you'll push forward, stop robbing our kids blind, future generations blind. we need to balance the budget.

we need a leader who will repeal and replace obama care. in the cromnibus bill john boehner just funded obama care for another fiscal year. we also need as a national security concern, we need somebody who will secure the borders first. also i want a fire and brimstone message coming from every republican. look at north dakota. look at all the jobs that they created. look at the economic development. america needs to be energy independent. you know what? that creates jobs, that helps national security. and lastly, i'd like to see someone offer kids that are in failing or mediocre schools a way out. failing schools give them school choice. up to this point i don't think boehner has been up to the job. i hope i'm wrong. i hope with a new senate majority this gives him an opportunity, the american people have given him the blessing of power. it is a gift. i hope he uses it well and i wish him the best.

joining me now two men who challenged the speaker louie gohmert and ted yoho is with us. >> great to see and hear you, sean. >> you guys came pretty close, i think closer than some people thought. louie, i told you when we first talked about this behind the scenes that i thought this was an uphill battle. what's your reaction to what happened today? >> it was an uphill battle. originally we were just trying to get people to vote for anybody but the speaker so that we can get this thrown to a conference and then have somebody we could all agree on to get some new blood into the position so that it would help us keep our promises, exactly like you've talked about. and the idea was pitched by jim weinstein, thomasy we need someone declared as a candidate so no one could say nobody was a

candidate so we had to vote for him as speaker. then they said, why don't you get out there? because then it becomes boehner versus gohmert. so i want to say this is a real hero here. ted came in and announced -- >> i don't think john boehner's thinking that right now. i think he doesn't like either of you or me. >> well, let me tell you daniel webster came in today. he's a real hero. i'm trying to get it confirmed but i heard that he might have just got picked with nugent and that -- >> i'm running out of time. let me go to ted. what i think -- i love what reagan said. bold colored differences. there's an opportunity here with the new senate to put bill after bill after bill on obama's desk. energy independence, key stone pipeline, if you like your plan you can keep your plan, secure america's borders first there's your solution. i'd like to see republicans lay out that agenda, challenge the

president, do you think that's a good strategy? do you thing john boehner is up to that job? >> i think it's a great strategy. our goal is to work with the senate to bring out health care -- not just repeal but replacement, put it back in the hands of the doctors and the patients where it needs to be. challenge the president on overstepping the constitution and let him know that we'll hold him accountable. he was elected to faithfully execute the laws of the land, national security agency that you just brought up and starts with keystone. dpas prices are down now because of the private sector. we need to keep those down. then tax reforms so businesses come back to america creating jobs for americans on our soil to increase the living standards of those people then bring up poll sis and bills based on merit, not on politics. >> louie, i'll go back to you. in spite of the vote that you guys wanted to be different today, there's a huge opportunity here. >> huge. >> and that is to lay out an agenda. i think if i were to ask the

lining up. >> juan is right this is about politics. the president's going to veto the keystone pipeline says he's going to veto the gop's move on obama care reforms, raising the work week from 30 to 40 hours by definition, probably a medical device tax. i actually think this is good because republicans are laying down their marker. in my opinion, make this president veto everything. thoughts? >> i think that's absolutely correct. they should be putting a fresh piece of paper on his desk every single day. let obama decide with what little time he has left, does he want to have a positive legacy or be president no and just block one reform after another many of which american people want and which will pass with bipartisan votes. >> juan williams with immigration, keystone energy, securing the borders all these issues and on obama care the polls are with the american people, not with the president. if the republicans follow that strategy, does that hurt or help the democrats?

roy black, all of the legal dream team. the prosecutors private's lives were investigated. they were pressured, jerked around, everything was appealed. eventually they get epstein to agree to plead guilty to a state charge, it was 13 months and for 16 hours a day he could go to his mansion in palm beach, so he got basically no jail time. he is a registered sex offender. there is a federal law sponsored by among others senator jon kyl and it says victims are asking for, could we please just have the rights of criminals. they want to be notified as a case is going forward. none of that happened in this case. a secret agreement was struck. the documents are under seal. a no prosecution agreement against not only epstein but his lawyers and all these other friends of his. >> so -- >> they're suing under that

they can open this case again. they could breach the no prosecution. that case has been going on since 2008. that's jane doe one jane doe two. now friday the new news that brings your favorite topic into this bill clinton jane doe three and jane doe four come forward and their allegations involve prince andrew alan -- one of them, jane doe three alan dershowitz the lawyer and bill clinton, of course. that's how their names have come into this. the allegations, i'm saying nothing about that. you can read the legal findings. the lawyer bringing this case paul cassell is probably the most impressive lawyer in the country. and he's up there with miguel estrada. this is not the simplest case. keep following this case. and thus far only been covered on fox news. it is shocking.

wants to end the broken windows theory. for some reason he thinks that the broken windows theory that comes from the professor that i brought in with bill bratton and mayor bloomberg uses is unfair. most people attributed the phenomenal decline in crime between myself and bloomberg to the broken windows theory and why he wants to change the broken windows theory, so when the mayor complains about a slowdown, he's got to worry about his own rhetoric in telling the police, oh, don't worry about these small offenses any more. don't worry about these small offenses. maybe they're sending him a signal. >> he also kind of stepped in it again by saying they dishonored the memory of these cops by turning their back on him. that too has created a backlash. al sharpton says that his anti-police protests are

this time instead of repealing obama care, the bill so already 1,000 pages we'll make it 2,000. this are a thousand pages we'll get rid of and our thousand pages which will have tax incentives, change the tax system, john mccain is very much in favor of that. i have to say something, i was the first one to introduce that when i ran for president in 2007, the idea that everybody should get a tax exemption and buy their own health insurance. your employer buys your health insurance, my employer buys mine. give us the money tax free, we'll go in the market place have the whole country to choose from and we'll pick the policy that we want. you, because you have a lot of children, will pick a certain kind of policy. me, because i'm older and my children are grown, i'd pick a catastrophic plan, high deductible and save money. the price would drop.

on that note there is a note that former senator rick santorum is meeting next week with some old advisers. does that mean he's running? joining me is rick santorum. are you ready to get back into that rat race again? >> well, you know, i'm seriously looking at it, sean. obviously, i've got a lot of things that i think are very very important to this country and that you know, we need a candidate in 2016 that's going to unite america. we've had the greatest divider as president since i can't remember. we need someone to start getting things done that's going to help average, ordinary working americans have a better opportunity at their life. >> there seems to be a divide. what i, for example speaker boehner were ever to come on the program, and i don't think he's too fond of me right now, or if i had an opportunity, i would say to him, he should unite tea party conservatives like myself

and more moderate republicans. there's a lot of low hanging fruit that can help the country energy independence, secure borders, a solution for obama care, balanced budgets, these are simple things that would thing every republican would agree on. do you agree with that? >> i do. i think we have to be positive. we have to have a message out there that not only unites moderate republicans but tea party republicans but also can bring some democrat votes. one example, i saw this article today that the folks up at harvard are not happy about obama care being visited on the medical programs up atted on the harvard. why doesn't the congress pass a bill that says what the president did by executive order. pass a bill and if you have a plan you can keep it and grandfather in every plan that's out there now. i guarantee you a bunch of democrats would vote for it, tea

party folks would vote for it, it would be the way to start off on the right vote. their policies now and want to keep them. >> i have that article in front of me. all of the professors helped advise the administration are in an uproar about their own policies >> yes. >> maybe they didn't read the plan before they passed it. >> yes. i mean well you saw the saw the incidents extended to har yard as it turns out because she didn't know what was in this plan. let's do something you and i can get behind something that can help harvard professors if you have your plan you can keep it. >> i'm sure they care what i think. >> i don't think that is clever. it's the president made the

promise. put the bill on his desk. >> he did. >> let's see where he stands i think there are many opportunities i'd like to see republicans take advantage of. you served in the senate and by my count 12, 13, maybe 14 candidates, governors, ex-governors senators maybe congressmen in there. how do you separate yourself from the pack? what will -- how do you beat jeb bush? marco rubio? scott walker? ted cruz? how do you distinguish yourself in that field? >> yes. a message. you know? that is how, people saying you're sort of the last guy standing against romney. there is a reason for that. we had a strong message that appealed to working americans people who believed energy independence and jobs created by the energy industry in this

country and opportunities that low-priced energy will create in manufacturing and construction that will help working americans that connected with people. we have been talking about it ever since 2012 a did a book last year called blue collar conservatives if we're going to be successful we have to make sure the middle of america is strong and healthy. i support the republican party and we need more than that. we need to make sure everyone is participating and that we need to be not just pro growth party but pro worker party. so we've put forth ideas to make sure that every american all working americans who want to work and support themselves and families are going to have an opportunity to be successful again. >> a lot of people are suffering. that is my push be the party that solves
