we've heard voices from all sides of the aisle. new york daily news not a conservative newspaper with the headline today sueaying you let the world down. the white house said look. there was a scheduling conflict and our security is so massive. for once this event wasn't about us. do you really believe that the white house let everybody else have the spotlight because of security concerns? >> no. of course not. i thought he came out good in the beginning. obviously when the tragedy happened but since then is very typical in that he doesn't follow through. there's a lack of follow-through with this administration. when you have -- as allen west pointed out, when you have netanyahu and abas there, the high representative of russia right there together, arm in arm, he is the leader of the free world. we live in the greatest country of the world. we should have been there, set the tone, set the example and once again it's a missed opportunity. very similar to hey, listen.

draw a red line in the sand. if you cross that line you're in trouble. guess what? tralys don't trust us or respect us. our foes don't fear us anymore and it's leading to this increased energy when it comes to the jihadists and terrorists around the world. >> harris, i was watching last night on the fox report as i always do, toggling between the golden globes and harris but i heard you report, the president's schedule and what he did do last night and look. it was a big game yesterday. a couple of big football games. the president instead of stand and unite with world leaders, he was eating popcorn, watching america's pastime. >> i think it's interesting not just a missed opportunity in terms of leadership at that summit but this president on his resume, the number one thing is community organizer. like that was kind of a punch line, a punch word phrase as you will when he was running for president the first time. this is in his wheel house. this is what he's good at. right? he's probably -- he's considered

an expert in organizing stuff like that. so you've got that but then you've got the two areas of the world that are enflamed right now. you mentioned abas and netanyahu. that would have been an opportunity right there. separate from each the march. pull them aside and talk. you mentioned leaders from russia. they just invaded krimea maybe a missed opportunity there. there were a lot of missed opportunities there but at the end of the day and i do want to point this out, the ambassador to france did represent america in that march. but of all the people you could send -- >> that's exactly right. >> but you sent a law enforcement officer to this thing. >> that's like having a aaa business ball player pitching in the finals. >> president bush would have shimmied in between there. he would have been in the center of the picture >> with a bullhorn.

>> why didn't the administration send high level officials to ferguson missouri? when springs into action when it wants to. we saw the president concede that he isn't good with optics remember after the james foley beheading. why doesn't the president learn the lesson? haven't they figured it out that certain things look really bad? >> it's amazing. if you look at past administrations, you can't imagine either george bush or bill clinton not being there. think back to 9/11 and how devastated we were in the aftermath and how much better it made us feel to have other leaders from the world staying you're there with us and we're not alone. it's embarrassing. >> could have sent the vice president. >> he's only good at community organizing when it is campaigning. this actually involved -- he needed to be a leader. he needed to go there and stand side by side with netanyahu and needed to project leadership and strength. that's not what campaigning is about.

that's not what he's good at. i want to see the president's schedule, you detail some of that. i want to see kerry's schedule, biden's schedule and what eric holder's schedule. >> unexpected visit to pakistan to talk about anti-terrorism. that's where he is today. >> eric holder was there. i want to know what he was doing that he was there already. >> he was assessing terrorism t. makes a little more sense to me that he wouldn't shift the meeting to later in the day but i think the president knew he was going to be asked about the words he won't say radical islamic terror and he didn't want to have to say the words. >> he didn't want to go. so we reached to the white house. you were talking about the fox report last night. we asked, will there be anything like this? they are planning an anti-terrorism summit for the beginning of february. that came out with the same statement where they said we didn't go because we didn't want to be a distraction. >> let's see. does the distraction from what?

>> it's not about the president. >> we have the same opportunity to go to the sidelines and say, i'm so glad to see you here. now let's talk about what else we can do. >> speaking of summits, harris obama administration is also coming under fire for its response to the terror attack the french prime minister saying his country is at war with radical islam following the deadly attacks. but in two interviews on sunday attorney general eric holder refusing to follow his lead and use the same term. >> i would say that we are at war with terrorists who commit these heinous acts and who use islam. they use a corrupted version of islam to justify their actions. we are bound and determined to hold them accountable. >> meanwhile, senator mccain says a growing number of terror threats to the u.s. are a result of the obama administration being too lax. >> this is because the result of leading from behind. this in the same organization these people are trained from that the president of the united

states said yemen and somalia were success stories. >> he also says the president has no strategy to degrade or defeat terrorist groups in iraq and syria. so senator brown, i think the president doesn't want to use the words he's come out and said, there is no war on terror. we're not at war with islam. he doesn't want to say the words. he didn't go to paris because i don't believe he cares. but as far as defeating the enemy, he has given speeches after he's called them j.v. saying we're doing what we can. do you see any clear strategy in the white house or strategy at all to defeat radical islamic terror? >> i don't and i have spoken about this before. you have a situation where we drew a red line and crossed the red line and did nothing. that set in motion a whole host of things. as i said, our allies don't trust us when it comes to us standing up and being there when they need us. the foes are emboldened moving forward. what's the easiest thing you can do right now? they could go into the senate or

the house of representatives, take away the passports and citizenship of the people right now they've identified that are over there fighting so they don't come home. how about that for a simple first step? so they stay there, they can stay with the new friends and fight with them but can't come back. we know who they are. there's been reports on that issue and i agree with senator mccain. we're always coming from behind coming from behind not really taking the leadership role. we are america. the president is the leader of the free world. i believe he's missed some amazing opportunities not only to unify the world against isis and islamic terrorism but also deal with a whole host of other issues. >> we're taking some action harris. the problem i have is the actions are actually emboldening the terrorists like release them outside of gtmo get rid of enhanced interrogation, i could go on and on and on fail to seal the border, everything we're doing is working against defeating the enemy. >> what we are doing today and what we started last night were

on the streets of new york and streets across the country and that's after this isis video warning we reported on last night. they say that they want to hunt down and kill intelligence officers police officers soldiers and civilians in the united states and western allies. that nine minute video caused a ripple effect here in new york where we saw them looking at people's hands as they were out in public areas making sure that people didn't have things in knapsacks and that sort of thing. the president has repeatedly said al qaeda is decimated, decapitated, on the run. just days ago u.k. 5 director said he's witnessing threats to cause a large scale loss of life by members of al qaeda terrorists often by attacking transport systems or iconic targets. that's a quote. both things cannot be true. so is the president just plain wrong or is there something else going on? >> they're also allergic to the terms radical islam. what are you so afraid of?

>> welcome back. president obama's executive order protecting millions of illegal immigrants from deportation will reportedly cost states billions of dollars. that's according to court documents. first hearing in the suit filed by 25 states trying to stop the executive order set for this thursday in a federal district court in texas. among some of the claims texas officials say they'll have to hire more than 100 people new employees, to process hundreds of thousands of driver's license applications with state taxpayers shelling out more than $130 per applicant. indiana claiming it will pay unemployment benefits to illegal immigrants and wisconsin says they'll be allowed to carry sealed weapons permits. as half the states get ready to duke it out in court, republicans in the house are targeting funding for parts of the homeland security department

halled carry out the president's immigration orders. this is what drives me crazy about american politics. you have these sweeping reforms, these grand ideas of things that people want to do and they never break down the dollars and cents of what it's actually going to cost taxpayers. you may agree with what texas is saying but what they're doing is spelling out, this is going to cost money and it's going to come from you and it's going to come from me. >> that's where the backlash is coming in when the states start reviewing the costs and all taxpayers have been looking at the policy and this administration acts like this is free. nothing is free. someone else is taking for that. so if you're going to offer these exemptions or whatever you're going to do for illegal immigrants, there's a tax pay to her foot the bill. taxpayers will realize we don't have the money. this is money that could be going to other causes that could support state education, whatever it might be. republicans will have a lot of support on this and they need to monitor this properly.

>> do you believe those numbers? does that sound right? >> president doesn't care. of course they're right. the states are coming up with those numbers. they know what their costs are going to be and they know what the ramifications are and you know the president, he said it's no mystery. he's going to use his pen and the phone to use his executive order, executive memos to change the way we live in this country. so here's the issue, really. is what he's doing unconstitutional or is he exceeding his authority? that's really the issue. and they need to file suit immediately. they need to go after the purse strings as they're doing, micro targeting the areas where they have some control and then any legislation that the house comes up with they need to specifically put within that legislation, the dos and don'ts. right now it's a little too open ended. >> i have to bring in the economic side of it. as an economist you say more people is better for the economy. more labor and more consumers than any time you'll make the entire population better. it will grow the whole economy. that's what economists argue.

what do you think? >> i think if republicans were smart, they would step up and talk about the jobs that are at stake. you talk about economics. so there's a lot of people out of work right now and we've talked on this couch about seizing the populous message. republicans are missing the opportunity. look. it's one thing to go after homeland security funding but that's a nuanced issue. where is the larger theme to connect with those voters? and also the cost of obamacare, we heard the white house originally and you know this better than anybody say, look. we're not going to have any illegal immigrants. we're not going to bring them into the system and have them enroll in obamacare. we're seeing that happen and we've seen the white house reverse course. those numbers that you list ready about to double and triple. >> it's even worse on that front because illegal immigrants aren't necessarily eligible for obamacare, that means that employers can employ them without having to pay that tax. so it gives them an advantage to hire them over americans because it's cheaper and businesses make economic decisions. >> so in other words, nothing

really has changed with regard to that because that's what we kind of have now, right? especially if you live -- we have a home in arizona so when you live near the border you say that play out. we talked about defunding and measures to do that with the department of homeland security. you've talked about so much, how tricky that is for republicans to even go down. do they have a stomach to even do that? >> can they all get on the same page messagewise? you know what's going to happen. the media and the white house with the media in the back pocket is going to say, republicans are against security. they don't want to protect you in this tenuous time. they're not going to dig up the small print saying we're going to keep border patrol agents, all of these things. it's going to be republicans don't want you safe. here at the white house, we do. i think republicans have no way to coherently fight against that message, unfortunately. >> keystone pipeline is taking center stage in the senate today. can republicans get enough votes

president's veto. >> actions speak louder than words. he's delayed this project more than six years. americans won world war ii in less than two years so he's trying to defeat the project with endless delays which is why it's important that congress acts. >> with 50% plunge in crude oil projects, it's a question whether it makes financial sense at all. let's start with the money. i'll go to melissa first on that. >> i was in saudi arabia at an emergency meeting of oil. please remember this day when oil collapses below 50 and it's way below that now. the important is that i covered this for so long oil goes up and back down. it always returns to the median. at that time we said we had seen the most oil we would ever see in this country and that it was only going up from there. that was wrong. new technology came along and made the supply come back on market. to think now it's depressed this level and not going back, not

true. it's going to. this is our opportunity to build the pipeline. we should still do it because there will be a day that we will be happy that we did it because we'll be saving consumer money. >> i want to ask you is senator of north dakota even right to think they could get enough votes to ever ride a presidential veto? >> he's a great guy. this is very personal to him. it goes through his state. he's in the forefront sponsoring the legislation. they have the opportunity to get it. if the president is going to veto it great. then the people can see where his head is at and whose side he's really on. >> what do you think the chatter is like? you know. what's it like in the background of all of this? because you have seen the president and his team stall for six years in ru vees constant reviews. >> more and more excuses. >> and some of them conflicting but most of them saying it wouldn't hurt the environment the way that some democrats have argued it would. >> it's clear it's another tool in the tool box to step back from our dependence of foreign oil and right now it is low.

thank goodness. now people are feeling that there's an economic jolt helping the economy. you know, get invigorated a little bit. but we always have efforts in the senate in particular to raise the gas tax. like they need more money in the federal government. how about building on fixing our infrastructure? we don't have storage and natural gas. this is another effort to develop that north-south relationship with canada. >> what's interesting about that we're just starting to -- and the white house touted this to give some release to the middle class. and now you want to take the gap between what they were pay to go what they are paying now at the pump, money they could spend on other things. your thoughts? >> i think of long term energy dpind -- independence. and i agree with the senator. let the president veto it. but republicans, be there to explain what he just did in terms of jobs, in terms of energy independence. articulate why that was so bad. although i think the american people are saying, hey,

mr. president, we've tested this. >> they're using it as an excuse. low gas prices. we don't need to do this project. we talked about this a couple of weeks ago but i think if republicans wanted to use a strong argument what's happening in the middle east what's happening with isis isn't the perfect time now to talk about getting off foreign oil and stop empowering the middle east? >> we have a big report come up in the fox business network at 2:00 because we dug into how they're wasting the current money that they have. >> government wasting money? >> can you imagine our current taxes as you're bridges crumble? we have a big report coming up on that. they're not fixing anything. they're spending it on schools, on education, on medicaid on bike paths, on hiking trails. >> that's the biggest problem with taxpayers. not opposed to fixing the roads and bridges but if we're going to raise gas taxes they want the money to go where it's supposed to go. that's the problem. >> we're going to shift over to

some presidential politics now because there's a potential shakeup in the g.o.p. presidential field after months of speculation. former massachusetts governor romney admitting he's considering a run for president in 2016. it will be his third white house bid. his announce maniedment -- announcements coming weebs after governor jeb bush also says he's considering a bid. if he runs, they would be looking to establish the right lane. you've spoken to both of these gentlemen very recently. what is your take on this on this competition that could be emerging between these two potential candidates? >> i had a luncheon with jeb bush. he was complimentary of mitt romney and there's a mutual competition between the romneys today and romneys of yesteryear. you have a situation where governor romney is interested. he's -- i've encouraged him to get involved. he was right on russia. he was right on obamacare. he's been right on the economy.

and i believe personally and i've said this before that we would be in a much better situation not only internationally but domestical physical we had a president romney. >> so if he got in would you support him? >> i'm going to wait until that happens because there's some good people running. i want to understand their issues and what their platforms are. >> if he doesn't get in, would you support jeb bush? >> i'm glad you brought that up. i've been contacted by quite a few candidates. i've said that i would set up a meeting with activists and others in new hampshire to make sure they would be able to make their pitch and let the citizens decide because the first in the nation primary voting state is obviously one of the new hampshires. >> it's not great for the republican party to have so many candidates in the race early on. >> it's not about the candidates. it's about the process. how long we wait until we get through the nomination process. it freezes the money it doesn't allow people to actually move

forward with their message. all the president had to do president obama had to do was save his money and keep banging away at romney. he didn't have a chance to recoupe and recover. >> i see a lot of conservatives that are worried. some of them were making jokes on twitter. we've seen this play out before. and they're really hungry for new blood. i say the more the merrier. let them get on the stage and if they can't take the heat they'll be out. looking at what conservatives are saying, do they have a point we've seen the story and it hasn't worked? >> i think that money matters and when you divide up money early on it is a problem. and you talk to folks behind-the-scenes, especially as recently as this weekend talking to governor romney and he's saying, hang on. before you give jub beach your checks, i'm still out there. hit the pause button. i think that confuses the big donors and it divides up the money in a way that ultimately isn't helpful to a republican getting elected.

that's what i worry about. >> can i say one thing? all my response is to that hillary clinton, elizabetho my conservative friends. if you don't want good people someone like governor romney governor bush, others who are out there ready to lead this country, you have a choice. >> but what they will tell you is that mitt romney won't be the best candidate that you need someone who is strong to take on a hillary clinton. senator brown, you came very close to winning a critical state, new hampshire. would you, if you were asked, consider a vice presidential role? bush-brown, would you consider it? >> i love being here on the couch with you ladies obviously, and -- >> you're more like a president to us. >> there's no way right now you can say you like this more than you would like perhaps -- >> that's never going to happen but the role i do want to play is the ability to have people who care about our country and want to get involved because that's why the people are running, because they're very

very distraught about what's happening right now in america in our position in the world. that's why they're running. that's why somebody like governor romney and governor bush and others are running. i want to meet the people who are going to make the decisions, fix the voting laws in new hampshire and go and start to process. that's my role. >> that was not a no. >> i had one more really uncomfortable question i was going to ask you about maybe you running for something, anything again but i think i'll save it for "outnumbered overtime." >> okay. how about next week? >> police in new york city on highest alert after isis releases a propaganda video urging followers to kill police in the u.s. they're told no more vacation days following a work slowdown confirmed by the commissioner last week. is it time for the police unions and mayors to come together for the sake of the city?

>> the showdown between the nypd and the new york city mayor's office is heating up after police commissioner confirms officers have engaged in a work slowdown amid the political standoff between mayor de blasio and police unions. now top brass are barring cops from taking vacation and sick days until the slowdown ends. all right. in defense of the police here in new york city, it's not that they're not responding to calls. it's not that they're saying we're not going to answer them. they're just not doing proactive policing on things like the mayor's war on tobacco, things like that. >> and i think it's making people nervous because they're seeing the headlines and you have all this terrorism news out there and they're saying, my gosh. this is new york city. we need our police. i do believe that something needs to happen here. there needs to be a resolution between police and the commissioner something needs to

happen but i don't think people need to be alarmed. for the tough jobs, police are showing up. i think it's exactly what you're talking about. other frivolous things that they can say hands off, they will. but if you need police officers if you're talking about crime, security issues they'll be there to protect you. >> i've gotten two tickets in the past month, parking tickets, so i've been hearing about the police showdown and -- >> you haven't felt it yet. >> i'm getting two parking tickets so i'm not sure it's a slowdown. they could slow down more on the upper east side. >> sounds like you need to slow down. not the police. you need to slow down. >> probably true. >> if i'm a cop and i know the mayor is not on my side and you've seen what happens to police in new york when they do their jobs they risk a lot of things. they risk their lives, careers being ruined risk having their name in public their job, their pension so a lot of them pulling back saying why would i risk doing these things? i know where i live in new york city and the cops are around. i don't feel unsafe now that

they're not doing their jobs. i think the neighborhoods that may need them the most are the ones that are going to feel and we predicted this absence in policing. >> there's a revenue versus safety because every time they're not issuing citations and not issuing tickets, a loss of revenue in the city. >> except for me. i'm down $120 this month. >> i know. >> but you do have a situation where the police are saying do you know what? he doesn't have my back. he doesn't have my back and they're very -- it's a brotherhood/sisterhood of law enforcement. they care very deeply but they're hurting right now and they need to have a massive come together session. they need to sit down with the mayor, the commissioner and just hammer it out just shut the door and say we're not leaving until we have a meeting of the minds and i don't know if the mayor has kind of the personality to do that.

mayor de blasio. >> i walked outside last night and we always have new york city's finest. they were mounted on the horses the way they always are there. i think what you're saying is right. they'll look at this political issue that the mayor -- how much big gulp are you drinking are you breaking the cigarello rule or whatever it may be. >> are you drinking a beer on the street? >> isis put out a nine minute video on our heads. i'm not worried. nypd blou is there. >> it's not that they're going after crimes. they're not going after the progressive campaigning, cigarettes and things like that. we're awaiting the daily white house briefing at the top of the hour and the barrage of questions that he could likely get during the absence of high level administration officials at the paris rally yesterday.

kneeling in prayer before a cross. but not any longer. city officials have voted to remove that sculpture to settle a lawsuit on behalf of -- would you believe it? an army veteran. he claimed the memorial violated his constitutional rights by promoting christianity. officials in king, north carolina, a town of about 6,000 people are citing the mounting legal costs in their decision to settle. was this a case of bullying or something else? >> i think it's bullying and it always comes down to cost. what happens is people look at the cost. you're talking about $2 million and it's not worth the fight. if you give in across the country, you have people bullying you. i want to meet the people that feel the need to sue and get a huge case out of it. i think it's ridiculous. it wasn't bothering anyone. i just don't understand why people go to such great lengths. >> for the perspective from the army veteran he said he served

side by side people of many many faiths and he wanted there to be equity ability in terms of how we would remember the service and there was a christian flag that was flying over this memorial site too. >> did you see the response to that? they established a lottery to let people decide what flag, my flag, would be flown. so they immediately tried to give everyone a voice and it isn't really the veteran behind it. the group was americans united for the separation of church and state who go around and look for causes like this to get behind and pour their money into in order to fight this. the town -- i don't know. i'm torn because they were bullied but then also that's the tax dollars so does the whole community want them to spend the tax dollars fighting the fight or did they change the memorial? >> it all comes down to money. what's interesting is you have a lawsuit for $2 million but they'll have to pay the group $500,000 to cover the legal costs to get the whole thing started. >> these groups do look for one person who will be the face or
