the year by the family that created the estate. when the estate transfer you're taxed on that. >> yeah. >> as estate tax transfer. >> he wants to increase top capital gains on couples above $500,000. it's been raised under obama from 15% to 23.8%. >> he wants to soak the banks with more fees and the money will go to what? what the president says are tax breaks for the middle class. a $500 second earner tax break which will encourage both spouses to work. child care tax credit being hiked, and expanding a earned income tax credit which is basically free money to lower income workers. >> right. up to $3,000 per child under the age of 5 now. there's a cap on the income up to $210,000 in the family household. the $500 for two working parents

would only go to the $200,000 threshold. >> look, the president is making the case he's made many times before. we're going to soak the rich. they have the money. you have none. you're not going to feel it at all. only people you've never met before will be paying the taxes. >> when you spread the wealth around it's good to everybody. remember when he said in 2010? it's a narrative we've seen before. president obama's weekly address he said he wants the gop to push all games aside and to basically come to the table and do what he wants with this. >> our job is to make sure every american feels they're a part of our country's comeback. that's what i'll focus on in my state of the union. how to build on our momentum with rising wages, growing incomes, and a stronger middle class. i'll call on the new congress to join me in putting aside the political games and finding areas where we agree so we can deliver for the american people. >> so how is the president going to sell this t people in front of the

republican audience? he likes to invoke republican presidents at the events. he talked about how much he likes ronald reagan. he plans to invoke ronald reagan during the state of the union address saying the top tier capital gains rate of 28%, hey, ronald reagan raised it to 28%. why shouldn't we do it now? >> republican spokesman said it's ridiculous. it's meaning is the open silt of the literal meaning. stop playing games. this is a game. he knows it won't go through. the irony underneath it. income inequality has grown faster than obama than any president in american history. his solution? more taxes money goes to washington and we'll figure out how to doll it out. really? has that ever worked? >> it's a great way for the president to rally his base and to pit them against the evil republicans. as you mentioned, paul ryan said this is not a serious proposal. we lift families up and grow the

among the people. to kiss babies, to talk to people, to shake hands. >> think this man was elected when he was hoping to retire. and he said, yes, i'll put my life in danger but i'm 78 and i'm going to do it. he said i'm going to try to get as close as i can to the people. one remarkable thing about the trip is the people who came to see him were not the big donors. nothing wrong with big donors. we need them. every charitable institution does. the people suffering most he visited an ororphanage. he had two 12 year-olds tell their story of being kidnapped and abused and sold and then they were eventually freed. those are the type of people he's spending time with. >> and pushed aside his prepared remarks to address these concerns of the people. how is that different from what we've seen in the past?

obesity and fatness. we'll put up on the screen. 19% of ten to 17-year-olds in texas are fat. 16% of high school kids 31% of adults. those numbers are pretty high. should the government have any role in helping to bring them down? can it? >> well, these rules were put in ten years ago in 2004 and those figures haven't gotten any better. government intervention hasn't worked. but individual responsibility, local control is what works. so we're getting out of the school mandate business. i started -- >> ten years cupcakes have been banned and the numbers are the same. i didn't know that. >> yeah. that's correct. >> wow. didn't work. >> it absolutely didn't work. side miller, i think you're probably a hero to a lot of moms in the state of texas.

your party again. >> here is one area the republicans may have the agreement. impose a fee on big financial firms with assets over $50 billion. but you mentionedth $500 for the second earner tax credit in families working so both spouses working. they each get a $500 tax credit for the year. >> yeah. that's what your money would go to. expanding the child care tax credit up to $3,000 per child under the age of 5 and expanding the earned income tax credit to workers without children. >> it's so interesting the idea behind this and the president said we're going address income inequality and falling wages or stagnant wages for the middle class. what they don't mention and the irony behind this is income inequality has risen faster. wangs have been more stagnant than under any president in american history. it doesn't result in more

children in the philippines live in poverty. and he wanted to be there with them to weep with them. to cry out that something needs to be done to take care of these children. >> so what is his message for poverty? is it a message to the poor about how to live with being poor? a message to the rest of us about how to help the poor? what can we take away from it? >> this is a two-fold message. the pope always speaks about our responsibility. but he tells us about our responsibility to one another. and the responsibility of governments to work for the common good. and to deal with the structure barriers to help create poverty. so his message is multiple in that sense. he's very concerned that the poor not be left out. they not be marginalized. these are people who just don't make it in the marketplace. they need a help. they don't want to you know,

they don't want to be subsidized. they don't want to be treated like charity cases. they want jobs. they want decent jobs. they want good education so they can help their children to prosper. >> yeah, job training and education is a great ticket for them to make a better life for themselves. what can we take away from the message that the pope gave there in the philippines here in america? >> well, i think that the message that the pope gave is one that has been throughout his pagan si. we have to be concerned about the poor. they have to be a piratety. they were a priority for jesus. this is a message that has been constant in his preaching. that when the poor are left out of any kind of economic system then the economic system is flaw flawed. they need to be focussed on.

join us to talk about that. the white house getting big preview of the state of the union address this week. and the president has released the details of his plan. if you read the new york times this morning you would have thought that this was all about reducing taxes and really helping out america. but if you break it down the opposite side of this this could be seen as a tax increase on the wealthy. here is the president's plan. eliminate a tax break on inheritances. so the big tax that when an estate is handed down. you see an increase in taxes there. capital gains rate would go up to 28% from 15% when the president came into office. >> that's right. and also impose a fee on financial firms with assets of more than $50 billion. >> right. >> so in return that is what he's taking. the pitch is we tax the rich people you never meet. see on television. they're the only ones that pay for it. and you'll reap the benefits. that will include a $500 second earner tax credit for families

who are both spouses work. the federal government would be subsidizing having two parents in the work force. expand the child care tax credit up to $3,000 for kids under the age of 5. and expand the earned income tax credit to workers without children -- it was thought up by republicans years ago. transfer payment basically payment of people with jobs. >> harkin back to 2008 and when the president was on the campaign trail running for the first time and joe the plumber asked him in northwest ohio about his tax policy for small business owners too. he basically said when you spread the wealth around it's good for everybody. so the redistribution of wealth is nothing new. >> a big point on the $500 second earner tax credit for families and also $3,000 for child tax credit that's for families who are capped at $210,000 in annual income tax.

glutton for punishment. my buddy runs the adaptive training foundation and we're doing this through the high five foundation and david was like hey, jake, i need you to do this skiing scene and they want to make a documentary about it and originally i was like i'm not doing that and five minutes later i was like yeah i'll do it. so what it is is he's training me to get on skis again and snowboard. i'm doing both. ski and snowboard over a five day period out in lake tahoe in march. so he's setting me up and training me to do it. he's not nice to me in the gym. that's the only place that we don't get along. but it's awesome because it gives me a chance to show other warriors that have been wounded and anyone if you've been in a car wreck or tragic accident it

and dogs that have thinning hair coats. she is all of those things. she's a chihuahua mix. she does have a thinning coat and she's really little. i wanted a coat that covered up her belly. she will be close to the ground. >> i have a big yellow lab at home. he hates his coat i make him wear. he thinks you make me wear this dumb thing. he doesn't like putting it on but if it's under 20 degrees he needs it. >> i probably would. it allows him to stay more active. >> when she gets out there and is playing in the puddles you can wash that throw in the wash piece of cake. >> they get more exercise. >> exactly. >> even big dogs. >> exactly. so a lot about going out in the rain. today is miserable for dogs. so i found this awesome little raincoat that actually has an umbrella, the hood acts like an umbrella and goes right over the top of his head. >> is there a shame factor? >> there is. you have to be really secure.

>> but is your dog humiliated. >> i really love that they can see really well and hear really well too. and calvin's paws are covered in boots. >> these are adorable. >> the lights are super cool. great for visibility but the important thing is it gives him lots of traction and protects him from the ice and the salt and there's a great band that goes around the bottom because if you find a boot that doesn't have this band they're going to fall off. you'll have a three-pawed boot dog. you can buy one that have a strap in them. >> not worth it. so if you can't do boots though you can do you need to take care of their feet like with wipes. she has been out in the ice and snow and salt and we need to clean off her paws. anything that goes on the foot goes in the mouth. that's my rule of thumb.

but we'll see what proposal the president has. we're looking at a situation where you are making it more expensive for those groups that actually create jobs including small business. >> what's the response from wall street on all of this? there might be agreement between democrats and republicans on the big assets. the companies over $50 billion. that tax increase may be the only thing that dems and republicans agree on. >> one of the big issues is the amount of money that large corporations have overseas. we're talking trillions in terms of cash being held overseas because they're getting double taxed. that's one area that actually the president is going to continue to dig in in and say no we're not going to change this the idea that you get tax when you bring that money back and by the way companies are going to keep that money there and sit on that money and that's not going to go in the way of job creation. it is a mistake in terms of continuing to make it so difficult for these companies large and small. >> it's just mindless and

counter counterproductive. you say there's some that aren't as good. >> theow oil prices and continuing to see this drop in oil. oil prices down 20% over the last year. the conversation all of us have been having and the conversation throughout wall street and main street is i'm paying lower than $2 a gallon for gasoline. i'm going to take that extra money that i have and i'm going to go spend it. here's what happened in december. down in terms of retail sales. people are not spending that money that they have saved as a result of lower gasoline prices but the negative that has happened as a result of low gasoline prices are oil companies are cutting jobs and this whole idea that the shale revolution has been the place where job creation has happened that's seeing a dent put into it. since 2007 all the jobs created. all the jobs created since 2007 have been in texas and now we're

seeing a dent in the shale revolution. it's just not as economic for the smaller and mid cap shale companies to continue the projects that they were on. you're seeing rig cancellations and lay offs. bp oil companies are cutting jobs. so there's a concern. >> you have big guests on that topic and more this morning. >> we have dan coming up to talk about the falling gasoline prices. i don't think there's many people out there that feel we have bottomed out. oil prices will continue to go down. we'll see an impact not only on lay offs but way to see if this is going to help consumers and get the consumer spending move going. of course we'll talk about the president's state of the union on tuesday and what might be the reaction. i find it interesting that after the president's state of the union the president is going to sit down with a youtube sensation and talk about his proposal right after. >> it's a new world. your show on in looks like about 11 minutes. >> yeah. >> we'll be watching this. we always do. >> i'll see you next. >> coming up here on the show,
