racing to prevent a new terror attack are looking to muslim countries for help. official with the european undown called today for sharing intelligence that coot help track down terror cells-following a week of arrests across europe, including a raid in belgium to stop what officials called a major imminent attack. police in greece rounded up suspects over the weekend, including one they say is linked to the plot in belgium. in france military troops are still working with police to protect possible targets after the deadly attacks there. french prosecutors have said as many as six terrorists linked to the attack at "charlie hebdo" could still be on the run. and officials across europe are warning there could be even more sleeper cells out there waiting to strike. so, with all of that now the top homeland security leader in congress says the united states could also be at risk. catherine herridge is live in washington. what are we learning about the

arrests in france and a possible connection to the united states? >> well, shep, an intelligence source tells fox news into expect more arrests as investigators disemployed phones and computers and more of their contacts win the networks. the source emphasizing that command and control means operatives are tied by a terror group, given training and financing but the timing for the plot is left up to the cell. with republicans and democrats now calling for more scrutiny of high risk cases including americans that travel to syria. >> you see what is happening in europe france, belgium germany, you have to assume that's a risk we have to consider. >> these are americans who we know have been associated with these extreme groups. it's really important that our intelligence community concentrate on those who are the highest risk to the united states. >> reporter: there was a near universal cry for less intelligence collection and

sharing with other countries after the snowden leaks senator johnson, who heads up the senate homeland security committee says there now needs to be more sharing and more collection, shep. >> what more do we know about the travels of these paris suspects? >> the growing body of evidence shows the kouachi brothers brothers and amedy coulibaly knew each other socially but there's no evidence that coulibaly ever travel to syria. an intelligence fours says the americans are sharing information with the europeans and the arrest could spread into eastern europe including romania and bulgaria. a yemeni government official confirmed the two french nationals have been arrested inemn on suspicion with meeting with al qaeda in yemen, the group linked to the paris massacre and those two citizens are being detained. >> let's bring in steve palmer. former assistant deathy and counterterrorism chiefty fbi. what needs to be done that eggs

compass. that it don't think we're doing things well. >> certainly having greater success than they are and there are any number of reasons but part of it is the kind of effort we have made since 9/11 to make ourselves more secure, and we have accomplished that. that's not to say we're out of the woods and not to say we won't have these incidents. we have certainly done better than they have and the events playing out there clearly demonstrate that. >> we haven't had anything major here, thank inness. listening to what they're talking about over there though they're talking very much about the need to protect individual rights and liberties and freedoms but there's this widespread belief from everything i've read that we have lost some of our freedoms here unnecessarily so and because of it we lost a little bit of the soul of who we are. >> well, your people are free to draw that conclusion. i argue that's not the case. that we're still -- we try to balance the need for privacy and civil liberties and our agencies

here operate within the law. the laws are made for our protection, and we operate within those statutes and again it's worked to our benefit there has to be a balance, i absolutely agree with that. they have democratic societies we have a democratic society and you certainly want to maintain that. that's not to -- it's not either/or. there's a balance that needs to be reached, and we're trying to reach that balance here in this country. i'm sure they'll do the same. but if you give up aggressively trying to counter these people gaining intelligence and learning what they're going to do before they do it, then you wind up with a situation like you have in paris and the situation like you have in belgium, and that's not where you want to be. >> the former assistant director of the fbi and the former chief of counterterrorism sir nice to see you, thank you so much. >> yes, sir. >> cease fire now in effect in yemen where, man, yemen is a real, real mess.

officials warned that a rebel group is moving in toward a coup. the group0s slogan, death to america, death to israel. that is near the presidential palace. firefight breaking out in the capitol city the same day the rebel seized control of the government run media. the rebels are shiites but deny they're linked to iran. the power struggle comes as the west targets al qaeda in yemen, which american officials call al qaeda's most dangerous branch for the united states. the rebels promised to crush the terror group and also call for the destruction of the united states. the cease fire came after the rebels seized critical land near the presidential palace, and there are many varying reports whether the cease fire has held or not. and whether they're going to be able to maintain control of the government. yemen is in complete disarray. the situation there is very

fluid. officials in indonesia say so far they found no evidence of the terrorism in that airasia crash. investigators listened to at the entire cockpit voice recording and say they have heard no gunfire and no explosions nobody else talking except for the pilots, and no mention of any threats. crews say they recovered 53 bodies from the wreckage, 162 people were onboard that jet when i crashed into the java sea last month. investigators have said they believe bad weather likely played a role in the crash. president obama getting set to deliver the "state of the union" address. we'll propose tax hike on the wealthiest americans to pay for tax breaks for the middle class americans. republicans argue that could hurt all of us. both sides coming up on the fox news deck on this monday afternoon. you just got a big bump in miles. so this is a great opportunity for an upgrade. sound good? great. because you're not you you're a whole airline...

the virginia governor, terry mcauliffe, is recovering from injuries after a horse tossed him off it's back in africa. a spokesman says that the governor broke seven ribs in tanzania during family trip around christmas day. the spokesman says the governor went back to the hospital today so the doctors could remove fluid from his lungs. still the injuries have not kept him from the job. he delivered the virginia state of the commonwealth address last week ask visit norfolk today.

>> white house officials say president obama will propose a tax hike on the richest americans use that money to help out the middle class. of course republicans are fighting the move even before president obama outlines the plan in the state of the union address. it's a call for raising the capital gains tax on couples making more than half a million does. it goes up to 28% where it was by the end of president reagan's time in office. officials say that money, plus new fees for the largest corporations, would help pay for tax breaks for the middle class. but republicans say the move would hurt the overall economic recovery by pushing small businesses -- but pin issuing small businesses and companies that create jobs. ed henry has the news from the white house. can the white house sell any of this? >> it's going to be hard because these are the same policies the president has been pushing for six years. the difference now is he has neither control of the house nor the senate. republicans in charge of the

entire congress. where his aides believe he does have some room to run, though is republicans for six years have said those policies would not work. the president's advised point out the economy is now recovering. >> now that the economy is in a stronger place than it's been in a long time weeks in to double down on efforts to deal with wage stagnation and declining economic mentality. >> reporter: the president may have a growing share of the public on his side. this latest abc news poll shows this president's approval rating climbed above 50% for the first anytime well over a year shep. giving you an idea that the recovering economy is lifting him up at least a little. >> this idea of tax increases on the wealthiest and aid for people in the middle class that's other wide lie seen as a political move to highlight the difference between the president and the republicans. >> the president's aides acknowledge in part this is part of the "state of the union."

homes in grayson county kentucky, two weeks another. cops believe the boyfriend and girlfriend made stops in south carolina georgia, stealing trucks and writing bad chengs. the sheriff says the teens could face charges in multiple states. >> they were forging checks in each state. i don't think they realize when you forge a check in another state, they get charged in that state. so they could be facing charges in four different states. >> he says the boyfriend could also face charges of custodial interfering for taking the young girl away from heir family. she was 13. the girl facing charges of her own in juvenile court. unanimous young joins us now and is live, criminal defense attorney. children should not do such things. you shouldn't steal cars and write bad checks and run away from mommy when your 13 years old, but in the grand scheme of things, how much trouble could these two really be in? nobody got hurt. >> that's right, and in fact the defense attorneys are likely going to make that argument.

these are lower level felonies no one was injured or hurt or cops shot at. the defense attorney will be looking at mitigating factors how serious with the crimes. on the flipside the prosecution will argue that dalton hayes, the 18-year-old took the 13-year-old, and his criminal behavior was escalating from going on a multistate crime spree of burglarizing houses taking cars, and all of those things are really going to rise to the level of we need to make an example out of him. so it's going to be interesting how this pan out. >> there's been questions whether he knew how old she was. if he did know, then he is deal waiving 13-year-old child here, does that complicate the mess for him? >> it could. this is the thing inch most jurisdictions you don't have the mistake of age defense inch at the state of kentucky you do. so he could technically argue, well, didn't know she was 13. i south she was 19, and that's going to be dependent upon what she says, what he says, how they met, and all those different factors in terms of figuring out

the totality of the circumstances. >> they call each other boyfriend and girlfriend. if he had some sort of sexual relations with her there's another set of problems, isn't there? >> absolutely. he could be potentially looking at statutory rape. so instead of just looking at lower level felonies of theft related crimes he could be looking at statutory rape if they had sexual relations and if he is looking at statutory rape then he is looking at a possible lifetime registration as a sexual offender. so, he is looking at a whole slew o problems in adult accurate where she will be looking at juvenile court, where it's about rehabilitation as opposed to punishment. >> this case got a lot of attention. are you surprised that they found hem in a truck in panama city beach there, hanging out, it took this long? >> i'm absolutely surprised. if was thinking about that. it took two weeks, and a that's scary because he is 18 and she was 13. tenth particularly the other states have sure disk but because they waived extradition i have a feeling this will be

"new york times" newspaper. it's reporting that the national security agency secretly installed tracking software into north korea's commuter systems in 2010. fox news can now confirm the purpose of the tracking was to gain insight into north korea's nuclear program. the spokesman for the director of national intelligence told fox news today that the u.s. intelligence community has been tracking north korean intrusions and fishing attacks on a routine basis. for more, let's bring in david sanger the national security correspondent for "the new york times" and helped break the story. fascinating to see how it was that they did -- they had to go through china. can you explain that to in the viewers? >> well, shepard, north korea does not have a whole lot of internet connections to the world. they only have 1,024 registered i. p. addresses internet

addresses. where you are in new york there are probably more than a thousand on every block that you walk past. so one thing they did was go in through the chinese connection, about if you take a look carefully at some of the snowden documents, the documents leaked by edward snowden and quickly some that were publish over the weekend by the german magazine, you'll discover there was an operation to get into north korea through south korea has early as november 20. it had been a hard target for the united states for some years. >> does your regarding give us an idea of why if we were in their systems, our government wasn't aware to inform sony of what was going down? >> there's no question we spent a lot of time on with our sources, very good question. the answer is, once you're in these systems you may be able to see things like a spear phishing

attack that like an e-mail that may be from a friend but don't click on it because it will put malware in thunder system. day were doing spear phishing attacks on sony and others, and seemed this was fairly routine stuff. nobody in the intelligence community put together that with the threats that north korea had issued about sony and about the movie, "the interview" that crude comment about an assassination plot against kim jong-un. north korea's leader. had they done so they might have thought the spear phishing might be a little more serious and had a greater intent. they didn't see the destructtive software which made the think different and destroyed computers at sony, until that happened on november 24th. >> after reading your report, i was wondering if there's been a

>> reporter: shep, right now it feels like things are getting back to normal here. this is back to being a quiet neighborhood barley mill road the vice-president's street is back to just being long and winding and unremarkable except for the secret service guard outpost just a few hundred yards hen me and that's the same guard shack on saturday night where agents say they heard multiple gunshots and saw a car racing away for parts unknown. when it went down a perimeter was set up, the street was closed, mean something residents couldn't get to their kids at movie theaters and things like that. but the road opened up at midnight yesterday and today no sign of the chaos of saturday night and sunday morning while the vice-president and dr. biden were out to dinner. >> have the firth what it was about. >> the secret service would not confirm to us.
