republicans calling on the centerpiece of the president's expected speech, raising taxes a nonstarter, will we see more of the same in washington or will we not? with that we bring in chief congressional correspondent mike emanuel who joins us live from capitol hill. >> reporter: hi, an diao. so far top republicans don't sound overly impressed what white house aides say will be president obama's key themes. senate majority leader mitch mcconnell, is talking about saying hopes the president will present ideas that can be passed by this congress. >> i hope he can present positive bipartisan ideas that can pass the congress americans just voted for. give us new ideas to prevent iran from becoming a country with nuclear weapons, or to confront the threats posed by terrorism, or to remove regulations that hurt struggling coal families. >> reporter: capitol hill will be buzzing tonight as the president delivers his annual state of the union. some areas where republicans

deals can get done, trade promotion authority, cybersecurity, tax reform and the authorization of the use of military force against isis but lawmakers are calling on the president to invest time and energy to make those issues happen. meanwhile top congressional democrats are speaking in favor of the president's plans. >> we want to try to make the earned income tax credit available to more and more working americans. so that we can supplement their income and as they struggle to get by paycheck to paycheck. that is one of the first things we can do. the second thing the president will address is college affordability. oh, there are plenty of critics of the president's plan but i think he put his finger on reality. >> reporter: at this point it appears both parties are talking past one another. we'll see tonight if the president lays out some ideas that this republican-led congress can support. andrea? >> thanks, mike. well, no one on the right or the left really thinks the president's plan to raise taxes

will go anywhere with the republican congress but earlier on fox news white house press press tried to explain why the president is choosing tonight to lay out his plan? >> this is opportunity for the of the of the united states at the state of the union address when he is before the country on live television, before congress, to lay out his idea, how his vision to move the country forward. if republicans have a different vision if there are areas they disagree they're welcome to say so. if they think it is more important to protect a loophole for people with trust fund they can certainly make that case. >> all right. senator brown our own bill hemmer asked josh earnest and challenged him why it has taken the president seven years to draw to address these problems in the middle class? if you look at statistics a lot of factors that play into a middle class household health care premiums income median household income, they have either declined or they have gone up. premiums gone up. median income has fon down. more people out of work or quit looking for work.

what do you think? >> all good points. what is his legacy going to be? first thing, hold on to your wallets, everybody the president and congress want more of your money. if anyone thinks the federal government is a good steward of your money they're not. there is tremendous amount of fraud, waste and abuse overpayments. every time the american people get a little break, lowering gas prices putting 20, $30 in their pockets what do they want to do? they want a new gas tax. unbelievable. i made a couple notes. it will be divisive speech, us versus them have versus have-nots, rich versus middle class and poor instead of finding common sense solutions to get things done for the first time in six years. >> it sound kennedy, like a campaign speech they heard before. even white house insiders says this will not be a typical state of the union speech, a messaging speech and a speech that speaks right to the base.

>> he is experimenting how to bolster his legacy to speak to senator brown's point this president, he gained so much more when he is aggressive against republicans. when he paints republicans into a corner and they have been capitulating with that, he sees his numbers go up. he has nothing to lose with the tough talk. it is completely empty. i can't emergency anyone sitting at home, yes pass the tax increases on to us. this is fantastic because all the tax increases he talks about they will all hit middle income earners and if he doesn't see that well, we all know. >> it is interesting, whether it is in the state legislatures or the federal government if you want to send more money tot federal government you can write a check to irs every single day. >> they will take it. >> virtually every state legislature when they passed that law, they don't do it. the people who are complaining the most don't send the extra money. >> melissa if you look at this, a lot of policies that the progressives which is where president obama's policies lie,

they targeted middle class. even though the president is expected to step up to the podium, spike the foot ball, deflated football much like the patriots -- >> hey. >> i had to get that in, senator. he will tack off things he has done, low gas price, all these things but you pointed out something very interesting according to a new "fox news poll." that is the not way people are feeling. >> no, right exactly and there is a reason why he has this message going because people feel like they are worse off. does your family feel like the recession is over? this is really telling poll, because if you look at the numbers, only 31% of the families polled think recession is over. 64% think we're still in it. fact check we're not in recession. two consecutive quarters where economy is contracting. we've been out of recession first time. the fact people feel like we're in one is very telling. says your pocketbook is worse off than it was before the recession. the facts bear that out from the federal reserve. whether incomes, net worth especially in the middle.

people are poorer. that is the reason why he is trying to deliver this message. the problem is, until we deliver economic growth, real growth and people start earning more money, feeling better they're able to save more, seeing values of homes go up. feeling more hopeful about the economy, that sentiment doesn't turn around. >> that stagnation to put a button on this, leads to apathy. that is the problem. people feel like they can't spend money even though mathematically they come out of it. >> you know what? i don't think that is the poll he will cite. in bc news.com. read at top of the page, and i mean a lot of exclamation points. brand new nbc/"wall street journal" poll shows this, 45% of the americans say they are satisfied with the state of the economy, highest number in levens years. parenthetically, january 2004. this is their editorial. let us repeat, 11 years. one two, three three exclamation points there. in other words according to nbc, writing it means the countrymen tally has exited the

great recession. you have two different narratives there. i think he will choose that one. >> not surprising. same folks that wanted to keep the message about obamacare and fact that you wouldn't be able to keep your doctor and that you wouldn't be able to keep your insurance plan, they didn't want the facts out there either. that is not surprising. >> can we shift gears into terrorism? for the first time, senator terrorism and foreign affairs but specifically terrorism has risen to the same level of concern as the u.s. economy. people care about that. when you talk to people who read the speech on background they say this is not really where the president is going to go. if you expect him to outline a strategy for defeating isis tonight's not the night. >> that is unsupport gnat. he is missing an opportunity to reassure our allies. right now they don't trust us. you can see he didn't go to paris. he didn't talk that last time. missing opportunity after opportunity giving iran more and more extensions when they in fact did not desafety

♪ >> welcome back to "outnumbered." new fallout after filmmaker michael moore's comments about the blockbuster hit, "american sniper." the war drama is nominated for six academy awards, tells the real-life story of chris kyle the deadliest sniper in american history. after it came out this weekend moore tweeted that snipers are cowards and will shoot you in the back. then he wrote a long facebook post to say what he meant by that. saying in part, i didn't say a word about "american sniper" in

my tweets. here is what i think about "american sniper." awesome performance for bradley cooper. one of the best of the year. great editing, costumes, make up superb. oy too bag clint gets vietnam and iraq confused in story telling. has characters calling iraq savages throughout the film. i think most americans don't think snipers are heroes. he goes on to mention martin luther king, jr., who he points out was killed by a sniper's bullet. moore's facebook post sparking this reaction from former navy seal sniper scott taylor. >> i challenge michael moore to come with me, to come with me and see what snipers do and come with me and walk and talk to veterans who feel that snipers saved their lives or they knew they were out there in overwatch and providing cover for them. >> kennedy do you believe he wasn't talking about "american sniper"? >> of course he was talking about "american sniper." why would you talk about snipers in the site geist. he doesn't have his finger on the american pulse like he think.

from across the street. that is the kind of sniper he and most americans think of not "american sniper." very convenient. it is very clever. >> actually very perverse and very demented. putting a criminal and a killer who killed someone, so wonderful as martin luther king on the same moral equivalency as an american hero who covers the backs of his fellow soldiers so that they can go and kill terrorists. if you talk to these guys they're going door-to-door in some of the most dangerous players and who has their back? who allows them to find terrorists we're releasing from gitmo by the way? snipers like chris kyle who gave them cover. who sat on rooftops as kennedy points out alone isolated. they have courage, a lot of things. they have everything michael moore doesn't have. >> to the veterans came afterwards what is most frustrating him he has never been close to being in the situation. >> because they don't have arby's in iraq.

and that is not only expected to trigger vigorous opposition from republicans, it could also create some big problems for former secretary of state hillary clinton if she decides to run for president. clinton herself said in her last run for president she wouldn't raise capital gains rate above 20% if at all. meanwhile syndicated columnist charles krauthamer and fox news contributor explains why tonight is about president obama defining his own legacy and has nothing to do with helping hillary. >> he wants to be the man who changed or at least brought the party back from the clintonian, meaning the bill clintonian idea of a party that was moderate that was able to balance the budget, that abolished welfare. that is the clinton idea the moderate, sort of center left. obama is not a center left man. he wants to change america and wants to change the party. >> so perhaps she will be

watching, holding her nose if that is the case because that might hurt her. what are your thoughts? >> first of all president obama does not care about hillary clinton. he cares about his legacy and that is what he will focus on period. >> you agree with that? >> absolutely. i think he was spot on. that being said in addition you have joni ernst obviously who will be giving the response. here you have a mom a wife, a state senator accomplished person in her own right. 1993, served in the military, a lieutenant colonel a veteran, the first woman to represent iowa in the united states senate. and you have a situation right now where she is getting hammered right now but a lot of more liberal media types and the like. >> we'll talk a little bit more about senator ernst in just a second. i'm curious to know though for hillary clinton, you're watching this thinking about getting in, do you need president obama's help melissa? >> financially you do. he controls so much of the purse strings for the democrats going
