to "the factor." again, thanks for watching us tonight. ms. megyn is next. remember the spib spin stops here because we're definitely looking out for you. breaking tonight, three big stories raising new questions about americans security. first, chaos reigns in one of the worst terror hot spots in the world after radical forces take control of yemen. second, one of our best allies in the middle east saudi king abdullah just died creating what sources tell fox news creating a worst case scenario. and third, israeli media out with satellite images of what it calls "new iranian intercontinental ballistic missiles." bigger, stronger and capable of flying farther than before as talks drag on with tehran about playing nice. all this after president obama seemed to suggest on tuesday night that things are getting

better in the middle east, suggesting we have turned the page on terror. and that's where we begin a busy night on "the kelly file" everyone. welcome everyone. i'm megyn kelly. all of this is far away, but all of it could directly affect your safety. first, yemen, where the u.s. allied government has fallen. now we're told there's anarchy in the place that's home to the worst and most lethal branch of al qaeda. then, in just the last couple of hours we learned saudi king abdullah has died at age 90. his successor is pro-western but told that creates a big headache. we'll get to that in a moment. first, fox news just got this video from channel 2 in israel. it shows what we are told is a brand new intercontinental ballistic missile just outside of tehran, potentially capable of reaching far beyond the middle east. something the pentagon warned could be in development two years ago. we will get to all of this with

ambassador john bolten who is here with me live in a moment. first to chief white house correspondent ed henry working overtime for us on the breaking news. ed. >> reporter: megyn, good to see you. this is really a dangerous trifecta iran edging closer yemen government has fallen and fears king abdullah's death could rock the already volatile oil markets. i remember the king was already ailing last march. when i went there his desert compound in saudi arabia with president obama, bottom line is the president just released a statement hailing the u.s.-saudi relationship as a force of security and stability in the middle east but you're seeing very little stability. the white house's strategy is in tatters. as recently as september remember the president hailed yemen as a success. right now it is in chaos. yet state department spokeswoman general psaki said earlier today we have not yet changed our security posture.

listen. >> anarchy is not enough to get you to adjust your presence? >> well, matt with all due respect to your assessment as an a.p. reporter we have the united states government and our team on the ground. >> okay. that's fine. >> -- assessing what is needed. we take it very seriously -- >> now, the president did some interviews earlier tonight with some youtube stars. he said in the world right now there's a "lot of bad stuff going on out there," an understatement saying the least. >> i'm sure glozell asked him all about yemen. ed, good to see you. as ed mentioned we've reached out to the state department and pentagon about these satellite pictures that reportedly show iranian missiles at what the israelis say are brand new missile sites just outside ft capital of tehran. iran's ballistic missile program is moving forward at full throttle. the israeli prime minister shared a warning about this

during an interview with charlie rose a little more than a year ago. >> by the way iran, charlie would not be interested in having one bomb or two bombs, they're gearing up for infrastructure for 200 bombs. and they're not developing those icbms for us. they can reach us with what they have. it's for you. it's for you. >> joining me now formerer ambassador to the united nations and fox news contributor. so catherine herridge citing a former u.s. diplomat close to the saudi royal family saying the death of king abdullah combined with the collapse of government in yemen is a worst case scenario for the united states. because why? current events are allowing iran to extend its reach and influence in a very dangerous region. >> right. what we're seeing across the middle east is a dissent into chaos, crisis in country after country is now spreading across the entire region. and these two developments what was left of the government of yemen collapsing, allowing a

pro-iranian shia sect coupled with the iranian territory in the former state of yemen meanwhile we are at risk of the saudis in the state of some confusion. they have a crown prince but it's far from a constitutionally stable government. all of those oil producing monarchies now squeezed on two sides from iran and with the threat of terrorism if not from al qaeda in the arabian peninsula from isis. the risk here is very high no doubt about it. when you add iranian ballistic missiles potentially capable of delivering nuclear missiles on us prime minister netanyahu said it's very dangerous for us. this is an absolute disaster. it's a policy of appeasement that president obama has pursued. and you'll see appeasement in short order. >> i don't think a lot of our viewers pay a lot of attention to yemen, but this group that's

now taken over they like to chant death to america death to israel. they keep those signs at the checkpoints. on the bright side they hate al qaeda too. they don't like american missile strikes. they don't like american drones unlike the government that just fell. and that's his whole policy there. that's what he was touting in his big address back in september. look at yemen, that's the model for the future. the model as ed reported is in tatters. >> that was just as delusional as his state of the union message. and the origin of the delusion goes back to his 2009 speech in cairo where he welcomed the arab spring and said this would be the answer to al qaeda. in fact, a stable pro-american government in yemen fell some time back this new government has always been at risk. and what the pro-iranian group -- >> nobody knows who they are. >> they want anarchy, so does

aqap. >> the reason we don't want anarchy in yemen is one of the worst adversaries, if there's anarchy in yemen guess what's going to happen? >> it's on the back door of the arabian peninsula with the saudis with a potential succession issue. >> you would think they would be on top of that watching yemen it'd been all over this could happen there might be a coup, the leadership might be falling. and you would be wrong. watch a little highlight of jen psaki today. >> it just happened. we've obviously seen the report. our team is seeking confirmation of all of the reports. we continue to support a peaceful transition. >> there is no government. >> i don't think we look at it -- we're still seeking confirmation. >> right. but you're referring to an agreement that came out yesterday between a government that no longer exists and a rebel force that appears to have control -- not just appears does have control of the capital. >> again, we don't have

confirmation of it. we're not going to jump to conclusions about what it means. >> what? >> it's bad enough when the president of the united states withdraws from his responsibilities in the wider world when the state department gives up on foreign affairs then you know we're in real trouble. i'm speechless at that kind of reaction. >> meantime we've got the two u.s. air carriers in the region now. and reports tonight that the embassy is being evacuated at least in part. and yet you've got the pentagon and state department saying today no change in strategy, we're good we're good. >> well, this is the consequence of years of neglect and the withdrawal of american influence. we're not entirely capable of changing everything, but one thing is clear. when the united states walks away from the middle east, it's a further invitation to chaos and it's exactly what we're getting. >> ambassador, good to see you. >> thank you. >> he just outlined the challenge from this breaking news in the middle east. and up next we will hear from governor scott walker who many call potential 2016 candidate. he's here to discuss the president's foreign policy and

success story. >> we've targeted al qaeda's affiliate in yemen and recently eliminated the top commander of its affiliate in somalia. taking out terrorists who threaten us while supporting those on the front lines is one we've pursued in yemen and somalia for years. >> the president went onto claim that iran's nuclear program had been halted a statement "the washington post" greeted with three pinocchios for accuracy. that comes even as top democrats are slamming the white house for going too easy on iran. >> the more i hear from the administration and its quotes, the more it sounds like talking points that come straight out of tehran. >> ironically it was one year ago this week that president obama dismissed the islamic state terror army as jayvee junior varsity, downplaying the threat from a group that now controls major parts of both iraq and syria. joining me now to discuss it governor scott walker of

wisconsin. governor, good to see you tonight, sir. i know you believe it comes down to the most important thing you say on foreign policy is leadership. how did the president fail to lead in these areas in your view? >> well, it's very -- you took the words right out of my mouth talking about the jayvee reference from nearly a year ago. this president talked about not only turning the page but talking about the shadow of crisis passed. i think any of us watching what's happened in the world not just the last 48 hours but the last few weeks, in france, any time you have freedom loving people anywhere in the world under attack by islamic radical terrorists, it's a threat to all of us. we send mixed messages to israel at the same time this administration is opening its arms to iran. i think that's a huge mistake. we need to speak with one voice aligned with our allies and ready to speak out against any who would threaten not only american lives but any other innocent life around the world. >> let's talk about iran. i want the viewers to know

obviously you are considered a possible 2016 gop presidential candidate. >> uh-huh. >> and some have said, well, one of his faults, this is from somebody at uw madison says his biggest limitation is foreign policy. iran, what should the president be doing? his position is we're not going to go over and bomb iran. the american people don't want to bomb iran. what is our choice, we should sanction them? we've done that. but before we just keep loading on the sanctions and while the sanctions we already had on are having some effect let's sit down and see if we can get them to agree to something. >> well, i just don't agree with that. i think you've seen while we bought them some time, this latest video you just talked about in the first segment shows exactly why opening the door to relieving sanctions is a bad idea. that's not a republican or conservative idea. there are plenty of democrats in the house and senate who share that same sentiment. the problem i mentioned you

allude to is leadership didn't come from a foreign policy expert, at least not early on in his tenure, it came from ronald reagan in the early days of his presidency in the early 1980s when he took action against the air traffic controllers. that sent a powerful message not only domestically, it sent a message around the world both to our allies that this president was serious and could be trusted. we have not more importantly sent a message to our adversaries at the time soviet union and iran ironically that this president was serious and shouldn't mess with him. >> how about yemen? i know most people realize yemen is a hot mess. it's not a complete shock there's anarchy there. and yet the state department seemed very caught on guard about this whole thing in a country where our worst enemy the al qaeda branch in yemen is the worst and most lethal according to the experts when it comes to america. so why wouldn't we be watching it more carefully? it's what the critics say. on the other hand, governor, how are we supposed to control the

internal politics of a country like that? >> well, the first part i think this goes to part of a pattern. unfortunately we saw a little bit in france with that administration currently in charge as well where they were tracking some of the very people who appear to be responsible for some awful attacks against innocent individuals there. when you have an administration whether it's the united states or france or anywhere else it doesn't take seriously the threats, who doesn't invest the resources needed to take those threats seriously, you open the door to chaos. i think that's something we all should have learned after 9/11. it's not a matter of if they'll be attempts, it's a matter of when. we need to be prepared here and around the world to make sure the fight doesn't come to us, that we take the fight to them. whether it's yemen iran, anywhere else out there. there's a concerted effort that if we want to protect our families our children, our livelihood here in the united states, we've got to be prepared to act elsewhere. >> last question, when are we going to get an announcement from governor scott walker he's

apparently rebecca is involved in democratic party politics. how does that affect her standing as a witness? >> well, there's nothing wrong with being a partisan. that's cool. we have a system based on that. there's no problem there. the problem comes in when the president passes off this person as just a random mom, just a hard working mom out there who wrote a letter to the white house to share her story and golly gosh she was great. why do you think they liked her so much? they liked her so much because she was already good at issuing democratic talking points because that's what she had done as a campaign worker and when she was out in washington state. that was her earlier career. they said she did career retraining, the previous career was campaigning for democrats. i'm sure they liked her letter and i'm sure they liked the idea of using her as the example because she'd stick to the script. >> why does it matter? rebecca, you know, she has -- she splurges on friday with pizza night.

that counts. how does that make her story any less persuasive? >> look i'm no prude. and i certainly don't -- i have a very low expectation for forthrightness when it comes to politicians. >> it's true. i can vouch for you on that. >> i've been here long enough to know that you will be instantly disappointed if you do otherwise. but, but when you talk about authenticity, when you are draped with this terrible attitude that the president carries forward about laying it on straight, real stories, real people, on and on and on and if it turns out that the story may be real but the talking points may be doctored that is yet another asterisk. presidents a s as a risk we go through. if you want to know why this administration and why this president struggles with trust, with confidence, with other things, all those small things

developing tonight, it has now been 24 hours since reports surfaced that it appears the doj will not bring civil rights charges against officer darren wilson in connection with the shooting death of michael brown in ferguson, missouri. "the kelly file" has reached out to the doj to ask whether that's true. the doj's declining whether to comment. as for the white house it has directed our comments to the noncommenting doj. all this comes at a fresh look at the violence after the grand jury decided not to indict. video showing nearly 200 people storming a local store and destroying it. served as assistant director of the fbi until april of 2014, ron, good to see you tonight. >> thank you. >> so the obama justice department saying nothing now as we hear reports that the fbi's concluded there's no there there and there's no case that can be brought against officer darren wilson no matter what people told you over the past couple of

months. >> so here we are almost six months after this spark that ignited across the country. and we're hearing leaks coming out of doj saying there's nothing there. megyn, i am disappointed that it's taken this long for not only the leaks but for the truth to come out of doj. i think from what i'm hearing there's no sen till la of evidence indicating officer wilson did anything wrong that day, his actions were completely justifiable. >> and andy mccarthy came on last night and said he's not surprised. he doesn't believe the obama justice department is surprised but this was all a lure, this is all -- it was a hoax basically so they could get sort of the camel's nose under the tent into the ferguson police department to investigate the ferguson police department. they never had their eye on this officer but they've done this in 25 different cities. holder's doj wants to control

how cops do business. >> well, quite clearly there's another message here because the events that day in ferguson are finite. this is not some sprawling white collar or cyber investigation that requires review of servers full of information or rooms full of documents. the number of witnesses is finite. the number of purgers are finite. those facts have been known certainly to doj prosecutors for months. >> why does it take so long? >> that's exactly the question. is this incompetence out of doj or is this some grander design to influence? and my fear is look at the influence that it's had so far in those five months. look at the protests. when you were talking earlier about yemen, you know, the parallels in some of your comments relate to this case. we're talking about people hollering for the deaths of americans. here in our own country in the streets of new york we have

people hollering for the deaths of cops. we're looking for leadership. we're looking to start this conversation on race. the starting point should be the truth and if you look back to august 9th the truth was a young officer was trying to defend himself against a violent attacker. and he took the steps that cops across this country would take. my concern is all those cops are watching, and my advice is mr. holder, it's time to cut darren wilson down from that tree. it's time to cut him loose. cops are watching. apparently you want them to watch this show. >> well, we'll see. and when the doj has a formal announcement to make, perhaps we will get a statement on the record from eric holder about darren wilson and what he has concluded and what he hasn't. ron, good to see you. >> you too. >> when the grand jury in ferguson decided not to indict officer wilson in november reverend al sharpton calls it a blow to justice and told people to wait and see what the doj would do here. the white house has said

sharpton is its laison. we are told sharpton is on his way to england where oxford university has invited him to make the case that america is institutionally racist. on the other side of that debate david webb, a series xm patriot host, fox news contributor and co-founder of -- i spoke with him earlier about news that sharpton wanted to sidestep the showdown. your thoughts now on the fact that we're now learning al sharpton after agreeing to participate in this debate in oxford, your name pops up and suddenly he's too busy, he just wants to speak on his own. >> well, for the ones al sharpton would have to face in a parliamentary style debate questions of opposition. megyn, he would have to answer not just the points he puts out on narrative, but he would have to face facts.

he can't do that. he has to push his message out. if he goes to oxford and he gets to speak and does whatever he wants, he tells his story and walks away. >> even on his show he asks the questions. he never answers them. no one ever makes al sharpton hold himself accountable. >> there's no rebuttal. the reason i accepted this debate and it's a three-on-three debate and i looked at the people proposing america was constitutionally racist and i saw sharpton and i said this is the president's go-to man on race this is bill de blasio's right-hand man literally here in new york city. and they're representing around the country these "black community" which is not a monolithic community. and i'm going there to defend frankly america who has done an amazing job in advancing issues of race relations institutionally racist matters. institution is apartheid, institution is slavery. >> why don't you ask the folks

in england do they ever have a black prime minister? >> that's a good question. >> why don't you ask them that? >> they covered the woman not the black. >> how about this study says nearly a third of britains admit being racist. why i must ask racism in america? >> it's the debate that goes on as lisa explained about the eric garner case, ferguson -- >> sharpton and others. >> and this is what happens. you have someone that makes his living off race makes his living off a false cry in a charmg of racism. >> but when is he ever held to account? so he's going to go there and debate and suddenly david webb's name shows up and now he wants to go and do a speech. maybe he wants to do a show. maybe timing changed but it's all so suspicious because we never hear him pressed one-on-one by somebody who knows, somebody who's lived this experience like yourself on whether those claims that he's been making hold up.

developing tonight, new england patriots head coach bill belichick and star quarterback tom brady both addressing allegations that the team deflated footballs, which is not allowed, in their sunday night afc championship win. in separate press conferences today they also both denied knowing anything about it. >> i never touched a game ball. that's not something i have any familiarity with on that. and again i was completely and totally unaware of any of this that we're talking about in the last couple days until monday morning. >> i think that's the main thing over the last couple days it's trying to figure out, you know what happened. as i said, i -- i was surprised as anybody when i heard monday morning what was happening. >> joining me now, donovan mc mcnabb alum of syracuse university, nice.
