questions. >> who bombed pearl harbor? >> you are putting me on the spot. >> caution. you are about to enter the no spin zone. the factor begins right now. ♪ ♪ hi, i'm bill o'reilly. thanks for watching us tonight. is president obama being humiliated by speaker of the house john boehner? that is the subject of this evening's talking points memo. on march 3rd israeli prime minister benjamin netanyahu will address congress about iran and terrorism in general. speaker of the house john boehner invited mr. netanyahu but did not tell the president until the last minute does it make you get a sense of really how, forgive me, wicked this whole thing is, the secretary of state john kerry met with the israeli ambassador to the united states for two hours on tuesday and ron did you did you durmer

never mentioned the fact that netanyahu was in negotiations and finally agreed to come to washington. i have to say i'm shocked. >> chris wallace believes that netanyahu move is designed to embarrass the president and many other americans feel the same way. but talking points dissents. i want to hear what netanyahu has to say. and i hope president obama rebuts his remarks publicly if they are false or misleading. the intelligence agency one of the best in the world. mr. netanyahu has information about iran. he and his nation are directly threatened by terrorism and iran. thus, they have to be deeply involved in what's going on. thus it's important for all americans to know what benjamin netanyahu knows. now, the bigger picture. americans are in danger. we're all in danger from islamic terrorists and from the nation of iran.

some estimates say iran is within two months of being able to put together the components of a nuclear weapon. president obama believes is he making progress in a new deal with iran, but the current negotiations have been going on for 14 months and extended twice. the next dead line the end of june. some in congress want to impose sanctions right now. those sanctions would be dormant until june 30th and kick in only if iran doesn't seal the deal. talking points has said that will be a mistake. yes, severe sanctions would have to be imposed if the deal falls apart. president obama has said he will do that but the u.s. congress should not give iran any excuse to walk away from the table. if there is no deal by the end of june, then congress can unleash hell and president obama will have no choice but to go along with it again we might get into a shooting war with possible. and if it happens the entire world has to know

that america did everything possible to make a nuke deal. so let's put the saber rattling aside for five months no antagonize them. that's the same position. that being said, many americans have no confidence president obama will ever confront islamic terrorism. >> isil or any of the other jihadist groups can reconstitute themselves on a moment's notice, move in and destabilize the government and behead a japanese journalist and cause great chaos in the world and then disappear again into the hills we don't seem to have a plan for dealing with that kind of warfare and it's been going on for a long time. >> that's correct. it's been going on for a long time and we have no coordinated strategy to defeated the jihad. we know where the killers are and they sit there committing atrocities all day long in fact, some might surmise that the white house is actually afraid of the

muslim world what we simply do not believe chuck. is that they somehow should be seen as representatives of islam. they are not. it's one of the world's great religions. the overwhelming majority of muslims do not abide by this hateful ideology. and so we just ought not to give them any kind of belief that somehow they deserve that title. >> that's right. we don't want to offend anyone in the muslim world. even though in general they have done very little to fight the jihad. the reason the white house gets away with this kind of nonsense is that the american public by and large, not you guys you guys care. but the american public by and large doesn't care to know what's going on. the iran issue is under covered. people do not pay attention in general to complicated situations. >> i have a lot of things that are going on in my life that i don't have enough time to worry about what's going on in iran. i barely have enough time to worry about what's going on

in america. >> is the iran thing on my radar a concern to me? no, not at all. >> why be concerned if iran got a nuclear weapon? no, not right now. other people who are worse top them so we are find. >> i don't think people think about it. there is a blizzard going on. i think people have other things going on in their minds. >> one of the reasons america was hit so hard in 2001 is that we were unprepared. our intelligence services under estimated al qaeda and our immigration authorities were asleep. well, here is the truth in 2015 immigration authorities are still asleep. anyone can get into this country. and while our intelligence certainly has improved, public interest in terrorism overseas and the dangerous iranian situation slm nonexistent. instead, american citizens are fixated on personal matters as you heard and an obsession with the internet. the jihadists know. this they know they can pretty much do anything and america and the west will not respond directly. by drones, that's it. isis doesn't fear the u.s.a. and certainly iran is

pushing us to the wall. sadly the president doesn't seem to be very engaged. the president didn't spend but a few seconds talking about the threat, the terrorist threat that we as americans face. this problem is growing all over the world. and, you know, the president is trying to act like it's not there. but it is there. and it's going to be a threat to our homeland if we don't address it in a bigger way. >> it's a threat now speaker boehner is correct. and, again, his invitation to valley prime minister netanyahu is not out of line. president obama should be able to counter whatever netanyahu says with an effective strategy. note the words should be age. so let netanyahu speak his mind. let him spell out the danger he sees to the world. that will be instructive and maybe, maybe some americans will finally pay attention. probably not. and that's the memo. next on the rundown, we have

saw a lot of people this weekend nobody mentioned netanyahu and obama. they mentioned tom brady. they mentioned the "american sniper." they mentioned snow megeddon not one netanyahu. >> you have got to come to the neighborhood of political. >> mary katharine you offended netanyahu who is going to talk? >> i'm not offended. representative boehner told the white house within a period of time apparently not the requisite time. here is the thing i'm not sure what the president expects here. he does not operate within a vacuum but he thinks he does. he has systematically undermined his relationship with congress. he has system mat technically undermined his relationship with netanyahu's office and with israel. and, yet, when it comes to something like, this he expects everything to go swimmingly. >> i don't understand why he is upset. if i were the president of the united states, i would want netanyahu to get up there and tell me from your point of view as america's biggest ally the only democracy in the middle east how you see it. go, tell everybody. that's transparent is i is it not?

factor follow up segment tonight, as you may know sergeant bo bergdahl left his unit without permission in 2009 and captured by the taliban. bergdahl was held for five years until president obama traded five captured taliban commanders for the sergeant. upon coming home, bergdahl was investigated by the army. that investigation was concluded in october now almost three months later it is being stonewalled. joining us now from washington lt. colonel tony schaffer senior fellow at the london center for policy research closely following the story has some new information tonight and what is that colonel? women, the army has come to its conclusion and bo bergdahl sergeant berg doll will be charged with desertion. i have been told and confirmed by two other sources that his attorney was given what we call a charge sheet a charge sheet is results of the investigation listing out the articles of the unitary form which have been violated.

the key violation is desertion. this is has been done. the decision has been made. let me be very clear. as a corporate entity, the army has decided that they want to pursue bergdahl for this violation. let me just ask you a series of simple questions. >> sure. >> bergdahl's attorney a military guy. >> no, is he a civilian. >> civilian guy by charging bergdahl with desertion that means there has to be a trial, right? >> this is essentially the equivalent of a grand jury hearing is what we call an article 32. and, yes that is the procedure you must go through to go to the court martial. >> military trial. bergdahl will have a military attorney, civilian attorney if he wants. he will come in and either plead guilty or not guilty to the desertion charge. >> that's correct. >> now, we hear that the white house has been stonewalling this information that they came to this conclusion a long time ago. er with there was a prior investigation before this latest one with the army. and. >> that's correct. >> who in the white house is

the point person to tell the army not to release what you just told us? >> there is a huge battle going on at multiple levels. the individual that i have been told this in the effort to suppress it is ben roads. ben roads has been the liaison between the pentagon and the white house and a number of key issues to include a lot of the intelligence failures that you have seen. we have talked about here regarding isis and the reark military. bebb has been the guy in the middle of all of that i'm told he is the the guy. >> national security advisor is that his title upstairs? i'm not sure of exact title. >> so he is the liaison to general mark miley who is the guy overall in charge but miley's boss is martin dempsey who said on january 12th there is miley dempsey said is he expects the decision to be released soon. that was two weeks ago. >> right. >> still no decision

released and you are saying just want to be very clear the white house wants it delayed but what good does that do because sooner or later they have to put it out. >> this is shaping up to be titanic struggle behind the scenes. the army here wants to do the right thing. factually there is no way they cannot do the right thing regarding bergdahl and the white house because of the political narrative, president obama cozying up to the parents and because he president obama releases five taliban by the way those five taliban were never briefed to senior leadership to the pentagon before it happened. the narrative is white house does not want to have of course they don't want it look, the white house can't tell the army not to charge him with disz -- desertion. if what you say is true. >> he has been. >> he has already been charged. >> right. >> they got it so what good does it do for ben rhodes or anybody else don't tell anybody.

i'm shepard shepard smith in new york with a fox news blizzard alert. a monster storm expected to dump up to 3 feet of snow in some parts of the northeast. take a live look at some of the latest totals that we are expecting now according to the first alert forecasters. they are saying some 1 to 2 feet in the new york area. some 2 to 3 feet in the boston area and all through here according to the national weather service and the winds will be a problem

massive corruption charges may be forced to give up speaker position. probably will go to jail. silver says he is not guilty but this is amazing story of alleged corruption. here now to tell us more about it it the anchor of the kelly file miss megan. what's the worst thing silver allegedly did. >> kick backs of $4 million. state grants, for example he says he has no relationship with one doctor who refers as bestos patients to a law firm that sheldon silver happens to be a partner at. he doesn't have to show up to work at said law firm according to the complaint. instead, he just says to the doctor, please send all the sick asbestos patients to that law firm and then the law firm allegedly gives sheldon silver millions of dollars and then sheldon silver takes $500,000 worth of taxpayer money and say hey, doctor use this for research it's out of the goodness of our heart. >> these are allegations he denies. >> sheldon, looks like the
