>> got promoted about month 1/2 ago. >> well-deserved. >> major. nice. >> they give you a lobotomy when you get promoted to the range of major. you lose your common sense. >> i doubt that. i doubt that. please don't lose it. we have 59 minutes of common sense. coming up senate confirmation hearings underway on president obama's pick to be the america's next attorney general. loretta lynch attorney for the eastern district of new york getting a grilling on the first two days of hearings. if confirmed she would replace eric holder who announced last fall he would be stepping down. republicans controlling the senate pressing lynch for her views on several hot-button issues left unresolved by eric holder especially the president's amnesty for illegal immigrants. >> who has more right to a job in this country, a lawful immigrant here, green card holder citizen or person who entered the country unlawfully?

>> senator, i believe the right and obligation to work is shared by everyone in this country, regardless of how they came here. certainly if someone is here, regardless of status, i would prefer they would be participating in the work place than not participating in the work place. with respect to -- >> now, that was, so you think that a person, anybody that is here lawfully or unlawfully is entitled to work in america? >> well, at the same time house speaker john boehner announcing plans to sue the administration over the president's executive action on immigration but democrats are slamming that decision saying it is quote an embarrassing admission of failure for not passing immigration reform. pete first to the hearings. republicans wanted these hearings to happen under their watch when they took over the senate, not during the lame-duck session. they're getting their way. in fairness, a lot of policies that they're going to ask her about, they're not really her position to defend it is

solicitor general's. but there should be pretty fair line of questioning shouldn't the questioning be are you going to defend the law? are you going to enforce the law? >> the line of questioning should be are we getting top cop or another activist as eric holder, an activist serving as attorney general. they want to get to the bottom how she thinks and reviews the role of the constitution and enforce the laws and not interpret them or make them. that is a base underlying this entire hearing we want to know someone in that position is serving laws and constitution properly which we haven't had for so long. republicans get at that. the elections have consequences. we'll get podium when you win. they need to grow her sharply they seem what i have seen like a pretty reasonable pick as reasonable as administration is going to get. >> the president is entitled to his pick, harris. she doesn't need many republican supporters and only need 51. this look is like likely

is on immigration in other issues, how they're handling police forces and things like that. is that a fair question. >> that is a very fair question. i think she from what i've seen so far is unable to answer a question. she would not give a definitive answer but she says she is about upholding the constitution like you said. i hope she will do that. >> what is interesting, we talked about this before the show stays sir, and i will tell this to you too kennedy. >> i'm right here. >> hi, kennedy. she is sitting up there and she is saying blanket amnesty would not be constitutional. however a lot of people believe that is what president obama is doing. so she is actually putting onus on republican senators to say that is what he is doing. she is saying, no if he would be doing that it would be unconstitutional. is this boehner lawsuit critical? they're going back and forth playing word games in these hearings? you need the courts to hammer it out? >> the courts may need to hammer

it out. he is legislator the legislation should have been there during president obama's first term when they had both houses of congress. that is when they should have passed immigration reform. that is the avenue to pass it and not executive. i don't agree with boehner's lawsuit and totally disagree with nancy pelosi. loretta lynch i want to answer questions about federal government and the states and between the two? many states voted to legalize marijuana. it is federally illegal. what is her position, and how does she plan on enforcing laws where there is disconnect between the two? >> that is supposed to come up at hearings and we'll follow that as well. immigration enforcement is changing right before our ice. telling agents it is their job whether or not they might qualify under president obama's plan on deportation? according to training materials

obtained by associated press. the materials show the obligation is on the government to identify immigrants who might qualify for lenient treatment. before it was up to immigrants or their lawyers to figure it out. harris, i do not think this is a good use of time by the government or taxpayer dollars. >> it is interesting. a lot of people know my husband and i have a near border home in arizona, not far from nogales where we got married. this is issue a few times a year we go home talk about at dinner table. that is a lot to put on the federal government. what do you do when somebody lies? is this prosecutorial? what would you say? obviously you would say yes, i fall under president obama's right to stay here. who wouldn't say that? >> what happens, where is the responsibility, because i think part of being if you're not an american citizen participating in america and american democracy and the economy is that person responsibilities? if it is not your responsibility

to show that you are able to be here under the new program what about all people skipping their hearings. at some point people have to be held accountable. if people want to work and really participate, they have to do their part as well. >> how do you do that? how do you hold each one of these people accountable? >> nsa. >> start by enforcing the law. >> what kennedy just said -- >> that is why hearings are important. >> they're not being asked to show. those are two different things. >> you liken to the irs. they're effectively telling, be like if we were recommending certain exemptions or deductions, irs recommending that to people that is effectively what you're seeing through immigration. what my mind goes to enforcement officer on the ground. i immediately think about people working this stuff who have another set of complications they have to manuever underneath already broad set of guidelines. >> exactly. >> everyone they stop they have to figure out? >> worry about terrorism? law enforcement and people's feelings. that is a lot.

to stay under the special provision, the answer is yes. >> sure. >> they made the trek. again to go back to a hearing happening today with loretta lynch, look what she said when she was asked about the president's executive action which i read to you before. it was financial concern of having to deport these people. that is what came up as topic and issue. >> all of sudden. >> we need to hone in as we put yet another person in that person who may only see it the way the president does. >> all of sudden they're fiscal steward at the white house watching every single penny. >> when they want a minimum wage and one thing that immigration does for a lot of people it frees them. they're able to do other things, if you've got someone doing sufficient at competitive rate, you can go out and earn extra money. that is one of benefits of immigration. if you have minimum wage across the board no one will have financial flexibility. >> i know you didn't agree with the lawsuit but at this point you almost have to have a lawsuit because if the courts weed this out to check the

president, only stopgap -- >> defund it. >> you can do a lot of things. courts would be only way. if he defies after court rules what is doing on immigration is wrong you have a constitutional crisis. >> i don't have a problem with states like texas who bring up very specific issues that go through the court system. my problem is with boehner. he need to focus on legislation. >> they have the power of the purse. they can defund the actions. >> kennedy, be honest, you're jealous of his tan. >> look how pale i am? >> i know i am. he call this is apology? howard dean says he is sorry to our nation's veterans saying it is angry tea partiers who are making movie "american sniper" such a huge success but dean still taking a shot at his critics and taking heat from a hollywood star for his controversial remarks. maybe the kids will be all right. the impact a pair of 13-year-old girls could have on sex education and how it is taught. a great story. don't want to miss that.

>> you're watching "outnumbered" and we're glad you are. democrats accused caving in on more sanctions with iran. 10 democrats working with republicans on a bill that would impose harsher penalties on iran if it doesn't accept a deal curbing its nuclear program. in an apparent about face, you know they do that in washington, the democrats told the white house they will seek to delay a vote on the measure for two months, saying they will stiff give the administration more team to reach a deal before the march deadline. one of the harsh harshest critics on president's foreign policy lindsey graham, has this chilling warning. >> the biggest mistake is yet to come. if we continue on the path with the iranians they will wind up with nuclear capability with north korea and have a bomb. he is about to make the biggest mistake of this presidency, allow nuclear capability, thousands of centrifuges in iran to be operated by iranians to be overseen by the united nations. >> did you hear it?

♪ >> some 8th graders are teaching school officials a thing or two about sex and consent. two 13-year-old girls in ontario, canada launched a we give consent campaign. they say the school curriculum doesn't include anything on the issue. that it needs to say what clear confirming consent is and should be taught. they said some kids are not getting it from home from parents. what do you think, kennedy? >> i think this is really interesting because, like harris, got two daughters and i think most of that stuff should come from home, i really do. i think i take on the responsibility of talking to my daughters about everything, about social media and you know one of the arguments in favor of this is they have a really high rate in ontario for some reason of sexual assault against kids particularly young women under the age of 16. sothis is in some way tied to empowerment and keeping kid from
