that on friday's "the factor." again, thanks for watching us tonight. ms. megyn is next. i'm bill o'reilly. the spin stops here cause we're definitely looking out for you. breaking tonight, u.s. officials now confirming to fox news that at least one of five taliban killers recently released by the obama administration has now returned to terror. welcome to "the kelly file" everyone. i'm megyn kelly. in june of last year president obama agreed to swap five top taliban commanders for captured american soldier bowe bergdahl, a sergeant accused by his squad of deserting. these guys are considered generals in the taliban terror army with the united nations saying they ordered or supervised the murder and torture of thousands. nearly all have deep ties to al qaeda. and one of them even harbored osama bin laden before the 9/11 attacks. but they went free anyway. and even the president had to

acknowledge that they may again threaten the united states. >> is there the possibility of some of them trying to return to activities that are detrimental to us? absolutely. >> republican congressman peter king is chairman of the counterterrorism and subcommittee of the homeland security committee. good to see you tonight. sir, thanks for being with us. in fairness barbara starr broke this story and she had it and now we have confirmed it and senator lindsey graham has come out in advance saying these guys -- he uses plural, they have had some haqqani people that's the worst of the worst, come to meet with them. they're reaching out. they're communicating with people inside afghanistan. so so much for the plan of qatar's going to watch them for a year. not to worry. >> megyn, this is what we've been concerned about and angry about from the start. this was a hoax. the president released the five

of the worst of the worst and all we got in return saying qatar saying they'll monitor them and keep an eye on them. there's no reason why we should trust qatar. just last week when the other terrorist sent back to qatar, he got a welcoming ovation. so us relying on them to keep an eye or to monitor or to be honestly monitoring these five al qaeda terrorists is absolutely absurd. this is part of the president's overall policy to shut down gitmo at any cost. tonight i was feeling mike mccaul, nunez, this is going to result in the loss of life. >> do you believe there is a threat to america? i want to remind the audience of what hillary clinton said about this when it was announced that we had made this deal when she was rolling out her book in

june. listen. >> these five guys are not a threat to the united states. they are a threat to the safety and security of afghanistan and pakistan. >> was she right? >> no. secretary clinton's wrong. the fact is if they were a threat to afghanistan, if they were a threat to anyone in the world they were a threat to the united states. if we learned anything from september 11th is that islamist terrorist, their ultimate target is the united states. and secretary clinton above all should know that. they are definitely a threat to the united states. tonight you'll see statements coming out from members of congress saying this is going to -- this does risk american lives. that's the reality here. lives are at risk and there's no policy reason for it. there's no possible justification whatever for this other than the president's ideological passion to close guantanamo. >> congressman pete king, good to see you, sir. >> megyn, thank you. >> when the taliban five were released many questioned the

wisdom of allowing our enemies a chance to return to the battlefield while some of the president's defenders came on "the kelly file" and told us not to worry. >> okay. wait a second. they can't get back to the battlefield in less than a year. also, to whom are they a danger? >> respectfully that just sounds insane to me. >> plus, they've been out of action for 12 years. >> come on larry, you are smarter than that. >> they have to have the skills. okay. a lot of people have bad motivations. >> i'm sure omar would be happy to sit down and go over the briefing manual on how to kill americans. the head of the taliban. here now is the man you just heard, larry korb. so there you have it not even a year into the so-called custody of qatar and they're already back at it. one, possibly more according to senator graham meeting with haqqani people who came right to them. i mean the worst attract tors

have been proven right. that qatar could not keep this under control and we do have to worry about this threat? >> remember how we found out, we're monitoring their communications. >> we, not qatar. >> of course we are. working with qatar. we're the ones who found out they've been trying to communicate. >> how did they have a meeting with the haqqani network larry? the system's got some holes in it. >> wait a second, that hasn't been proved. >> correct. senator lindsey graham has come out saying to the associated press they've had some haqqani people come to meet with them. >> okay. wait a second. he knows more than you do. >> no he doesn't. >> he does too. he gets briefs. he's a u.s. senator. you are not. >> all right. what john kirby, who's the pentagon spokesman, okay who was on cnn tonight -- >> and will be on "hannity" as well. >> okay. basically said we're monitoring their communication -- i assume if they met with the haqqani people we were monitoring what

they said. we didn't just let -- >> so not to worry. it's not a big deal. the haqqani network, which is one of the major threats that we now face in the middle east, go ahead and talk to those top five taliban commanders. it's not an issue for us. we're so happy to have sergeant bergdahl, it was all worth it. >> wait a second. as i mention they've been out of action for 13 years. what can they know about what's happened since then? >> they've lost all -- amazingly they went completely limp in prison and forgot mentally intellectually all the things they do to unleash hell. let's say that's true. maybe they connect with omar who runs the taliban and they learn new things. suddenly they're operatives. >> but we're listening to them. >> are we going to re-arrest them? qatar's only going to watch them for another couple months. >> a year okay. and part of the reason we did it and got the year is because our

combat mission will be over. and actually the main combat mission is over. but we're monitoring, we know what they tell haqqani or anything and we can use it to combat it. >> the pentagon is taking it very seriously. >> of course. >> and believes it can handle the threat. they seem to be taking it more seriously than you are. >> no they are. take it seriously that they're trying to do that. that's what they're trying seriously. and they know what they're doing. >> okay. >> if they know what they're doing -- >> the system of qatar didn't work out glad we had eyes on it. thank you for being here. joining me with more retired u.s. air force lieutenant mcinerney, predicted it months ago. good to see you. not to worry, they're old. they don't know how to unleash hell. >> yep. that's our good friend larry. the fact is we got a buck sergeant for five four-star generals, megyn. they have a lot of knowledge that they were continuing to

generate at gitmo. and they are now going back down the battlefield. it's like world war ii at the battle of the bulge. we decided to release five german general officers that we captured. it doesn't make sense. it doesn't pass the sniff test. >> this is what the administration had said, that they're not really -- it's not like we did a prisoner swap. this is a prisoner of war that we had bowe bergdahl, so we traded for these five guys. the reason we did it is because the war is ending. and whenever wars end we get our guys back and we give the other side's guys back. >> first of all, the war is not ending against radical islam. we may be pulling out of afghanistan. and when they talk about leave no one behind, we leave no honorable person behind. we leave deserters behind. we did that in korea. and we've done it before in our history. and so i would not have brought a deserter back for five

four-star general officer equivalents. >> do you believe that that argument, that the war is ending and therefore we need to start releasing these prisoners we caught on the battlefield and now at gitmo, the president's so determined to empty out that prison, that that holds? i mean this doesn't seem like your typical sort of symmetrical warfare that we've had in the past. >> it doesn't make sense megyn. look, when we left iraq, "the war was over." well, look at what we've got today. we've got isis a much more dangerous threat than we had before and it is growing. it's metastisizing in the whole region spreading to lebanon now. and it's going to have the same impact in afghanistan. so one, it doesn't make sense to anybody to let five senior taliban leaders go in the middle of a war. >> and what a shock, what a shock. they still want to kill people.

breaking tonight, the white house doubling down on its controversial argument that the taliban is not a terror group. it started yesterday when the deputy white house spokesperson tried to argue that a group that has killed thousands and that the u.s. designated as a terrorist group back in 2002 is actually just an armed insurgency. thought maybe that was just a deputy guy filling in for josh earnest. well, josh earnest was back today and he was asked what seemed like a very simple question. >> does the administration consider the taliban a terrorist organization or not? >> john, the reason that the taliban is listed on the description that you have put forward here is for two reasons. one is they do carry out tactics that are akin to terrorists. they do pursue terror attacks in an effort to try to advance their agenda. it is important to draw a distinction between the taliban and al qaeda.

the taliban has resorted to terror tactics, but those terror tactics have principally been focused on afghanistan. al qaeda is a terrorist organization that has aspirations that extend beyond just the border between afghanistan and pakistan. and that explains the difference in classification. but there is no doubt that both of these organizations are dangerous and have drawn our attention. after all there are a large number of taliban fighters that have been taken off the battlefield thanks to u.s. and courage and bravery of our service -- courage and bravery of our servicemen and it wasn't an hour-plus answer. he got hammered by the press corps for that amount of time. but you can see him on the ropes and not being very forward from the sound of it. why are they so determined not to answer this question with the obvious yes? brook goldstein, and andrew mccarthy, why won't they just say yes? >> people ought to be really

angry. that was absurd. factually it's absurd. legally they don't want to answer the question because they are trying to redefine american law of terrorism. the only thing you need under american law to be a terrorist organization is to be foreign to conduct terrorist activity, which is what he said they do, and to be a national security threat to the united states. that's it. >> uh-huh. >> and factually they are a part, ied logically they align themselves with al qaeda. >> so why don't they just say that, of course they are yes? >> because he decimated al qaeda already, right? he told us that. put them on the path to defeat. the war is winding down. and terrorism is going away. we have to find another word for it. >> brooke, they tried to make a distinction today as well the taliban just murdered 140 school children, so they kind of seem like a terrorist organization.

and he said well that was the pakistani taliban as if the afghanistan taliban is some ball of joy that we don't have to worry about. >> right. and, you know, this latest charade is very symptom attic of a larger problem within the administration which is its inability to call evil what it is. its inability to call islamist terrorists islamist terrorists. and we see this throughout. isis is not islamic. ft. hood was not an act of terrorism. it was an act of workplace violence. and now we have the taliban they're not terrorists they're insurgents which denotes mere rebellion. you can be an insurgent group and terrorist at the same time. it's not mutually exclusive. the question is why won't this administration say the afghan taliban -- it would mean we were leaving afghanistan in the hands of a terrorist group and the conflict is not over.

>> i know you believe that too. there's a reason they try to say hamas and hezbollah and the taliban, they're sort of focused on their own countries. that's very different from al qaeda and isis which are on a global jihad. why is that not valid? >> because, well, what they're doing is discounting the ideology that fuels the entire global jihad. and by minimizing -- yes. and by minimizing each place. so hamas is just concerned about what's going on in the palestinian territories. and boko haram is in nigeria. and the pakistani taliban has to be distinguished from the afghan taliban because -- >> who can keep track of it all? >> they're counting on you not being able to keep track of it all. when bush actually said exactly the right thing after 9/11, it was clarifying. he said our message to all regimes across the world is you are with us or you're with the terrorists. it wasn't a bunch of little network independently acting organizations that didn't have a

shared ideology. >> go ahead. >> but we're fooling ourselves when we don't -- when we say hamas and the taliban are not international per se. hamas is a proxy of iran. >> right. >> it gets its funding from iran. if you look even at the afghani taliban, they're engaged in a human trafficking network that does span international borders. and they take that money and use it to fund terrorism. >> the administration they don't want to use that term terrorist. this is of course a day after we saw al jazeera english, the television channel, say we're going to ban the use of the word terrorist because one man's man's terrorist is another man's freedom fighter. that is a word we use, at the same time the administration is denying that this group is a terrorist organization notwithstanding the fact the national counterterrorism center lists taliban in afghanistan as a terrorist group.

the state department has a $10 million award for the taliban leader as a terrorist. and as i mentioned before they were added to the list of specially designated global terrorists july 2002. >> megyn in october the obama justice department indicted a guy from the afghan taliban from material support to terrorism for supporting the activities of the taliban and its partners the haqqani network -- >> i got to go. i got to ask you a quick question before i go. >> yeah. >> you said the real danger in releasing those five guys. and now they're back to it, or at least some of them are, is what? >> recruitment. when people commit terrorist acts against the united states or are imprisoned by the united states, they become stars in the jihad. as far as recruitment as far as fund raising that's what they do. they're effect is exponential. >> they're going to go get a hero's welcome. good to see you both. the fight between the american president and the israeli prime minister took an ugly new turn today.

congratulations to him for standing up. this fellow worked for al jazeera back in 2011. he gave an interview to the columbia journalism review. they asked him about his role. this is what he said, the arab viewer doesn't want just news. they want something more polemic. they want to feel they have someone fighting on their behalf. now, with that he enters the field of journalism. what is remarkable megyn, is he went from al jazeera, doing that, to cnn which hired him to do that to nbc which now has him to this day as their mideast correspondent doing exactly that projecting an islamic agenda propaganda on that news network. then they take him from nbc news at night and they move him over to msnbc in the daytime to be a fill-in anchor and to be a round table participant promoting that which he's reporting as true. >> okay. but let me say, i mean, that was -- scarborough was listening

prime minister benjamin netanyahu, it was not cleared by the white house. now the "new york times" is quoting an anonymous senior obama administration official attacking the israeli ambassador to the united states for allegedly putting politics ahead of the two countries' relationship. trace gallagher reports from our west coast newsroom. trace. >> megyn, when the israeli prime minister accepted house speaker john boehner's invitation to america without running it by president obama, the white house went on the record calling it a departure from protocol. but it's crystal clear the upcoming trip has left the white house furious. a senior unnamed administration official is now openly venting to "new york times" pointing fingers at israeli ambassador to the u.s. ron dermer and saying putting benjamin netanyahu putting his -- once a political consultant responded by saying he has no regret and that he

never meant to slight the white house but assumed the speaker of the house would notify the president about netanyahu's visit. the senior administration official also finds it odd that during a lengthy meeting with secretary of state john kerry dermer never mentioned the netanyahu trip. other critics of john dermer accuse him of soiling his pad but his supporters fire back saying dermer is doing his job by representing israel's best interest. and if anyone's tried to undermine and embarrass the israeli prime minister it's this administration. the white house today said this. listen. >> the point is that this relationship between the united states and israel is bigger than any single diplomat. in fact, it's an alliance that shouldn't be turned into a relationship between two political parties. >> the president won't meet with netanyahu in march saying it's elections. and the white house doesn't want to appear to be taking sides. megyn. >> trace thank you. and ambassador dermer says he

has no regrets. brit hume, pastel brit very good to see you tonight. the question is how much damage has been done here in all of this back and forth between our two countries? >> this is a regular mess megyn, no doubt about it. and it possibly could have been avoided if the speaker of the house had notifyied the white house of the invitation to netanyahu. the speaker has a perfect right to extend the invitation. mr. netanyahu has a perfect right to accept. normally these things are done with the full knowledge and possibly the approval of the administration. i suspect that mr. boehner felt if he did go to the administration ahead of time the administration would object and he would be accused of having done this over the administration's objectives -- objections, excuse me i think his idea was worse than what we have now. but what we have now is not particularly a nice situation in terms of u.s. and israeli

relations. >> i realize they got ticked off at the white house. >> that's right. >> what is with the ongoing "anger and fury," that's how it was being reported at msnbc that the white house is furious about this. >> well, it's no secret, megyn, that the relationship between the president and mr. netanyahu has been tense and difficult. and i think what needed to happen here once we got to where we are is -- or to where we were once the invitation became public was the president needed to kind of put on his big boy pants and say, well, we'll welcome the prime minister to washington and i'll look forward to meeting with him. that might have been smart from the president's point of view because if prime minister netanyahu was facing after his speech to congress a visit with the president, he probably would have been a little loathe even indirectly criticize capitol hill knowing he was going to sit down with the president within the next day or so. >> good point. >> but the president obviously got annoyed. and the men around him -- or men

and women around him we don't know who this unnamed official was, just who said these things about ron dermer and do you remember megyn earlier a senior administration official quoted as saying that benjamin netanyahu was a chicken feed although she didn't say feed. so this is more of the same kind of thing that's been going on. this is a tumultuous and difficult relationship. and the situation isn't doing anything to improve it. >> brit, great to see you. >> thanks megyn. well this all comes just a day after iranian-backed hezbollah launched a deadly missile attack on israeli forces leaving two soldiers dead and more wounded. israel retaliated firing mortars and artillery into lebanon. one peace keeper was killed. our next guest was an eyewitness to that assault. lieutenant colonel oliver north live in jerusalem tonight. colonel, good to see you. so your take from those on the ground, and i know you know a

lot of people in the idf, the israeli defense forces, on their feel do they care, are they following this riff? >> well, yes. i think people in israel it's a small country, it's under siege from hamas in the south and hezbollah in the north as you just reported. we were eyewitnesses to the attack yesterday. six coronet missiles, i counted at least five as the impact came in on the israeli patrol. here's the important thing about that attack by the way. the attackers are two and a half to three kilometers inside lebanon with so-called peacekeepers. those hit are two kilometers inside israel on a road used by both israeli military and civilian traffic. so what that all means is an attack on a sovereign country. that was going on as this tiff if you will, in washington where people are dumping on the israeli ambassador trying to keep netanyahu from coming to

address the congress and what's important to the people of israel is two of their soldiers was killed one of them an officer, seven of them were wounded. we watched -- coming in. and the response was reprisal it was to protect the helicopters coming in to evacuate the wounded. i think people are looking at what's occurring now politically as obama is acting like a petulent child. he's detached from the reality of what's going on both on the border with hamas, with hezbollah. he is focused in the case of prime minister netanyahu on the threat that is being posed by the possibility and now even the likelihood of an iranian nuclear weapon. >> do you think they're listening to him? do you think the israelis want to know what our president thinks? >> i think the israeli people are quite fed up with mr. obama. i hear that routinely. it's almost as though that is a side bar issue to the protection of israel and the determination

is the outcome of an election that could be very very important to their future. and they look at the white house as the one who is are interfering. and they're getting help from hezbollah. this attack could not have happened yesterday were it not for iran. hezbollah doesn't go to the bathroom without checking with iran. >> and that's their mission is to destroy israel. before i let you go i got to ask you, you have your wife there with you? you get shot at your whole life you brought your wife into this? >> well, it was not intentional. and i don't accept any responsibility for the iranian attack, but my wife is now an expert on whether it's incoming or outgoing rounds. and she and several of our friends who are with us also know how to drop don't run in the midst of incoming. >> ollie, the kind of life you lead. thanks for being here with the update. god bless. >> my pleasure, megyn. >> sounds like a good woman.

you want to make about foreign policy under his leadership has no -- you know, this group code pink that interrupted and was completely a nuisance and completely obnoxious, has been a thorn in the side. not just of republicans but when i was working on the kerry campaign or the obama campaign they would come out -- >> everybody's got a story about them. >> oh, yeah. they're horrible. they're atrocious. they're nefarious and so infamous if you live in washington, d.c. so the thing that i took issue with is i wish senator mccain hadn't stooped to their level. as a public servant, as a public official, he did exactly unfortunately what they hoped he would do which is he took their bait and he shot back. and it was below the dignity of his office and below his dignity. i have tremendous respect for senator mccain and basically shot back and called them scum. he engaged them when he should have just taken the high road. >> what do you make of that, marc thiessen? >> i agree with that actually. the problem with these kinds of

protests is the left always goes too far. they can't help themselves. they're so filled with hate that they have to protest and disrupt things. they're not convincing anybody when they do this. nobody was convinced by this protest. and i remember the moment -- do you remember all the protests against governor scott walker in wisconsin? i remember the moment that scott walker -- i knew scott walker was going to win his re-call election was when the protesters came and disrupted a speech he was given to special olympians. they came in dressed as zombies and disrupted an event for special needs kids. what he did was, which was very smart, somebody said to him, why didn't you go chris christie on them? he said it was because it was about the kids. i didn't want to make it about me and the protesters. he didn't rise to the bait and i think john mccain should have done the same. >> do you think, mark hannah, this is about a general lack of civility? people say there's less civility in washington than there's ever been before. is that true? >> we like to rowicize our -- seeing john mccain say that see

in ferguson, missouri even though months have passed since a grand jury decided not to indict the police officer in connection with the shooting death of michael brown, some members of the community and the police still seem to be miles apart. exhibit a happened last night. trace gallagher has the story from our west coast newsroom. trace. >> megyn, it was a meeting at st. louis city hall. it was to hear public comment on whether to create a civilian oversight board for police. when several people got up to speak in favor of the oversight board, they were cheered. but when two police officers
