also spout off about "the factor" from anywhere in the world. name and town if you wish to opine. word of the day, do not be tendentious. thanks for watching. i'm bill o'reilly. the spin stops here. breaking tonight, president obama says we are safer under his watch despite the rise of radical islam and the return to terror just last week of a taliban genre leased by his administration. welcome to "the kelly file" everyone. i'm megyn kelly. last summer president obama freed five top taliban generals from the guantanamo bay prison camp with the white house insisting freedom came with conditions. and we need not worry. the five men had to stay under house arrest in the gulf nation of qatar. they could not return to afghanistan for one year. and they could not communicate with other terrorists. but then last week just months after their release shockingly we learned that at least one of

the five had in fact attempted to return to terrorizing people. on friday night i asked the pentagon's spokesman how these killers had the ability to reach out to fellow terrorists when they were supposed to be under such close watch. and more importantly, what's going to happen when they are scot-free in three months. what we're being told they made contact with the haqqani network. if our protocols are so great, how did they make contact? >> i'm not at liberty to describe what the re-engagement system was. >> obviously there's a flaw in the system. >> actually, no megyn, it was the system in place the assurances and security measures we put in place that allowed us to discover the re-engagement activity. >> so we don't shut down the opportunity for these five guys to make contact with other terrorists. that's a little disconcerting. i mean should they be allowed to have this communication in the first place? >> well, obviously we don't want them to have communication with former taliban -- >> qatar's only going to watch

them for a year and that year is up in may and clearly they're interested in returning to terror. what are we going to do after may? >> again, i can't talk about the specific security arrangements with qatar. >> can they go back to afghanistan? >> again, i'm not -- they are not free to travel. >> even after the year? after the year in qatar are they free to travel out of qatar after the year? >> i can't go into the details -- >> why don't we get to know? joining me now republican senator lindsey graham, he has introduced legislation that would ban the transfer of medium and high risk prisoners out of guantanamo bay. senator, good to see you tonight. he wouldn't get specific about what happened, but he said the system worked. do you agree? >> no. the admiral is a fine man, and he's trying to tell the american people something that doesn't make sense. at the end of may they're going back to the fight. they have not been reformed. ask them tomorrow do you renounce the taliban, they're in

military prison in guantanamo bay because they collaborated with al qaeda to attack the homeland. they were in charge of the taliban government. they were senior taliban officials before 9/11. that's the reason they're in jail. and they're going back to the fight just as sure as night follows day. this makes absolutely no sense. >> he seemed to think that the system worked because clearly without getting specific about how we found out, we were monitoring them, we caught one guy, i guess, trying to make contact with terrorists, presumably taliban. and now we're on it. and we'll stay on it. >> well, these are the same people that administration told you al qaeda's been decimated and that isil is basically the jayvee team. the president of the united states is who i have a beef with, not admiral kirby. they put him in a box. >> he has to defend the pentagon, correct, that's what general keane said. >> he's a good man. but here's what i really do have a problem with. our president will not call this radical islam.

you know before world war ii people believed that they just gave hitler one more country or a german speaking portion of a country he would be fine. they never really understood that hitler wanted a master race. his goal was not to take part in the -- but dominate the world with an arian race and others would suffer and the jews destroyed. motivated by a religious doctrine that has no place for your eye, modern muslims or anyone else who disagree -- they want to master religion. >> he doesn't seem to dispute that, but he doesn't like describing it as radical islam. and he spoke to why just this past weekend in an interview with cnn. listen. >> there is an element growing out of muslim communities in certain parts of the world that have perverted the religion. i reject a notion that somehow

that creates a religious war. because the overwhelming majority of muslims reject that interpretation of islam. they don't even recognize it as being islam. >> your thoughts on that. >> well number one, mr. president, when you talk about closing gitmo, and you talk about -- if you close gitmo tomorrow and gave the palestinians everything they wanted, they would not stop radical islamists. radical islam is motivated by a religious doctrine that requires them to purify their religion. they can't be accommodated or appeased. >> his point is it's not all of islam, so why even bring islam into it. >> the biggest victims of radical islam are other people within the faith. if you don't understand what these people are trying to do you can't defeat them. clearly he doesn't understand that isil is no longer the jayvee team. he clearly doesn't understand that part of their charter is to

destroy israel and to come after us. if you really believe isil represented a threat to our homeland, would you be engaged in the strategy we are today? wouldn't you have some american ground forces working in the region to defeat these guys? when president bomb accuses john mccain and lindsey graham of wanting 250,000 troops to fight isil, he is basically mischaracterizing what we're saying to hide his weakness and his incompetence. the president of the united states is disconnected from what's going on in the mideast. his strategy is failing. and if you don't admit that we're at war with radical islam they're certainly at war with us, you can't defeat these people. you have to understand what they want and what motivates them to defeat -- >> that's what the general said last week which is why i was pressing the rear admiral kirby about it. senator lindsey graham, we appreciate it. >> thank you. we have new developments in the fight between washington and jerusalem. started when the prime minister

accepted an invitation to speak to congress without a green light or heads up to the white house. the administration then said it would not meet with mr. netanyahu during his visit because it was too close to the upcoming election and the president did not want to "influence the outcome." but my next guest says they may be doing just that. serves in the foreign affairs committee. sir, thank you very much for being here tonight. >> great to be here. >> do you believe that the white house, the administration, is interfering in the israeli election, how? >> well, senator ted cruz and i last week joined together calling for answers from the state department as to why u.s. tax dollars are being sent to a not for profit trying to overthrow the israeli government as far as netanyahu's regime. one voice, which is a u.s. taxpayer funded 501c3 not for profit has partnered with victory 15 in an effort to oust prime minister netanyahu.

one voice advertises on their website they are partners with the state department. they recently received two state department grants. v-15 and one voice are talking about merging, the plan is to merge prior to to the march election. and v-15 has entered into a contract of political consultant firm called 270 strategies, which has over a dozen individuals who are in leadership positions for obama's re-election and original election including jeremy bird who in 2012 was the national field director. >> let me ask you, one voice got that money from the state department prior to even the announcement that israel was going to have this election. so it's not like that money went to this specific cause. so who cares? >> well the second grant was recent. they just received the second grant just a couple months ago. i think it was around november 2014. and they are advertising on their website that they are partners with the state department. they clearly are merging with v-15 in their effort to oust the

prime minister. >> you think they should have to give back the money? even if it wasn't designated for this purpose that the money is in the same pot should they have to give back that money? >> i question their tax exempt status if they're engaging in those political -- we have a lot of great allies all across the entire world, but none more stronger than israel. which is a beacon of freedom and democracy and liberty in a region filled with radical islamic extremists and state-sponsored terrorism. so this president needs a refresher course on who our friends are and who our enemies are. he won't meet with the prime minister when he's coming to washington. his minions are racing overseas to topple -- >> joe said on the show last week they'd be doing that they didn't have to get the president's approval. that's what political operatives do. they move on to the next campaign.

-- we think it's an important part of protecting their health and public health. i also think parents need to have some choice -- >> breaking tonight new political fallout after offhand remarks about vaccinations. first, governor chris christie of new jersey took flak for talking about a parents right to choose whether to vaccinate. then senator rand paul took it a step further not only arguing this is an issue of choice and freedom, but talking about how he has been told that some vaccinations led to "mental disorders." chris stirewalt is our digital politics editor and with me now. let's start with rand paul because we played the chris christie remarks but here's

what rand paul said in part. listen. >> i've heard of many tragic cases of walking, talking normal children who wound up with profound mental disorders after vaccines. >> and so if we get him on stage in a presidential debate the follow-up will be from whom, jenny mccarthy? that's the problem. that type of allegation needs to be backed up by science. and the scientists who have studied now millions of children say that's not true. >> well, and he's a doctor. and it's part of his story about his work in the medical field and that is a very big part of his biography. so when he says that it's more than just when a candidate like i don't know barack obama in 2008 for example trots out some concerns. we have concerns we have worries, we should investigate more. it's one thing when a guy who's a state senator from illinois throws it out there, but a guy

who talks about being a doctor when he says it boom, that's a big boom. >> not only that then chris christie today talked about choice is important but said mary pat and i vaccinated our kids. but look what he said in 2009 when he was running for governor. many of these families affected by autism have expressed their concern over the new jersey -- i stand with them now and will stand with them as their governor in their fight for greater parental involvement in vaccination decisions. there shouldn't be choice governor candidates senators what the other side says -- we're not talking about as a human being, we're talking about going to school mandatory vaccinations. there shouldn't be because the science that led some to have concerns back then has been totally debunked. totally debunked. >> well, and beyond that here's the thing, any vaccination folks

are a powerful lobby, they are passionate and feel children's health has been at stake or damaged. they'll work hard for candidates who they think are on their side. and candidates have, and i wsay pandered necessarily because i don't know the condition of their hearts but have definitely reached out in ways to accommodate these folks and often have found themselves usinguse ing weasel words as president obama did in 2008. paul seems to be a true believer. >> even today. chris, great to see you. >> you bet. >> joining me with his take judge andrew napolitano. so i think you could defend those comments in 2009 2008 because even -- somebody who had a child in 2009. >> right. >> i remember saying wait, i'm hearing this stuff, is it true? my pediatrician set me straight we've had all three of our children vaccinated on time as prescribed by the doctor. but today the science is uniform. >> but the choice must be -- and this is what i think senator paul was saying and this is what

i think governor christie was saying though he backed off it. i think he used the word balance in inadvertently. they were both arguing the default position is parental, not governmental. half the states in the union allow parents to opt out -- >> for philosophical reasons. >> yes. not religious reasons. >> but -- >> that's the rand paul -- >> finish the sentence. they allow to opt out for philosophical reasons and then send them to public schools. >> that's the problem. that's the only government involvement we're talking about. none of these states says you must vaccinate your children period. no one's doing that. it's in order for them to go to school. >> only mississippi says that. >> and west virginia. >> right. so they're out of this equation. but if you don't vaccinate the child, and the child is ill and you know it and you send the child to school you commit a crime.

you could be indicted for that. >> but these candidates are going to get pressed -- so chris christie lives in a tough state. new jersey is a state that doesn't allow for the philosophical exception. if you don't get your kid vaccinated, your kid's not going to school. all these candidates are going to be forced to take a position. i ask you whether they're going to stand on the side of science which as i've said studied millions of children pediatrics, all reputable journals have come out and said there's no link between vaccines and autisms. based on a 1998 study by a guy in the uk who has now lost his medical license and a fraud and all have had to take it back and renounce it. >> couple points here. one, chris stirewalt, as usual, is right. there is a huge group in the republic -- conservative republican base that votes in republican primaries that does not accept the science as you've described it. and they vote. two, and i'm waiting for rand paul to say this, this is not a federal issue. this is not in the constitution. he's not running for governor of

new jersey or governor of kentucky. >> good point. >> this is for each individual state to decide because the states are in charge -- >> he's got an out clause. >> yes. >> and he apparently didn't see it because he talked about it and talked about it a lot. >> i hope he's watching. >> well governor christie's in a different position. he runs a state and talked about it. he's getting hit today because people are the one who say you locked up -- locked up kacih kaci kaci kaci hicoks. running -- he wanted those votes. he did not govern the way he said he would in 2009 once he became the governor. he enforces, better or worse whatever you think of this new jersey's vaccination laws to the letter. >> as written. here's another question.

got the chance to ask the tough questions of the commander in chief before 100 million viewers. she did so in the white house kitchen. >> i don't know if this makes it into your presidential briefing books, but have you been following deflategate. people notice you have pep in your step. you were confident. your critics say maybe a little cocky. your party lost in november but you went in with such swagger. should you have been more conciliatory? quick game of either/or? football or basketball? offense or defense? wings or chips and guac? >> compare that to some of the questions you saw on the fox news channel last year. >> was it the biggest mistake of your presidency to tell the nation over and over if you like your insurance you can keep your insurance? you testified on the day the ambassador was murdered and three other americans he told secretary panetta it was a terrorist attack.

did he tell you secretary panetta, it was a terrorist attack? i got to get to the irs. you're saying no corruption? >> not even a smidgen was the answer. howard kurts is host of media buzz. savannah guthrie went on this morning to air her pre-taped interview with barack obama and was a fair interview. she pressed him on some significant issues like isis and then he gave her an answer she pressed him again and she didn't let his answer stand. but talk about a missed opportunity with the viewership of the super bowl watching the one we just showed the clip of. >> you took the words right out of my mouth because this was a massive audience biggest tv show in history. it it was kind of like infotainment. wings or chips? particular when she asked the president was his state of the union speech like an end zone dance? he denied it.

there weren't very many questions where she tried to pin him down on much of anything. it was more of a casual chat. >> is that a decision? in my experience of people that work worked at nbc news and work there now, managed by the highest level. this isn't savannah deciding how she's going to do this, this is nbc brass saying this is exactly how it's going down, go do it. >> oh, yeah. do we want to air the serious questions in the morning on "today" show. she's not freelancing. you have a rare opportunity with the super bowl and the president and i could have done without some of the fluffier stuff because it just gives barack obama a chance to be funny but doesn't hold him accountable. >> is that the point? >> well you know, maybe the thoughts of nbc it's super bowl sunday and everybody's partying and we don't want to get too serious. but still, it's an opportunity and you can do it in a way, savannah guthrie shouldn't try to be bill o'reilly. they have very different styles.

travel the world with my best friend. and i won't ever get married. i couldn't grow up. because i died from an accident. >> good gracious. >> this was a bigger outrage than seattle throwing the ball on the 1 yard line with a minute left. lots of kids including mine were upset. for a company to use a child's death, we had to say nobody really died, to peddle insurance. and nationwide's attempts to justify it afterwards were pathetic. did nobody at the company understand how offensive this would be with so many kids in the audience? >> have they won though? because now we've mentioned their company name and shown the ad here? >> no, you don't want this kind of publicity. everybody online and on twitter is hammering nationwide for it's insensitivity. i think they're losers. >> what did you make of we had the typical kim kardashian with the selfies and the katy perry came out with the full you know, she wasn't like janet jackson wardrobe malfunction but she had it going on. what did you make of the

entertainment both in the commercials and super bowl halftime show? >> well, i've studied kim kardashian about 20 times. >> you're an excellent researcher. >> yeah. i think that was a spoof. she was mocking her image. i thought it was okay but my focus group, my 5-year-old looked at her and said that's inappropriate. i don't think boys should see that. i think a lot of boys were seeing that. i didn't think katy perry was out of line when it comes to what she was wearing. but the sharks that she was dancing with didn't have any bite. she has a great voice but she's not much of a dancer. just seemed so overproduced and a theatrical production that i wish i could fast forward. >> that left shark really got hammered -- nice james. for not knowing his moves. he was like a last-minute fill-in, was that the deal? >> we need to find out the identity of that shark because he screwed the thing up. >> the one on the left. they're giving him a hard time. cue up the tape. let's see. he's a little off. >> let's go to the slow-mo.

you as a potential darling vice presidential candidate because you would bring diversity both in terms of business experience and gender. but if you wound up being tapped by somebody for a vice presidential role, would any of these people who are potentially vying for the top spot be acceptable to you? in other words, would you run with any of these folks including sarah palin who i just mentioned? >> first of all i don't think you run for the vide presidency. there's only one job you can run for and that's the vice president. we have a broad, well-qualified slate of candidates that are considering this. and i think that's a very good thing. because i think we must win in 2016. i think our country is at a point where we need to make serious changes. i don't think this country can endure four years of hillary clinton or elizabeth warren.

hospital tonight after being found facedown in a bathtub in her home. trace gallagher live in our west coast newsroom with the very latest. trace. >> megyn, tmz is reporting bobbi kristina's eyes have been fluttering and brain reaction has gone up. the hospital won't comment at all but the situation appears to be very grim. when she was found facedown in that bathtub, she could have been that way for several minutes. we no bobbi kristina has had drug issues in the past. but police say they found no drugs or bottle medication in or around the bathtub. but listen to this conversation on a police scanner shortly after the incident. >> company 4, has an update. it's possible it was domestic related earlier. she has been drinking etoh this morning. >> so there appears to be some indication she was drinking wine. remember, this happened just after 10:00 in the morning.
