he also said yesterday we're winning. by what metric are we winning. if you listened yesterday to lieutenant flinch who was on fox news sunday this is a guy who would create strategies, he would execute missions. he said this white house has completely dropped the ball on the war on terror. >> i think what i'm saying is that the strategy we've had, it's not working. it's clearly not working. we're kind of like a football team with a quarterback at the huddle and the quarterback says ready, break everybody is supposed to step to the line and the team is supposed to move down the field together in a synchronized way to the goal line to win. i feel when we say ready break, all the players on the team, they're going off into different stadiums playing different sports. we really don't have an effective strategy that is coherent that actually addresses the wider problem. >> i want to get into -- >> which is ideology.

tom, you've been telling us these stories about how these people from the midwest and in particular the twin cities are interested in joining. as it turns out the feds were waiting for the airport. >> they were but they're mixing things up a little bit now. this is having interesting. this morning a federal judge will decide whether hamza ahmed should be release from jail back to his parents but they are mixing it up a little bit. they're changing their tactics. this time instead of leaving from twin cities international they hopped a grape hound bus in minnesota, took the 1000 mile journey. hamza ahmed and three other people's were stopped. ahmed made it on the plane they were headed to istanbul turkey were pulled off by the f.b.i. they said that he actually going to spain. they didn't believe him.

they found video that said he came with these individuals. he is now charged with lying to the f.b.i. at this point. going back and looking at his social media accounts is fascinating. he was communicating with some of the others on this social media account. it traces his trajectory going from a lonely teenager, then starting to talk about religious lectures presumably radical religious lectures. back in march he got very interested in syria. he had this tweet: i'm afraid i've been ungrateful, those in syria and elsewhere starving until their soul departs and i complain if i get shoes from wal-mart. so far those indicted have been the foot soldiers. two people in minnesota died fighting isis in syria. what we don't have yet are recruiters, people above them giving them the plane tickets, giving them the bus tickets and saying go to syria. >> are they radicalizing themselves on-line or is there somebody in minnesota talking to them? >> i think it's a little bit of both. according to the u.s. attorney, a lot of it does

proposes. we are now going to have a debate on this. heather, you don't think this is a good idea this idea we put all these cameras outside of bars. they would have to foot the bill for this. they are going to have to pay up to 50%. the city will foot the bill for the rest of it. >> i understand this mother's grief and wants to do something to help but there is a number of reasons why this is a questionable idea. one, it wouldn't have made a difference here. ultimately they found footage from another business owner and it didn't stop anything from happening to shane. more importantly to make bars put cameras up and not do the same to other businesses is an undue burden on bars. so there's that concern. there's also fourth amendment concerns i have about this as well. i think all around there's way too many risks and not enough benefits. >> she brings up the fourth amendment. this idea of privacy. should we have an expectation of privacy outside of a bar. look at london you can't walk on any street in the city of london without there being a camera

somewhere. >> the fourth amendment issue is an important issue and i definitely respect that opinion. however, the supreme court has ruled since the late 1970's, and not to get too lost in the weed but there was the case of katz v. united states. the court ruled there is no expectation of privacy in public areas such as sidewalks. i think the courts have been pretty clear on that. these facilities have two public duties, follow the law and protect their investors. they are following the law. in terms of protecting their patrons, i agree. in this situation it wouldn't have prevented this tragic death but i think it would prevent other problems and help facilitate public investigation or problems moving forward. >> my question is who owns the tapes? are the police officers going to need to get a warrant or subpoena to get these tapes from the business? are they going to be able to go in willy-nilly. you're right about the fact that there is no expectation of privacy. at the same time what can

happen with these tapes if we're talking about people doing things they don't want people to know about but they are legal outside of bars? i think it is a slippery slope. >> would it have prevented anything. we had that nail salon video from across the street which caught him on camera. would it have helped stop him at all? >> in this instance no in other instances yes. there are other situations we can point to. last year there was the tragic loss of a young woman who died leaving a social situation at the university of virginia and the police are really having a tragic time with that right now trying to have the family seek justice because there is no supporting evidence on that. i think there are a lot of good point here but the bottom line is that this is really a question of what is a reasonable business balance? in order to provide a slight intrusion, i think that that's reasonable. by the way the police always have to have probable cause and have a search warrant for this. that's not an imbalance. >> heather, final word. >> i think we're going down a slippery slope. are we going to start

area. that shows we're looking more at a mix. we have warmer air aloft helping transition to that snow. farther north across parts of new england upstate new york, that precipitation is staying only in the form of rain and it's forecast to continue throughout the entire day today. in some areas in eastern new england even as we head into very early tomorrow morning so this is going to be a long duration event for many areas. it is going to be quite a mess out there across parts of upstate new york and into new england you're looking at potentially more than a foot of snow. locally a foot and a half possible in some of those areas. winter storm warnings are in effect. winter weather advisory here for new york city but in pennsylvania very widespread area looking at freezing rain advisories because that ice is going to be sticking on roadways and high temperatures are going to stay quite chilly out there. 30 for new york city. in new england take a look at caribou, maine, the high temperature only 9 degrees. factor in the wind and

ben sasse took a tour and took a number of pictures and joins us from capitol hill. good morning to you, senator. >> good morning. thanks for having me. >> you were on a bipartisan learning tour. what did you learn? >> there are a lot of great americans working hard for us in the customs and border patrol and there is some good leadership but we don't have a secure border. >> and in fact i know that you took an overflight, 90 minute overflight and there are parts of the border fence where there is no fence. so that's not going to stop anybody. >> yeah. the rio grande river, one of our pilots joked it's really the rio piqueno. it's 100 yards wide and eight inches deep in places and people can just come right across. >> sure. we're looking at a picture now. it's kind of hard to see but along the rio grande you see three or four guys, i believe on the american side. they're running. also at one point you saw three or four guys with a raft in a

tree. your pilot said what to you about those guys? >> this is what they do. again, our border patrol agents are doing really good, hard work. but there is a lack of will to solve this problem. so there were unmanned overflights. we were in manned overflights helicopters, boats on the rio grande, and pretty much everywhere you would go, either by eyesight or surveillance, you would see people trying to get across the river. there are traffickers that do this as a business. there are more of them than there are of us right now. >> surely. you are particularly concerned with the jihad-minded migrants, aren't you? >> right. there are a whole bunch of reasons people are trying to get across the border. this is the greatest country in the world. and economic opportunity is going to be a magnet. there are human traffickers, sex traffickers, smugglers. my primary question is once there are jihadi attacks in the u.s., which i think is our future, and we find some of them came across our pourous borders, what are we going to do then, because that's what we should be

doing now. >> i understand you talked to texas ranchers. what did they tell you? >> they're folks trying to make a living and they'll have folks crashing through their fences because they're trying to flee border patrol agents and then we have to renegotiate issues of whether or not the border patrol can pursue folks that come through their fences. they also find dead bodies on their property of people who die of heat and thirst in the summer. so there is a big problem. we put pictures at bens sse of what we saw these three days. >> in addition to that you've been vocal questioning the president's so-called amnesty benefits. explain what those are and your concerns. >> the president hasn't been forth coming about what his executive amnesty will do. my beginning concerns about this are obviously constitutional, about the separation of powers. but there are long-term financial implications as well. the president is envisioning a world where he will issue four to 5 million social security numbers. once an illegal immigrant has a

i'd rather them have the vaccination. >> but there is a benefit, we ask, or just putting more kids at greater risk? we're going to ask attending physician who joins us now. so when you hear about -- we heard about the chicken pox parties. did they work and how much more dangerous is this that these teasels parties are actually happening? >> it's a great question. this whole idea of measles parties came from the idea of pox parties that were started in the 1980s to mix children ho had chicken pox with children ho did not have chicken pox to try and increase exposure as a way of building up natural immunity. that's what happened in the 1980s. unfortunately, we're seeing a resurgence of this with measles because parents are very concerned about the risks of vaccination, particularly this link with autism which has been completely discredited. we must emphasize that. vaccination is safe and effective. but some parents are very

concerned about this association with autism which actually came out from a study in the 1990s. it's just completely flawed. >> how dangerous are these measles parties? who is most vulnerable? >> the problem with measle, they're highly contagious. and we know that if you have good vaccination, the vaccination is very safe and very neglective. but for children not vaccinated they're very at risk of getting measles because it's so contagious. the problem is that for a percentage of children ho get measles, 30% of children there can be complications associated with getting measles. for a percentage of children, they can get issues with ear infection, and inflammation of the brain pneumonia. these can result in children being in hospital and two out of three children will die from measles. >> gosh, that's so risky. how much immunity can you build up by these parties? >> the concept is if go to the parties and develop measles

it's kind of considered to be natural immunity. but if not controlled, you're putting a child at unnecessary risk. the risk of the disease is much much higher than the risk of having the vaccination. so vaccinate your children against measles is a very clear message. this vaccination is safe, effective. and for those children that have the vaccine the coverage is excellent. it's over 90%. >> so we're seeing over 100 cases now in 16 states. what if you get the measles? what do you do? >> the important thing to say here is that in 2004 the number of cases were absolute lowest. ten years on we saw over 600 cases last year. we only have 34 cases in 2004. this is am that there are groups in america particularly in california, there were a number of children unvaccinated. if you get measles for children pretty much supportive -- it's fluids. we don't get baths, but when there is a big problem but

yeah, i think that's what he's saying. pay back is expected that empathy should be extended to the islamic caliphate that we are no better than the people who pursued the crusades, and that the risk of pursuing islamic extremism in a drastic way is the same risk as the crusades. the president sees the crusades as an attack on the islamic people and that we are sinners and that we have an innate deparagraphity and if we succumb to that, we will succumb to the same sins that those who engaged in the crusades did. so not enough lifting message. a message consumed with guilt, a emergency consumed with shame remorse, and saying that we need to be really careful before we get up on our high horse. >> yeah. so what reverend wright was saying was -- 9-11 was we got what we had coming to us. is that what the president is saying? >> i hope not.

i think it's a confused message. i think he's confused. i think this entire white house administration needs some therapy to expiate and purge the guilt that they are consumed with, need to understand whether it's islamic based, whether it is sectarian based, it is a threat and existtential threat. it means to act as if you're better or more intelligent than other people. president advises us not to get up op our high horse. let's not act superior or more intelligent or more morally superior. we need to understand the conduct of the united states is morally superior to the tragic terrorist islamic extremism that we've seen and that we need to act in accord. we have nothing to be ashamed of. we should not be extending empathy or sympathy. we need to act in a way that's consistent with christianity the judeo-christian ethic and a
