violence, more tolerance, less strife, less poverty -- >> do you think the media sometimes overstates the sort of level of alarm people should have about terrorism and this kind of chaos as opposed to a longer term problem like climate change? >> absolutely. i don't blame the media for that. what's the thing saying about local newscasts right? if it bleeds it leaks. all right. you show crime stories and you show fires, because that's what folks watch. it's all -- >> well that message in conflict with the warnings of several four-star generals, chairman of the joint chiefs and former defense secretary all of whom have recently warned of a threat that seems very real and very grave. >> we are facing a form of a cancerous component of the islamic religion, which has a

fanaticism to it that has everything which is against our way of life. and they in fact have declared war on us. >> the united states is confronting emergency security challenging on a scale not seen since the rise of the soviet union. >> they're beyond a terrorist group. oh this is beyond anything we have seen. we must prepare for everything. >> because of open borders and immigration issues it's an immediate threat. >> chief white house correspondent ed henry is live in washington tonight at the white house. ed. >> megyn good to see you. bottom line the president had joint news conference with german chancellor angela merkel and they discussed some of those threats all around the world you were just referring to from ukraine to iran. the president barely mentioned isis, that comes after his friday speech where national security adviser susan rice said we can't give into alarmism about these terror threats.

the president's speech at the prayer breakfast appearing to downplay these terror threats. listen to another part of the vox.com interview where he compared his job to big city mayor battling small crime. >> it is entirely legitimate for the american people to be deeply concerned when you've got a bunch of violent, vicious zell outs who behead people or randomly shoot a bunch of folks in a deli in paris. we devote enormous resources to that. and it is right and appropriate for us to be vigilant and aggressive in trying to deal with that. the same way that a big city mayor's got to cut the crime rate down if he wants that city to thrive. >> that part about a random shooting, remember what he left

out is that deli in paris was a kosher deli specifically targeted because it was in a jewish neighborhood. megyn. >> ed, thank you. here now to react colonel oliver north, fox news military analyst. colonel, let's start with that. you've got a bunch of vicious zealous who behead people or randomly shoot a bunch of folks in a deli in paris. the thing is it wasn't random at all. >> no, not at all. of course it was targeted specifically because they were jewish. and the person who did it acknowledged that on a video that he was preparing while he was doing it. >> is that downplaying? that's what he's being criticized for here. for downplaying what happened in paris, for downplaying the national threat, downplaying saying the media is hyping it. >> we've got the secretary of state saying we're on the road to defeating isis. we're walking slowly uphill in the wind in the median strip because we're not doing didly. six months ago cia estimated

number of isis fighters between 20,000 and 31,500. think about how poor our intelligence has to be for an estimate that could vary by more than a third. by the way the number now is over 50,000. last month the state department said that more than 18,000 fighters -- foreign fighters have traveled to syria and iraq. now that's over 20000. when you look at these kinds of things and the head of state and iraq, the prime minister of iraq saying the coalition isn't doing enough. >> secretary kerry came out and suggested we'd made real progress in iraq. i'm looking for his exact quote. i had it in front of me. he says the coalition has regained more than 20% of the territory that had been under isis' control and killed a significant proportion for the

leadership. >> little reality check, isis still controls almost all of anbar province from baghdad west of the syrian border. the iraqi plan -- the plan for iraq first is on hold. the whole idea isis is going to be defeated in mosul is on hold. the obama administration's doing nothing to give assurances to the members of the coalition that the iraq first plan is going to work. and nobody believes bashar al assad is going to be removed from power in damascus. so all this says particularly given the opportunity that was there last week with the king of jordan willing to equip and train the peshmerga if the united states would provide arms, none of that has happened. yes, the uae has rejoined the coalition, but jordan is already flying more than 20% of the missions over iraq and syria. they've got 57 combat configured aircraft compared to the saudis with 230. how come jordan is carrying the bulk of the load?

>> do you think the president means to understate the threat we face? or is it his job to sort of tamp down fears say we got this you know, we're on this, go about your lives and don't worry. >> megyn, the scary part of it is he actually believes what he's saying. listen the transition in saudi monarchy, the collapse in yemen disaster in libya isis engagement with boko haram al shabaab and now afghanistan shows isis today has a global reach. they're not smaller, they're bigger. and what we ought to be doing right now, the marines have a wonderful saying. nothing says sincerity like a carrier strike group and a u.s. marine air ground task force. >> wordy but it's catch chi. >> i'm saying if they supplied they would have effect on what's happening not only inside what's happening in syria but also

putin, ukraine and turkey. >> got it. colonel oliver north, thanks for being here sir. >> any time. >> joining me with more former chief of staff to congressman luis gutierrez. start where i started with oli. this comment by the president that you've got a bunch of vicious zelout saying a lot of folks it wasn't random, it wasn't just a bunch of folks in a deli. it was targeted. and this is a group whose motivations and hatred needs to be taken seriously, understood and we need to be reminded of it at every turn instead of having it downplayed. >> exactly. the president has never said we could not take him seriously and that was not a serious attack that happened. i think to the colonel's words i think that we did in july for example send u.s. forces to iraq to establish what their needs were. i think we need to continue that

with a force that perhaps corrupt, needs to be trained and that even the israelis are saying we need to keep supported with sophisticated weaponry. >> are we doing enough to support the battle against isis? >> i think we could do more. i think we could do more. and i think it's bipartisan support to give them more backup and sophisticated weapons. it's also clear nobody wants troops on the ground. i think we need to continue to move in that direction. but that's not what the president said. the president did not say they were not a serious threat. >> he talks about how he believes the media sometimes overstates the threat. >> absolutely. >> hypes the threat. you look at the testimony of those generals and his own joint chairman soft chiefs -- i don't feel like i'm overhyping. i feel like i'm repeating what your people are saying. >> megyn you and i have a more chance of dying of cancer of a heart attack of a traffic accident and even from a gunfire than dying from an attack by

isis. i think the president's say inging what is a real threat -- >> we're not going on the air saying run for your lives. we're repeating what -- >> let's look at a fox poll. fox took a poll in october and 50% of americans believed isis was a real threat. so people believe that this is something that could affect them. >> just said there's an isis operative under investigation in every state in the union except alaska. >> we are in danger. come on, the numbers of what causes deaths in america are not surely isis or terrorism. are heart attack cancer guns and traffic accidents. >> we're scared of those things too. >> we should be. one and two actually are tied and preventable. so we should look into our health. >> that's a good takeaway. great to see you. >> thank you. >> republican senator tom cotton

truth about his 2003 time in iraq, he seems to express genuine bewilderment that he wasn't in fact under fire in 2003. listen. >> what i was told by one of the crew members who was actually on your chinook is that you guys were like an hour behind this grouping of three chinooks out in front. and the middle one was hit. >> and that's the first i've heard of that. i did not think we were in trail by that far. i, i could not see in front of us but i thought we were just in one flotilla, for lack of a better word. >> does that help him? >> no. because brian williams has now told seven or eight different exaggerated versions deceptive versions of the same iraq story. here's the situation, megyn, brian williams is in utter limbo right now because the strategy he had to save himself has collapsed and here's why. first he did the apology but the

apology contained inaccuracies, everybody close to him even say he botched it. then he self-deported off nbc news. but that made nbc executives look like they're not in charge and this investigation they're conducting is not really an investigation. he was going to go on letterman this week but things got so toxic and as you noted new questions about some of his hurricane katrina reporting which i believe remains in dispute, what he has to do is find a way to address whether there's a pattern of deception on these various stories. and he has to seek the forgiveness of the american public. right now he doesn't have a forum to do that. >> i agree with you there are big question marks on the hurricane katrina accusations made against him. but not so much on the iraq. and something came out over the weekend of an interview he gave to a student journalist back in 2007 where he talked about the fears he's had for his life in ever coing stories.

just watch. >> i look down the tube of an rpg that had been fired at us and it hit the chopper in front of ours. and i'm so fortunate to be sitting here. >> okay. he never looked down the tube of an rpg. >> right. >> that was never true. now we know his life was never in danger. so when you hear these stories, this underscores the problem he faces when he goes back on the air. >> exactly. and this is one of these stories that has just broken through that everybody is talking about. i've heard a lot of civilians. people are not obsessed with what the media and politics say. i don't know that i could ever look at him the same or ever trust him. so he has multiple problems of having to play defense on these various stories having to become a national punch line and a bloodthirsty mob online that doesn't care about the rest of his career and thinks he should be kicked out to sea or mixed the analogy that he should just be hung over the series of

mistakes. i think nbc very desperately would like to hang onto him because he's the franchise, i think it's getting increasingly difficult to do that. he has no way right now to turn it around. >> let's talk about the blood letting. obviously he's -- if i were brian williams, i think the only thing he can do at this point is say i truly screwed up the iraq coverage. i think he can still credibly say in my mind i was scared, i was confused, i guess i was just wrong from the beginning. and now i realize that i was wrong. and i really was wrong when i then added the rpg fire into it in my helicopter. but i think the desire by so many to tear him down is also somewhat discomforting, isn't it? >> it really is. and i'm not here defending what brian williams did. as a journalist i obviously feel some sympathy what he's going through. it's all self-inflicted wound. but this is like every other public figure who falls and makes a mistake you get

well, a lawyer for the architect of the 9/11 attacks is lashing out tonight against republican senator tom cotton after he suggested the prisoners held down at gitmo can "rot in hell." senator cotton made those comments last week when he was grilling a pentagon official for president obama's rationale for wanting to close. >> they don't need a reason to attack the united states. they don't attack us for what we do. they attack us for who we are. it's a political decision made by the promise he said on his campaign. to say propaganda that our enemies get from it is a pretext to justify a political decision. in my opinion the only problem for began tan mo bay is there are too many empty beds and cells there right now. we should be sending more there for further interrogation. as far as i'm concerned every

qaeda, don't need an excuse to treat any of our captives terribly. >> let me ask you this. because the response by those -- to that argument is we're supposed to be better than them. we're supposed to have a rule of law. the constitution does apply to those being held at gitmo. >> megyn, we are better than them. in fact, none of these people at began guantanamo bay are entitled to those protections. none were fighting among civilians. president bush made the decision to provide those protections to them. and the people now left at guantanamo bay approximately 120 terrorists are not innocent goat herders. we can't expect our soldiers in the middle of the battle in 2001 to be csi detectives. they're there to fight and win our country's wars. that means taking captive terrorist who is have a clear known intent to attack americans

whenever and wherever they can if released from guantanamo bay. >> normally in the course of war you have a war you lock up the enemy's prisoners -- you take prisoners of war or your kill the enemy. but if you lock them up and when the war is over you release them in a prisoner exchange. that's how it used to go. but this is an unconventional war where it's ongoing. they wanted to kill us, they wanted to do it yesterday, they want to do it today and still do it tomorrow. begs the question what to do with the guys at gitmo. you can't hold them imperpurpose tuty. they say they're already living in hell down there. one guy said he's on a hunger strike and shower strike and in solitary confinement because he'd rather die than live out in perpetuity. >> they're terrorists. they're not entitled to the rights of terrorists. if they didn't want to be detain detaineddetain

detained they should haven't have taken up arms against america. you can be sure a large number will return to the battlefield. by some estimates almost one-third of all detainees released have returned to the battlefield. what's regrettable is the president hasn't sent a single captured terrorist there in his six years in office. >> he wants to close it down and not add to what he sees the problem. originally the obama administration said bring them to the united states, try them on u.s. soil, we can handle them in federal court. then said let's bring them to u.s. prison. we can handle them there. and republicans controlling the congress said we're going to defund all that. that's not going to happen. not going to give you the money to do that. so now it's try them at gitmo or release them. and the question is where are we releasing them to? half were going to go back to yemen but now yemen's in tatters and al qaeda is basically rising. >> it wasn't only republicans. it was a democratic supermajority in congress that

started these funding restrictions to prevent the president from bringing these terrorists to the united states. in my opinion we should preserve guantanamo bay as a critical part in the overall war on terror. we should be sending more terrorists there. it's always good to kill a terrorist if that's the only choice, but it's even better to capture them and interrogate them to develop more intelligence so we can stop attacks against the american homeland and against american citizens and interests around the world. >> to the lawyer for sha k -- >> terrorists need no excuse to attack us here. they've shown that for decades and decades. we should be proud for the way we treated these savages and the way our soldiers conduct themselves all around the world to include the people doing the very hard work at guantanamo bay. >> senator tom cotton, thank you for your service and thank you for being here. >> thank you, megyn. >> joining me with more judge

andrew napolitano. i know you are in favor of closing gitmo. >> yes. >> however, let me ask you the same question i asked him. what are we supposed to do with the guys who are still in there? >> you know, i don't know the answer to that. the president's going to have to come up with an answer or he can't. >> most are from yemen and we cannot send them back to yemen right now. >> i understand that. and my beef with the senator, and quite frankly i think he was angry when he spoke before the senate armed services committee, he was a lot calmer when you interviewed him a few moments ago. iraq veteran and lawyer should know what the supreme court ruled. and the supreme court ruled in five out of five cases, and you know this that those people down there are entitled to the basic due process. he's also insulting the system. i am very familiar with the prosecutors. there are military prosecutors and civilian prosecutors. they are headed by general mark martin of west point and harvard law school. a brilliant guy and dedicated

patriot. his team believes in the system. they don't believe these people should rot in hell. they believe these people are entitled to a fair trial. the military judges believe these people are entitled to a fair trial. >> but we've had so few. why are we having so few trials in gitmo? almost all the guys down there are just being held without facing trial. >> it takes a lot longer in the military system than it does in the civilian system. and i've argued that more of these people should be tried here, but the more i've gotten to know about the military prosecutors and their legal dedication to following the rule of law, the more respect i have for them. crazy things have happened. an fbi agent insinuated himself into one of the defense teams pretending to be a paralegal. he was actually spying on the defense team. and that has resulted in a trial over whether his behavior was appropriate. look this is basically a fair system. and it has to be given a chance to work. the senator's entitled to his views. he probably shares the views of

most of his constituents. >> he was trying to get that pentagon official a hard time because he was saying it's a recruiting tool, it's a recruiting tool for terrorists. and he was saying was it a recruiting tool, no it didn't exist and they wanted to hit us. >> correct. but when a senator who is a lawyer basically thumbs his nose at the system and says these people should rot in hell or gitmo guilty or innocent? >> could have killed you, could have put a bullet in your brain right then and there. we don't want to release you because pointed oit this is an unconventional war you're going to run out there and take back arms up against us. >> made those fooi five times in front of the supreme court and lost them all. >> they have a legal process. >> correct. >> to which they are entitled. >> i suspect -- only been a senator for a month. the longer he's there the more he'll come to appreciate the process and the dedication of the military people who are

developing tonight, bruce jenner reportedly obtaining a top defense attorney after being involved in a fatal car accident. "the kelly file" has received pictures showing the moment the chain reaction crash happened saturday afternoon in california. police say jenner slammed into the back of a white lexus pushing it into oncoming traffic. the vehicle was hit by another suv and the driver was killed. a trial attorney mercedes criminal defense attorney and fox news legal analyst. welcome to you both. let me get this straight. i thought, andell, that the white prius had hit another car and then bruce jenner's car rammed into the white car. do i not have my sequence correct? >> there's a black prius in front of the white lexus. and bruce jenner's escalade runs into the back of the white lexus which crosses over into oncoming

traffic and is hit by a hummer. >> so did the white lexus crash into the black prius first? and then bruce jenner crashed into the crash site? >> that's what reports are saying. they're saying that black prius stopped to do a u it have-turn, bruce jenner could not avoid the lexus, he hit it and then goes into the other lane of traffic and gets hit by a hummer. >> if that's the case how is anybody even arguably considering manslaughter or other charges against bruce jenner? >> this is all moving parts right now. that's why. because there's so many things in play right now. the first chain of reaction, what caused it. if it was actually the other car that caused the accident, then obviously bruce jenner's going to say no way there's culpability. first they did a field sobriety test. apparently he passed that. then they looked was he texting.

they have to determine that. what was he doing at the very moment of impact? all of these questions are still unanswered because frankly there's someone who died here. and there are so many investigators involved. >> the woman in this white lexus died. basically these pictures are taken as the accident is happening. apparently tmz is reporting tonight that law enforcement now believes reportedly bruce was not texting and driving but he may have been following too closely. if that's the case, theoretically could he be charged with vehicular manslaughter? that is what some are suggesting? >> i don't believe so. in order for a vehicular manslaughter charge to stick he's going to have to be acting with gross negligence. and following too closely is not advised, but it's not what you would consider gross negligent. he'd be having to act in a reckless manner. >> mercedes, let's talk about bobbi kristina brown whitney houston's daughter who was found facedown in her bathtub dead -- not dead near death.

now they say she may be near death as well. we've had terrible reports. now they're looking at this as a criminal investigation. why? >> very close to home to me as you know megyn. frankly because there are these injuries to her face that are unexplained. apparently they're injuries around her mouth area. now of course they're looking very closely at the relationship between her and determining whether they've had a history of violence between them whether he had anything to do with bobbi not death, near death. >> right. we don't know what the truth is. but with respect to the injuries it's very suspicious. if they think -- apparently there's some history between bobbi kristina and her boyfriend, i guess it is. it's very coincidental she was found in the same position and in the same way in the bathtub as her mother. >> i mean, that is extremely tragic and koinscoincidental. it's not only the injuries that are suspicious, but it's the facts surrounding what happened that are suspicious.

one of the things that max lomax, bobbi and -- saw nick gordon cleaning up blood and trying to clean up other things around the house. also he says nick gordon was acting strangely that day. those are some of the things that have roused the suspicion of the authorities and why police are looking at nick gordon as a target of investigation. >> so is the suggestion that the boyfriend may have hurt her and tried to make it look like she tried to kill herself in the same manner that her mother died? >> how foolish is that to even think there's some plausibility to that. her mother died unfortunately because of her addiction and passed out in the bathtub. but these are different circumstances. there's no toxicology report that's confirmed she had any sort of narcotic in her system or any drug that would have rendered her unconscious and then slipped into the bathtub. and those injuries are unexplained. and frankly with the history that this couple had and ultimately what's at issue here? it's money. it's a big estate.

somehow nick gordon thought he's going to inherit this although he's not married to her that could be a big issue. ultimately if really money was at the heart of it, then obviously implicate him even further. >> before i let you go there's a report tonight that drew peterson, our viewers may remember him this is the guy convicted of murdering his third wife kathleen savio out of the chicago area. and he was also a suspect in the death of his fourth wife or maybe reversed -- i may have four and three reversed. but convicted of killing a wife and the suspect the other wife and now he's charged with something new. >> yeah. they're saying that he's accused of putting out a hit on the prosecutor that prosecuted him for the death. just like you, megyn, i'm not sure third or fourth wife, they're saying he put a hit out on the prosecutor. >> how did they figure that out, mercedes? somebody turned on him from prison. he called up hit men.
