windows of the caf fiat the event ongoing killing a 53-year-old documentary filmmaker and wounding three police officers. the targeted artist was unhurt. in a second attack hours later outside the main synagogue the government shot and killed a 37-year-old jewish security guard during a barmitsvah and wounded two additional police officers. this morning, the danish prime minister visited that synagogue. >> translator: we have as a nation experienced something which we will never forget. we have tasted the worst fear and powerlessness terrorism likes to create but we have also responded as a community. >> lets bring in amy kellogg joining us live from the london newsroom with the latest on the investigation. amy, what can you tell us? >> hi. it might be worth mentioning at this point denmark has been under threat fme. really, that country was first out of the gate with the

and her family were celebrate an important right of passage. police know the suspect's name now dead he was on quote their radar. what nay don't know is whether or not he was one of the 100 or so danes who traveled to iraq and syria in recent years. he was traced by tv footage. police determined they knew where to find him and waited for him near the train decision, when they spotted him at 5:00 a.m. they called out, he opened fire at the police, they shot back killing him now. danish media is reporting police have arrested two people in an internet cafe. danish police don't want to talk about this ongoing investigation because they feel it will damage their work. they just say they are working certain neighborhoods of denmark. they believe they got the man who acted alone last night acted alone yesterday. but the question does remain, was he part of the bigger network, as you mentioned the

piling up in huge mounds over 7 feet in the past month. they've grounded flights at the airport. they have grounded ferries and buses and trains not running at all today in the boston area, encouraging drivers to stay off the roads so the plows can do their job to clear the pavement and solve the problem. 600 plows helping out and national guard helping clear out fire hydrants and remove piles of snow. they're worried about roof collapses as well. the wind whipping gusting to 60 miles an hour or more in parts of the state and blowing and that blizzard warning in effect through tomorrow morning in parts of massachusetts, due to high winds and reduced visibility. >> we have high winds, low visibility. i just ask people to stay off the roads today. even if you're walking, don't walk in the main streets because on our way from my house to city hall this morning, there

the global islamic community strongly condemning the killing of three muslim students in north carolina. 76 76-year-old steven hicks is accused of gunning down his neighbors neighbors. saudi arabia calling it an act of terrorism and the palestinian authority demanding to be involved in the investigation. police say they think the incident was over a parking dispute. critics and family members insist it was a hate crime. but proving that may be easier said than done.

let's bring in doug, a defense attorney and former prosecutor. thanks for joining us. are there any hallmarks of a hate crime at this time? >> no. hate crimes are hard to prove and right out of the gate, let's stress we don't know this was a hate crime. we don't know. when somebody says it's hard to prove, we don't know it was. how do you prove a hate crime. interestingly enough in a regular motive case you don't have to show motive. jurors want to know why did this person allegedly kill this person but not a critical element. in a hate crime you have to show not only the motive but he killed them because they were muslim, to quote a statute by reason of their national origin. how do you prove that? you can't take a photo as they say in court all the time, ladies and gentlemen, we'd love to take a snapshot of the

defendant's brain and put a sticker of it in evidence before you. how do you prove it? statements they've made social media, e-mails and organizations. that's how you piece it together. the police there in north carolina are paying at this point we haven't developed that. then you get the question of what about a federal investigation. >> how would that work? >> yeah. basically it's interesting. apparently there's no specific hate crime in north carolina that would cover this situation. the federal government there is a hate crime statute. i looked at it and worked with it before. again, killing somebody by virtue of their ethnicity, color, religion et cetera. the interesting thing the department of justice has a policy that they want to justify a reprosecution. think about it. if he's convicted of three murder counts and ostensibly gets life in prison on three different counts. >> also, north carolina is a death penalty state. >> exactly. it would be very hard to

justify -- again, people could take this the wrong way -- not saying i don't think it should be vindicated as a hate crime if it as a practical justice resources matter you're not necessarily going to want to prosecute for a hate crime if there's three murder counts. >> and if it's not considered or proven to be a hate crime that does not take the death penalty off the table? >> exactly right. that calculus back and forth is highly relevant. what should happen police evince and open mind and attitude and see if we can develop and uncover evidence, let's get to the facts of this case. some people say it was a parking dispute. you heard that. an interesting legal question, what if there are multiple motives, let's say it was a parking dispute and ostensibly it's some part of a hate crime. what would happen? one professor wrote, a north

carolina law professor said it has to be the main motivation. i'm not really 100% on that. the fact is it would be difficult with multiple motives make it difficult. >> bottom line, this guy will go to trial and face a jury and something will happen. >> absolutely. look, i think it's a very very strong case. i won't prejudge anything. i don't think they will have a hard time with a conviction here. >> we know he murdered these people. >> exactly. the point of the matter is the hate crime matter should be investigated but i don't think they'll necessarily charge him with it. >> thanks. i do have to run. i want to end on a quick note, your mother, yeah83 years young today. happy birthday. >> wish there was happiness out west. hear about this? the strikes at the port on the west coast has been rocking the
