back in washington, the administration is kicking off a three-day summit on quote, violent extremism. talking about fighting the terrorists on the internet and arguing that not only can we not, quote, kill our way out of this but that the key to winning could be job creation. here's the deputy state department spokeswoman. >> the egyptians jordanians, they're in the fight with us. we cannot win this war by killing them. we cannot kill our way out of this war. we need to go after the root causes that leads people to join these groups. whether it's lack of opportunity for jobs. we can work with countries around the world to help improve their governance. we can help them build their economy, so they can have job opportunities for these people. >> chief white house correspondent ed henry is live on those controversial comments from the white house. >> reporter: the bottom line is, this gruesome body count is now

66 in just a couple of days, because of the christians killed you mentioned, as well as the kurds today. it comes as the president met with the new defense secretary ash carter and insists he will defeat isis. and vice president bide p kicked off the summit on violent extremism. interesting that the vice president declared we need answers that go just beyond a military solution. that's why hart suggested maybe you can use tools like social media, economic tools that can battle terrorism. but it was so controversial, that marie hart went on cnn tonight to try to clarify. meanwhile, i pressed her colleague at the state department to clear up what was going on on a conference call. listen. >> we cannot kill every terrorist around the world nor should we try. how do you get at the root causes of this? it may be an argument for, like over the past 24 hours some of the commentary out there. the democrats, republicans military commanders, our partners in the arab world thing

we need to combat this. >> your colleague last night was on msnbc saying that we can't win this war by killing them she was talking about isis. what was she trying to say there? >> the military component is important. we've done thousands of strikes in iraq and syria. that's continuing to pick up as you know, and you've covered quite a bit. we also need to delegitimize isil. >> she made the point that george w. bush said that fighting poverty is also a tool to go after terrorism. but retired general jack keen told us that today, yes, those tools are important, but much more important in terms of battling terrorists is killing and capturing them. >> ed henry, thank you. joining me with mar, a fox news contributor and american enterprise institute fellow. and mark was mercilessly mocked on the internet today because people felt she was suggesting if only we could get these guys into community college. set them on the road toward

gainful employment, we would have no more people who believe this. let's watch a little bit about the way isis views the world. this would be eradicated if we could only -- you know community college is the way. watch. >> it is he who directs the rpg grenades punishing the enemy with the mujahadin. >> your thoughts on that. when you say we can't kill all terrorists, you've pretty much gone off the deep end. we have to try to kill all the terrorists and we also have to defeat their etiology. but the problem is you have to do both of those things. president obama isn't doing either of those things very well. if you go back to the -- and sometimes, by the way, the best way to defeat their etiology is

their military action. it was a military defeat because we drove them from their safe haven. with an etiology defeat, the sunni masses joined with america to drive al qaeda, now isis out of iraq. so that was an etiological rejection, by the very people they claim to be the vanguard of. that's how you defeat them is by rallying arabs and muslims against them to reject their etiology. you have to defeat them militarily. that's what we're not doing today. >> how much of a backlash has to do with the fact that she works for an administration that refuses to identify the enemy as what we all know it is which is radical islam. so she's coming to this debate already hampered, because the administration refuses to be clear in who the enemy is and then when you hear people trying to downplay it at least that's how it's perceived she's

downplaying the battle by saying this is all about getting them jobs, she was sort of set up to fail. >> you're absolutely right. george w. bush so kay similar things, but he was actually meeting the surge to defeat isis. he said we need to bring the hope of freedom, it wasn't seen as a dodge from doing the hard work of it. and he was actually calling it radical islam. barack obama is forcing our military to fight isis with one hand tied behind our back. fighting them from the air, when every military commander has said you cannot defeat them without boots on the ground. we're not defeating them militarily, just thinning them down a little bit. and he's a conscientious object ir in the etiological struggle in islamic extremism. you cannot defeat them when you dismiss them as terrorists. >> here's what eric holder said today. this is much ado about nothing and really just a fox news invented issue. listen. >> talking about what do you

struggle. >> the former dai, director of the intelligence agency went on fox news this sunday sounding the alarm on this for a long time now, said it is important to name it. and here's why. lisp. >> i think what the american public is looking for is moral and intellectual courage and clarity and not a sense of -- and i just say it as passivity or confusion, you can't defeat an enemy that you don't admit exists. and i think that we have to clearly define what the enemy is. that's number one. >> lieutenant general flynn does think this is an issue not a fox issue, mr. holder. the question is whether the white house will ever agree as they hold a summit about violent extremism. >> yeah. i mean it's important to -- it's not just important to name them. if you can't name them you cast talk about their ideas and debate their ideas and explain why their ideas are repugnant. the problem is you have to take the words of the enemy

breaking tonight, a growing chorus of christian leaders sounding a stark warning after a sickening terrorist video out of libya surfaced this weekend. the video showing 21 christians wearing orange jump suits, marched to a beach, forced to kneel down before the terrorists dressed in black simultaneously slit their throats. today pope francis asking people to join him in prayer for, quote, our brother cops whose throats were slit for the sole reason of being christian. new york's cardinal dolan weighing in, writing, quote these aren't sporadic attacks. this is part of an orchestrated ideology that sees christianity and judaism, a worldwide crisis that must not be ignored. the reverend franklin graham saying we would be better -- we

better take this warning seriously as these acts of terror will only spread throughout europe and the united states. the storm is coming. brit hume when you look at that landscape, you see these christian leaders taking these threats and these actions very seriously, and some doubt that our president, white taking them seriously, is -- whether he is appreciating the targeting of specific religious groups, and the importance of that in identifying this conflict. >> well, megyn i think he recognizes that the people killed were killed for being christians. what he's trying to do is not fan any sentiment that might result in pressure on him to do something really serious about this. because i do not believe that the president is faking when he says that he does not believe isis is a existential threat to

the united states of america. i don't think he believes that. and i think he's only doing what he's doing in resisting isis because of the pressure that was generated by the beheadings of the americans and by these other hideous atrocities that we've seen. i think he believes the american military footprint in the world has been more often a cause of than a solution to the problems we're facing now. and unless he sees what he considers to be an ex to extension threat, he's not going to go there. >> what did you may of mary hart? if we just get them jobs, we'll all be better off. playing to an overall narrative that's ascribed to the administration right now of you're downplaying this. >> well i think it's true they are downplaying it. i think what she said was manifestly silly. the fanatic behavior of isis and some of these other terrorist organizations is not a product of social problems. it is a product of their version of the religion that they deeply

believe in. and what isis is doing is true to a path that they have found for themselves in the islamic faith. they're trying to establish it. caliphate, which is different in many ways from the kind of franchise operation that al qaeda was for so long this is an effort to take and control territory, which a caliphate as they see it requires. so this is you know qualitatively and quantitatively, really, when you think about it, different from the terrorists we faced before when you heard people like bob gates and others say this is something truly different. martin dempsey said that as well. chuck hagel said it. i don't think the president really believes that. i think he may believe it's different, but he doesn't think it's a threat to the united states. moreover, he doesn't want to label it islamic. because i think he has a deeper goal in mind here. i think he believes first of all, that the overwhelming majority of muslims oppose this sort of thing and you don't want

to do anything or say anything that would turn them away from your side, to the bad guys. >> right. >> that's one point. in the long run -- i think these -- certainly these people, these peaceful muslims they know what's going on here. they know that it is a version of their faith that these people rely on and believe in, that leads them to do this. there's an argument going on for some time whether they, the peaceful muslims of the world, have done enough about it. but that's a separate matter. the other thing you have to keep in mind, long run, the president is looking at iran. and while these -- the isis fighters are sunni and iran is shiite, i think he thinks that because of that, in fact, iran in the long run should be an ally to the united states. in fact, i think the core of his foreign policy in the region is a hope for strategic alliance with iran, which is why you see

this never-ending search for a deal on the nuclear program in iran, because i think he believes that that really -- that getting that off the table and out of the way will help pave the way to the strategic partnership that he thinks is possible. i'm not saying i agree with that, but i think there is a vision there and it's a big idea. >> that would explain a lot. if you accept that as his fundamental concept going into the middle east, that would explain a lot of his actions. brit great to see you tonight. >> you bet, meghan. thank you. people have a right to protest. did a group of angry union supporters cross the line when they swooned the house with scott walker's elderly parents inside. the governor is here to react in a kelly file exclusive. the trial of the man who killed chris kyle today nearly came to a complete halt. the courtroom mistake that had the defense asking for this entire case to be thrown out.

breaking tonight a dramatic twist in an apparent road rage case that ended with the shooting of a mother of four. las vegas police say they don't believe the suspect immediately followed tammy meyers home as previously thought. cops now believe after the original incident, meyers and her adult son returned home, then went back looking for the other driver, and found him. that's when she was followed home and shot. and her son, who was also armed, returned fire. cops are still searching for the suspect. they have released surveillance video of the suspect's car and say it may have front-end damage. there was also major drama today in the trial of the man who murdered chris kyle. trace gallagher has the latest. >> a mistake by the prosecution had the potential to bring this trial to a halt.

a texas ranger testified two glass vials with a liquid found with drug paraphernalia inside eddie routh's home. it turns out the vials did not belong to eddie routh, they were placed into evidence by a crime lab, and the liquid inside is used to test drug evidence. the defense wanted a mistrial. the judge instead told the jury to disregard testimony about the vials. today the prosecutor also questioned one of the arresting officers who testified about the difference in the defendant's demeanor, saying when eddie routh was alone, he quote appeared to be sitting back relaxing. but when a crowd was around, he, quote, acted distraught. on that point, the jury then saw video of routh in the back of the police cruiser. you can hear the officer asking him, quote, hey marine you all right back there? routh responds i've been so paranoid and so schizophrenic all day, i don't know if i'm

insane. the prosecution rested and the defense called routh's mom, who said her son tried to get va benefits for years but was denied. then when he was arrested for double homicide the va deemed him disabled and started paying him $2800 a month. he now has $30,000 in the bank, and the judge was not pleased to hear that. considering routh has a court-appointed lawyer. the defense continues tomorrow. megyn? >> trace gallagher thank you. a court just halted the president's executive order on immigration. why the president's plan may be going nowhere. governor scott walker is here on the protesters who swarmed his parents' home. new fallout after a court dealt a major blow to president obama's executive action on immigration. a new ruling from a federal court judge in texas forcing the department of homeland security to put a hold on the president's executive order that would have deferred deportations for millions. judge andrew hannon wrote that dhs secretary jay johnson is not just rewriting the laws, he is creating them from scratch. the obama administration has vowed to appeal that ruling, although hasn't yet. here to react we have senator ted cruz and judge napolitano. we go first to the judge. judge, how bad is it for the administration? >> this is devastating for the administration. this is a preliminary injunction which means the court viewed the court's documents and

challenger's documents the attorneys generals of 26 states. at the end of the case, the challengers will probably prevail, meaning the president probably overstepped his bounds and he has ordered the department of homeland security to create new law. and two, if he does not impose the temporary restraints that he imposed last night, actually irreparable harm will be visited upon the 26 states. >> what was about to happen on wednesday, tomorrow, is the administration was about to start issuing paperwork for these illegal immigrants, and actually doing things to help the transition take place. and the judge said, no you are asking the dhs to use discretion that they do not have. >> here's the lead. in my opinion, i suspect senator cruz agrees as well but of course, he can speak for himself, in my opinion the obama amnesty plan is absolutely dead. i don't think the appeals court

will interfere with this decision. and i think it will take this trial judge for the duration of president obama's term to rule on this with finality. once president obama is no longer in office, these executive orders are no more. >> it's hard to get temporary relief like these 26 states got. normally they'll say we'll hear you out on the mir its. but they convinced this judge that if he did not stop this executive order, there was no way to put the genie back in the bottle. >> the judge actually called them disenjen wous. he ruled that they were changing the law and that they violated federal law in the manner in which they changed federal law. they didn't have a 30-day waiting period. they didn't give congress the opportunity to weigh in. they didn't let the public weigh in. they just changed, changed like the president said he would, with a phone and with a pen. >> what are the odds of the fifth circuit court of appeals reversing this lower court

judge? >> it is now the most conservative circuit court of appeals in the united states. prediction? they will not interfere. this opinion reads like a treatis on the government's inappropriate behavior on this case. >> if the fifth circuit upholds the lower ruling eric holder will likely appeal that to the u.s. supreme court. what is the chance of the high court getting involved in this? >> none. the fifth circuit doesn't want to hear on this case until it's heard from finality. >> good to see you. >> likewise. >> i had a chance to get reaction from ted cruz of texas. he was in houston tonight. senator, good of you to be here. at this -- as this is playing out in the courts but it's also playing out in the u.s. congress. where the republicans have agreed to fund the department of homeland security, except for that part of the department of

homeland security that would implement the president's executive action. and because that spending bill has that limitation the democrats have been saying, we're going to filibuster that, we're not having a vote on that that's not appropriate. so in light of this ruling today, where does that leave us? >> well, megyn, you're exactly right. last night's ruling was a major victory for the rule of law. texas led a coalition of 26 states challenging the president's illegal and unconstitutional amnesty. the federal government concluded last night that the executive amnesty that the u.s. president attempted to put into place in november was contrary to federal law. that that is a major victory, and it is a major step in stopping and permanently stopping the illegal amnesty that the president put into effect in november in defiance of the results at the polls in

november of 2014. now, your question is, what happens in congress. congress needs to fund the department of homeland security. and senate democrats should look very carefully at this decision because senate democrats right now are filibustering, funding for dhs, at a time where we've got growing threats, both at home and abroad. >> but that's because they want everything funded. they want to fund the department, but they want it all funded. >> well, and the house of representatives has voted to fund dhs. and the senate democrats are filibustering the bill they're refusing to let the senate even take up the bill. if they disagree with the bill the house funded what they can do is take it up and offer it. we're not in the harry reid senate anymore. with a republican majority, the republicans have been allowing democrats to offer the amendments they want. they can offer an amendment. but the democrats three times

have filibustered funding and to do it at a time where we face such threats i think is reckless. they're holding national security hostage in order to defend the president's illegal amnesty. given the fact that last night a federal court made clear, this amnesty is contrary to federal law, it's illegal, it makes the democrats' position all the more intenable, that they're threatening to shut down the department of homeland security in order to stand as a partisan block protecting the amnesty court declared to be illegal. >> said that the obama administration is disingenuous that the actions do not significantly alter policy. and yet in the wake of the brushback that the administration was given yesterday, here is what president obama said his future plans are on this. >> with respect to the ruling, i disagree with it.

i think the law is on our side. and history is on our side. and we are going to appeal it. we will be prepared to implement this fully as soon as the legal issues get resolved. >> he seems undeterred. >> well that has been the nature of the obama presidency from day one. you know it's interesting, he says the law is on his side. there's at least one person who calls himself a legal scholar who disagreed. his name is barack obama. 22 times president obama has admitted he doesn't have the authority to issue unilateral amnesty. 22 times he said the constitution doesn't allow it. he said, this is not a monarchy, that's his quote. then after the last election he said, never mind i issued it anyway. >> i want the viewers to know, that is a fact. and the administration continued to deny it. and failed to explain it and tried to tell us it's not a fact. but it is a fact that is yet to be explained. we'll see whether that has an

impact on the courts. but in the meantime, the administration is fighting back on the merits as well. saying to people like you who disagree with his action they want to go back to the mom. they talk about, this is the president today, we should not be tearing some mom away from a child when the child is born here and the mom has been living here minding her own business. to pretend we're going to ship these folks off is not who we are. >> look, the president can make policy arguments, and the place to make them is to congress. when it comes to immigration reform, i think there's a lot of common ground. i think outside of washington, there is overwhelming bipartisan agreement that we've got to get serious about securing the borders and stopping illegal immigration. i think there's also substantial bipartisan agreement outside of washington, that we need to improve and streamline legal immigration. >> the president said he waited and waited coastuldn't wait any

longer and you guys didn't do it fast enough. >> he does say that, megyn. but his definition is, it's my way or the highway. our constitution was designed to force compromise. and you're right, congress didn't give the president everything he wants. under our system of checks and balances, that doesn't mean the president can unilaterally ignore federal law and ignore the constitution. this district court opinion, a 50-page opinion which i would encourage anyone interested in the law to read this opinion. it's a careful scholarly opinion. one of the things it points out is the president has claimed rather absurdly that the basis of his authority is quote, prosecutorial discretion. that he simply is choosing not to prosecute 4.5 million people here illegally. what the district court concluded quite rightly, is they're doing far more than that. the administration is printing work authorizations. it is affirmatively acting in

contravention of law counterfeiting immigration documents. the work authorizations it's printing are directly contrary to the text of federal law. that is dangerous when the president ignores federal law. >> he talks about how the law mandates these illegal individuals must be removed, and the administration is affirmatively saying exactly the opposite to the dhs. i've got to leave it there because we're out of time on this tonight. senator ted cruz good to see you. >> thank you megyn. >> this immigration challenge came originally from the state of texas. we also had a chance tonight to get reaction from former governor rick perry. >> i don't think the american people after eight years of barack obama are going to make just a slight change in direction. i think there's going to be a major sea change, if you will, and one of the governors that's out there a tested individual who's got a real record a competent individual who has led a major entity.

out on twitter, quote protesters march on scott walker's home. correction protesters march oi machine grandparents' home. alex tweeted they're protesting out in front of our home. who lives there you mightk? my grandma and grandpa. the union has not commented on the mistake. governor walker does own the home and he lived there for several years. but now that his sons are in college, he lives in the executive mansion in madison. because of scott walker's possible presidential hopes, many in the national media have also been camped out in wisconsin and some of them also didn't realize that walker's parents lived in the home. as for grandma and grandpa walker, they didn't comment. trace, thank you. scott walker is joining me now. grandma and grandpa really? your mother and father are being subjected to protesters on the front lawn of their own home?

were they there at the time? >> they were. i think my dad said this morning when i talked to him, he turned his hearing aid down a little bit. my mom is so wonderful she was actually half tempted to send them some chocolate chip cookies outside because she sends those to our neighbors all the time. but my neighbors are bummed because normally she's dropping off chocolate chip cookies. it was a little hard for her to go out and do that. >> was this a nothing burger for them, or were they a little put off? how old are they? in their 70s? >> they're in their mid-70s. unfortunately, four years ago, they had some experience in this. they were living there since i started out as governor, they've lived with us my parents moved in. my kids were still in high school back then. we tried to come home each night. we had literally thousands of protesters four years ago. my mom not only had a protester out in front of her house she had someone chase my youngest son and her down the aisle just to yell at them four years ago. but i think those things

backfire. >> it's too much, right? it's like these folks have a right to be angry if they don't like the state budget proposals and they're controversial. but don't you think it goes too far, whether a politician is a republican or democrat, to go to a person's home? >> four years ago, in the height of the protests, i had someone who -- a republican lawmaker who was from jansville used to be a union member -- actually a union leader, at one of the unions where the old gm plant was. he said we would protest by the plant and manager's office, we would never go to the manager's personal home fl that's crossing a line. but that's what they did with the protests and death threats. we haven't had the threats we had four years ago but we have some of the same sorts of personal protests out in front now. i just think it back fires in the end. good people here in the midwest realize you can have your disagreements, but really taking it out in front of someone's

home with elderly parents that's too far. >> i guess they don't feel any remorse, sitting in looking out. saying, oh no. let's talk about other potential backfiring. last week, governor howard dean your friend who used to be the governor of the state of vermont, said they need to worry that you are a dumb dumb because you didn't finish college. you left in your senior year. and here's what he had to say about that. >> scott walker, were he to become president, would be the first president in many generations who did not have a college degree. how well educated is this guy? >> are you serious? >> he said there are a lot of people who are going to worry about that. and you say? >> i said it's interesting, that's kind of the elitist government knows best approach from washington we've heard in

years. i don't know about you, megyn but we've had an ivy league trained lawyer in the white house for the last six years who was pretty good at reading off the teleprompter, but has done a lousy job leading this country. i i think there's a lot of americans out there that scratch their head and say, we have people who help found microsoft apple, facebook, plenty of other successful business enterprises across the country that did the exact same thing i did have an opportunity to start a career, an opportunity to start a business, senior year of college and went out and did it. my wife and i helping to fund our sons with the pafway with the hard work they put in. we value college for those who pursue that career. but in the end you don't have to have that to be successful. >> you know this is what's going to happen. the "washington post" ran a long article last week about how questions linger about your college experience. i mean it's been no mystery you

did not finish college. but look at this, at scott walker mulls white house bid, questions linger over college exit. do you remember michael fleet? he taught you a class on politics of the third world. and he went on record saying you, governor, you seemed utterly bored in class. what say you? >> yeah it's one of those amazing things where i think the more the left works themselves up in a tither, like you saw at the protests in front of my home, like you see with issues like this, they think there has to be more to this that i couldn't have possibly left to take a job at the american red cross, there had to be something more to the story. >> if you were bored when you were 19 about third world politics, so therefore, you cannot fight isis. >> yeah. an early-morning class where half the students were probably asleep, i don't know. that's not an uncommon practice. i think people want to judge what have you done lately. to me, in terms of world

politics, i would like to have a governor like ronald reagan who was a governor back before 1980 come in with a strong sense of leadership. at that time to take on the soviets and others. >> i've got it. maybe michael fleet was boring. i don't know. let me ask you this. you got into some trouble for not coming out and answering the question on evolution when you were across the pond. some said, hey, you want access to the red button on the nukes? you have to answer everything. you came out and tried to do it after the fact. but do you wish you had been clearer when you were asked that question? >> no, i think what i should have said is i was there on the taxpayers' dime to do traded investment. that's why i didn't talk about foreign policy. i think the taxpayers of wisconsin would have been upset. i answered after the fact. i think god created the earth. i think science and my faith aren't incompatible. but if you're there on official
