evidence from bin laden compound against a terrorist in court and they could hear from the intelligent agent wearing wigs and makeup to hide their identity. let's get to it. first from the deck this afternoon, isis fighters out in force a few hundred miles from europe. video out of libya shows a fleet of pickup trucks showing the black flags of the islamic state. the trucks have police lights and people are seen cheering as the vehicles make their way through what is believed to be benghazi. the group, which apparently posted these images, has pledged its allegiance to isis and benghazi, of course is where four americans died during an attack on the u.s. outpost in 2012. libya has been in chaos for years now since rebels overthrew long-time dictator there, moammar gadhafi. he died during that uprising. analysts say the new propaganda

video adds to the evidence that ooids is isis is expanding there. there was a beheading of it 1 christians on the beach in libya. in the same video, the same terrorists threatened to conquer rome. they plan to use libya as a, quote, gateway to the rest of europe. officials have warned isis is not after just territory. it's also trying to infiltrate western nations. now two of australia's most wanted men appear in execution video in syria. the men holding the knife there and the man just heepd him and to the left of him. we will not show you the video obviously. here at home the white house is hosting a summit on violent extremism and how to fight it. president obama is set to speak out during the next hour. ed ed henry w details in a minute. but first, connor if isis gets

a foothold in libya it will have access to very powerful weapons. >> reporter: as we've been discussing in the last few days, libya is awash in weapons, conventional weapons mainly. but what we're hearing is that one of the main militia that is part of this umbrella militia they have gotten their hands on warplanes, former gadhafi jets, and they have used those planes to bomb a city in an area linked to the internationally recognized government. this obviously is extremely problematic in the sense that if you now have terrorist groups with planes, it opens up a much larger wider area. now, it should be noted that this group right now that is -- has these planes that have bombed this libyan government, they are not tied directly to isis but they have a large population of the extremist fighters and if isis gets a hold

of libya this would be the pool of people that they would be drawing from and so it's very conceivable, helpshepard, that these planes could get in the hands of isis in the future. very problematic for the entire middle east. >> conor, there's a scheduled meeting from the military chiefs. what do you know about that? >> reporter: this is a meeting between all of the coalition countries, more than two dozen countries are attending. commander lloyd austin is there. it's not clear what is being discussed in this particular meeting right now. previous meetings, from what we've heard, have gone like this. the arab country says that the u.s. needs to do more about battling isis. that seems to have been the main sort of discussion. but what we do think they are discussing is another effort to sort of create a program that would train moderate syrian

rebels on the ground and there's talk of sending trainers to the middle east to help train these rebels and help get the iraqi military in shape. this seems to be the main focus of the push and there has to be people on the ground that could help fight isis. shepard? >> conor powell in jerusalem, thank you. we're expected to hear from the president in about an hour. there's going to be a summit at the white house on fighting violent extremism. ed henry at the white house, what do we expect out of this summit ed? >> shep, perhaps not much. that may be a problem for the administration. josh earnest said this is just a talking shop, basically an academic exercise where the administration is going to study this problem of violent extremism but not really come up with any results. pressed on what will be deliverables from the summit, as you asked, here's what earnest said. >> there will be a number of

things important about this summit. the thing that i find the most is it interesting is that there are already, in local communities across this country, coordinated efforts to counter extremist messaging that's aimed at vulnerable youth. >> so aides say the president's keynote address will focus on trying to stop the recruitment by isis and other terror groups here in the united states where they try to radicalize americans who could launch attacks here. but as you hear josh earnest there, it's vague on how they plan to do that, shep. >> critics suggest they need more action. what sort of action are they talking about specifically? >> reporter: well, republicans are saying, look it's great to do what josh earnest was saying and it's great to do what marie harf is saying. she got heat for saying, look, let's find them jobs. and sure, fine, economic opportunity can help prevent the

spread of terror but what republicans are saying, the key piece here is more military power to actually kill the terrorists. listen. >> you know, look, jey johnson says we can't kill if they are recruiting faster. i agree. they need to kill more and they've got to kill as many as we can and quickly as we can. >> reporter: that gives you an idea of the stakes. the united nations is going into an emergency session to discuss isis and libya an important highlight, because this shows that isis has expanded beyond iraq and syria and now into libya and others as well. >> ed henry, thank you. now let's bring in stewart also serving as intelligence officer in the united states army. thank you for being here. >> good to be here. >> almost to a man with notable exceptions they say, no of

course not not ground troops. so it's just all political yackity-yack. >> the political will is not there for committing ground troops absence some sort of unfortunate activity here in the united states. i think that's the threshold. but this is an imminent threat and having this conference is like having a fire prevention seminar while your kich sen actually on fire. and there is some immediate threats that need to be addressed through more robust means some of our people have been killed and it's awful but is the solution putting in ground troops the conventional overriding situation at this point seems to be no. what needs to be done? they shouldn't be talking about this or they should be doing what exactly? >> well in the long term there is alienated youth.

what we have is large swaths of libyan territory unchecked. and this is right across the map from italy. they talk about on to rome. that's significant for two reasons. one, it's where the vatican is but it's also, libya was an italian colony. there is no control in libya. there has to be much more involvement by the part of, i believe, the partners in the region and the united states to get more stability there. >> the facts seem to suggest that every time you ask someone if you're complaining, well, they are having a fire drill while there's a fire going on and yet there's no real -- you have no real suggestion about what they should be doing. it sounds to me like we are taking a very serious national and international issue and suggesting that the president isn't doing something that you believe he should do and yet you don't have a suggestion for what he should do unless i missed it. i'll give you another shot. >> well, you saw general cece

and -- >> the pentagon itself, not the political leaders and the pentagon said hey, slow down over here. we've got a huge mess that could blow up into something awful. the same reason they give for not wanting to put u.s. troops in on the ground. this could become something uncontrollable. >> well, if you ask me, egypt is our first line of defense over there in that region. we train many of those people. what they can do, what we can do with others in the neighborhood there's got to be other things that we can do. >> like what? everybody says there ought to be something more that we can do. every single american agrees with that talking point but nobody that has that talking point, except for lindsey graham, they don't like the talking part. >> well, i think we are getting to that stage. these images from isis across the board the fact that there may be an american involved and

we're getting to a point where there's going to be more support, certainly for more air strikes and possibly for more direct involvement. >> wait now, because the military leaders not the political leaders who everybody is complaining about, the military leaders say, we're striking every target that is available. isis has changed and does not move around in groups anymore. it doesn't keep its weapons in one place. if you want to drop some bombs there's nothing we can do about that but as far as striking we're striking everything that we can strike. that leaves what exactly? >> i think you've led us to the conclusion which i think is pretty obvious, there needs to be courage some leadership and a greater commitment to look at putting ground troops in. >> ground troops. so american ground troops should go in, in your opinion, on the ground and begin fighting this war just as the leaders of isis have begged us to do. please, second your soldiers in because then they'll have the opportunity to take an american soldier and burn him alive

inside a cage and the military leaders suggest there is absolutely no way to win this thing militarily. you cannot do it with air strikes, with ground ptroops and yet today mr. ambassador, you're suggesting that we need to send in ground troops? >> what i'm suggesting is what you have said intelligence cooperation, it's going to be a long slog. i'm not talking about a full-scale ground war but we have to become more engaged in this effort. >> all right. we'll see what that means. thank you, mr. ambassador. appreciate it. pro-russian rebels have delivered a blow to ukraine's military. they are retreating from a key town. and marching into a deadly ambush. in other words, they were surrounded, they went to escape and they were attacked and they have lost. it is a very serious development. coming up from ukraine right after this. her science project. and you could make it happen.

the truth is they retreated. a military force tells fox news the retreat was and i quote, chaotic. associated press reporters said they saw dozens of government troops covered in dirt, exhausted looking. the town is a transportation hub and links the stronghold donetsk with another. vladimir putin yesterday urged the ukrainians to accept defeat. said, and i quote, life is life. and no need to dwell on it. russia and ukraine signaled a cease-fire was coming. in fact, they even signed an agreement last week which clearly has failed to stop the fighting but the rebels have said that they have no direct evidence. greg palcot is live in the capital city of kiev. what have you learned about this chaotic retreat, as it's being

described to us? >> reporter: well shep we've learned in the last couple of minutes that there's squirmishing in that town but for the most part it's over. this retreat, around 6:00 a.m. this morning soldiers said they didn't know until about ten minutes before they got the orders. an eyewitness nearby the town said there is a huge amount of firing as troops made their way to get out. we're told soldiers were separated, communications were down. as for the casualties we still don't have an official toll. we spoke to an army medic at a nearby town and he told us he believed that toll will be over 20 dead, over 100 injured. it's also reported that those who made it out are just happy to be alive. shep? >> the ukrainian president downplaying this but it seems to be a very serious defeat for them. >> reporter: yeah. it's big stuff, shep. just about two blocks from where we're standing right now the

ukrainian leadership is meeting in an emergency session to try to decide what to do next. ukrainian president petro poroshenko rushed over to the eastern front today to give medals to soldiers he called heroes and called the retreat orderly and well organized. critics are calling it a botched operation and another sign at how bad the ukrainian military is running this thing. we'll see the impact for the prospects for peace as some rebels go through the motion of pulling back the heavy weapons, the fear is that the separatists could have moves through ukraine and a peace deal that many think is very tilted in their direction in vladimir putin's direction. shep? >> greg palkot from the ukrainian territory thanks. and now to the deadly las vegas shooting, cops are telling

22 minutes past the hour. a brand-new story from authorities in las vegas about what happened before a deadly road rage incident of which we've been reporting here. this is certainly not what we've heard initially from the police. first, some background. cops say last week, this woman, tammy meyers had just given her daughter a driving lesson when a car passed them when the

daughter reached over and honked the horn. the suspect stopped, got out of his car, approached the mom but she sped away and went home. now, the initial word from police was that the driver followed the mom and the driver home. and that's when there was this confrontation. mom called the son on the way home, son comes out of the house with a shotgun and starts to fire at the perpetrator and the perpetrator shoots the mom. but there was an important step missing from that narrative. now the cop tells us the mom went home after the initial confrontation without the person following her to pick up her son to head out and find the people who were giving problems. >> she gets home, tells her 15-year-old daughter to wake up her son who was in bed, who was an adult, and he's 22 years old, to wake him up and have him come outside and get in the car with her so they can find who frightened them while they were on the roadway. her 22-year-old son came out of

the house, got into the car, he was armed with the firearm that is registered to him and then they left the house. >> the police say meyers and her son drove around the neighborhood for about ten minutes. cops say the woman found the silver sedan and followed it for a while and eventually drove back home. that's when the same car drove up, somebody inside the car shot tammy meyers in the head. trace gallagher is at our news hub. this is a strange thing. what in the world is going on here? >> because if you look back shep, during all of the interviews the family gave after this incident, there was not a single mention of the son and mom going back out to find that silver gray sedan. remember, the family said that when the mom and daughter were on the way home after the driving lesson the suspect's vehicle sideswiped them. now police believe that the cars never made contact.

and police never mentioned exactly where or how the son and the mom were able to relocate that suspect vehicle five to ten minutes after the initial confrontation. police were asked to characterize the family's actions and they said this. listen. >> i would never say that anybody went looking for trouble but unfortunately i can't ask tammy was in her mind at that point. tammy is a victim. this family right now is in mourning. they are very distraught over what has occurred. >> we should note, it's still unclear who inside the suspect vehicle fired the shots. there were believed to be three people inside that car. shep? >> what are we hearing from the family now after these new developments? >> well keep in mind the twist in this story came on the same day that a vigil was being held for 44-year-old tammy meyers. family and friends are fighting to pay for her funeral and

medical expenses. the husband, ron meyers avoided most of the questions about the family's account of what happened but he did offer this. listen. >> people are panicked and things happen you know, and not always the right things to do if i could say it that way. but, you know, sometimes -- emotions get ahead of what you should do you know, and i think there might be a case of that. >> the family by the way, is asking for privacy as they prepare for the mom's funeral. shep? >> trace gallagher, thanks very much. ever leave something at a store and then you wonder, wow, i wonder if anyone found my stuff, maybe i could reach out to them on social media because i really want my stuff that i left there? well, we have a problem. somebody apparently left a bag of cocaine at a super dollar store. oops. where is my blow? now police in virginia are reaching out to try to find the

owner and my guess is they are trying to return said cocaine so the owner could do whatever they want to do with that blow. right? >> yes. this is about an hour south of richmond and they responded to a call of drug paraphernalia. they posted this on facebook. we were called to the super dollar for narcotics. we are now in possession of a white substance that appears to be cocaine. if you mistakenly dropped your cocaine today and were there at the store, please contact us. people are saying, you know, i lost 3.7 grams, police responding saying well, that's not the amount. somebody asked whether they would return the coke to which the cops say, no, they give out things like lollipops for children and stuff like that but they are not redistributing drugs. they figure this is more of a joke. they wanted to show that they had a sense of humor. if, in fact, somebody would like

egypt launched air strikes and now they are calling for an international response. rick leventhal. rick? >> he welcomes the help from egypt and hopes the u.n. will stand up claiming there are thousands of isis fighters in libya. they have been battling with the islamic militants for some time now, well before the beheading of the 21 christians on a beach in libya. they need help as soon as possible and the egyptians who bombed isis targets in derna, libya, on sunday want to avenge the murders of its people so they are addressing the emergency session of the u.n. security council. a draft resolution has been crafted which calls for an end to the arms embargo.

evidence seized during that raid that killed osama bin laden. the defendant is nasir and he's acting on his own as his own attorney. he's accused of conspireing to blow up new york city subways. he denied the claims. prosecutors say nasir may have taken a terrorist pledge of allegiance reciting from the document found during the bin laden raid. british intelligence officers are testifying in wigs and makeup to hide their identity. what happened in court today lea? >> reporter: had he a thick beard and wore a long-sleeve collared shirt with dark slacks.

now, this morning he cross-examined the first witness for the prosecution who pleaded guilty in connection with a plot to attack new york city subways. he got zazi to acknowledge that he had never met him before and never heard his al qaeda contact mention nasir's name. he hasn't come across as unruly and according to a federal prosecutor, that separates him from other terrorist suspects that have appeared in court. >> it seems like he really wants to get off, doesn't want to go to jail, doesn't seem to be using this as a bully pulpit as so many terrorists have done at different times. >> reporter: now, as for those documents that you mentioned from the bin laden raid we haven't seen those yet but prosecutors have given the court a preview of what they say. in a court filing prosecutors say they reference plans to attack america with snippets of

quotes, like quote our war with america, having to strike the americans and killing and wounding dozens of u.s. soldiers. now, today we heard testimony by e-mail accounts that prosecutors claim nasir used to contact al qaeda operatives and, shep prosecutors say he used those e-mail accounts to disguise his identity and used code words for the attack. for example, marriage or wedding, shep. >> lea gabrielle at the courthouse, thanks. the man accused of murdering chris kyle, eddie ray routh is claiming that he was insane when he shot and killed kyle and littlefield. the defendant's sister said that he came to her house after the shooting and told her, quote, he

took some souls. routh's sister said the person who came to my house is not the person i know as my brother. prosecutors prosecutors rested their case yesterday. chris kyle, of course s. a former navy s.e.a.l. and is featured in the award-winning movie "american sniper." he said in his confession i know what i am doing, i'm sorry and it was wrong. >> he also said shortly after the confession in a tape that the government for some reason played to the jury i think i'm insane. that's basically what he told the police. look there's no dispute in this case but that he pulled the trigger and that he killed chris kyle and there's another victim as well. the issue is what's going on in his head. so in texas, it is the burden of the defendant to prove insanity.

in most of the united states it's the burden of the government to prove sanity. that's not an academic difference, it's a real difference. that means he has to come up with the psychiatric evidence and the lawyers have to rebut it. what they are doing is laying the basis for it by having lay witnesses, his mothers and sisters, describe bizarre behavior and then the expert witnesses will say he thought he was shooting a sack of potatoes. >> but there's a distinct and important difference between being all crazy, as somebody might describe you and it might be an easy thing for somebody to do who killed these two guys and being legally insane. >> legally insane you did not know right from wrong, you really thought you were shooting a sack of potatoes. you did not realize that by pulling the trigger you would kill a human being. it's a very high bar and very very rarely reached in the state of texas. >> the suspect in this case, the

now defendant, said in his confession to police that he knew it was wrong and he was sorry. that will have some weight? >> absolutely. the prosecutors will play that over and over and over again. not to the defendant, because he's never going to take to the witness stand but to the defendant's doctors they will have to somehow explain away that phrase as well as other things he said and did to the jury in order to demonstrate his incentive. >> from what we know of the evidence, it sounds like this guy is going away? >> i think the evidence of guilt is overwhelming. the government has made some mistakes. i don't know that those mistakes without more, are enough to reverse a conviction but the mistakes are starting to build up. >> and they certainly will be used when they decide whether to get an appeal? >> yes of course, assuming he's con convicted. all the mistakes the government and judge made will form the basis for the appeal. >> like always. thank you, judge. >> you're welcome.
